SFS 2014:424"},"label":"2 a §","heading":null,"chapter":null,"in_force_from":null,"in_force_until":null,"text":"Genom avtal får avvikelse göras från 5, 12, 12 b, 19-21 och 30 a §§, i den utsträckning som framgår av de bestämmelserna.\n\nGenom kollektivavtal, som på arbetstagarsidan har slutits eller godkänts av en central arbetstagarorganisation, får avvikelse göras från 3, 3 a, 9, 11 § andra stycket, 16-16 b, 22, 26, 26 a, 29, 29 a och 30 §§.\n\nEn arbetsgivare, som är bunden av ett kollektivavtal som omfattar frågor som avses i första och andra styckena, får i dessa frågor tillämpa avtalet även på en arbetstagare som inte är medlem av den avtalsslutande arbetstagarorganisationen. Detta gäller under förutsättning att arbetstagaren sysselsätts i arbete som avses med avtalet och inte omfattas av något annat tillämpligt kollektivavtal.
