        "paragraph_id": "para_20"
      },
      {
        "text": "human resources specialist at Ascension. In 2021, Chitwood",
        "paragraph_id": "para_21"
      },
      {
        "text": "was approved to take intermittent leave under the Family and",
        "paragraph_id": "para_22"
      },
      {
        "text": "Medical Leave Act (“FMLA” or “the Act”), 29 U.S.C. §§ 2601",
        "paragraph_id": "para_23"
      },
      {
        "text": "et seq., for her serious health condition. Later that year, she",
        "paragraph_id": "para_24"
      },
      {
        "text": "was also approved to take continuous FMLA leave for a two-",
        "paragraph_id": "para_25"
      },
      {
        "text": "month period to care for her son. When Chitwood’s",
        "paragraph_id": "para_26"
      },
      {
        "text": "2 No. 25-1933",
        "paragraph_id": "para_27"
      },
      {
        "text": "continuous FMLA leave ended, Ascension instructed Chit-",
        "paragraph_id": "para_28"
      },
      {
        "text": "wood to return to work. But Chitwood did not return, and",
        "paragraph_id": "para_29"
      },
      {
        "text": "Ascension fired her. The next day, Chitwood attempted to ret-",
        "paragraph_id": "para_30"
      },
      {
        "text": "roactively report intermittent FMLA leave for her absences af-",
        "paragraph_id": "para_31"
      },
      {
        "text": "ter her continuous leave ended—to no avail. Chitwood then",
        "paragraph_id": "para_32"
      },
      {
        "text": "sued Ascension, claiming that Ascension had interfered with",
        "paragraph_id": "para_33"
      },
      {
        "text": "her FMLA rights and retaliated against her for using FMLA",
        "paragraph_id": "para_34"
      },
      {
        "text": "leave. The district court granted summary judgment to Ascen-",
        "paragraph_id": "para_35"
      },
      {
        "text": "sion, and Chitwood appeals.",
        "paragraph_id": "para_36"
      },
      {
        "text": "We affirm the district court’s judgment. To prevail, Chit-",
        "paragraph_id": "para_37"
      },
      {
        "text": "wood needed to present evidence that would permit a reason-",
        "paragraph_id": "para_38"
      },
      {
        "text": "able jury to find that Ascension denied her FMLA leave to",
        "paragraph_id": "para_39"
      },
      {
        "text": "which she was entitled, or that Ascension terminated her for",
        "paragraph_id": "para_40"
      },
      {
        "text": "legitimate use of FMLA leave. Chitwood failed on both",
        "paragraph_id": "para_41"
      },
      {
        "text": "grounds.",
        "paragraph_id": "para_42"
      },
      {
        "text": "I. Background",
        "paragraph_id": "para_43"
      },
      {
        "text": "Chitwood began working for Ascension as a human re-",
        "paragraph_id": "para_44"
      },
      {
        "text": "sources specialist in March of 2019. In July of 2021, Chitwood",
        "paragraph_id": "para_45"
      },
      {
        "text": "was granted intermittent FMLA leave for her migraines. She",
        "paragraph_id": "para_46"
      },
      {
        "text": "was required to report her intermittent FMLA leave usage to",
        "paragraph_id": "para_47"
      },
      {
        "text": "Ascension’s third-party leave administrator, Sedgwick",
        "paragraph_id": "para_48"
      },
      {
        "text": "Claims Management Services, Inc., on “the same day the ab-",
        "paragraph_id": "para_49"
      },
      {
        "text": "sence occurs.” Chitwood was also required to notify her su-",
        "paragraph_id": "para_50"
      },
      {
        "text": "pervisor of “any time taken under the FMLA … as soon as",
        "paragraph_id": "para_51"
      },
      {
        "text": "practicable.” Chitwood used her intermittent FMLA leave at",
        "paragraph_id": "para_52"
      },
      {
        "text": "least eight times during the summer of 2021.",
        "paragraph_id": "para_53"
      },
      {
        "text": "In late August of that year, Chitwood stopped reporting to",
        "paragraph_id": "para_54"
      },
      {
        "text": "work entirely. She requested continuous military leave under",
        "paragraph_id": "para_55"
      },
      {
