        "text": "[1] Caitlin Bernard, M.D., and Caroline Rouse, M.D. (collectively, “Doctors”), are",
        "paragraph_id": "para_22"
      },
      {
        "text": "both board-certified obstetrician-gynecologists who provide clinical care,",
        "paragraph_id": "para_23"
      },
      {
        "text": "including abortion care, in Indiana. Doctors filed a complaint against the",
        "paragraph_id": "para_24"
      },
      {
        "text": "Indiana State Health Commissioner (“the Commissioner”), in the",
        "paragraph_id": "para_25"
      },
      {
        "text": "Commissioner’s official capacity, and Voices for Life, Inc. (“VFL”), an anti-",
        "paragraph_id": "para_26"
      },
      {
        "text": "abortion nonprofit organization based in South Bend (collectively,",
        "paragraph_id": "para_27"
      },
      {
        "text": "“Defendants”). Doctors sought a judgment under the Uniform Declaratory",
        "paragraph_id": "para_28"
      },
      {
        "text": "Judgment Act (“the UDJA”) that a terminated pregnancy report (“TPR”),",
        "paragraph_id": "para_29"
      },
      {
        "text": "which a health care provider is statutorily required to submit to the Indiana",
        "paragraph_id": "para_30"
      },
      {
        "text": "Department of Health (“the Department”) for each abortion that the provider",
        "paragraph_id": "para_31"
      },
      {
        "text": "performs, is exempt from disclosure under the Access to Public Records Act",
        "paragraph_id": "para_32"
      },
      {
        "text": "(“the APRA”) as a patient medical record. Doctors also sought a preliminary",
        "paragraph_id": "para_33"
      },
      {
        "text": "injunction prohibiting the Commissioner from disclosing TPRs in response to",
        "paragraph_id": "para_34"
      },
      {
        "text": "any request made under the APRA, including those that had previously been",
        "paragraph_id": "para_35"
      },
      {
        "text": "made by VFL. After a hearing, the trial court issued an order in which it",
        "paragraph_id": "para_36"
      },
      {
        "text": "concluded that Doctors had standing to seek a declaratory judgment and were",
        "paragraph_id": "para_37"
      },
      {
        "text": "entitled to a preliminary injunction prohibiting the Commissioner from",
        "paragraph_id": "para_38"
      },
      {
        "text": "disclosing TPRs in response to any APRA request.",
        "paragraph_id": "para_39"
      },
      {
        "text": "[2] Defendants now appeal that order, arguing that the trial court erred in",
        "paragraph_id": "para_40"
      },
      {
        "text": "concluding that Doctors have standing to seek a declaratory judgment, that the",
        "paragraph_id": "para_41"
      },
      {
        "text": "Court of Appeals of Indiana | Opinion 25A-PL-782 | December 5, 2025 Page 3 of 35",

      },
      {
        "text": "trial court abused its discretion in granting Doctors a preliminary injunction,",
        "paragraph_id": "para_43"
      },
      {
        "text": "and that the injunction is overbroad because it also applies to APRA requests",
        "paragraph_id": "para_44"
      },
      {
        "text": "for TPRs not submitted by Doctors. We disagree and therefore affirm the trial",
        "paragraph_id": "para_45"
      },
      {
        "text": "court’s order in all respects.",
        "paragraph_id": "para_46"
      },
      {
        "text": "Facts and Procedural History",
        "paragraph_id": "para_47"
      },
      {
        "text": "[3] Because they play such a prominent role in the procedural history of this case,",
        "paragraph_id": "para_48"
      },
      {
        "text": "we set forth our legislature’s onerous requirements for the content and",
        "paragraph_id": "para_49"
      },
      {
        "text": "submission of the TPRs at the heart of this dispute. Indiana Code Section 16-",
        "paragraph_id": "para_50"
      },
      {
        "text": "34-2-5(a) states,",
        "paragraph_id": "para_51"
      },
      {
        "text": "Every health care provider who performs a surgical abortion or",
        "paragraph_id": "para_52"
      },
      {
        "text": "provides, prescribes, administers, or dispenses an abortion",
        "paragraph_id": "para_53"
      },
      {
        "text": "inducing drug for the purposes of inducing an abortion shall",
        "paragraph_id": "para_54"
      },
      {
        "text": "report the performance of the abortion or the provision,",
        "paragraph_id": "para_55"
      },
      {
        "text": "prescribing, administration, or dispensing of an abortion",
        "paragraph_id": "para_56"
      },
      {
        "text": "inducing drug on a form drafted by the [Department], the",
        "paragraph_id": "para_57"
      },
      {
        "text": "purpose and function of which shall be the improvement of",
        "paragraph_id": "para_58"
      },
      {
        "text": "maternal health and life through the compilation of relevant",
        "paragraph_id": "para_59"
      },
      {
        "text": "maternal life and health factors and data, and a further purpose",
        "paragraph_id": "para_60"
      },
      {
        "text": "and function shall be to monitor all abortions performed in",
        "paragraph_id": "para_61"
      },
      {
        "text": "Indiana to assure the abortions are done only under the",
        "paragraph_id": "para_62"
      },
      {
        "text": "authorized provisions of the law. For each abortion performed",
        "paragraph_id": "para_63"
      },
      {
        "text": "and abortion inducing drug provided, prescribed, administered,",
        "paragraph_id": "para_64"
      },
      {
        "text": "or dispensed, the report shall include, among other things, the",
        "paragraph_id": "para_65"
      },
      {
        "text": "following:",
        "paragraph_id": "para_66"
      },
      {
        "text": "(1) The age of the patient.",
        "paragraph_id": "para_67"
      },
      {
        "text": "(2) Whether a waiver of consent under section 4 of this chapter",
        "paragraph_id": "para_68"

        "text": "(B) coerced;",

        "text": "(D) trafficked.",

        "text": "(21) The following information concerning the abortion or the",

      {
        "text": "provision, prescribing, administration, or dispensing of the",

      },
      {
        "text": "abortion inducing drug:",

      },
      {
        "text": "(A) The postfertilization age of the fetus (in weeks).",
        "paragraph_id": "para_113"
      },
      {

        "paragraph_id": "para_117"
      },
      {
        "text": "(D) Whether the fetus has been diagnosed with or has a",
        "paragraph_id": "para_118"
      },
      {
        "text": "potential diagnosis of having Down syndrome or any",
        "paragraph_id": "para_119"
      },
      {
        "text": "other disability.",
        "paragraph_id": "para_120"
      },
      {
        "text": "(E) If after the earlier of the time the fetus obtains viability",
        "paragraph_id": "para_121"
      },
      {
        "text": "or the time the postfertilization age of the fetus is at least",
        "paragraph_id": "para_122"
      },
      {
        "text": "twenty (20) weeks, the medical reason for the performance",
        "paragraph_id": "para_123"
      },
      {
        "text": "of the abortion.",
        "paragraph_id": "para_124"
      },
      {
        "text": "(22) For a surgical abortion, the medical procedure used for the",
        "paragraph_id": "para_125"
      },
      {
        "text": "abortion and, if the fetus had a postfertilization age of at least",
        "paragraph_id": "para_126"
      },
      {
        "text": "twenty (20) weeks:",
        "paragraph_id": "para_127"
      },
      {
        "text": "(A) whether the procedure, in the reasonable judgment of",
        "paragraph_id": "para_128"
      },
      {
        "text": "the health care provider, gave the fetus the best",
        "paragraph_id": "para_129"
      },
      {
        "text": "opportunity to survive;",
        "paragraph_id": "para_130"
      },
      {
        "text": "(B) the basis for the determination that the pregnant",
        "paragraph_id": "para_131"
      },
      {
        "text": "woman had a condition described in this chapter that",
        "paragraph_id": "para_132"
      },
      {
        "text": "required the abortion to avert the death of or serious",
        "paragraph_id": "para_133"
      },
      {
        "text": "impairment to the pregnant woman; and",
        "paragraph_id": "para_134"
      },
      {
        "text": "(C) the name of the second doctor present, as required",
        "paragraph_id": "para_135"
      },
      {
        "text": "under IC 16-34-2-3(a)(3).",
        "paragraph_id": "para_136"
      },
      {
        "text": "(23) For a nonsurgical abortion, the precise drugs provided,",
        "paragraph_id": "para_137"
      },
      {
        "text": "prescribed, administered, or dispensed, and the means of delivery",
        "paragraph_id": "para_138"
      },
      {
        "text": "of the drugs to the patient.",
        "paragraph_id": "para_139"
      },
      {
        "text": "(24) For a nonsurgical abortion, that the manufacturer’s",
        "paragraph_id": "para_140"
      },
      {
        "text": "instructions were provided to the patient and that the patient",
        "paragraph_id": "para_141"
      },
      {

      {
        "text": "signed the patient agreement.",
        "paragraph_id": "para_143"
      },
      {
        "text": "(25) For an abortion performed before twenty (20) weeks of",
        "paragraph_id": "para_144"
      },
      {
        "text": "postfertilization age of the fetus, the medical indication by",
        "paragraph_id": "para_145"
      },
      {
        "text": "diagnosis code for the fetus and the mother.",
        "paragraph_id": "para_146"
      },
      {
        "text": "(26) The mother’s obstetrical history, including dates of other",
        "paragraph_id": "para_147"
      },
      {
        "text": "abortions, if any.",
        "paragraph_id": "para_148"
      },
      {
        "text": "(27) Any preexisting medical conditions of the patient that may",
        "paragraph_id": "para_149"
      },
      {
        "text": "complicate the abortion.",
        "paragraph_id": "para_150"
      },
      {
        "text": "(28) The results of pathological examinations if performed.",
        "paragraph_id": "para_151"
      },
      {
        "text": "(29) For a surgical abortion, whether the fetus was delivered",
        "paragraph_id": "para_152"
      },
      {
        "text": "alive, and if so, how long the fetus lived.",
        "paragraph_id": "para_153"
      },
      {
        "text": "(30) Records of all maternal deaths occurring at the location",
        "paragraph_id": "para_154"
      },
      {
        "text": "where the abortion was performed or the abortion inducing drug",
        "paragraph_id": "para_155"
      },
      {
        "text": "was provided, prescribed, administered, or dispensed.",
        "paragraph_id": "para_156"
      },
      {
        "text": "(31) The date the form was transmitted to the [Department] and,",
        "paragraph_id": "para_157"
      },
      {
        "text": "if applicable, separately to the [Department of Child Services].",
        "paragraph_id": "para_158"
      },
      {
        "text": "[4] A provider is required to transmit a completed form to the Department within",
        "paragraph_id": "para_159"
      },
      {
        "text": "thirty days after the date of an abortion. Ind. Code § 16-34-2-5(b). If an abortion",
        "paragraph_id": "para_160"
      },
      {
        "text": "is for a female under sixteen years of age, the provider is required to transmit",
        "paragraph_id": "para_161"
      },
      {
        "text": "the form to the Department and separately to the Department of Child Services",
        "paragraph_id": "para_162"
      },
      {
        "text": "within three days after the abortion is performed. Id. Subsection (d) of the",
        "paragraph_id": "para_163"
      },
      {
        "text": "statute provides that “[e]ach failure to complete or timely transmit a form … for",
        "paragraph_id": "para_164"
      },
      {
        "text": "each abortion performed or abortion inducing drug that was provided,",
        "paragraph_id": "para_165"
      },
      {
        "text": "prescribed, administered, or dispensed, is a Class B misdemeanor.” I.C. § 16-34-",
        "paragraph_id": "para_166"
      },
      {

