Även om tillståndsplikt inte följer av föreskrifter som har meddelats med stöd av 6 §, får tillsynsmyndigheten besluta att förelägga en verksamhetsutövare att ansöka om tillstånd, om verksamheten eller åtgärden kan antas medföra betydande miljöpåverkan. Lag (2024:963).
