Avlämnas inte varan eller avlämnas den för sent och beror det inte på köparen eller något förhållande på hans sida, får köparen enligt 23--29 §§ kräva fullgörelse eller häva köpet samt dessutom kräva skadestånd. Han får även hålla inne betalningen enligt 42 §.