      },
      {
        "text": "2-5(d).1 And subsection (e) of the statute requires the Department, “[o]n a",
        "paragraph_id": "para_168"
      },
      {
        "text": "quarterly basis,” to",
        "paragraph_id": "para_169"
      },
      {
        "text": "compile a public report providing the following:",
        "paragraph_id": "para_170"
      },
      {
        "text": "(1) Statistics for the previous calendar quarter from the",
        "paragraph_id": "para_171"
      },
      {
        "text": "information submitted under this section.",
        "paragraph_id": "para_172"
      },
      {
        "text": "(2) Statistics for previous calendar years compiled by the",
        "paragraph_id": "para_173"
      },
      {
        "text": "[Department] under this subsection, with updated information",
        "paragraph_id": "para_174"
      },
      {
        "text": "for the calendar quarter that was submitted to the [Department]",
        "paragraph_id": "para_175"
      },
      {
        "text": "after the compilation of the statistics.",
        "paragraph_id": "para_176"
      },
      {
        "text": "I.C. § 16-34-2-5(e). The Department “shall ensure that no identifying",
        "paragraph_id": "para_177"
      },
      {
        "text": "information of a pregnant woman is contained in the [public] report.” Id.",
        "paragraph_id": "para_178"
      },
      {
        "text": "[5] Indiana physicians operate under two complementary legal obligations",
        "paragraph_id": "para_179"
      },
      {
        "text": "regarding patient information: (1) they must maintain patient confidentiality;",
        "paragraph_id": "para_180"
      },
      {
        "text": "and (2) they must report certain information to state regulators, including the",
        "paragraph_id": "para_181"
      },
      {
        "text": "Department. See, e.g., I.C. § 16-39-5-3(c)-(d) (imposing duties on medical",
        "paragraph_id": "para_182"
      },
      {
        "text": "providers to keep patients’ identities confidential when releasing patients’ health",
        "paragraph_id": "para_183"
      },
      {
        "text": "records to third parties); Henry v. Cmty. Healthcare Sys. Cmty. Hosp., 134 N.E.3d",
        "paragraph_id": "para_184"
      },
      {
        "text": "435, 437-38 (Ind. Ct. App. 2019) (acknowledging a historic common law duty",
        "paragraph_id": "para_185"
      },
      {
        "text": "of confidentiality owed by the physician to the patient); I.C. § 16-34-2-5(a).",
        "paragraph_id": "para_186"
      },
      {
        "text": "1 A physician’s failure to transmit a TPR to the Department may also result in the revocation of the",
        "paragraph_id": "para_187"
      },
      {
        "text": "physician’s license. Ind. Code § 25-22.5-8-6(b)(1).",
        "paragraph_id": "para_188"
      },
      {

      {
        "text": "[6] Another statute creates tension in this dynamic. The APRA presumes that",
        "paragraph_id": "para_190"
      },
      {
        "text": "government agency records are publicly accessible unless the agency proves that",
        "paragraph_id": "para_191"
      },
      {
        "text": "they fall within a statutory exception. I.C. §§ 5-14-3-1, -9(f)-(g). One such",
        "paragraph_id": "para_192"
      },
      {
        "text": "exception shields “[p]atient medical records … created by a provider” from",
        "paragraph_id": "para_193"
      },
      {
        "text": "disclosure without the patient’s consent. I.C. § 5-14-3-4(a)(9). The dispute in",
        "paragraph_id": "para_194"
      },
      {
        "text": "this case centers on whether TPRs qualify as patient medical records, such that",
        "paragraph_id": "para_195"
      },
      {
        "text": "they are exempt from disclosure under the APRA through Section 5-14-3-",
        "paragraph_id": "para_196"
      },
      {
        "text": "4(a)(9).",
        "paragraph_id": "para_197"
      },
      {
        "text": "[7] The State’s position on patient confidentiality has changed dramatically over",
        "paragraph_id": "para_198"
      },
      {
        "text": "the last two years, resulting in the legal uncertainty that fueled the underlying",
        "paragraph_id": "para_199"
      },
      {
        "text": "action and this appeal. Initially, the State viewed certain patient details as",
        "paragraph_id": "para_200"
      },
      {
        "text": "confidential patient information.",
        "paragraph_id": "para_201"
      },
      {
        "text": "[8] July 2023: At the Attorney General’s urging, the Indiana Medical Licensing",
        "paragraph_id": "para_202"
      },
      {
        "text": "Board (“the Board”) disciplined Dr. Bernard for publicly disclosing a patient’s",
        "paragraph_id": "para_203"
      },
      {
        "text": "age (ten years old), state of residence (Ohio), referral date (approximately June",
        "paragraph_id": "para_204"
      },
      {
        "text": "27, 2022), and gestational age (six weeks, three days).2 The Board found that",
        "paragraph_id": "para_205"
      },
      {
        "text": "this information was confidential because it either identified the patient or could",
        "paragraph_id": "para_206"
      },
      {
        "text": "reasonably be used to identify her. Appellants’ App. Vol. 2 at 143-44 (citing I.C.",
        "paragraph_id": "para_207"
      },
      {
        "text": "§ 25-1-9-4(a)(3) and 45 C.F.R. §§ 164.502(a), 164.514).",
        "paragraph_id": "para_208"
      },
      {
        "text": "2 Pursuant to Indiana Code Section 25-1-7-2, the Office of the Attorney General “may receive, investigate,",
        "paragraph_id": "para_209"
      },
      {
        "text": "and prosecute complaints concerning regulated occupations.”",
        "paragraph_id": "para_210"
      },
      {

      {
        "text": "[9] October 2023: Under the APRA, VFL requested from the Department all TPRs",
        "paragraph_id": "para_212"
      },
      {
        "text": "filed in August 2023. The Indiana Public Access Counselor (“the PAC”), who",
        "paragraph_id": "para_213"
      },
      {
        "text": "interprets public access laws, issued an informal opinion to the Department’s",
        "paragraph_id": "para_214"
      },
      {
        "text": "chief legal counsel that TPRs are medical records exempt from APRA",
        "paragraph_id": "para_215"
      },
      {
        "text": "disclosure. Citing the patient medical records exception in the APRA, the PAC",
        "paragraph_id": "para_216"
      },
      {
        "text": "reasoned that “the entirety of the [TPR] form is a medical record” and that",
        "paragraph_id": "para_217"
      },
      {
        "text": "public release of the TPRs, even if partly redacted, would “defeat the statutory",
        "paragraph_id": "para_218"
      },
      {
        "text": "purpose” of protecting patient medical records from disclosure. Id. at 83; see",
        "paragraph_id": "para_219"
      },
      {
        "text": "I.C. § 5-14-3-4(a)(9). The PAC also noted that the TPR statute requires only",
        "paragraph_id": "para_220"
      },
      {
        "text": "aggregate “public” statistics, which suggests that individual forms are non-",
        "paragraph_id": "para_221"
      },
      {
        "text": "public. Appellants’ App. Vol. 2 at 83 (referring to I.C. § 16-34-2-5(e)).",
        "paragraph_id": "para_222"
      },
      {
        "text": "Ultimately, the PAC concluded that TPRs “should be withheld from disclosure",
        "paragraph_id": "para_223"
      },
      {
        "text": "in their entirety.” Id. at 84. The Department therefore refused VFL’s request for",
        "paragraph_id": "para_224"
      },
      {
        "text": "the TPRs.",
        "paragraph_id": "para_225"
      },
      {
        "text": "[10] The State, however, soon shifted its position on whether such information",
        "paragraph_id": "para_226"
      },
      {
        "text": "could be publicly disclosed.",
        "paragraph_id": "para_227"
      },
      {
        "text": "[11] April 2024: The Attorney General issued an advisory opinion concluding that",
        "paragraph_id": "para_228"
      },
      {
        "text": "the APRA’s “exception for ‘medical record[s]’” does not encompass TPRs.",
        "paragraph_id": "para_229"
      },
      {
        "text": "Attorney General, Opinion Letter 2024-2 on Non-Disclosure of Terminated",
        "paragraph_id": "para_230"
      },
      {
        "text": "Pregnancy Reports, 1 (April 11, 2024),",
        "paragraph_id": "para_231"
      },
      {
        "text": "https://www.in.gov/attorneygeneral/about-the-office/advisory/opinions",
        "paragraph_id": "para_232"
      },
      {
        "text": "[https://perma.cc/2SGX-8468]. The advisory opinion stated that TPRs may be",
        "paragraph_id": "para_233"
      },
      {
        "text": "disclosed with redactions, arguing that complete confidentiality would frustrate",
        "paragraph_id": "para_234"
      },
      {

      {
        "text": "the TPR statute’s purpose. Id. (referring to I.C. § 16-34-2-5). The Attorney",
        "paragraph_id": "para_236"
      },
      {
        "text": "General promoted this view at a news conference and “wrote letters to the",
        "paragraph_id": "para_237"
      },
      {
        "text": "Governor and key members of the Indiana legislature urging them to take",
        "paragraph_id": "para_238"
      },
      {
        "text": "retaliatory action against [the Department] and the [PAC].” Appellants’ App.",
        "paragraph_id": "para_239"
      },
      {
        "text": "Vol. 2 at 39.3",
        "paragraph_id": "para_240"
      },
      {
        "text": "[12] May 2024-September 2024: Within weeks of the Attorney General’s advisory",
        "paragraph_id": "para_241"
      },
      {
        "text": "opinion, VFL sued the Department to compel disclosure of TPRs, arguing that",
        "paragraph_id": "para_242"
      },
      {
        "text": "they were not exempt as patient medical records under the APRA. Doctors",
        "paragraph_id": "para_243"
      },
      {
        "text": "intervened in the lawsuit, as they were entitled to do under Indiana Code",
        "paragraph_id": "para_244"
      },
      {
        "text": "Section 5-14-3-9(e) based on the Department’s denial of VFL’s request for the",
        "paragraph_id": "para_245"
      },
      {
        "text": "TPRs.4 Represented by private counsel, the Department moved to dismiss,",
        "paragraph_id": "para_246"
      },
      {
        "text": "arguing that TPRs were exempt patient medical records. The trial court granted",
        "paragraph_id": "para_247"
      },
      {
        "text": "3 This language appears in the trial court’s findings in this appeal. The parties do not challenge that finding as",
        "paragraph_id": "para_248"
      },
      {
        "text": "inaccurate.",
        "paragraph_id": "para_249"
      },
      {
        "text": "4 Indiana Code Section 5-14-3-9(e) states,",
        "paragraph_id": "para_250"
      },
      {
        "text": "A person who has been denied the right to inspect or copy a public record by a public agency",
        "paragraph_id": "para_251"
      },
      {
        "text": "may file an action in the circuit or superior court of the county in which the denial occurred to",
        "paragraph_id": "para_252"
      },
      {
        "text": "compel the public agency to permit the person to inspect and copy the public record. Whenever",
        "paragraph_id": "para_253"
      },
      {
        "text": "an action is filed under this subsection, the public agency must notify each person who supplied",
        "paragraph_id": "para_254"
      },
      {
        "text": "any part of the public record at issue:",
        "paragraph_id": "para_255"
      },
      {
        "text": "(1) that a request for release of the public record has been denied; and",
        "paragraph_id": "para_256"
      },
      {
        "text": "(2) whether the denial was in compliance with an informal inquiry response or advisory",
        "paragraph_id": "para_257"
      },
      {
        "text": "opinion of the public access counselor.",
        "paragraph_id": "para_258"
      },
      {
        "text": "Such persons are entitled to intervene in any litigation that results from the denial. The person",
        "paragraph_id": "para_259"
      },
      {
        "text": "who has been denied the right to inspect or copy need not allege or prove any special damage",
        "paragraph_id": "para_260"
      },
      {
        "text": "different from that suffered by the public at large.",
        "paragraph_id": "para_261"
      },
      {