        "text": "the FMLA from August through December of 2021 based on",
        "paragraph_id": "para_56"
      },
      {
        "text": "her ex-husband’s military orders. Sedgwick denied that",
        "paragraph_id": "para_57"
      },
      {
        "text": "No. 25-1933 3",
        "paragraph_id": "para_58"
      },
      {
        "text": "request as unauthorized by the FMLA, but Chitwood did not",
        "paragraph_id": "para_59"
      },
      {
        "text": "return to work. Instead, in October of 2021, Chitwood applied",
        "paragraph_id": "para_60"
      },
      {
        "text": "for retroactive continuous FMLA leave to care for her son,",
        "paragraph_id": "para_61"
      },
      {
        "text": "who had a serious health condition. Sedgwick approved that",
        "paragraph_id": "para_62"
      },
      {
        "text": "request for August 31 through November 3, 2021.",
        "paragraph_id": "para_63"
      },
      {
        "text": "When Chitwood’s continuous FMLA leave expired in No-",
        "paragraph_id": "para_64"
      },
      {
        "text": "vember, however, she did not return to work. Ascension em-",
        "paragraph_id": "para_65"
      },
      {
        "text": "ployee Scott Godsey contacted Chitwood about the conclu-",
        "paragraph_id": "para_66"
      },
      {
        "text": "sion of her leave. Godsey instructed Chitwood at least three",
        "paragraph_id": "para_67"
      },
      {
        "text": "times to return to work on November 15. Godsey also told",
        "paragraph_id": "para_68"
      },
      {
        "text": "Chitwood that if she did not return to work as instructed, As-",
        "paragraph_id": "para_69"
      },
      {
        "text": "cension would fire her. Chitwood applied for a personal leave",
        "paragraph_id": "para_70"
      },
      {
        "text": "of absence for November 4 through December 1, 2021, but that",
        "paragraph_id": "para_71"
      },
      {
        "text": "request was denied.",
        "paragraph_id": "para_72"
      },
      {
        "text": "November 15 came, and still Chitwood did not return to",
        "paragraph_id": "para_73"
      },
      {
        "text": "work. Instead, she left a voicemail on Ascension’s attendance",
        "paragraph_id": "para_74"
      },
      {
        "text": "absentee line that morning, stating that she had been unable",
        "paragraph_id": "para_75"
      },
      {
        "text": "to log into her computer and assumed she had been termi-",
        "paragraph_id": "para_76"
      },
      {
        "text": "nated. Chitwood said that “it was a pleasure to work with you",
        "paragraph_id": "para_77"
      },
      {
        "text": "all,” thanked Ascension “for the opportunity,” and expressed",
        "paragraph_id": "para_78"
      },
      {
        "text": "her intent to return company property.",
        "paragraph_id": "para_79"
      },
      {
        "text": "Ascension terminated Chitwood’s employment later that",
        "paragraph_id": "para_80"
      },
      {
        "text": "day, citing the reason as “Leave Exhaust/Failure to Return to",
        "paragraph_id": "para_81"
      },
      {
        "text": "Work.” On November 16, the day after she was terminated,",
        "paragraph_id": "para_82"
      },
      {
        "text": "Chitwood attempted to report intermittent FMLA leave to",
        "paragraph_id": "para_83"
      },
      {
        "text": "Sedgwick for her absences on November 11, 12, and 15. Sedg-",
        "paragraph_id": "para_84"
      },
      {
        "text": "wick notified Ascension of Chitwood’s requests, but Ascen-",
        "paragraph_id": "para_85"
      },
      {
        "text": "sion considered them invalid since Chitwood had been termi-",
        "paragraph_id": "para_86"
      },
      {
        "text": "nated the previous day.",
        "paragraph_id": "para_87"

        "text": "Chitwood then sued Ascension, alleging that her termina-",

      {
        "text": "tion amounted to interference with and retaliation for her ex-",
        "paragraph_id": "para_90"
      },
      {
        "text": "ercise of FMLA rights. The district judge granted summary",
        "paragraph_id": "para_91"
      },
      {
        "text": "judgment to Ascension, holding that no reasonable jury could",
