Om en import av varor avser en unionsvara eller om varan ska deklareras för övergång till fri omsättning i Sverige men inte är belagd med tull, är den som skulle ha varit skyldig att betala tullen om varan hade varit tullbelagd skyldig att betala mervärdesskatt för importen, om inte annat följer av 20 §.