      {
        "text": "dismissal in September 2024, finding unpersuasive VFL’s claim “that the law,",
        "paragraph_id": "para_263"
      },
      {
        "text": "as written, makes the [TPRs] public records.” Id. at 89.",
        "paragraph_id": "para_264"
      },
      {
        "text": "[13] October 2024-February 2025: VFL appealed, and the Attorney General—who",
        "paragraph_id": "para_265"
      },
      {
        "text": "had previously urged “retaliatory action” against the Department—entered an",
        "paragraph_id": "para_266"
      },
      {
        "text": "appearance on the Department’s behalf. Id. at 39. VFL and the Attorney",
        "paragraph_id": "para_267"
      },
      {
        "text": "General then settled, with the Department agreeing to release TPRs as public",
        "paragraph_id": "para_268"
      },
      {
        "text": "records while not redacting many data points, including patient age, state of",
        "paragraph_id": "para_269"
      },
      {
        "text": "residence, gestational age, and abortion date. Id. at 94-96. This contradicted the",
        "paragraph_id": "para_270"
      },
      {
        "text": "Attorney General’s earlier position that this same information could identify",
        "paragraph_id": "para_271"
      },
      {
        "text": "patients—the basis for Dr. Bernard’s public reprimand nineteen months earlier.",
        "paragraph_id": "para_272"
      },
      {
        "text": "VFL moved to dismiss the appeal based on the settlement. Two days later, our",
        "paragraph_id": "para_273"
      },
      {
        "text": "Chief Judge granted VFL’s motion and dismissed the appeal with prejudice.",
        "paragraph_id": "para_274"
      },
      {
        "text": "[14] That same day, Doctors filed the instant complaint against Defendants under",
        "paragraph_id": "para_275"
      },
      {
        "text": "the UDJA, seeking a declaratory judgment that TPRs are patient medical",

        "text": "records and thus are exempt from disclosure under the APRA. Doctors also",
        "paragraph_id": "para_277"
      },
      {
        "text": "filed a motion for a temporary restraining order and a preliminary injunction to",
        "paragraph_id": "para_278"
      },
      {
        "text": "prohibit the Commissioner from “disclosing or otherwise providing access to",
        "paragraph_id": "para_279"
      },
      {
        "text": "[TPRs] in response to any request made under” the APRA. Id. at 43.",
        "paragraph_id": "para_280"
      },
      {
        "text": "[15] In February, the trial court held a hearing on and granted Doctors’ motion for a",
        "paragraph_id": "para_281"
      },
      {
        "text": "temporary restraining order. In March, the court held a hearing on Doctors’",
        "paragraph_id": "para_282"
      },
      {
        "text": "motion for a preliminary injunction. Later that month, the trial court issued an",
        "paragraph_id": "para_283"
      },
      {
        "text": "order in which it found that Doctors had standing to seek a declaratory",
        "paragraph_id": "para_284"
      },
      {

        "text": "judgment. The court further found that Doctors had satisfied the prerequisites",
        "paragraph_id": "para_286"
      },
      {
        "text": "for obtaining a preliminary injunction, including “establish[ing] probable",
        "paragraph_id": "para_287"
      },
      {
        "text": "success on their claim that a TPR is subject to exemption from disclosure as a",
        "paragraph_id": "para_288"
      },
      {
        "text": "[patient] medical record.” Appealed Order at 11. Consequently, the court",
        "paragraph_id": "para_289"
      },
      {
        "text": "prohibited the Commissioner “from disclosing or otherwise providing access to",
        "paragraph_id": "para_290"
      },
      {
        "text": "[TPRs] created in accordance with Indiana Code section 16-34-2-5, and in",
        "paragraph_id": "para_291"
      },
      {
        "text": "response to any request made under” the APRA. Id. at 20.",
        "paragraph_id": "para_292"
      },
      {
        "text": "[16] Defendants each filed a notice of appeal of the trial court’s order and a motion",
        "paragraph_id": "para_293"
      },
      {
        "text": "to stay the injunction pending appeal. On May 30, this Court denied",
        "paragraph_id": "para_294"
      },
      {
        "text": "Defendants’ motions to stay. This interlocutory appeal ensued.",
        "paragraph_id": "para_295"
      },
      {
        "text": "Discussion and Decision",
        "paragraph_id": "para_296"
      },
      {
        "text": "Issue One: Doctors’ standing to seek a declaratory judgment",
        "paragraph_id": "para_297"
      },
      {
        "text": "[17] Defendants argue that the trial court erred in determining that Doctors have",
        "paragraph_id": "para_298"
      },
      {
        "text": "standing to seek a declaratory judgment. “The threshold issue of standing",
        "paragraph_id": "para_299"
      },
      {
        "text": "determines whether a litigant is entitled to have a court decide the substantive",
        "paragraph_id": "para_300"
      },
      {
        "text": "issues of a dispute.” Solarize, Ind., Inc. v. S. Ind. Gas & Elec. Co., 182 N.E.3d 212,",
        "paragraph_id": "para_301"
      },
      {
        "text": "216 (Ind. 2022). “To be entitled to such a decision, a plaintiff must be a ‘proper",
        "paragraph_id": "para_302"
      },
      {
        "text": "person’ to invoke the court’s authority.” Id. (quoting Horner v. Curry, 125",
        "paragraph_id": "para_303"
      },
      {
        "text": "N.E.3d 584, 589 (Ind. 2019)). “A party’s standing to invoke this authority can",
        "paragraph_id": "para_304"
      },
      {
        "text": "be conferred either through common law or by statute.” Id. Here, Doctors",
        "paragraph_id": "para_305"
      },
      {
        "text": "assert standing based on the UDJA.",
        "paragraph_id": "para_306"
      },
      {

      {
        "text": "[18] “Regardless of the alleged basis for standing, if ‘plaintiffs allege no injury, there",
        "paragraph_id": "para_308"
      },
      {
        "text": "is no justiciable dispute.’” Ehrlich v. Moss Creek Solar, LLC, 219 N.E.3d 760, 763",
        "paragraph_id": "para_309"
      },
      {
        "text": "(Ind. Ct. App. 2023) (quoting City of Gary v. Nicholson, 190 N.E.3d 349, 351",
        "paragraph_id": "para_310"
      },
      {
        "text": "(Ind. 2022)), trans. denied. “An injury must be personal, direct, and one the",
        "paragraph_id": "para_311"
      },
      {
        "text": "plaintiff has suffered or is in imminent danger of suffering.” Holcomb v. Bray,",
        "paragraph_id": "para_312"
      },
      {
        "text": "187 N.E.3d 1268, 1286 (Ind. 2022). Our Supreme Court has stated, “Under the",
        "paragraph_id": "para_313"
      },
      {
        "text": "[UDJA], which is designed to allow parties to resolve conflicts while there is",
        "paragraph_id": "para_314"
      },
      {
        "text": "still time for ‘peaceable judicial settlement,’ plaintiffs can satisfy the injury",
        "paragraph_id": "para_315"
      },
      {
        "text": "requirement by showing their rights are implicated in such a way that they",
        "paragraph_id": "para_316"
      },
      {
        "text": "could suffer an injury.” Id. at 1287 (emphasis added) (quoting Volkswagenwerk,",
        "paragraph_id": "para_317"
      },
      {
        "text": "A.G. v. Watson, 390 N.E.2d 1082, 1084-85 (Ind. Ct. App. 1979), trans. denied).",
        "paragraph_id": "para_318"
      },
      {
        "text": "Whether a party has standing is a legal question that we review de novo.",
        "paragraph_id": "para_319"
      },
      {
        "text": "Hensley v. Lewis Bros. Bakeries, Inc., 263 N.E.3d 199, 201 (Ind. Ct. App. 2025).",
        "paragraph_id": "para_320"
      },
      {
        "text": "[19] The UDJA “confers on the judiciary ‘the power to declare rights, status, and",
        "paragraph_id": "para_321"
      },
      {
        "text": "other legal relations whether or not further relief is or could be claimed.’”",
        "paragraph_id": "para_322"
      },
      {
        "text": "Adams v. Hamilton Cnty., 255 N.E.3d 498, 503-04 (Ind. Ct. App. 2025) (quoting",
        "paragraph_id": "para_323"
      },
      {
        "text": "I.C. § 34-14-1-1). The UDJA “is ‘remedial’ with a stated purpose ‘to settle and",
        "paragraph_id": "para_324"
      },
      {
        "text": "to afford relief from uncertainty and insecurity with respect to rights, status[,]",
        "paragraph_id": "para_325"
      },
      {
        "text": "and other legal relations,’ and it ‘is to be liberally construed and administered.’”",
        "paragraph_id": "para_326"
      },
      {
        "text": "Id. at 504 (alteration in Adams) (quoting I.C. § 34-14-1-12). The UDJA further",
        "paragraph_id": "para_327"
      },
      {
        "text": "provides,",
        "paragraph_id": "para_328"
      },
      {
        "text": "Any person interested under a deed, will, written contract, or",
        "paragraph_id": "para_329"
      },
      {
        "text": "other writings constituting a contract, or whose rights, status, or",
        "paragraph_id": "para_330"
      },
      {

      {
        "text": "other legal relations are affected by a statute, municipal",
        "paragraph_id": "para_332"
      },
      {
        "text": "ordinance, contract, or franchise, may have determined any",
        "paragraph_id": "para_333"
      },
      {
        "text": "question of construction or validity arising under the",
        "paragraph_id": "para_334"
      },
      {
        "text": "instrument, statute, ordinance, contract, or franchise and obtain",
        "paragraph_id": "para_335"
      },
      {
        "text": "a declaration of rights, status, or other legal relations",
        "paragraph_id": "para_336"
      },
      {
        "text": "thereunder.",
        "paragraph_id": "para_337"
      },
      {
        "text": "I.C. § 34-14-1-2 (emphases added).",
        "paragraph_id": "para_338"
      },
      {
        "text": "[20] In its order, the trial court noted that Doctors “seek a declaration of the",
        "paragraph_id": "para_339"
      },
      {
        "text": "construction of APRA” “to determine whether TPRs fall within the exemption",
        "paragraph_id": "para_340"
      },
      {
        "text": "from APRA disclosure for ‘patient medical records.’” Appealed Order at 3, 7.",
        "paragraph_id": "para_341"
      },
      {
        "text": "The court also made the following relevant findings:",
        "paragraph_id": "para_342"
      },
      {
        "text": "[Doctors] have demonstrated sufficient injury to meet the",
        "paragraph_id": "para_343"
      },
      {
        "text": "requirements of standing. At least one of Dr. Bernard’s patients",
        "paragraph_id": "para_344"
      },
      {
        "text": "left Dr. Bernard’s care for an out-of-state abortion provider to",
        "paragraph_id": "para_345"
      },
      {
        "text": "avoid the public release of the patient’s information via a TPR",
        "paragraph_id": "para_346"
      },
      {
        "text": "APRA request. Dr. Bernard has set forth an actual injury she",
        "paragraph_id": "para_347"
      },
      {
        "text": "suffered – the loss of a patient. Dr. Bernard’s showing is also",
        "paragraph_id": "para_348"
      },
      {
        "text": "sufficient to demonstrate Dr. Rouse’s standing to bring this",
        "paragraph_id": "para_349"
      },
      {
        "text": "declaratory judgment action as it follows that Dr. Rouse could",
        "paragraph_id": "para_350"
      },
      {
        "text": "suffer such an injury. Moreover, disclosure of a TPR, if it",
        "paragraph_id": "para_351"
      },
      {
        "text": "included any patient health information, could have a chilling",
        "paragraph_id": "para_352"
      },
      {
        "text": "effect on the patient/physician relationship. A patient could be",
        "paragraph_id": "para_353"
      },
      {
        "text": "less likely to disclose certain medical information to the",
        "paragraph_id": "para_354"
      },
      {
        "text": "physician knowing that the physician must report such",
        "paragraph_id": "para_355"
      },
      {
        "text": "information and that the Department may publicly release that",
        "paragraph_id": "para_356"
      },
      {
        "text": "information.",
        "paragraph_id": "para_357"
      },
      {
        "text": "Id. at 4.",

