Om det i ett fall som avses i 4 § första stycket uppstår synnerliga olägenheter vid pågående användning av fastigheten, har fastighetsägaren rätt att få fastigheten inlöst i stället för att få ersättning enligt 4 §. Beror olägenheten på ett förbud att vidta viss åtgärd utan tillstånd skall 5 § första stycket tillämpas.
