Tillstånd till anläggande av bergvärmepump. Fråga om tillstånd att, inom den yttre skyddszonen för ett vattenområde för vattentäkt, installera en bergvärmeanläggning ----- Kommunen befarade att tillstånd till aktuell anläggning skulle medföra att samtliga fastigheter inom området skulle ha möjlighet att beviljas motsvarande tillstånd. Miljööverdomstolen (MÖD), som fastställde miljödomstolens dom varigenom tillstånd till anläggningen meddelades, uttalade bl.a. att bedömningen gjorts med utgångsläge i de specifika förhållanden som råder på den aktuella fastigheten och att ett tillstånd inte utgör tillräckliga skäl för att bevilja andra anläggningar tillstånd. MÖD erinrade om att det för ett generellt förbud mot inrättande av bergvärmeanläggningar inom den yttre skyddszonen krävdes ändringar av de gällande föreskrifterna för vattenskyddsområdet.
