Om näringsidkaren är i dröjsmål gäller 3 kap. 2-5 §§ och 6 kap. om påföljder vid näringsidkarens dröjsmål vid köp av varor.
Vid hävning med anledning av näringsidkarens dröjsmål, ska konsumenten meddela näringsidkaren att han eller hon häver avtalet.