      },
      {

        "text": "[21] We agree with the trial court’s assessment.5 We further observe that Dr.",
        "paragraph_id": "para_360"
      },
      {
        "text": "Bernard has already suffered an additional concrete injury: she was publicly",
        "paragraph_id": "para_361"
      },
      {
        "text": "reprimanded by the Board for disclosing patient information—age, state of",
        "paragraph_id": "para_362"
      },
      {
        "text": "residence, gestational age, and approximate date of treatment. Although Dr.",
        "paragraph_id": "para_363"
      },
      {
        "text": "Bernard was not disciplined for submitting a TPR containing this information",
        "paragraph_id": "para_364"
      },
      {
        "text": "to the Department—that disclosure was mandatory under Indiana Code",
        "paragraph_id": "para_365"
      },
      {
        "text": "Sections 16-34-2-5 and 25-1-9-4(a)(3)—she was disciplined for making the",
        "paragraph_id": "para_366"
      },
      {
        "text": "information publicly available.",
        "paragraph_id": "para_367"
      },
      {
        "text": "[22] Yet this is precisely the information that TPRs must contain and which the",
        "paragraph_id": "para_368"
      },
      {
        "text": "settlement now requires the Department to make publicly available upon",
        "paragraph_id": "para_369"
      },
      {
        "text": "request. If TPRs are publicly disclosable, then every physician who submits a",
        "paragraph_id": "para_370"
      },
      {
        "text": "mandatory TPR becomes the source of information that may publicly identify",
        "paragraph_id": "para_371"
      },
      {
        "text": "their patient—the same conduct for which Dr. Bernard was sanctioned.",
        "paragraph_id": "para_372"
      },
      {
        "text": "[23] This creates a conundrum faced by both Doctors. Physicians cannot determine",
        "paragraph_id": "para_373"
      },
      {
        "text": "the legal boundaries of patient confidentiality when the State treats identical",
        "paragraph_id": "para_374"
      },
      {
        "text": "information as both confidential and non-confidential. Dr. Bernard was",
        "paragraph_id": "para_375"
      },
      {
        "text": "sanctioned for publicly disclosing patient information—age, state of residence,",
        "paragraph_id": "para_376"
      },
      {
        "text": "gestational age, and treatment date—because it identified her patient. The State",
        "paragraph_id": "para_377"
      },
      {
        "text": "5 We also agree with the trial court’s finding that Doctors did not attempt to assert their “patients’ interests in",
        "paragraph_id": "para_378"
      },
      {
        "text": "maintaining the privacy of their medical records as a means for [Doctors] to bootstrap their standing.”",
        "paragraph_id": "para_379"
      },
      {
        "text": "Appealed Order at 5. Accordingly, we reject Defendants’ arguments to the contrary.",
        "paragraph_id": "para_380"
      },
      {

      {
        "text": "now deems this same information non-identifying when contained in TPRs and",
        "paragraph_id": "para_382"
      },
      {
        "text": "plans to publicly release it.",
        "paragraph_id": "para_383"
      },
      {
        "text": "[24] Doctors also face imminent injury. The Department itself previously expressed",
        "paragraph_id": "para_384"
      },
      {
        "text": "concerns that TPRs contain “information that could be reverse engineered to",
        "paragraph_id": "para_385"
      },
      {
        "text": "identify patients—especially in smaller communities[.]” Appellants’ App. Vol. 2",
        "paragraph_id": "para_386"
      },
      {
        "text": "at 83. The Attorney General successfully argued in Dr. Bernard’s disciplinary",
        "paragraph_id": "para_387"
      },
      {
        "text": "proceeding that this type of information was sufficient to identify a patient. Yet",
        "paragraph_id": "para_388"
      },
      {
        "text": "the settlement between VFL and the Department requires the Department to",
        "paragraph_id": "para_389"
      },
      {
        "text": "“release [TPRs] as public records upon lawful request” without redacting the",
        "paragraph_id": "para_390"
      },
      {
        "text": "very information that Dr. Bernard was disciplined for disclosing. Id. at 94.6",
        "paragraph_id": "para_391"
      },
      {
        "text": "Absent a judicial determination that such information is nondisclosable,",
        "paragraph_id": "para_392"
      },
      {
        "text": "disclosure will occur. When it does, Doctors may suffer concrete injuries,",
        "paragraph_id": "para_393"
      },
      {
        "text": "including reputational harm, increased harassment, and erosion of public trust.7",
        "paragraph_id": "para_394"
      },
      {
        "text": "Moreover, the State’s contradictory positions create legal uncertainty that itself",
        "paragraph_id": "para_395"
      },
      {
        "text": "6 We are unaware of any authority for the proposition that parties to a settlement agreement may",
        "paragraph_id": "para_396"
      },
      {
        "text": "independently rewrite a statute and, without legislative clarification, give it a meaning that a court has",
        "paragraph_id": "para_397"
      },
      {
        "text": "previously rejected.",
        "paragraph_id": "para_398"
      },
      {
        "text": "7 Doctors allege that VFL has used TPR data as the foundation for allegedly false claims on VFL’s website",
        "paragraph_id": "para_399"
      },
      {
        "text": "regarding abortion providers, including Dr. Bernard. VFL’s website identified Dr. Bernard, displayed her",
        "paragraph_id": "para_400"
      },
      {
        "text": "photo, and accused her of committing four “violations” of Indiana law. Tr. Vol. 2 at 78-86; Appellees’ App.",
        "paragraph_id": "para_401"
      },
      {
        "text": "Vol. 2 at 8-9. Dr. Bernard testified that she has not been prosecuted or sanctioned in connection with that",
        "paragraph_id": "para_402"
      },
      {
        "text": "conduct. She also described some of VFL’s allegations as reflecting a fundamental misunderstanding of",
        "paragraph_id": "para_403"
      },
      {
        "text": "abortion requirements in Indiana. Tr. Vol. 2 at 81-87.",
        "paragraph_id": "para_404"
      },
      {
        "text": "Dr. Bernard also testified that she is “harmed by the fact that they’re making false claims against me that",
        "paragraph_id": "para_405"
      },
      {
        "text": "cause irreparable damage to my reputation as a physician” and “by the fact that these are inflammatory, there",
        "paragraph_id": "para_406"
      },
      {
        "text": "is real concern that publicly disseminated information like this on a website could be used to target and harm",
        "paragraph_id": "para_407"
      },
      {
        "text": "myself and my family.” Id. at 91. She reported being contacted by the FBI several years ago about “a threat",
        "paragraph_id": "para_408"
      },
      {
        "text": "that somebody was going to kidnap my daughter to prevent me from providing abortion[s].” Id. at 94-95.",
        "paragraph_id": "para_409"
      },
      {

      {
        "text": "constitutes injury. Doctors struggle to provide abortion care and to submit",
        "paragraph_id": "para_411"
      },
      {
        "text": "TPRs while uncertain of their intertwined obligations under the statutes that",
        "paragraph_id": "para_412"
      },
      {
        "text": "govern their professional conduct.8",
        "paragraph_id": "para_413"
      },
      {
        "text": "[25] Based on the foregoing, we hold that the trial court did not err in concluding",
        "paragraph_id": "para_414"
      },
      {
        "text": "that Doctors have standing to seek a declaratory judgment.",
        "paragraph_id": "para_415"
      },
      {
        "text": "Issue Two: Preliminary injunction",
        "paragraph_id": "para_416"
      },
      {
        "text": "[26] Defendants also argue that the trial court erred in granting Doctors a",
        "paragraph_id": "para_417"
      },
      {
        "text": "preliminary injunction. “Appellate review of a preliminary injunction is ‘limited",
        "paragraph_id": "para_418"
      },
      {
        "text": "and deferential.’” In re Paternity of H.F.D.S., 247 N.E.3d 834, 837 (Ind. Ct. App.",
        "paragraph_id": "para_419"
      },
      {
        "text": "2024) (quoting State v. Econ. Freedom Fund, 959 N.E.2d 794, 801 (Ind. 2011)),",
        "paragraph_id": "para_420"
      },
      {
        "text": "trans. denied. We review a trial court’s grant of a preliminary injunction for an",
        "paragraph_id": "para_421"
      },
      {
        "text": "abuse of discretion, which occurs if its decision was against the logic and effect",
        "paragraph_id": "para_422"
      },
      {
        "text": "of the facts and circumstances before it or if it misinterpreted the law. Willow",
        "paragraph_id": "para_423"
      },
      {
        "text": "Haven on 106th St., LLC v. Nagireddy, 252 N.E.3d 418, 422 (Ind. 2025). “We",
        "paragraph_id": "para_424"
      },
      {
        "text": "review the trial court’s factual findings for clear error and its legal conclusions",
        "paragraph_id": "para_425"
      },
      {
        "text": "de novo.” Id. “We do not reweigh the evidence or assess witness credibility.”",
        "paragraph_id": "para_426"
      },
      {
        "text": "Great Lakes Anesthesia, P.C. v. O’Bryan, 99 N.E.3d 260, 268 (Ind. Ct. App. 2018).",
        "paragraph_id": "para_427"
      },
      {
        "text": "“Rather, we consider only the evidence favorable to the judgment and the",
        "paragraph_id": "para_428"
      },
      {
        "text": "8 VFL asserts that “[i]t is absurd to suppose that [Doctors] would be disciplined for performing a duty",
        "paragraph_id": "para_429"
      },
      {
        "text": "imposed by state law, and there is no question that the [Board] would be estopped from doing so.” VFL’s Br.",
        "paragraph_id": "para_430"
      },
      {
        "text": "at 13. In light of the State’s contradictory positions on the disclosability of TPRs and the legal uncertainty this",
        "paragraph_id": "para_431"
      },
      {
        "text": "creates, Doctors’ concerns about potential discipline for complying with mandatory reporting requirements",
        "paragraph_id": "para_432"
      },
      {
        "text": "are neither speculative nor unfounded.",
        "paragraph_id": "para_433"
      },
      {

