Kommunen ska transportera bort det avfall som avses i 12 § från den fastighet där avfallet har producerats, om
1. borttransport behövs för att tillgodose såväl skyddet för människors hälsa och miljön som enskilda intressen,
2. fastighetsinnehavaren begär att kommunen ska transportera bort avfallet och det inte är oskäligt med hänsyn till omständigheterna, eller
3. det framgår av föreskrifter som har meddelats med stöd av detta kapitel.
När kommunen planerar och beslutar hur den ska ta sitt ansvar för avfallshanteringen ska kommunen ta hänsyn till de behov som finns för olika slag av bebyggelse. Lag (2026:507).
