Le code civil impose un devoir d'information précontractuelle : celui qui connaît une information dont l'importance est déterminante pour le consentement de l'autre doit l'en informer, dès lors que l'autre l'ignore légitimement. Le devoir ne porte pas sur l'estimation de la valeur de la prestation.
