Någon rätt till återbetalning finns inte för
1. sådan felaktigt debiterad mervärdesskatt som avses i 2 kap. 12 §, eller
2. mervärdesskatt som fakturerats för en leverans av varor som är undantagen från skatteplikt enligt någon av följande bestämmelser i 10 kap.:
- 42 eller 46 § om unionsinterna leveranser av varor, eller
- 64 § 3 om leverans av varor när en beskattningsbar person som inte är etablerad inom landet förvärvar varan för sin verksamhet i utlandet och hämtar den för att direkt föra ut den till en plats utanför EU.