        "paragraph_id": "para_92"
      },
      {
        "text": "decide in Chitwood’s favor. The district judge determined",
        "paragraph_id": "para_93"
      },
      {
        "text": "that Chitwood had been terminated and was no longer enti-",
        "paragraph_id": "para_94"
      },
      {
        "text": "tled to FMLA leave at the time she attempted to retroactively",
        "paragraph_id": "para_95"
      },
      {
        "text": "report her November absences. The judge also found that she",
        "paragraph_id": "para_96"
      },
      {
        "text": "had not reported those absences as soon as “practicable,” as",
        "paragraph_id": "para_97"
      },
      {
        "text": "required by FMLA regulations and Ascension’s policy. This",
        "paragraph_id": "para_98"
      },
      {
        "text": "appeal followed. 1",
        "paragraph_id": "para_99"
      },
      {
        "text": "II. Discussion",
        "paragraph_id": "para_100"
      },
      {
        "text": "We review the district judge’s ruling on a motion for sum-",
        "paragraph_id": "para_101"
      },
      {
        "text": "mary judgment de novo, construing all facts and making all",
        "paragraph_id": "para_102"
      },
      {
        "text": "reasonable inferences in the light most favorable to the non-",
        "paragraph_id": "para_103"
      },
      {
        "text": "moving party. Nicholson v. Pulte Homes Corp., 690 F.3d 819, 824",
        "paragraph_id": "para_104"
      },
      {
        "text": "(7th Cir. 2012). Summary judgment is appropriate when",
        "paragraph_id": "para_105"
      },
      {
        "text": "“there is no genuine dispute as to any material fact and the",
        "paragraph_id": "para_106"
      },
      {
        "text": "movant is entitled to judgment as a matter of law.” Fed. R.",
        "paragraph_id": "para_107"
      },
      {
        "text": "Civ. P. 56(a).",
        "paragraph_id": "para_108"
      },
      {
        "text": "The FMLA grants eligible employees the right to take up",
        "paragraph_id": "para_109"
      },
      {
        "text": "to “a total of 12 workweeks of leave during any 12-month pe-",
        "paragraph_id": "para_110"
      },
      {
        "text": "riod” for certain qualifying reasons, including the employee’s",
        "paragraph_id": "para_111"
      },
      {
        "text": "own “serious health condition that makes the employee una-",
        "paragraph_id": "para_112"
      },
      {
        "text": "ble to perform the functions of” their job or to care for a child",
        "paragraph_id": "para_113"
      },
      {
        "text": "1 Chitwood also sued Ascension for Title VII retaliation, claiming that",
        "paragraph_id": "para_114"
      },
      {
        "text": "Ascension terminated her in retaliation for seeking a religious exemption",
        "paragraph_id": "para_115"
      },
      {
        "text": "from Ascension’s COVID-19 vaccine mandate. The district judge granted",
        "paragraph_id": "para_116"
      },
      {
        "text": "summary judgment to Ascension on that claim, and Chitwood does not",
        "paragraph_id": "para_117"
      },
      {
        "text": "challenge that decision on appeal.",
        "paragraph_id": "para_118"
      },
      {
        "text": "No. 25-1933 5",
        "paragraph_id": "para_119"
      },
      {
        "text": "with a “serious health condition.” 29 U.S.C. § 2612(a)(l). An",
        "paragraph_id": "para_120"
      },
      {
        "text": "employer may not “interfere with, restrain, or deny the exer-",
        "paragraph_id": "para_121"
      },
      {
        "text": "cise of or the attempt to exercise, any right provided under”",
        "paragraph_id": "para_122"
      },
      {
        "text": "the FMLA. Id. § 2615(a)(l). Nor may an employer “discharge",
        "paragraph_id": "para_123"
      },
      {
        "text": "or in any other manner discriminate” against an employee for",
        "paragraph_id": "para_124"
      },
      {
        "text": "exercising their FMLA rights. Id. § 2615(a)(2); see, e.g., Kauff-",
        "paragraph_id": "para_125"
      },
      {
        "text": "man v. Fed. Express Corp., 426 F.3d 880, 884 (7th Cir. 2005) (“We",
        "paragraph_id": "para_126"
      },
      {
