Domstolen ska avgöra mål efter huvudförhandling, om det inte med hänsyn till utredningen i målet är tillräckligt med skriftlig handläggning.
Om parterna begär det ska huvudförhandling hållas. Huvudförhandling behöver dock inte hållas i frågor som avses i 26 § andra stycket och inte heller i fall som avses i 42 kap. 18 § första stycket 1, 3 och 4 rättegångsbalken eller om det annars är uppenbart obehövligt. Lag (2024:963).
