When can an advertising claim be deceptive under the FTC Act?

Section 5 prohibits deceptive acts or practices in or affecting commerce. The FTC evaluates the representation, omission or practice from the perspective of a reasonable consumer and whether it is material, while objective claims generally require a reasonable basis before dissemination.