        "text": "have construed [§ 2615(a)(2) and (b)] to create a cause of ac-",
        "paragraph_id": "para_127"
      },
      {
        "text": "tion for retaliation.”). FMLA claims thus “generally come in",
        "paragraph_id": "para_128"
      },
      {
        "text": "two forms: interference and retaliation.” Juday v. FCA US LLC,",
        "paragraph_id": "para_129"
      },
      {
        "text": "57 F.4th 591, 595 (7th Cir. 2023). Both are at issue here.",
        "paragraph_id": "para_130"
      },
      {
        "text": "A. FMLA Interference",
        "paragraph_id": "para_131"
      },
      {
        "text": "To succeed on her FMLA interference claim, Chitwood",
        "paragraph_id": "para_132"
      },
      {
        "text": "must show that (1) she was eligible for FMLA protection, (2)",
        "paragraph_id": "para_133"
      },
      {
        "text": "Ascension was covered by the FMLA, (3) she was entitled to",
        "paragraph_id": "para_134"
      },
      {
        "text": "take leave under the FMLA, (4) she provided sufficient notice",
        "paragraph_id": "para_135"
      },
      {
        "text": "of her intent to take FMLA leave, and (5) Ascension denied",
        "paragraph_id": "para_136"
      },
      {
        "text": "her FMLA benefits to which she was entitled. Davis v. Ill. Dep’t",
        "paragraph_id": "para_137"
      },
      {
        "text": "of Hum. Servs., 137 F.4th 641, 648 (7th Cir. 2025).",
        "paragraph_id": "para_138"
      },
      {
        "text": "Chitwood can make almost none of these showings. Her",
        "paragraph_id": "para_139"
      },
      {
        "text": "suit focuses on her unsuccessful effort to report intermittent",
        "paragraph_id": "para_140"
      },
      {
        "text": "FMLA leave for her absences on November 11, 12, and 15,",
        "paragraph_id": "para_141"
      },
      {
        "text": "2021. But at the time Chitwood attempted to retroactively re-",
        "paragraph_id": "para_142"
      },
      {
        "text": "port those absences, she was no longer employed by Ascen-",
        "paragraph_id": "para_143"
      },
      {
        "text": "sion. She therefore was not denied FMLA benefits to which",
        "paragraph_id": "para_144"
      },
      {
        "text": "she was entitled. See, e.g., Riley v. City of Kokomo, 909 F.3d 182,",
        "paragraph_id": "para_145"
      },
      {
        "text": "188 (7th Cir. 2018) (affirming summary judgment for em-",
        "paragraph_id": "para_146"
      },
      {
        "text": "ployer where “undisputed facts show that [employer] had al-",
        "paragraph_id": "para_147"
      },
      {
        "text": "ready decided to terminate [employee] … before [employee]",
        "paragraph_id": "para_148"
      },
      {
        "text": "requested leave”); Guzman v. Brown County, 884 F.3d 633, 640",
        "paragraph_id": "para_149"
      },
      {
        "text": "(7th Cir. 2018) (affirming summary judgment on FMLA",
        "paragraph_id": "para_150"
      },
      {
        "text": "6 No. 25-1933",
        "paragraph_id": "para_151"
      },
      {
        "text": "interference claim because plaintiff was not “denied FMLA",
        "paragraph_id": "para_152"
      },
      {
        "text": "benefits to which she was entitled” when her supervisor de-",
        "paragraph_id": "para_153"
      },
      {
        "text": "cided to terminate her before her supervisor had any",
        "paragraph_id": "para_154"
      },
      {
        "text": "knowledge that she requested FMLA leave).",
        "paragraph_id": "para_155"
      },
      {
        "text": "Chitwood contends that she was entitled to retroactively",
        "paragraph_id": "para_156"
      },
      {
        "text": "report her November 11, 12, and 15 absences as FMLA leave",
        "paragraph_id": "para_157"
      },
      {
        "text": "on November 16. Even setting aside her November 15 termi-",
        "paragraph_id": "para_158"
      },
      {
        "text": "nation, that claim fails on both the law and the facts. FMLA",
        "paragraph_id": "para_159"
      },
      {
        "text": "regulations require employees to give notice of leave “as soon",
        "paragraph_id": "para_160"
      },
      {
        "text": "as practicable under the facts and circumstances of the partic-",
