        "text": "Since 1986, the Systematic Alien Verification for Entitle-",
        "paragraph_id": "para_12"
      },

        "text": "ments (SAVE) program has allowed federal, state, and local",
        "paragraph_id": "para_13"
      },
      {
        "text": "government agencies to verify the citizenship and immigra-",
        "paragraph_id": "para_14"
      },
      {
        "text": "tion status of noncitizens applying for public benefits. For",
        "paragraph_id": "para_15"
      },
      {
        "text": "decades, it relied on records maintained by the Department",
        "paragraph_id": "para_16"
      },
      {
        "text": "of Homeland Security (DHS), the Department of Justice,",
        "paragraph_id": "para_17"
      },
      {
        "text": "and the Department of State.",
        "paragraph_id": "para_18"
      },
      {
        "text": "Last year, the Federal Government expanded SAVE’s",
        "paragraph_id": "para_19"
      },
      {
        "text": "scope. In March 2025, President Trump signed an Execu-",
        "paragraph_id": "para_20"
      },
      {
        "text": "tive Order directing DHS to put new systems in place to",
        "paragraph_id": "para_21"
      },
      {
        "text": "allow state and local authorities to verify the citizenship",
        "paragraph_id": "para_22"
      },
      {
        "text": "status of registered voters and individuals registering to",
        "paragraph_id": "para_23"
      },
      {
        "text": "vote. Exec. Order No. 14248, 90 Fed. Reg. 14006 (2025).",
        "paragraph_id": "para_24"
      },
      {
        "text": "The Executive Order also directed the Social Security Ad-",
        "paragraph_id": "para_25"
      },
      {
        "text": "ministration (SSA) to make its records available to DHS for",
        "paragraph_id": "para_26"
      },
      {
        "text": "that purpose. Id., at 14007.",
        "paragraph_id": "para_27"
      },
      {
        "text": "Two months later, DHS launched a modified SAVE pro-",
        "paragraph_id": "para_28"
      },
      {
        "text": "gram. The modified program differed from the original in",
        "paragraph_id": "para_29"
      },
      {
        "text": "two key respects. First, it incorporated checks against ad-",
        "paragraph_id": "para_30"
      },
      {
        "text": "ditional records—including social security numbers",
        "paragraph_id": "para_31"
      },
      {
        "text": "(SSNs)—maintained by SSA. Second, it allowed state and",
        "paragraph_id": "para_32"
      },
      {
        "text": "local authorities to conduct bulk searches of multiple indi-",
        "paragraph_id": "para_33"
      },
      {
        "text": "viduals at once.",
        "paragraph_id": "para_34"
      },
      {
        "text": "Under the modified SAVE program, a state or local",
        "paragraph_id": "para_35"
      },
      {
        "text": "agency seeking to determine an individual’s citizenship",
        "paragraph_id": "para_36"
      },
      {

