En vara med digitala delar ska inte anses felaktig om den avviker från vad som anges i 1 eller 2 § enbart till följd av att konsumenten inte inom skälig tid har installerat en uppdatering som har tillhandahållits enligt 4 §. Detta gäller dock endast om näringsidkaren har informerat konsumenten om att uppdateringen finns tillgänglig och om konsekvenserna av bristande installation, och konsumentens bristande installation inte har berott på anvisningarna för installationen.