      {
        "text": "reasonable inferences to be drawn therefrom.” Id. “We will reverse the trial",
        "paragraph_id": "para_435"
      },
      {
        "text": "court’s judgment only when it is clearly erroneous, that is, when our review of",
        "paragraph_id": "para_436"
      },
      {
        "text": "the record leaves us with a firm conviction that a mistake has been made.” Id.",
        "paragraph_id": "para_437"
      },
      {
        "text": "[27] “The purpose of a preliminary injunction is to preserve the status quo pending",
        "paragraph_id": "para_438"
      },
      {
        "text": "an adjudication of a case on the merits.” Holcomb v. T.L., 175 N.E.3d 1177,",
        "paragraph_id": "para_439"
      },
      {
        "text": "1180 (Ind. Ct. App. 2021).9 To obtain a preliminary injunction, the moving",
        "paragraph_id": "para_440"
      },
      {
        "text": "party must demonstrate the following by a preponderance of the evidence: (1)",
        "paragraph_id": "para_441"
      },
      {
        "text": "9 In a separate argument, the Commissioner asserts that Doctors are using an injunction to privately enforce",
        "paragraph_id": "para_442"
      },
      {
        "text": "the APRA, where no private right of action exists. On the contrary, Doctors are merely seeking a judicial",
        "paragraph_id": "para_443"
      },
      {
        "text": "interpretation of the APRA regarding the disclosability of TPRs and requesting injunctive relief to preserve",
        "paragraph_id": "para_444"
      },
      {
        "text": "the status quo (i.e., maintaining TPRs in the Department’s custody) pending an adjudication of that issue.",
        "paragraph_id": "para_445"
      },
      {
        "text": "After all, a judicial interpretation of Section 5-14-3-4(a)(9) is essential so that all parties can conform their",
        "paragraph_id": "para_446"
      },
      {
        "text": "conduct to that intended by the legislature. And it is the core constitutional function of the judiciary, not the",
        "paragraph_id": "para_447"
      },
      {
        "text": "Attorney General, “to say what the law is[.]” Ind. Off. of Util. Consumer Couns. v. Duke Energy Ind., LLC, 248",
        "paragraph_id": "para_448"
      },
      {
        "text": "N.E.3d 1205, 1211 (Ind. 2024) (relying on Ind. Const. art. 3, § 1 (dividing governmental powers into “three",
        "paragraph_id": "para_449"
      },
      {
        "text": "separate departments; the Legislative, the Executive including the Administrative, and the Judicial[,]” and",
        "paragraph_id": "para_450"
      },
      {
        "text": "stating that “no person, charged with official duties under one of these departments, shall exercise any of the",
        "paragraph_id": "para_451"
      },
      {
        "text": "functions of another,” except as “expressly provided” in the Constitution) and id. art. 7, § 1 (vesting judicial",
        "paragraph_id": "para_452"
      },
      {
        "text": "power “in one Supreme Court, one Court of Appeals, Circuit Courts, and such other courts as the General",
        "paragraph_id": "para_453"
      },
      {
        "text": "Assembly may establish”)). If the final result of the instant adjudication is in Doctors’ favor, local prosecutors",
        "paragraph_id": "para_454"
      },
      {
        "text": "will be responsible for enforcing TPR disclosure violations under the APRA. See I.C. §§ 5-14-3-10(a) (making",
        "paragraph_id": "para_455"
      },
      {
        "text": "it a Class A infraction for “a public official, or an employee or officer of a contractor or subcontractor of a",
        "paragraph_id": "para_456"
      },
      {
        "text": "public agency” to knowingly or intentionally disclose information classified as confidential by state statute),",
        "paragraph_id": "para_457"
      },
      {

      },
      {
        "text": "Pursuant to statute, the Attorney General may oversee but may not preclude such enforcement actions. See",
        "paragraph_id": "para_460"
      },
      {
        "text": "I.C. § 4-6-3-2(a) (“The attorney general shall have charge of and direct the prosecution of all civil actions that",
        "paragraph_id": "para_461"
      },
      {
        "text": "are brought in the name of the state of Indiana or any state agency.”), -(c) (“This section does not affect the",
        "paragraph_id": "para_462"
      },
      {
        "text": "authority of prosecuting attorneys to prosecute civil actions.”).",
        "paragraph_id": "para_463"
      },
      {
        "text": "In any event, we note that this Court has stated that “Indiana courts may … grant executory or coercive relief",
        "paragraph_id": "para_464"
      },
      {
        "text": "in declaratory judgment actions in addition to determining the rights and status of the parties.” Artusi v. City of",
        "paragraph_id": "para_465"
      },
      {
        "text": "Mishawaka, 519 N.E.2d 1246, 1250 (Ind. Ct. App. 1988) (relying on Ind. Trial Rule 57 and Fed. R. Civ. P.",
        "paragraph_id": "para_466"
      },
      {
        "text": "57), trans. denied. The cases that the Commissioner cites to the contrary were decided long before Trial Rule",
        "paragraph_id": "para_467"
      },
      {
        "text": "57 was adopted in 1969. See Commissioner’s Br. at 37-38 (citing Brindley v. Meara, 198 N.E. 301, 303 (Ind.",
        "paragraph_id": "para_468"
      },
      {
        "text": "1935), Bryarly v. State, 111 N.E.2d 277, 278-79 (Ind. 1953), and Myers v. State Life Ins. Co., 110 N.E.2d 312,",
        "paragraph_id": "para_469"
      },
      {
        "text": "313 (Ind. Ct. App. 1953)); see also T.R. 57 (“The existence of another adequate remedy does not preclude a",
        "paragraph_id": "para_470"
      },
      {
        "text": "judgment for declaratory relief in cases where it is appropriate.… Affirmative relief shall be allowed under",
        "paragraph_id": "para_471"
      },
      {
        "text": "such remedy when the right thereto is established.”).",
        "paragraph_id": "para_472"
      },
      {

        "text": "the moving party has a reasonable likelihood of success on the merits; (2) the",
        "paragraph_id": "para_474"
      },
      {
        "text": "moving party’s remedies at law are inadequate and irreparable harm will occur",
        "paragraph_id": "para_475"
      },
      {
        "text": "while the case is pending; (3) the threatened injury to the moving party from a",
        "paragraph_id": "para_476"
      },
      {
        "text": "denial of the injunction outweighs the potential harm to the nonmoving party",
        "paragraph_id": "para_477"
      },
      {
        "text": "from granting the injunction; and (4) the public interest would not be disserved",
        "paragraph_id": "para_478"
      },
      {
        "text": "by granting the injunction. In re J.B., 246 N.E.3d 819, 825 (Ind. Ct. App. 2024).",
        "paragraph_id": "para_479"
      },
      {
        "text": "Reasonable likelihood of success on the merits",
        "paragraph_id": "para_480"
      },
      {
        "text": "[28] “To demonstrate this element, the moving party is not required to show that he",
        "paragraph_id": "para_481"
      },
      {
        "text": "is entitled to relief as a matter of law, but only that success on the merits is",
        "paragraph_id": "para_482"
      },
      {
        "text": "probable.” Bowling v. Nicholson, 51 N.E.3d 439, 444 (Ind. Ct. App. 2016), trans.",
        "paragraph_id": "para_483"
      },
      {
        "text": "denied. Here, addressing Doctors’ likelihood of success on the merits involves",
        "paragraph_id": "para_484"
      },
      {
        "text": "statutory interpretation, a question of law that we review de novo. Clarian",
        "paragraph_id": "para_485"
      },
      {
        "text": "Health Partners v. Evans, 848 N.E.2d 763, 765 (Ind. Ct. App. 2006), trans. denied.",
        "paragraph_id": "para_486"
      },
      {
        "text": "“When interpreting a statute, our primary goal is to determine and give effect to",
        "paragraph_id": "para_487"
      },
      {
        "text": "the Legislature’s intent.” Perry Cnty. v. Huck, 263 N.E.3d 138, 141 (Ind. 2025).",
        "paragraph_id": "para_488"
      },
      {
        "text": "“The best evidence of that intent is the statute’s language.” Id. at 141-42.",
        "paragraph_id": "para_489"
      },
      {
        "text": "[29] In its order, the trial court noted that the APRA does not define the term",
        "paragraph_id": "para_490"
      },
      {
        "text": "“patient medical record,”10 but that Indiana Code Section 1-1-4-5, which",
        "paragraph_id": "para_491"
      },
      {
        "text": "contains definitions that “apply to the construction of all Indiana statutes,",
        "paragraph_id": "para_492"
      },
      {
        "text": "10 The APRA defines “patient” by referring to Indiana Code Section 16-18-2-272(d), which states that a",
        "paragraph_id": "para_493"
      },
      {
        "text": "“patient” is “an individual who has received health care services from a provider for the examination,",
        "paragraph_id": "para_494"
      },
      {
        "text": "treatment, diagnosis, or prevention of a physical or mental condition.” I.C. § 5-14-3-2(m).",
        "paragraph_id": "para_495"
      },
      {

        "text": "unless the construction is plainly repugnant to the intent of the general assembly",
        "paragraph_id": "para_497"
      },
      {
        "text": "or the context of the statute[,]” states that a “medical record” is “written or",
        "paragraph_id": "para_498"
      },
      {
        "text": "printed information possessed by a provider[11] … concerning any diagnosis,",
        "paragraph_id": "para_499"
      },
      {
        "text": "treatment, or prognosis of the patient, unless otherwise defined.” I.C. § 1-1-4-",
        "paragraph_id": "para_500"
      },
      {
        "text": "5(a)(6). The trial court found that, based on the face of the TPR form itself and",
        "paragraph_id": "para_501"
      },
      {
        "text": "the testimony of the Doctors and Justin Stover, “the Department’s [Assistant]",
        "paragraph_id": "para_502"
      },
      {
        "text": "Commissioner who assists with APRA requests,” the form “calls for abortion",
        "paragraph_id": "para_503"
      },
      {
        "text": "providers to provide information concerning a patient’s diagnosis, treatment, or",
        "paragraph_id": "para_504"
      },
      {
        "text": "prognosis .… of the particular patient upon whom the abortion procedure was",
        "paragraph_id": "para_505"
      },
      {
        "text": "performed and for whom the TPR is submitted.” Appealed Order at 11. Thus,",
        "paragraph_id": "para_506"
      },
      {
        "text": "the court concluded that Doctors had “established probable success on their",
        "paragraph_id": "para_507"
      },
      {
        "text": "claim that a TPR is subject to exemptions from disclosure as a [patient] medical",
        "paragraph_id": "para_508"
      },
      {
        "text": "record.” Id.",
        "paragraph_id": "para_509"
      },
      {
        "text": "[30] We agree with this conclusion. Defendants contend that TPRs are not patient",
        "paragraph_id": "para_510"
      },
      {
        "text": "medical records because they do not include the patient’s name.12 But the",
        "paragraph_id": "para_511"
      },
      {
        "text": "absence of a patient’s name from a TPR does not make it something other than",
        "paragraph_id": "para_512"
      },
      {
        "text": "11 Doctors note that they are required by statute to retain a signed copy of a TPR “in the pregnant woman’s",
        "paragraph_id": "para_513"
      },
      {
        "text": "patient file[.]” I.C. § 16-34-2-5.1. Of course, a patient medical record in an agency’s possession that is",
        "paragraph_id": "para_514"
      },
      {
        "text": "requested by a person under the APRA is not in the provider’s possession, which suggests that the “possessed",
        "paragraph_id": "para_515"
      },
      {
        "text": "by a provider” language in Indiana Code Section 1-1-4-5(a)(6) is plainly repugnant to the context of Indiana",
        "paragraph_id": "para_516"
      },
      {
        "text": "Code Section 5-14-3-4(a)(9), which exempts patient medical records from disclosure.",
        "paragraph_id": "para_517"
      },
      {
        "text": "12 The Commissioner observes that Indiana Code Section 5-14-3-4(a)(9) allows patient medical records to be",
        "paragraph_id": "para_518"
      },
      {
        "text": "disclosed with the patient’s written consent and then argues, “Obviously, a public agency cannot obtain a",
        "paragraph_id": "para_519"
      },
      {
        "text": "patient’s written consent … unless the records at issue relate to someone it can identify.” Commissioner’s Br.",
        "paragraph_id": "para_520"
      },
      {
        "text": "at 44. We agree, and no consent has been obtained for purposes of disclosing these private TPR medical",
        "paragraph_id": "para_521"
      },
      {
        "text": "records regarding the patients’ “diagnosis, treatment, or prognosis[.]” I.C. § 1-1-4-5(a)(6).",
        "paragraph_id": "para_522"
      },
      {

