Om det finns särskilda skäl, får Skatteverket tillåta att ett företag förvarar elektroniska handlingar utomlands även om förutsättningarna enligt 3 a § inte är uppfyllda. I sådana fall får den utrustning och de system som avses i 2 § andra stycket hållas tillgängliga i samma land. Tillståndet får förenas med villkor och begränsas till viss tid.
Tillstånd enligt första stycket ges av Finansinspektionen när det gäller företag som står under inspektionens tillsyn. Lag (2024:342).
