Miljösanktionsavgift beslutas av tillsynsmyndigheten eller av den myndighet som utför kontroll enligt förordning (EU) 2017/625 eller enligt förordning (EU) 2019/1020.
Innan myndigheten beslutar om avgift ska den som anspråket riktas mot ges tillfälle att yttra sig. Lag (2022:1108).
