Trots att konsumenten kräver en annan påföljd än avhjälpande eller omleverans, har näringsidkaren rätt att vidta en sådan åtgärd, om det kan ske under de förutsättningar som anges i 4 § tredje stycket.
Första stycket gäller inte om konsumenten enligt 8 § har rätt att kräva en annan påföljd utan föregående försök till avhjälpande eller omleverans eller om konsumenten har avhjälpt felet och det med hänsyn till omständigheterna inte skäligen kunde krävas att konsumenten skulle avvakta avhjälpande eller omleverans från näringsidkarens sida.
