Om inte någon av de borgenärer som har blivit kallade enligt 22 § motsätter sig ansökan inom förelagd tid, skall Bolagsverket ge bolagen tillstånd att verkställa fusionsplanen. Motsätter sig någon borgenär ansökan, skall verket överlämna ärendet till tingsrätten i den ort där styrelsen i det övertagande bolaget skall ha sitt säte.
