Batteries Regulation
What does the EU Batteries Regulation require of Indian battery and cell manufacturers?
Answer
Batteries placed on the EU market carry a carbon footprint declaration, recycled content thresholds, performance and durability requirements, a due diligence policy on the raw materials, and from February 2027 a digital battery passport for industrial and electric vehicle batteries. Producer responsibility for collection and recycling has to be discharged through a registered representative in each Member State.
What has to be done
- Declare the carbon footprint per functional unit for electric vehicle, industrial and light means of transport batteries, on the Commission's methodology.
- Document the recycled content of cobalt, lead, lithium and nickel, and keep the supporting evidence.
- Operate a raw materials due diligence policy covering the supply chain, and have it verified by a third party.
- Register a producer responsibility representative in each Member State where you place batteries on the market; this is separate from the GPSR responsible person.
- Prepare for the battery passport: a unique identifier per battery with the data set the regulation prescribes, carried through to the end user.