        "paragraph_id": "para_161"
      },
      {
        "text": "ular case,” and generally “within the time prescribed by the",
        "paragraph_id": "para_162"
      },
      {
        "text": "employer’s usual and customary notice requirements.” 29",
        "paragraph_id": "para_163"
      },
      {
        "text": "C.F.R. § 825.303(a). Ascension policy, in turn, required Chit-",
        "paragraph_id": "para_164"
      },
      {
        "text": "wood to report her intermittent FMLA leave usage to Sedg-",
        "paragraph_id": "para_165"
      },
      {
        "text": "wick on “the same day the absence occurs,” and to notify her",
        "paragraph_id": "para_166"
      },
      {
        "text": "supervisor of her absence “as soon as practicable.” Failure to",
        "paragraph_id": "para_167"
      },
      {
        "text": "“follow the applicable regulatory and workplace require-",
        "paragraph_id": "para_168"
      },
      {
        "text": "ments” for notice can foreclose an FMLA interference claim.",
        "paragraph_id": "para_169"
      },
      {
        "text": "Righi v. SMC Corp., 632 F.3d 404, 412 (7th Cir. 2011); see also,",
        "paragraph_id": "para_170"
      },
      {
        "text": "e.g., Lutes v. United Trailers, Inc., 950 F.3d 359, 365 (7th Cir.",
        "paragraph_id": "para_171"
      },
      {
        "text": "2020).",
        "paragraph_id": "para_172"
      },
      {
        "text": "No reasonable jury could find the notice requirements sat-",
        "paragraph_id": "para_173"
      },
      {
        "text": "isfied here. It is undisputed that on November 15, Chitwood",
        "paragraph_id": "para_174"
      },
      {
        "text": "called Ascension’s attendance line and left a voicemail, as-",
        "paragraph_id": "para_175"
      },
      {
        "text": "suming she had been terminated and expressing gratitude for",
        "paragraph_id": "para_176"
      },
      {
        "text": "the opportunity to work at Ascension. At no point in her",
        "paragraph_id": "para_177"
      },
      {
        "text": "voicemail did Chitwood express any intention to take inter-",
        "paragraph_id": "para_178"
      },
      {
        "text": "mittent FMLA leave for that day. Instead, Chitwood waited",
        "paragraph_id": "para_179"
      },
      {
        "text": "until the next day, after she had been terminated, to retroac-",
        "paragraph_id": "para_180"
      },
      {
        "text": "tively report intermittent FMLA absences for November 11,",
        "paragraph_id": "para_181"
      },
      {
        "text": "12, and 15. Nothing in the record suggests that Chitwood was",
        "paragraph_id": "para_182"
      },
      {
        "text": "No. 25-1933 7",
        "paragraph_id": "para_183"
      },
      {
        "text": "unable to report these absences on “the same day” they oc-",
        "paragraph_id": "para_184"
      },
      {
        "text": "curred, as required by Ascension’s policy. To the contrary, the",
        "paragraph_id": "para_185"
      },
      {
        "text": "record is clear that it was “practicable” for Chitwood to report",
        "paragraph_id": "para_186"
      },
      {
        "text": "her absences on at least November 15, as evidenced by the fact",
        "paragraph_id": "para_187"
      },
      {
        "text": "that she was able to call Ascension’s attendance line that very",
        "paragraph_id": "para_188"
      },
      {
        "text": "morning. See 29 C.F.R. § 825.303(a).",
        "paragraph_id": "para_189"
      },
      {
        "text": "Chitwood asks us to excuse her belated reporting because,",
        "paragraph_id": "para_190"
      },
      {
        "text": "in her telling, she had previously been permitted to report in-",
        "paragraph_id": "para_191"
      },
      {
        "text": "termittent FMLA absences as much as 24 hours after their oc-",
        "paragraph_id": "para_192"
      },
      {
        "text": "currence. But Sedgwick’s records show just a single instance",
        "paragraph_id": "para_193"
      },
      {
        "text": "of Chitwood reporting an intermittent FMLA absence one day",
        "paragraph_id": "para_194"
      },
      {
        "text": "late. And on that instance, Chitwood had texted her supervi-",
        "paragraph_id": "para_195"
