Om fastighetsägaren har utfört eller låtit utföra ny-, till- eller ombyggnaden av fastigheten, gäller 22 § andra stycket bara om den del av fastigheten som omfattas av ny-, till- eller ombyggnaden inte tagits i bruk efter åtgärderna.
