Har en part rätt att sälja varan enligt 76 § men kan den inte säljas eller är det uppenbart att priset inte skulle täcka kostnaderna för en försäljning, får parten förfoga över varan på annat sätt som är försvarligt. Innan det sker, skall motparten om möjligt underrättas.