      },
      {
        "text": "sor on the day of her absence about her migraine and intent",
        "paragraph_id": "para_196"
      },
      {
        "text": "to take intermittent FMLA leave. The record therefore does",
        "paragraph_id": "para_197"
      },
      {
        "text": "not support Chitwood’s claim about Ascension’s accepted",
        "paragraph_id": "para_198"
      },
      {
        "text": "practice. The district judge properly granted summary judg-",
        "paragraph_id": "para_199"
      },
      {
        "text": "ment on Chitwood’s FMLA interference claim.",
        "paragraph_id": "para_200"
      },
      {
        "text": "B. FMLA Retaliation",
        "paragraph_id": "para_201"
      },
      {
        "text": "To prevail on an FMLA retaliation claim, Chitwood must",
        "paragraph_id": "para_202"
      },
      {
        "text": "show that (1) she engaged in statutorily protected activity, (2)",
        "paragraph_id": "para_203"
      },
      {
        "text": "Ascension took adverse action against her, and (3) the pro-",
        "paragraph_id": "para_204"
      },
      {
        "text": "tected activity caused the adverse action. Freelain v. Vill. of Oak",
        "paragraph_id": "para_205"
      },
      {
        "text": "Park, 888 F.3d 895, 901 (7th Cir. 2018). This “claim requires",
        "paragraph_id": "para_206"
      },
      {
        "text": "proof of discriminatory intent—evidence that the employer",
        "paragraph_id": "para_207"
      },
      {
        "text": "‘was acting under a prohibited animus.’” Juday, 57 F.4th at 596",
        "paragraph_id": "para_208"
      },
      {
        "text": "(citation omitted). 2",
        "paragraph_id": "para_209"
      },
      {
        "text": "2 Our cases have not been fully consistent about the causation stand-",
        "paragraph_id": "para_210"
      },
      {
        "text": "ard for an FMLA retaliation claim. Compare Lohmeier v. Gottlieb Mem’l",
        "paragraph_id": "para_211"
      },
      {
        "text": "Hosp., 147 F.4th 817, 830 (7th Cir. 2025) (“To make out an FMLA retaliation",
        "paragraph_id": "para_212"
      },
      {
        "text": "claim, Lohmeier must show that her FMLA request was the ‘but-for’ cause",
        "paragraph_id": "para_213"
      },
      {
        "text": "8 No. 25-1933",
        "paragraph_id": "para_214"
      },
      {
        "text": "Chitwood claims that Ascension retaliated against her for",
        "paragraph_id": "para_215"
      },
      {
        "text": "using FMLA leave. That contention is a non-starter as to her",
        "paragraph_id": "para_216"
      },
      {
        "text": "November 11, 12, and 15 absences, because Chitwood was ter-",
        "paragraph_id": "para_217"
      },
      {
        "text": "minated before even attempting to invoke FMLA for those",
        "paragraph_id": "para_218"
      },
      {
        "text": "days. See, e.g., Guzman, 884 F.3d at 639–40. In the months be-",
        "paragraph_id": "para_219"
      },
      {
        "text": "fore that, though, Chitwood did extensively use both inter-",
        "paragraph_id": "para_220"
      },
      {
        "text": "mittent and continuous FMLA leave. But the record is clear",
        "paragraph_id": "para_221"
      },
      {
        "text": "that it was Chitwood’s failure to return to work as directed—",
        "paragraph_id": "para_222"
      },
      {
        "text": "not her prior use of FMLA leave—that was the cause of her",
        "paragraph_id": "para_223"
      },
      {
        "text": "termination. After her continuous FMLA leave expired, Chit-",
        "paragraph_id": "para_224"
      },
      {
        "text": "wood was informed multiple times that she must return to",
        "paragraph_id": "para_225"
      },
      {
        "text": "work on November 15, 2021, or else she would be terminated.",
        "paragraph_id": "para_226"
      },
      {
        "text": "When Chitwood failed to return to work as instructed, she",
        "paragraph_id": "para_227"
      },
      {
        "text": "was terminated—just as Ascension had warned. There is no",
        "paragraph_id": "para_228"
      },
      {
        "text": "evidence that, had Chitwood simply reported to work as di-",
        "paragraph_id": "para_229"
      },
