I Sverige har tidigare ansetts gälla en princip om s.k. global konsumtion av varumärkesrätt, dvs. denna rätt får inte längre göras gällande oavsett var i världen den märkta varan har bringats i omsättning. Sedermera har här skett övergång till regional - s.k. EES-vid konsumtion - enligt vilken rätten släcks ut endast om varan omsätts inom EES. Det har ansetts att detta ändrade rättsläge har inträtt först den 1 juli 2000 genom införandet av 4 a § första stycket varumärkeslagen; detta trots att Sverige redan den 1 januari 1994 tillträtt EES-avtalet och EG-domstolen den 16 juli 1998 har fastställt att artikel 7.1 i EG:s varumärkesdirektiv hindrar nationella regler om global konsumtion.