        "text": "date of birth, or full or partial SSN to the SAVE portal. The",

        "text": "SAVE program automatically discloses that information to",
        "paragraph_id": "para_42"
      },
      {
        "text": "SSA, which runs it through its databases to find a match.",
        "paragraph_id": "para_43"
      },
      {
        "text": "SSA then discloses its search results to DHS, including the",
        "paragraph_id": "para_44"
      },
      {
        "text": "individual’s full name, date of birth, full SSN, and citizen-",
        "paragraph_id": "para_45"
      },
      {
        "text": "ship status. Finally, the SAVE portal returns a response to",
        "paragraph_id": "para_46"
      },
      {
        "text": "the agency, either confirming that the individual is a citizen",
        "paragraph_id": "para_47"
      },
      {
        "text": "or requesting that the agency resubmit its query with addi-",
        "paragraph_id": "para_48"
      },
      {
        "text": "tional information. If the modified SAVE program is unable",
        "paragraph_id": "para_49"
      },
      {
        "text": "to confirm that an individual is a citizen, the agency is re-",
        "paragraph_id": "para_50"
      },
      {
        "text": "quired to contact the individual and request that he provide",
        "paragraph_id": "para_51"
      },
      {
        "text": "proof of citizenship to register or remain registered to vote.",
        "paragraph_id": "para_52"
      },
      {
        "text": "Various organizations—including the League of Women",
        "paragraph_id": "para_53"
      },
      {
        "text": "Voters, its local affiliates, and the Electronic Privacy Infor-",
        "paragraph_id": "para_54"
      },
      {
        "text": "mation Center—sued DHS, SSA, and other federal actors",
        "paragraph_id": "para_55"
      },
      {
        "text": "to challenge the modified SAVE program. As relevant here,",
        "paragraph_id": "para_56"
      },
      {
        "text": "they raised three claims. First, they alleged that the modi-",
        "paragraph_id": "para_57"
      },
      {
        "text": "fications violated a confidentiality provision in the Social",
        "paragraph_id": "para_58"
      },
      {
        "text": "Security Act that prohibits the disclosure of SSNs and other",
        "paragraph_id": "para_59"
      },
      {
        "text": "SSA records. Second, they alleged that the modifications",
        "paragraph_id": "para_60"
      },
      {
        "text": "violated substantive and procedural protections in the Pri-",
        "paragraph_id": "para_61"
      },
      {
        "text": "vacy Act of 1974, which prohibits the nonconsensual disclo-",
        "paragraph_id": "para_62"
      },
      {
        "text": "sure of certain information and requires that agencies com-",
        "paragraph_id": "para_63"
      },
      {
        "text": "plete a notice-and-comment process for program",
        "paragraph_id": "para_64"
      },
      {
        "text": "modifications. Third, they alleged that the modifications",
        "paragraph_id": "para_65"
      },
      {
        "text": "were arbitrary and capricious under the Administrative",
        "paragraph_id": "para_66"
      },
      {
        "text": "Procedure Act (APA).",
        "paragraph_id": "para_67"
      },
      {
        "text": "The plaintiff organizations moved for summary judgment",
        "paragraph_id": "para_68"
      },
      {
        "text": "on all three claims. The Government cross-moved to dis-",
        "paragraph_id": "para_69"
      },
      {
        "text": "miss or, in the alternative, for summary judgment, arguing",
        "paragraph_id": "para_70"
      },
      {
        "text": "that plaintiffs lacked Article III standing; that the modified",
        "paragraph_id": "para_71"
      },
      {
        "text": "SAVE program did not violate the Social Security Act, Pri-",
        "paragraph_id": "para_72"
      },
      {
        "text": "vacy Act, or APA; and that Congress had authorized DHS",
        "paragraph_id": "para_73"
      },
      {
        "text": "in 8 U. S. C. §1373 to use SSNs and related records notwith-",
        "paragraph_id": "para_74"
      },
      {
        "text": "standing any other provision of law.",
        "paragraph_id": "para_75"
      },
      {

