Tilsyn utføres i samsvar med reglene i markedsføringsloven §§ 32 til 41, § 42 første ledd annet punktum og §§ 43 til 43 c.\n\nVed forsettlig eller uaktsom overtredelse av § 38 b som anses som vesentlig eller har skjedd gjentatte ganger, kan den ansvarlige ilegges et overtredelsesgebyr.\n\nDepartementet kan i forskrift gi nærmere regler om utmåling av overtredelsesgebyr.Tilføyd ved lov 16 juni 2023 nr. 38 (i kraft 1 okt 2023 iflg. res. 16 juni 2023 nr. 930).
