Enligt 8 § första stycket 7 rättshjälpslagen (1972:429) får allmän rättshjälp ej beviljas i angelägenhet rörande bodelning om det inte finns särskilda skäl i enlighet med vad som närmare anges i stadgandet (jfr 10 § första stycket 8 rättshjälpslagen 1996:1619). Stadgandet har inte ansetts utgöra hinder mot att bevilja rättshjälp i tvist mellan dödsbodelägare angående frågan, huruvida viss egendom skall ingå i dödsboet.
