Varan är felaktig om den avviker från vad som anges i 1 eller 2 § eller näringsidkaren inte uppfyller sin skyldighet enligt 3 eller 4 §, om inte något annat följer av 6-8 §§. I 9-12 §§ finns bestämmelser om att varan kan vara felaktig även i andra fall.
