Ett aktiebolag skall ha en styrelse med en eller flera ledamöter. Av 3 kap. 1 § första stycket framgår att antalet styrelseledamöter eller lägsta och högsta antalet styrelseledamöter skall anges i bolagsordningen.
I fråga om publika aktiebolag gäller även 46 §.
