Om det är nödvändigt för att skydda människors hälsa eller miljön får tillsynsmyndigheten köpa kemiska produkter, biotekniska organismer och varor under dold identitet (testköp).
Ett testköp får endast göras i syfte att kontrollera att föremålet för köpet uppfyller gällande krav för sådant skydd i
1. denna balk,
2. föreskrifter som har meddelats med stöd av balken, eller
3. EU-förordningar inom balkens tillämpningsområde.
Näringsidkaren ska underrättas om testköpet och resultatet av det så snart det kan ske utan att köpet förlorar sin betydelse. Lag (2020:627).
