Om en föreskrift enligt 2 § innebär att aktierna i bolaget inte skall ge lika rätt till andel i bolagets tillgångar eller vinst, skall det i bolagsordningen också anges vilken rätt aktieägarna skall ha till nya aktier vid en ökning av aktiekapitalet genom fondemission.
