How does REACH apply to Indian chemical exporters?
A non-EU manufacturer cannot register itself. Substances above one tonne a year are registered either by the EU importer or by an only representative established in the Union appointed by the Indian manufacturer, which is the route that keeps the registration under your own control.
What has to be done
- Decide the route: registration by the EU importer, or an only representative established in the Union appointed by you.
- Compile the registration dossier and the chemical safety report for the tonnage band, and share data through the substance information exchange forum.
- Check Annex XVII restrictions and the authorisation list for substances of very high concern before shipping, including substances present in articles.
