Miljööverdomstolen biföll därför Naturvårdsverkets yrkande

Tillstånd till nytt anriknings- och pelletsverk m.m. ----- Miljödomstolen gav i deldom bolaget tillstånd att uppföra nytt anriknings- och pelletsverk. Naturvårdsverket överklagade domen och yrkade bl.a. att energifrågan skulle sättas på prövotid med föreskrift att under prövotiden utreda möjligheter till energieffektivisering. I likhet med Naturvårdsverket ansåg Miljööverdomstolen att hushållningsprincipen i 2 kap. 5 § miljöbalken ställer längre gående krav på energihushållning än vad som motsvaras av bolagets arbete enligt PFE (Programmet För Energieffektivisering), som är inriktat på åtgärder av företagsekonomiskt intresse. Miljööverdomstolen biföll därför Naturvårdsverkets yrkande.
