How does the EU Deforestation Regulation affect Indian suppliers?

Commodities covering cattle, cocoa, coffee, oil palm, rubber, soya and wood, and the products derived from them, may only be placed on the EU market with a due diligence statement, and that statement requires the geolocation of the plots of land where the commodity was produced. For Indian rubber, leather, coffee, timber and furniture exporters this means traceability to the plot, not to the trader.

What has to be done

  • Collect the geolocation coordinates and the production period for every plot, down to the plot and not the aggregator or the mandi.
  • Show the commodity was produced on land not deforested after 31 December 2020 and was produced in accordance with Indian law, including land tenure and labour law.
  • Assess and mitigate the risk, and keep the documentation for five years.
  • Submit the due diligence statement in the EU information system and pass the reference number to the buyer before customs clearance.
  • Small plot holdings still need coordinates; simplified due diligence relieves the EU operator, not the traceability itself.
