Den som är underårig eller i konkurs eller som har förvaltare enligt 11 kap. 7 § föräldrabalken kan inte vara stiftare. Att detsamma gäller den som har näringsförbud följer av 11 § lagen (2014:836) om näringsförbud. Lag (2014:848).