        "text": "The District Court agreed with the plaintiff organizations",
        "paragraph_id": "para_78"
      },
      {
        "text": "across the board, set aside and vacated the modified SAVE",
        "paragraph_id": "para_79"
      },
      {
        "text": "program and its related notices, and denied the Govern-",
        "paragraph_id": "para_80"
      },
      {
        "text": "ment’s application for a stay pending appeal. A divided",
        "paragraph_id": "para_81"
      },
      {
        "text": "panel of the D. C. Circuit (Srinivasan, C. J., Wilkins, J., and",
        "paragraph_id": "para_82"
      },
      {
        "text": "Katsas, J.) also denied the Government’s application for a",
        "paragraph_id": "para_83"
      },
      {
        "text": "stay, with Judge Katsas dissenting.",
        "paragraph_id": "para_84"
      },
      {
        "text": "The Government now seeks a stay from this Court. To",
        "paragraph_id": "para_85"
      },
      {
        "text": "succeed, the Government must establish “(1) a reasonable",
        "paragraph_id": "para_86"
      },
      {
        "text": "probability that four Justices will consider the issue suffi-",
        "paragraph_id": "para_87"
      },
      {
        "text": "ciently meritorious to grant certiorari; (2) a fair prospect",
        "paragraph_id": "para_88"
      },
      {
        "text": "that a majority of the Court will vote to reverse the judg-",
        "paragraph_id": "para_89"
      },
      {
        "text": "ment below; and (3) a likelihood that irreparable harm will",
        "paragraph_id": "para_90"
      },
      {
        "text": "result from the denial of a stay.’’ Hollingsworth v. Perry,",
        "paragraph_id": "para_91"
      },
      {
        "text": "558 U. S. 183, 190 (2010) (per curiam). In “close cases,” we",
        "paragraph_id": "para_92"
      },
      {
        "text": "“balance the equities and weigh the relative harms to the",
        "paragraph_id": "para_93"
      },
      {
        "text": "applicant and to the respondent.” Ibid. We grant the ap-",
        "paragraph_id": "para_94"
      },
      {
        "text": "plication.",
        "paragraph_id": "para_95"
      },
      {
        "text": "To start, we consider the likelihood that this Court would",
        "paragraph_id": "para_96"
      },
      {
        "text": "reverse. At least one of plaintiffs’ members (J. Doe 4) is",
        "paragraph_id": "para_97"
      },
      {
        "text": "registered to vote in a State (Louisiana) that used the mod-",
        "paragraph_id": "para_98"
      },
      {
        "text": "ified SAVE program. She has demonstrated that SSA rec-",
        "paragraph_id": "para_99"
      },
      {
        "text": "ords do not accurately reflect that she is now a naturalized",
        "paragraph_id": "para_100"
      },
      {
        "text": "citizen. Supplemental Decl. of J. Doe in No. 25–cv–3501",
        "paragraph_id": "para_101"
      },
      {
        "text": "(D DC), ECF Doc. 16–3, ¶¶2, 14. Had the modified SAVE",
        "paragraph_id": "para_102"
      },
      {
        "text": "program not been set aside, she likely would have been re-",
        "paragraph_id": "para_103"
      },
      {
        "text": "quired to provide additional proof of citizenship. Such a",
        "paragraph_id": "para_104"
      },
      {
        "text": "“need to take . . . affirmative steps to avoid risk of harm . . .",
        "paragraph_id": "para_105"
      },
      {
        "text": "constitutes a cognizable injury” supporting standing. Meese",
        "paragraph_id": "para_106"
      },
      {
        "text": "v. Keene, 481 U. S. 465, 475 (1987).",
        "paragraph_id": "para_107"
      },
      {
        "text": "Although the plaintiff organizations likely have standing,",
        "paragraph_id": "para_108"
      },
      {
        "text": "their claims likely lack merit. The plaintiff organizations",
        "paragraph_id": "para_109"
      },
      {
        "text": "claim that the federal defendants violated the Social Secu-",
        "paragraph_id": "para_110"
      },
      {
        "text": "rity Act, Privacy Act, and APA. In 1996, Congress, how-",
        "paragraph_id": "para_111"
      },
      {
        "text": "ever, separately and expressly authorized DHS to request",
        "paragraph_id": "para_112"
      },
      {
        "text": "and receive information relating to citizenship and",
        "paragraph_id": "para_113"
      },
      {

