Från skatteplikt undantas en kommuns uttag av varor och tjänster för eget behov.
Skatteplikt gäller dock för uttag av tjänster avseende en stadigvarande bostad i de fall som avses i 5 kap. 33 och 34 §§ utom i fråga om sådana boendeformer som avses i 4 § lagen (2005:807) om ersättning för viss mervärdesskatt för kommuner, regioner, kommunalförbund och samordningsförbund.