      {
        "text": "rected, she still would have been terminated in retaliation for",
        "paragraph_id": "para_230"
      },
      {
        "text": "her legitimate FMLA use.",
        "paragraph_id": "para_231"
      },
      {
        "text": "Chitwood attempts to gin up pretext on Ascension’s behalf",
        "paragraph_id": "para_232"
      },
      {
        "text": "by pointing to email threads and messages between Ascen-",
        "paragraph_id": "para_233"
      },
      {
        "text": "sion employees that discuss prior concerns about her attend-",
        "paragraph_id": "para_234"
      },
      {
        "text": "ance and FMLA use. But these conversations, even when",
        "paragraph_id": "para_235"
      },
      {
        "text": "of her termination.”), with, e.g., Trahanas v. Nw. Univ., 64 F.4th 842, 856 (7th",
        "paragraph_id": "para_236"
      },
      {
        "text": "Cir. 2023) (“To succeed in showing causation, a plaintiff must demonstrate",
        "paragraph_id": "para_237"
      },
      {
        "text": "that ‘the protected conduct was a substantial or motivating factor in the",
        "paragraph_id": "para_238"
      },
      {
        "text": "employer’s decision.’” (citation omitted)). The distinction between “but-",
        "paragraph_id": "para_239"
      },
      {
        "text": "for causation” and “substantial or motivating factor” makes no difference",
        "paragraph_id": "para_240"
      },
      {
        "text": "in this case, and neither the parties nor the district judge focused on this",
        "paragraph_id": "para_241"
      },
      {
        "text": "issue. But we flag the question here because it may be a substantial one,",
        "paragraph_id": "para_242"
      },
      {
        "text": "implicating statutory and regulatory construction as well as Supreme",
        "paragraph_id": "para_243"
      },
      {
        "text": "Court precedent. See Malin v. Hospira, Inc., 762 F.3d 552, 562 n.3 (7th Cir.",
        "paragraph_id": "para_244"
      },
      {
        "text": "2014); see also, e.g., Lapham v. Walgreen Co., 88 F.4th 879, 890–94 (11th Cir.",
        "paragraph_id": "para_245"
      },
      {
        "text": "2023); cf. Univ. of Tex. Sw. Med. Ctr. v. Nassar, 570 U.S. 338 (2013).",
        "paragraph_id": "para_246"
      },
      {
        "text": "No. 25-1933 9",
        "paragraph_id": "para_247"
      },
      {
        "text": "construed in the light most favorable to Chitwood, do not es-",
        "paragraph_id": "para_248"
      },
      {
        "text": "tablish pretext or retaliation.",
        "paragraph_id": "para_249"
      },
      {
        "text": "Chitwood first points to an internal email chain between",
        "paragraph_id": "para_250"
      },
      {
        "text": "Godsey and another Ascension employee prior to her termi-",
        "paragraph_id": "para_251"
      },
      {
        "text": "nation. While discussing Chitwood’s return to work, the As-",
        "paragraph_id": "para_252"
      },
      {
        "text": "cension employee stated: “I agree we have to wait until Sedge-",
        "paragraph_id": "para_253"
      },
      {
        "text": "wick [sic] approves or denies. If they deny, we will move to",
        "paragraph_id": "para_254"
      },
      {
        "text": "term if she does not RTW [return to work]. I am not sure what",
        "paragraph_id": "para_255"
      },
      {
        "text": "the end game is here but it is not on the up and up.” Godsey",
        "paragraph_id": "para_256"
      },
      {
        "text": "responded: “It sounds like [Chitwood] is using FMLA for her-",
        "paragraph_id": "para_257"
      },
      {
        "text": "self, her son and her daughter. Perhaps she is trying to make",
        "paragraph_id": "para_258"
      },
      {
        "text": "at least one of them stick for the continuous leave.”",
        "paragraph_id": "para_259"
      },
      {
        "text": "At most, this email thread establishes that Ascension em-",
        "paragraph_id": "para_260"
      },
      {
        "text": "ployees had an “honest suspicion that [Chitwood] was abus-",
        "paragraph_id": "para_261"
      },
      {
        "text": "ing [her] FMLA leave.” Juday, 57 F.4th at 596. That is unsur-",
        "paragraph_id": "para_262"
      },
      {
