Loven her kan ikke fravikes til skade for arbeidstaker med mindre det er særskilt fastsatt i loven at en bestemmelse kan fravikes ved avtale. Avtale som fraviker loven til skade for arbeidstaker, må inngås skriftlig for å kunne påberopes av arbeidsgiver.
Arbeidsgiver som er bundet av tariffavtalebestemmelse som fraviker loven, kan anvende den overfor alle arbeidstakere som utfører arbeid av den art avtalen omfatter, såfremt et flertall av dem er bundet av avtalen.
