Digital Services Act and Digital Markets Act

A platform offering services to users in the EU must appoint a legal representative in a Member State, publish a point of contact, run a notice and action mechanism, and verify the traceability of every trader it lists. Reaching the very large online platform threshold adds systemic risk assessment, independent audit and data access for researchers. The Digital Markets Act only bites on designated gatekeepers, which no Indian marketplace currently is.

• Appoint the EU legal representative and publish a single point of contact for authorities and one for users.
• Verify trader identity before listing: registration details, address, payment account and a self-certification that the goods comply with Union law.
• Operate the notice and action mechanism and give a statement of reasons for every restriction you impose.
• Publish transparency reports and the main parameters of the recommender system, with an option not based on profiling where required.
• Keep the advertising repository if you serve ads, and do not profile minors for advertising.
