Kraven på säkerhet i 58-60 §§ gäller inte staten, kommuner, regioner och kommunalförbund.
Ett tillstånd som omfattas av undantag från krav på säkerhet får endast överlåtas till en verksamhetsutövare som inte är staten, en kommun, en region eller ett kommunalförbund om
1. tillståndet förenas med en skyldighet för den nya verksamhetsutövaren att ställa säkerhet för fullgörandet av de skyldigheter som gäller för verksamheten, och
2. tillståndsmyndigheten godtar den ställda säkerheten. Lag (2026:507).