        "text": "a patient medical record, just as the absence of a driver’s name from a Bureau",
        "paragraph_id": "para_524"
      },
      {
        "text": "of Motor Vehicles driving record does not make it something other than a",
        "paragraph_id": "para_525"
      },
      {
        "text": "driving record. “It is just as important to recognize what [a] statute does not say",
        "paragraph_id": "para_526"
      },
      {
        "text": "as it is to recognize what it does say.” Masterbrand Cabinets v. Waid, 72 N.E.3d",
        "paragraph_id": "para_527"
      },
      {
        "text": "986, 992 (Ind. Ct. App. 2017). And Indiana Code Section 5-14-3-4(a)(9) does",
        "paragraph_id": "para_528"
      },
      {
        "text": "not say that a patient’s name must be in a medical record for it to be considered",
        "paragraph_id": "para_529"
      },
      {
        "text": "a patient medical record under the APRA.",
        "paragraph_id": "para_530"
      },
      {
        "text": "[31] The Commissioner further contends that the trial court erred in enjoining the",
        "paragraph_id": "para_531"
      },
      {
        "text": "release of TPRs in their entirety, noting that the APRA provides that “[i]f a",
        "paragraph_id": "para_532"
      },
      {
        "text": "public record contains disclosable and nondisclosable information, the public",
        "paragraph_id": "para_533"
      },
      {
        "text": "agency shall … separate the material that may be disclosed and make it",
        "paragraph_id": "para_534"
      },
      {
        "text": "available for inspection and copying.” I.C. § 5-14-3-6(a). As mentioned above,",
        "paragraph_id": "para_535"
      },
      {
        "text": "however, the legislature has provided for the periodic release of a “public",
        "paragraph_id": "para_536"
      },
      {
        "text": "report” with statistics compiled from the TPRs submitted that quarter. I.C. § 16-",
        "paragraph_id": "para_537"
      },
      {
        "text": "34-2-5(e). We agree with the PAC that this “suggests the individual forms are",
        "paragraph_id": "para_538"
      },
      {
        "text": "non-public.” Appellants’ App. Vol. 2 at 83.13 We also agree with the PAC’s",
        "paragraph_id": "para_539"
      },
      {
        "text": "determination that “[s]eparation and redaction would defeat the statutory",
        "paragraph_id": "para_540"
      },
      {
        "text": "purpose of the confidentiality requirement declaring ‘patient medical records’",
        "paragraph_id": "para_541"
      },
      {
        "text": "13 Doctors observe that, “[u]nlike other records exempted from disclosure under APRA, patient medical",
        "paragraph_id": "para_542"
      },
      {
        "text": "records do not become subject to disclosure seventy-five years after their creation.” Appellees’ Br. at 39 n.7",
        "paragraph_id": "para_543"
      },
      {
        "text": "(quoting I.C. § 5-14-3-4(d) (“Notwithstanding any other law, a public record that is classified as confidential,",
        "paragraph_id": "para_544"
      },
      {
        "text": "other than a record concerning … patient medical records … shall be made available for inspection and",
        "paragraph_id": "para_545"
      },
      {
        "text": "copying seventy-five (75) years after the creation of that record.”)). Doctors assert, and we agree, that “[t]his",
        "paragraph_id": "para_546"
      },
      {
        "text": "underscores the vital nature of the public interest in safeguarding personal health information from public",
        "paragraph_id": "para_547"
      },
      {
        "text": "disclosure.” Id.",
        "paragraph_id": "para_548"
      },
      {

      {
        "text": "non-disclosable[,]” and thus “[m]edical records as monolithic documents can be",
        "paragraph_id": "para_550"
      },
      {
        "text": "withheld in their entirety.” Id. at 83-84.14",
        "paragraph_id": "para_551"
      },
      {
        "text": "Remedies at law are inadequate and irreparable harm will occur",
        "paragraph_id": "para_552"
      },
      {
        "text": "[32] Defendants do not address whether Doctors’ remedies at law are inadequate.",
        "paragraph_id": "para_553"
      },
      {
        "text": "They do, however, challenge the trial court’s finding of irreparable harm. “The",
        "paragraph_id": "para_554"
      },
      {
        "text": "party seeking an injunction carries the burden of demonstrating an injury which",
        "paragraph_id": "para_555"
      },
      {
        "text": "is certain and irreparable if the injunction is denied.” Wagler Excavating Corp. v.",
        "paragraph_id": "para_556"
      },
      {
        "text": "McKibben Constr., Inc., 679 N.E.2d 155, 157 (Ind. Ct. App. 1997), trans. denied.",
        "paragraph_id": "para_557"
      },
      {
        "text": "“Irreparable harm is that harm which cannot be compensated for through",
        "paragraph_id": "para_558"
      },
      {
        "text": "damages upon resolution of the underlying action.” Coates v. Heat Wagons, Inc.,",
        "paragraph_id": "para_559"
      },
      {
        "text": "942 N.E.2d 905, 912 (Ind. Ct. App. 2011).",
        "paragraph_id": "para_560"
      },
      {
        "text": "[33] In its order, the trial court found that",
        "paragraph_id": "para_561"
      },
      {
        "text": "[t]he harms [Doctors] seek to avoid via the issuance of an",
        "paragraph_id": "para_562"
      },
      {
        "text": "injunction are the same harms that substantiate [Doctors’]",
        "paragraph_id": "para_563"
      },
      {
        "text": "standing to bring this declaratory judgment action. [T]he",
        "paragraph_id": "para_564"
      },
      {
        "text": "disclosure of TPRs has resulted in at least one patient leaving",
        "paragraph_id": "para_565"
      },
      {
        "text": "[Doctors’] care to seek abortion care from a provider not subject",
        "paragraph_id": "para_566"
      },
      {
        "text": "to similar requirements to disclose personal health information.",
        "paragraph_id": "para_567"
      },
      {
        "text": "The release of TPRs containing patient health information also",
        "paragraph_id": "para_568"
      },
      {
        "text": "stifles open communication between a physician and his/her",
        "paragraph_id": "para_569"
      },
      {
        "text": "patient – a patient will be unwilling to describe her symptoms",
        "paragraph_id": "para_570"
      },
      {
        "text": "and medical conditions with a doctor who is required to report",
        "paragraph_id": "para_571"
      },
      {
        "text": "14 The PAC noted that “[t]his position is also consistent with the [Board’s] recent finding [in Dr. Bernard’s",
        "paragraph_id": "para_572"
      },
      {
        "text": "disciplinary proceeding] that disclosure of even partial and seemingly non-identifiable information by",
        "paragraph_id": "para_573"
      },
      {
        "text": "medical providers can lead to legal consequences.” Appellants’ App. Vol. 2 at 84.",
        "paragraph_id": "para_574"
      },
      {

      {
        "text": "such discussions to the Department, with the possibility that",
        "paragraph_id": "para_576"
      },
      {
        "text": "members of the public can access that information.",
        "paragraph_id": "para_577"
      },
      {
        "text": "Appealed Order at 12-13.",
        "paragraph_id": "para_578"
      },
      {
        "text": "[34] Defendants contend that the foregoing harms are merely speculative. We",
        "paragraph_id": "para_579"
      },
      {
        "text": "disagree. As mentioned above, Dr. Bernard has already been disciplined by the",
        "paragraph_id": "para_580"
      },
      {
        "text": "Board for disclosing patient information that would be released to the public in",
        "paragraph_id": "para_581"
      },
      {
        "text": "a TPR if an injunction is denied, and she has already lost a patient due to",
        "paragraph_id": "para_582"
      },
      {
        "text": "concerns about her duty to disclose the patient’s personal health information to",
        "paragraph_id": "para_583"
      },
      {
        "text": "the Department and the potential release of that information to the public under",
        "paragraph_id": "para_584"
      },
      {
        "text": "the APRA. The nature of these nonspeculative injuries supports the trial court’s",
        "paragraph_id": "para_585"
      },
      {
        "text": "finding that Doctors’ relationships with their patients will be harmed if the",
        "paragraph_id": "para_586"
      },
      {
        "text": "injunction is denied. See Collins v. Bair, 268 N.E.2d 95, 98 (Ind. 1971) (stating",
        "paragraph_id": "para_587"
      },
      {
        "text": "that the physician-patient “privilege has been justified on the basis that its",
        "paragraph_id": "para_588"
      },
      {
        "text": "recognition encourages free communications and frank disclosure between",
        "paragraph_id": "para_589"
      },
      {
        "text": "patient and physician which, in turn, provide assistance in proper diagnosis and",
        "paragraph_id": "para_590"
      },
      {
        "text": "appropriate treatment. To deny the privilege, it was thought, would destroy the",
        "paragraph_id": "para_591"
      },
      {
        "text": "confidential nature of the physician-patient relationship and possibly cause one",
        "paragraph_id": "para_592"
      },
      {
        "text": "suffering from a particular ailment to withhold pertinent information of an",
        "paragraph_id": "para_593"
      },
      {
        "text": "embarrassing or otherwise confidential nature for fear of being publicly",
        "paragraph_id": "para_594"
      },
      {
        "text": "exposed.”). Such a harm cannot be compensated for through damages, so we",
        "paragraph_id": "para_595"
      },
      {
        "text": "find no clear error on this point.",
        "paragraph_id": "para_596"
      },
      {