        "text": "prising given Chitwood’s attempts to obtain FMLA leave on",
        "paragraph_id": "para_263"
      },
      {
        "text": "multiple grounds, at least one of which was unauthorized by",
        "paragraph_id": "para_264"
      },
      {
        "text": "law. The Act does not insulate employees from discipline for",
        "paragraph_id": "para_265"
      },
      {
        "text": "abusing their FMLA rights, see Paterakos v. City of Chicago, 147",
        "paragraph_id": "para_266"
      },
      {
        "text": "F.4th 787, 800 (7th Cir. 2025); Juday, 57 F.4th at 595–96, and",
        "paragraph_id": "para_267"
      },
      {
        "text": "here, Chitwood has not established that her coworkers har-",
        "paragraph_id": "para_268"
      },
      {
        "text": "bored anything other than an “honest suspicion” about her",
        "paragraph_id": "para_269"
      },
      {
        "text": "FMLA requests. Paterakos, 147 F.4th at 800 (affirming sum-",
        "paragraph_id": "para_270"
      },
      {
        "text": "mary judgment for employer where supervisors “honestly be-",
        "paragraph_id": "para_271"
      },
      {
        "text": "lieved [employee] was abusing her FMLA leave,” even “if the",
        "paragraph_id": "para_272"
      },
      {
        "text": "employer was in fact mistaken in that belief”); Juday, 57 F.4th",
        "paragraph_id": "para_273"
      },
      {
        "text": "at 596. That is not enough to establish retaliation.",
        "paragraph_id": "para_274"
      },
      {
        "text": "Chitwood’s reliance on a second set of messages between",
        "paragraph_id": "para_275"
      },
      {
        "text": "Ascension employees fares no better. After Ascension decided",
        "paragraph_id": "para_276"
      },
      {
        "text": "to terminate Chitwood, Godsey told Chitwood’s supervisor,",
        "paragraph_id": "para_277"
      },
      {
        "text": "Jeanine Guzik, that the termination reason should be",
        "paragraph_id": "para_278"
      },
      {
        "text": "10 No. 25-1933",
        "paragraph_id": "para_279"
      },
      {
        "text": "“Exhausted LOA/Failure to Ret.” Godsey also advised Guzik",
        "paragraph_id": "para_280"
      },
      {
        "text": "about designating Chitwood’s rehire status, stating: “I would",
        "paragraph_id": "para_281"
      },
      {
        "text": "be careful not to make anyone failing to return from leave as",
        "paragraph_id": "para_282"
      },
      {
        "text": "not eligible. Perhaps you should put that she was not effec-",
        "paragraph_id": "para_283"
      },
      {
        "text": "tively completing her job duties and was unreliable.” But in",
        "paragraph_id": "para_284"
      },
      {
        "text": "response, Guzik clarified to Godsey that Chitwood did not",
        "paragraph_id": "para_285"
      },
      {
        "text": "have productivity issues; instead, she had attendance issues. 3",
        "paragraph_id": "para_286"
      },
      {
        "text": "Guzik thus did not follow Godsey’s recommendation, and",
        "paragraph_id": "para_287"
      },
      {
        "text": "Chitwood’s termination notice listed “Leave Exhaust/Failure",
        "paragraph_id": "para_288"
      },
      {
        "text": "to Return to Work” as the basis.",
        "paragraph_id": "para_289"
      },
      {
        "text": "An after-the-fact attempt to concoct nonretaliatory reasons",
        "paragraph_id": "para_290"
      },
      {
        "text": "for an adverse employment action may give rise to an infer-",
        "paragraph_id": "para_291"
      },
      {
        "text": "ence of pretext. See, e.g., Goelzer v. Sheboygan County, 604 F.3d",
        "paragraph_id": "para_292"
      },
      {
        "text": "987, 996 (7th Cir. 2010). But pretext requires a “lie, specifically",
        "paragraph_id": "para_293"
      },
      {
        "text": "a phony reason for some action.” Tibbs v. Admin. Off. of the Ill.",
        "paragraph_id": "para_294"
      },
      {
        "text": "Cts., 860 F.3d 502, 506 (7th Cir. 2017) (citation omitted). That",

        "text": "Godsey’s statements indicates that Ascension’s proffered rea-",

        "text": "son was “factually baseless” or “not the actual motivation for”",
