Ansvaret för att hantera avfall övergår till en ny avfallsinnehavare, om en kontroll enligt 27 § har gjorts och avfallet har lämnats över. Detta gäller dock inte om något annat har föreskrivits i lag eller annan författning.
Om en avfallsproducent eller annan avfallsinnehavare anlitar en transportör för att transportera avfallet, övergår ansvaret först när avfallet lämnas över till den nya avfallsinnehavaren. Om den nya avfallsinnehavaren anlitar en transportör, går ansvaret över till den nya avfallsinnehavaren när transportören har hämtat avfallet.
Om ingen kontroll enligt 27 § har gjorts, ansvarar både den nya och den föregående avfallsinnehavaren för avfallet. Lag (2026:507).
