How does REACH apply to Indian chemical exporters?

Answer

A non-EU manufacturer cannot register under REACH itself. Substances imported into the EU above one tonne a year must be registered either by the EU importer or by an only representative appointed by the Indian manufacturer, and appointing an only representative is what keeps the registration under your control rather than your customer's. Restrictions and authorisation requirements apply to substances in mixtures and in articles as well.

What has to be done

  • Decide the route: registration by the EU importer, or an only representative established in the Union appointed by you.
  • Compile the registration dossier and the chemical safety report for the tonnage band, and share data through the substance information exchange forum.
  • Check Annex XVII restrictions and the authorisation list for substances of very high concern before shipping, including substances present in articles.
  • Classify, label and package to CLP, and supply the safety data sheet in the language of the receiving Member State.
  • Track the candidate list updates: a substance added above 0.1 percent in an article triggers a communication duty down the chain.