        "text": "Threatened injury to moving party outweighs potential harm to nonmoving",
        "paragraph_id": "para_598"
      },
      {
        "text": "party",
        "paragraph_id": "para_599"
      },
      {
        "text": "[35] The trial court made the following findings regarding the potential harms to",
        "paragraph_id": "para_600"
      },
      {
        "text": "Defendants that would result from an injunction:",
        "paragraph_id": "para_601"
      },
      {
        "text": "The Commissioner presented evidence to support the claim of",
        "paragraph_id": "para_602"
      },
      {
        "text": "potential harms the Commissioner could suffer if the Court",
        "paragraph_id": "para_603"
      },
      {
        "text": "issued an injunction. Amy Osborne formerly was the Section",
        "paragraph_id": "para_604"
      },
      {
        "text": "Chief of Licensing Enforcement at the Office of the Attorney",
        "paragraph_id": "para_605"
      },
      {
        "text": "General. Her Section was tasked with ensuring doctors comply",
        "paragraph_id": "para_606"
      },
      {
        "text": "with Indiana law, bringing enforcement actions against",
        "paragraph_id": "para_607"
      },
      {
        "text": "physicians before the [Board]. To trigger an investigation, a",
        "paragraph_id": "para_608"
      },
      {
        "text": "complaint would be filed by “anyone” – a consumer, a patient, a",
        "paragraph_id": "para_609"
      },
      {
        "text": "family member of a patient, an association, another government",
        "paragraph_id": "para_610"
      },
      {
        "text": "agency, or an organization. Osborne added that generally, the",
        "paragraph_id": "para_611"
      },
      {
        "text": "Attorney General has received complaints of abortion law",
        "paragraph_id": "para_612"
      },
      {
        "text": "violations from the public; that the complainant learned of the",
        "paragraph_id": "para_613"
      },
      {
        "text": "purported violation from information from a TPR; and that it",
        "paragraph_id": "para_614"
      },
      {
        "text": "was more likely that the Attorney General’s Office would receive",
        "paragraph_id": "para_615"
      },
      {
        "text": "a complaint from the public than from the Department. In",
        "paragraph_id": "para_616"
      },
      {
        "text": "closing, VFL argued that part of its mission is to assist the",
        "paragraph_id": "para_617"
      },
      {
        "text": "Department with monitoring all abortions performed in Indiana",
        "paragraph_id": "para_618"
      },
      {
        "text": "via review of TPRs. Counsel for VFL asserted that VFL has an",
        "paragraph_id": "para_619"
      },
      {
        "text": "“interest in ensuring that the state abortion laws are being",
        "paragraph_id": "para_620"
      },
      {
        "text": "followed.”",
        "paragraph_id": "para_621"
      },
      {
        "text": "But the Department has not released TPRs for over one year.",
        "paragraph_id": "para_622"
      },
      {
        "text": "Stover, the Department’s Assistant Commissioner who assists",
        "paragraph_id": "para_623"
      },
      {
        "text": "with APRA requests, acknowledged that sometime in 2024, the",
        "paragraph_id": "para_624"
      },
      {
        "text": "Department had stopped releasing TPRs that were sought via",
        "paragraph_id": "para_625"
      },
      {
        "text": "APRA requests because the [PAC] issued an opinion, which led",
        "paragraph_id": "para_626"
      },
      {
        "text": "to the Department ceasing disclosure of TPRs. [Doctors]",
        "paragraph_id": "para_627"
      },
      {
        "text": "highlight the fact that though VFL could not obtain TPRs this",
        "paragraph_id": "para_628"
      },
      {
        "text": "past year, VFL could obtain the Department’s quarterly public",
        "paragraph_id": "para_629"
      },
      {
        "text": "reports, which are based upon submitted TPR information. See",
        "paragraph_id": "para_630"
      },
      {

        "paragraph_id": "para_631"
      },
      {
        "text": "IND. CODE § 16-34-2-5(e)(1) (Quarterly, the Department “shall",
        "paragraph_id": "para_632"
      },
      {
        "text": "compile a public report … from information submitted under this",
        "paragraph_id": "para_633"
      },
      {
        "text": "section”). And, at the hearing, neither the Commissioner nor the",
        "paragraph_id": "para_634"
      },
      {
        "text": "VFL presented any evidence that the lack of TPRs hampered any",
        "paragraph_id": "para_635"
      },
      {
        "text": "abortion law enforcement whatsoever. A reasonable inference",
        "paragraph_id": "para_636"
      },
      {
        "text": "from this point suggests that the Defendants’ claimed potential",
        "paragraph_id": "para_637"
      },
      {
        "text": "harm is no harm at all. Besides, it is the responsibility of the",
        "paragraph_id": "para_638"
      },
      {
        "text": "Commissioner and the Department, in conjunction with the",
        "paragraph_id": "para_639"
      },
      {
        "text": "Attorney General’s Office, to uphold abortion laws – they are the",
        "paragraph_id": "para_640"
      },
      {
        "text": "state entities specifically charged with investigating and initiating",
        "paragraph_id": "para_641"
      },
      {
        "text": "enforcement actions against any doctors who fail to follow such",
        "paragraph_id": "para_642"
      },
      {
        "text": "laws. Nothing prevents the Department from reviewing the TPRs",
        "paragraph_id": "para_643"
      },
      {
        "text": "to detect possible violations, which is why the legislature requires",
        "paragraph_id": "para_644"
      },
      {
        "text": "abortion providers to submit TPRs to the Department in the first",
        "paragraph_id": "para_645"
      },
      {

        "text": "To boost the Defendants’ position in support of the public release",
        "paragraph_id": "para_647"
      },
      {
        "text": "of TPRs, both the Commissioner and VFL argued that the",
        "paragraph_id": "para_648"
      },
      {
        "text": "Department had previously released TPRs pursuant to APRA. At",
        "paragraph_id": "para_649"
      },
      {
        "text": "the TRO hearing, the Commissioner represented that TPRs were",
        "paragraph_id": "para_650"
      },
      {
        "text": "subject to APRA disclosure “for decades” while VFL noted that",
        "paragraph_id": "para_651"
      },
      {
        "text": "it was “common practice” for the Department to release TPRs.",
        "paragraph_id": "para_652"
      },
      {
        "text": "The Defendants presented similar arguments during the",
        "paragraph_id": "para_653"
      },
      {
        "text": "preliminary injunction hearing. These contentions, while true, do",
        "paragraph_id": "para_654"
      },
      {
        "text": "not sway this Court because the type of information an abortion",
        "paragraph_id": "para_655"
      },
      {
        "text": "provider is required to submit via a TPR changed to include",
        "paragraph_id": "para_656"
      },
      {
        "text": "information about a patient diagnosis and any reasons why the",
        "paragraph_id": "para_657"
      },
      {
        "text": "physician performed the abortion. Dr. Bernard testified that this",
        "paragraph_id": "para_658"
      },
      {
        "text": "change took place after the State of Indiana banned abortions, a",
        "paragraph_id": "para_659"
      },
      {
        "text": "change of law that ultimately took effect in August 2023. The",
        "paragraph_id": "para_660"
      },
      {
        "text": "Court surmises that Indiana’s abortion ban triggered the request",
        "paragraph_id": "para_661"
      },
      {
        "text": "to the [PAC] for an opinion regarding the nature of TPRs as",
        "paragraph_id": "para_662"
      },
      {
        "text": "medical records exempt from APRA disclosure. The Court",
        "paragraph_id": "para_663"
      },
      {
        "text": "determines that the inclusion of diagnostic and treatment",
        "paragraph_id": "para_664"
      },
      {
        "text": "information on TPRs following Indiana’s abortion ban nullifies",
        "paragraph_id": "para_665"
      },
      {
        "text": "any argument that the Department’s prior practice of releasing",
        "paragraph_id": "para_666"
      },
      {
        "text": "TPRs should carry persuasive weight.",
        "paragraph_id": "para_667"
      },
      {

        "text": "[36] The court then reached the following conclusion:",
        "paragraph_id": "para_670"
      },
      {
        "text": "In balancing the parties’ competing harms, the Court rules that",
        "paragraph_id": "para_671"
      },
      {
        "text": "[Doctors’] injury from the lack of an injunction to prevent TPR",
        "paragraph_id": "para_672"
      },
      {
        "text": "disclosure outweighs the potential harm to the Commissioner",
        "paragraph_id": "para_673"
      },
      {
        "text": "and VFL. The Court holds that [Doctors’] injuries (the actual and",
        "paragraph_id": "para_674"
      },
      {
        "text": "potential future loss of patients, as well as the stifling of open",
        "paragraph_id": "para_675"
      },
      {
        "text": "communication between physicians [and] their patients)",
        "paragraph_id": "para_676"
      },
      {
        "text": "outweigh the Defendants’ potential harms (the Commissioner’s",
        "paragraph_id": "para_677"
      },
      {
        "text": "inability to enforce the TPR law and VFL’s incapacity to assist",
        "paragraph_id": "para_678"
      },
      {
        "text": "the Department with TPR enforcement). The potential harm the",
        "paragraph_id": "para_679"
      },
      {
        "text": "Defendants presented to the Court was VFL’s alleged inability to",
        "paragraph_id": "para_680"
      },
      {
        "text": "help ensure that the state abortion laws are being followed should",
        "paragraph_id": "para_681"
      },
      {
        "text": "this Court enjoin the release of TPRs. Yet the Commissioner",
        "paragraph_id": "para_682"
      },
      {
        "text": "(and, therefore, the Department) have unfettered access to the",
        "paragraph_id": "para_683"
      },
      {
        "text": "TPRs and may continue to enforce the TPR law. And VFL may",
        "paragraph_id": "para_684"
      },
      {
        "text": "continue to review the quarterly reports and provide any",
        "paragraph_id": "para_685"
      },
      {
        "text": "assistance to the Department to enforce the TPR law. The Court",
        "paragraph_id": "para_686"
      },
      {
        "text": "is not convinced that the Defendants have suffered or will suffer",
        "paragraph_id": "para_687"
      },
      {
        "text": "any harms from the issuance of an injunction. Thus, the injuries",
        "paragraph_id": "para_688"
      },
      {
        "text": "to [Doctors] outweigh any potential harms to the Defendants.",
        "paragraph_id": "para_689"
      },
      {
        "text": "Id. at 17.",
        "paragraph_id": "para_690"
      },
      {
        "text": "[37] VFL’s argument that the trial court erred in balancing the equities presupposes",
        "paragraph_id": "para_691"
      },
      {
        "text": "that it has a statutory right to access TPRs under the APRA, which is yet to be",
        "paragraph_id": "para_692"
      },
      {
        "text": "definitively determined.15 The Commissioner, on the other hand, argues that",
        "paragraph_id": "para_693"
      },
      {
        "text": "15 Doctors observe that if Defendants ultimately prevail, “VFL can obtain the TPRs it seeks at the conclusion",
        "paragraph_id": "para_694"
      },
      {
        "text": "of the proceedings; no one has suggested that the [Department] will fail to maintain the records until then.”",
        "paragraph_id": "para_695"
      },
      {
        "text": "Appellees’ Br. at 38.",

