Om näringsidkaren är i dröjsmål får konsumenten hålla inne betalningen enligt 3 §. Konsumenten får välja mellan att kräva att köpet fullgörs enligt 4 § och att häva köpet enligt 5 §. Dessutom får konsumenten kräva skadestånd av näringsidkaren enligt 6 kap.