        "text": "immigration status from other agencies, including SSA, in",
        "paragraph_id": "para_117"
      },
      {
        "text": "the Illegal Immigration Reform and Immigrant Responsi-",
        "paragraph_id": "para_118"
      },
      {
        "text": "bility Act (IIRIRA).",
        "paragraph_id": "para_119"
      },
      {
        "text": "The relevant IIRIRA provision, 8 U. S. C. §1373, contains",
        "paragraph_id": "para_120"
      },
      {
        "text": "two notwithstanding clauses. The first, section 1373(a),",
        "paragraph_id": "para_121"
      },
      {
        "text": "provides:",
        "paragraph_id": "para_122"
      },
      {
        "text": "“Notwithstanding any other provision of Federal,",
        "paragraph_id": "para_123"
      },
      {
        "text": "State, or local law, a Federal, State, or local govern-",
        "paragraph_id": "para_124"
      },
      {
        "text": "ment entity or official may not prohibit, or in any way",
        "paragraph_id": "para_125"
      },
      {
        "text": "restrict, any government entity or official from sending",
        "paragraph_id": "para_126"
      },
      {
        "text": "to, or receiving from, the [DHS] information regarding",
        "paragraph_id": "para_127"
      },
      {
        "text": "the citizenship or immigration status, lawful or unlaw-",
        "paragraph_id": "para_128"
      },
      {
        "text": "ful, of any individual.”",
        "paragraph_id": "para_129"
      },
      {
        "text": "The second, section 1373(b), which is captioned “Additional",
        "paragraph_id": "para_130"
      },
      {
        "text": "authority of government entities,” similarly provides:",
        "paragraph_id": "para_131"
      },
      {
        "text": "“Notwithstanding any other provision of Federal,",
        "paragraph_id": "para_132"
      },
      {
        "text": "State, or local law, no person or agency may prohibit,",
        "paragraph_id": "para_133"
      },
      {
        "text": "or in any way restrict, a Federal, State, or local govern-",
        "paragraph_id": "para_134"
      },
      {
        "text": "ment entity from doing any of the following with re-",
        "paragraph_id": "para_135"
      },
      {
        "text": "spect to information regarding the immigration status,",
        "paragraph_id": "para_136"
      },
      {
        "text": "lawful or unlawful, of any individual.”",
        "paragraph_id": "para_137"
      },
      {
        "text": "The “following” activities include “[s]ending such infor-",
        "paragraph_id": "para_138"
      },
      {
        "text": "mation to, or requesting or receiving such information from,",
        "paragraph_id": "para_139"
      },
      {
        "text": "the [DHS].” §1373(b)(1).",
        "paragraph_id": "para_140"
      },
      {
        "text": "By prohibiting interference with the disclosure of infor-",
        "paragraph_id": "para_141"
      },
      {
        "text": "mation regarding citizenship status to DHS—",
        "paragraph_id": "para_142"
      },
      {
        "text": "“[n]otwithstanding any other provision of Federal, State, or",
        "paragraph_id": "para_143"
      },
      {
        "text": "local law”—Congress necessarily authorized DHS to re-",
        "paragraph_id": "para_144"
      },
      {
        "text": "quest and receive that information. Otherwise, agencies,",
        "paragraph_id": "para_145"
      },
      {
        "text": "entities, and officials could find themselves in the impossi-",
        "paragraph_id": "para_146"
      },
      {
        "text": "ble predicament of either disclosing information consistent",
        "paragraph_id": "para_147"
      },
      {
        "text": "with section 1373 but in violation of legislation like the So-",
        "paragraph_id": "para_148"
      },
      {
        "text": "cial Security Act and Privacy Act or withholding that infor-",
        "paragraph_id": "para_149"
      },
      {
        "text": "mation consistent with those Acts but in violation of section",
        "paragraph_id": "para_150"
      },
      {

        "paragraph_id": "para_159"
      },

        "text": "of any individual.” Considered alongside section 1373’s",
        "paragraph_id": "para_160"
      },
      {
        "text": "“notwithstanding” clauses, section 1373(c) appears to con-",
        "paragraph_id": "para_161"
      },
      {
        "text": "template an information-sharing regime like the modified",
        "paragraph_id": "para_162"
      },
      {
        "text": "SAVE program. In light of these provisions, this Court is",
        "paragraph_id": "para_163"
      },
      {
        "text": "likely to reverse the District Court’s holding that the federal",
        "paragraph_id": "para_164"
      },
      {
        "text": "defendants violated the Social Security Act, the Privacy",
        "paragraph_id": "para_165"
      },
      {
        "text": "Act, and the APA.",
        "paragraph_id": "para_166"
      },
      {
        "text": "The remaining factors also warrant a grant. We have of-",
        "paragraph_id": "para_167"
      },
      {
        "text": "ten granted certiorari where a lower court has set aside an",
        "paragraph_id": "para_168"
      },

