Detta kapitel tillämpas inte på en leverans av ett sådant nytt transportmedel som avses i 2 kap. 16 §, om
1. transportmedlet har förvärvats från ett annat EU-land enligt 3 kap. 1 § 2 eller 2 §, eller
2. leveransen är en sådan unionsintern leverans av varor som omfattas av undantag från skatteplikt enligt 10 kap. 42 §.
