How does an Indian manufacturer meet the EU General Product Safety Regulation, and is a responsible person mandatory?

Answer

Yes, the responsible person is mandatory. Since December 2024 no consumer product may be placed on the EU market unless an economic operator established in the Union takes responsibility for it, and the product carries that operator's name and address. The regulation also requires an internal risk analysis, traceability information on the product itself and an accident reporting route through the Safety Business Gateway.

What has to be done

  • Appoint the EU responsible person and put the name, registered trade name and postal address on the product, the packaging or the accompanying document.
  • Carry out an internal risk analysis and keep the technical documentation for ten years from placing the product on the market.
  • Put traceability elements on the product: type, batch or serial number, and the manufacturer's own name and address.
  • Provide safety instructions and warnings in the languages of the Member States where the product is sold.
  • Report accidents caused by the product, and any recall or corrective action, through the Safety Business Gateway.