        "text": "law currently prohibits state and local election authorities",

      },
      {
        "text": "from clearing their voter rolls in the weeks leading up to",

      },

        "text": "federal elections. The organizations point to the National",

      },
      {
        "text": "Voter Registration Act (NVRA), 52 U. S. C. §20507(c)(2)(A),",

        "text": "which provides that “[a] State shall complete, not later than",
        "paragraph_id": "para_200"
      },

        "text": "90 days prior to the date of a primary or general election for",

        "text": "limits the potential impact of staying the District Court’s",

        "text": "order in this case. Still, all agree that the order prevents",

        "text": "tion for Entitlements (SAVE) to ensure that registered vot-",
        "paragraph_id": "para_250"

        "text": "ers are American citizens. For most of its life, SAVE con-",
        "paragraph_id": "para_251"
      },

        "text": "sisted almost entirely of immigration records from DHS. In",
        "paragraph_id": "para_252"
      },
      {
        "text": "2025, however, DHS and the Social Security Administra-",
        "paragraph_id": "para_253"
      },
      {
        "text": "tion (SSA) decided to connect SSA’s database of master",
        "paragraph_id": "para_254"
      },
      {
        "text": "files, including all its sensitive information, to SAVE. A",
        "paragraph_id": "para_255"
      },
      {
        "text": "group of organizations sued, arguing that the modifications",
        "paragraph_id": "para_256"
      },
      {
        "text": "to SAVE violated various federal privacy laws, and that the",
        "paragraph_id": "para_257"
      },
      {
        "text": "staleness of SSA’s citizenship records risked disenfranchis-",
        "paragraph_id": "para_258"
      },
      {
        "text": "ing recently naturalized U. S. citizens. After months of lit-",
        "paragraph_id": "para_259"
      },
      {
        "text": "igation, the District Court agreed and vacated the modifi-",
        "paragraph_id": "para_260"
      },

        "text": "cations.",

        "text": "The D. C. Circuit denied a stay of the District Court’s or-",

      },

        "text": "briefing or oral argument, this Court now grants one—ren-",

        "text": "in 1986 to help States verify eligibility for federally funded",

        "text": "ralization records in DHS’s systems (and occasionally, in",
        "paragraph_id": "para_291"
      },

        "text": "systems at the State Department and the Department of",
        "paragraph_id": "para_292"
      },
      {
        "text": "Justice). Users could also only conduct individual searches,",
        "paragraph_id": "para_293"
      },
      {
        "text": "usually by way of a person’s alien-identification number.",

      },

        "text": "President Trump signed an Executive Order purporting to",

      },
      {

        "text": "tion. The Order required this information-sharing even",
        "paragraph_id": "para_300"
      },
      {
        "text": "though the Social Security Act dictates that “[s]ocial secu-",
        "paragraph_id": "para_301"
      },
      {
        "text": "rity account numbers and related records . . . shall be confi-",
        "paragraph_id": "para_302"
      },
      {
        "text": "dential, and no authorized person shall disclose any such",
        "paragraph_id": "para_303"
      },
      {
        "text": "social security account number or related record.”",

        "text": "conclusive, a State might respond by asking the voter to",
        "paragraph_id": "para_321"
      },

        "text": "provide proof of citizenship in order to remain registered,",
        "paragraph_id": "para_322"
      },
      {
        "text": "and it might strike the voter from the rolls if she fails to",
        "paragraph_id": "para_323"
      },
      {

        "text": "Before the overhaul, DHS had recognized SAVE as the",
        "paragraph_id": "para_325"
      },

        "text": "sort of database that was covered by the federal Privacy",

        "text": "Act. That Act requires agencies to publish a so-called sys-",
        "paragraph_id": "para_327"
      },
      {
        "text": "tem of records notice (SORN) anytime it “establish[es]” or",
        "paragraph_id": "para_328"
      },
      {
        "text": "“modifie[s]” any system of records containing personal iden-",
        "paragraph_id": "para_329"
      },
      {
        "text": "tifying information. 5 U. S. C. §552a(e)(4). The agency is",
        "paragraph_id": "para_330"
      },
      {
        "text": "then prohibited from disclosing anyone’s information in the",
        "paragraph_id": "para_331"
      },
      {
        "text": "system without consent, §552a(b), unless (among other",
        "paragraph_id": "para_332"
      },
      {
        "text": "things) the disclosure is for a “routine use,” §552a(b)(3).",

