Can a company face FCPA liability for payments made through a third party?
Yes. The anti-bribery provisions cover corrupt payments made through an intermediary when the covered person knows that all or part of the value will be offered, given or promised to a foreign official. The statutory knowledge standard includes conscious disregard and deliberate ignorance.