        "text": "time, neither DHS nor SSA published a SORN or invited",

        "text": "Several organizations (Respondents here) promptly sued",

        "text": "DHS and SSA under the Administrative Procedure Act",

      },
      {
        "text": "(APA), alleging that the SAVE modifications were arbitrary",
        "paragraph_id": "para_347"
      },
      {

        "paragraph_id": "para_359"
      },

        "text": "claimed that the new routine uses would not go into effect",
        "paragraph_id": "para_360"
      },

        "text": "for 30 days. Id., at 40849, 50880. But the modified SAVE",
        "paragraph_id": "para_361"
      },
      {
        "text": "system (which involved disclosures that were covered by",
        "paragraph_id": "para_362"
      },

        "text": "the newly announced routine uses) had already been in op-",
        "paragraph_id": "para_363"
      },
      {
        "text": "eration since May. See 835 F. Supp. 3d, at 100–101.",
        "paragraph_id": "para_364"
      },

        "text": "So, Respondents filed an amended complaint, further al-",
        "paragraph_id": "para_365"
      },
      {
        "text": "leging that the modifications to SAVE violated the Social",
        "paragraph_id": "para_366"
      },
      {
        "text": "Security Act’s confidentiality provision at 42 U. S. C.",
        "paragraph_id": "para_367"
      },

        "text": "§405(c)(2)(C)(viii)(I). First Amended Complaint in No.",

        "text": "Privacy Act claims, arguing that SSA’s disclosures of",

        "text": "NUMIDENT information did not count as a “routine use”",
        "paragraph_id": "para_371"
      },

        "text": "under the Act, and regardless, DHS and SSA had unlaw-",
        "paragraph_id": "para_372"
      },

        "text": "fully failed to timely publish a SORN, or provide a public",
        "paragraph_id": "para_373"
      },

        "text": "comment period, before sharing that information. Id., at",
        "paragraph_id": "para_374"
      },

        "text": "data put some of their recently naturalized members at risk",

        "text": "that §1373 overrode the Social Security Act and the Privacy",

        "text": "Act and granted summary judgment to Respondents, con-",
        "paragraph_id": "para_397"
      },
      {
        "text": "cluding that the modified SAVE system violated both laws,",
        "paragraph_id": "para_398"
      },
      {

        "text": "136. The District Court then vacated the modifications to",

      },

        "text": "SAVE. Id., at 138. At that point, the Government sought",

        "text": "a stay in the District Court, where it raised several new ar-",
        "paragraph_id": "para_402"
      },
      {
        "text": "guments about why the Social Security Act’s confidentiality",
        "paragraph_id": "para_403"
      },
      {
        "text": "provision did not apply to the modified SAVE system. See",
        "paragraph_id": "para_404"
      },
      {
        "text": "No. 1:25–cv–3501 (D DC, July 8, 2026), App. to Application",
        "paragraph_id": "para_405"
      },
      {
        "text": "for Stay 81a–84a (App.) (describing the Government’s argu-",
        "paragraph_id": "para_406"
      },
      {
        "text": "ments).1 The District Court denied the stay and refused to",
        "paragraph_id": "para_407"
      },
      {
        "text": "consider the forfeited arguments in that posture, but in-",
        "paragraph_id": "para_408"
      },
      {
        "text": "vited the Government to raise them via a Rule 52(b) motion",
        "paragraph_id": "para_409"
      },
      {
        "text": "to reopen the judgment. See id., at 85a, n. 3.",
        "paragraph_id": "para_410"
      },
      {
        "text": "The Government did not take the District Court up on",
        "paragraph_id": "para_411"
      },
      {
        "text": "that invitation. Instead, it requested an emergency stay",