      },
      {

        "text": "the trial court’s ruling means that “the State cannot disclose information of",
        "paragraph_id": "para_698"
      },
      {
        "text": "great public interest that the Governor, the Attorney General, and the",
        "paragraph_id": "para_699"
      },
      {
        "text": "Commissioner have determined must be disclosed by law[,]” and thus “[t]he",
        "paragraph_id": "para_700"
      },
      {
        "text": "injunction clearly inflicts irreparable harm.” Commissioner’s Br. at 50 (citation",
        "paragraph_id": "para_701"
      },
      {
        "text": "and quotation marks omitted). But this argument disregards the fundamental",
        "paragraph_id": "para_702"
      },
      {
        "text": "precept that “it is ‘emphatically the province and duty of the judicial",
        "paragraph_id": "para_703"
      },
      {
        "text": "department to say what the law is.’” Rokita v. Tully, 235 N.E.3d 189, 202 (Ind.",
        "paragraph_id": "para_704"
      },
      {
        "text": "Ct. App. 2024) (quoting Marbury v. Madison, 1 Cranch 137, 177 (1803)), trans.",
        "paragraph_id": "para_705"
      },
      {
        "text": "denied. And we conclude that the trial court’s balancing of the harms is not",
        "paragraph_id": "para_706"
      },
      {
        "text": "clearly erroneous. As long as the injunction remains in place, Doctors’",
        "paragraph_id": "para_707"
      },
      {
        "text": "confidential relationships with their patients will be preserved, and Indiana’s",
        "paragraph_id": "para_708"
      },
      {
        "text": "abortion laws will continue to be enforced.",
        "paragraph_id": "para_709"
      },
      {
        "text": "Public interest will not be disserved",
        "paragraph_id": "para_710"
      },
      {
        "text": "[38] Finally, as for whether the public interest would be disserved by granting an",
        "paragraph_id": "para_711"
      },
      {
        "text": "injunction, the trial court made the following findings:",
        "paragraph_id": "para_712"
      },
      {
        "text": "1. Evidence of Public Interests:",
        "paragraph_id": "para_713"
      },
      {
        "text": "One interest [Doctors] consistently stated was confidentiality of",
        "paragraph_id": "para_714"
      },
      {
        "text": "patient health information. Both [Doctors] worried that the",
        "paragraph_id": "para_715"
      },
      {
        "text": "release of TPRs ultimately resulted in violating the confidence of",
        "paragraph_id": "para_716"
      },
      {
        "text": "their patients because TPRs contain private health information.",
        "paragraph_id": "para_717"
      },
      {
        "text": "Dr. Bernard expressed that one reason for intervention in the",
        "paragraph_id": "para_718"
      },
      {
        "text": "earlier case was “the significant amount of protected health",
        "paragraph_id": "para_719"
      },
      {
        "text": "information that is included in [a TPR][”] and her “concern[]",
        "paragraph_id": "para_720"
      },
      {
        "text": "about the privacy of [her] patients ….” Similarly, Dr. Rouse",
        "paragraph_id": "para_721"
      },
      {
        "text": "remarked that her patients “may not feel comfortable disclosing",
        "paragraph_id": "para_722"
      },
      {
        "text": "other parts of their medical history or procedures that they may",
        "paragraph_id": "para_723"
      },
      {

      {
        "text": "have.” Stover, the Department’s Assistant Commissioner who",
        "paragraph_id": "para_725"
      },
      {
        "text": "assists with APRA requests, conceded that TPRs contain",
        "paragraph_id": "para_726"
      },
      {
        "text": "potentially sensitive information that could be subject to",
        "paragraph_id": "para_727"
      },
      {
        "text": "redaction. A second interest the [Doctors] put forward was that",
        "paragraph_id": "para_728"
      },
      {
        "text": "TPR disclosure could have a chilling effect on the",
        "paragraph_id": "para_729"
      },
      {
        "text": "patient/physician relationship. A patient could be less likely to",
        "paragraph_id": "para_730"
      },
      {
        "text": "disclose certain medical information to the physician knowing",
        "paragraph_id": "para_731"
      },
      {
        "text": "that the physician must report such information and that the",
        "paragraph_id": "para_732"
      },
      {
        "text": "Department may publicly release that information.",
        "paragraph_id": "para_733"
      },
      {
        "text": "The Defendants countered that abortion law enforcement was",
        "paragraph_id": "para_734"
      },
      {
        "text": "hindered if the public release of TPRs was enjoined. Osborne,",
        "paragraph_id": "para_735"
      },
      {
        "text": "formerly of the Attorney General’s Office, remarked that the",
        "paragraph_id": "para_736"
      },
      {
        "text": "Attorney General was more likely to receive complaints of",
        "paragraph_id": "para_737"
      },
      {
        "text": "alleged TPR violations from the public than from the",
        "paragraph_id": "para_738"
      },
      {
        "text": "Department. VFL declared that the withholding of TPRs from",
        "paragraph_id": "para_739"
      },
      {
        "text": "public release would “render the AG’s … ability to regulate",
        "paragraph_id": "para_740"
      },
      {
        "text": "licensed professionals … meaningless.” VFL argued that the",
        "paragraph_id": "para_741"
      },
      {
        "text": "Attorney General “need[s] a third-party complaint to bring any",
        "paragraph_id": "para_742"
      },
      {
        "text": "action to the Medical Licensing Board” and that VFL has “an",
        "paragraph_id": "para_743"
      },
      {
        "text": "interest in ensuring that the state abortion laws are being",
        "paragraph_id": "para_744"
      },
      {
        "text": "followed.”[16]",
        "paragraph_id": "para_745"
      },
      {
        "text": "2. Serving the Public Interest:",
        "paragraph_id": "para_746"
      },
      {
        "text": "Issuance of an injunction would serve a significant public interest",
        "paragraph_id": "para_747"
      },
      {
        "text": "– keeping a patient’s information of diagnosis, treatment, and",
        "paragraph_id": "para_748"
      },
      {
        "text": "prognosis confidential, safeguarded from public disclosure.",
        "paragraph_id": "para_749"
      },
      {
        "text": "Indiana law supports this interest in APRA, making patient",
        "paragraph_id": "para_750"
      },
      {
        "text": "medical records exempt from public disclosure. Moreover, a",
        "paragraph_id": "para_751"
      },
      {
        "text": "federal law, the Health Insurance Portability and Accountability",
        "paragraph_id": "para_752"
      },
      {
        "text": "16 The Commissioner notes that “[i]f someone suspects a violation of Indiana’s laws regulating the medical",
        "paragraph_id": "para_753"
      },
      {
        "text": "profession and notifies the Attorney General’s Office, the Office can investigate.” Commissioner’s Br. at 50",
        "paragraph_id": "para_754"
      },
      {
        "text": "(citing I.C. §§ 25-1-7-2, -5(b)). “By law, however, the Office cannot investigate without a complaint from",
        "paragraph_id": "para_755"
      },
      {
        "text": "someone outside the Office.” Id. (citing I.C. § 25-1-7-4).",
        "paragraph_id": "para_756"
      },
      {

        "text": "Act of 1996 (HIPAA), 42 U.S.C. § 1320d et al. and 45 C.F.R.",
        "paragraph_id": "para_758"
      },
      {
        "text": "Parts 160 and 164, also prevents the public disclosure of a",
        "paragraph_id": "para_759"
      },
      {
        "text": "patient’s protected health information. Significantly, an",
        "paragraph_id": "para_760"
      },
      {
        "text": "injunction prohibiting the release of TPRs would give comfort to",
        "paragraph_id": "para_761"
      },
      {
        "text": "patients of abortion providers that the patient’s records of",
        "paragraph_id": "para_762"
      },
      {
        "text": "medical diagnosis, treatment, or prognosis will NOT be released",
        "paragraph_id": "para_763"
      },
      {
        "text": "for public review. Patients of abortion providers would no longer",
        "paragraph_id": "para_764"
      },
      {
        "text": "have incentive NOT to share sensitive information with a",
        "paragraph_id": "para_765"
      },
      {
        "text": "physician for fear that information would be revealed.",
        "paragraph_id": "para_766"
      },
      {
        "text": "Further, as the Court determined … above, enjoining the public",
        "paragraph_id": "para_767"
      },
      {
        "text": "release of TPRs is not harm to the Defendants – the",
        "paragraph_id": "para_768"
      },
      {
        "text": "Commissioner, via the Department, may continue to review",
        "paragraph_id": "para_769"
      },
      {
        "text": "TPRs to monitor for violations of the TPR law, and VFL may",
        "paragraph_id": "para_770"
      },
      {
        "text": "continue to assist by reviewing quarterly reports.",
        "paragraph_id": "para_771"
      },
      {
        "text": "The Court holds that issuance of an injunction will not disserve",
        "paragraph_id": "para_772"
      },
      {
        "text": "the public interest. To the contrary, an injunction will certainly",
        "paragraph_id": "para_773"
      },
      {
        "text": "serve a vital public interest – the confidentiality of a patient’s",
        "paragraph_id": "para_774"
      },
      {
        "text": "medical records.",
        "paragraph_id": "para_775"
      },
      {
        "text": "Appealed Order at 17-19.",
        "paragraph_id": "para_776"
      },
      {
        "text": "[39] VFL argues that the trial court “showed contempt for the judgment of the",
        "paragraph_id": "para_777"
      },
      {
        "text": "legislative branch, when it minimized that private parties like VFL play [sic] in",
        "paragraph_id": "para_778"
      },
      {
        "text": "assuring good government which is acknowledged by APRA.” VFL’s Br. at 31-",
        "paragraph_id": "para_779"
      },
      {
        "text": "32. Again, this argument presupposes that VFL has a statutory right to access",
        "paragraph_id": "para_780"
      },
      {
        "text": "TPRs under the APRA, and it disregards the legislative branch’s decision to",
        "paragraph_id": "para_781"
      },
      {
        "text": "require the Department to compile a quarterly “public report” of TPR statistics",
        "paragraph_id": "para_782"
      },
      {
        "text": "under Section 16-34-2-5(e). VFL also complains that the court “disregarded the",
        "paragraph_id": "para_783"
      },
      {
        "text": "opinion of the Attorney General acknowledging the important role that private",
        "paragraph_id": "para_784"
      },
      {
        "text": "parties play in helping public officials perform their duty.” Id. at 32. But the",
        "paragraph_id": "para_785"
      },
      {

        "text": "Attorney General’s opinion was only advisory and not binding on the judicial",
        "paragraph_id": "para_787"
      },
      {
        "text": "branch in any way. See McPeek v. McCardle, 888 N.E.2d 171, 177 n.4 (Ind. 2008)",
        "paragraph_id": "para_788"
      },
      {
        "text": "(citing Ill.-Ind. Cable Television Ass’n v. Pub. Serv. Comm’n, 427 N.E.2d 1100, 1111",
        "paragraph_id": "para_789"
      },
      {
        "text": "(Ind. Ct. App. 1981)).",
        "paragraph_id": "para_790"
      },
      {
        "text": "[40] The Commissioner asserts that “the injunction … weakens protections for",
        "paragraph_id": "para_791"
      },
      {
        "text": "maternal health and unborn life” by “depriving the public of access to",
        "paragraph_id": "para_792"
      },
      {
        "text": "terminated pregnancy reports that could form the basis for complaints” that",
        "paragraph_id": "para_793"
      },
      {
        "text": "abortions were not performed in accordance with the law. Commissioner’s Br.",
        "paragraph_id": "para_794"
      },
      {
        "text": "at 50-51. Doctors observe that the Commissioner “does not dispute that [the",
        "paragraph_id": "para_795"
      },
      {
        "text": "Department] has the authority to file such complaints as part of its broad power",
        "paragraph_id": "para_796"
      },
      {
        "text": "to enforce Indiana laws concerning health.” Appellees’ Br. at 37-38 (citing I.C.",
        "paragraph_id": "para_797"
      },
      {
        "text": "§ 16-19-3-1)).",
        "paragraph_id": "para_798"
      },
      {
        "text": "[41] On that topic, the Commissioner contends,",
        "paragraph_id": "para_799"
      },
      {
        "text": "Saying that Department employees could submit complaints to",
        "paragraph_id": "para_800"
      },
      {
        "text": "the Attorney General’s Office is no answer. The legislature did",
        "paragraph_id": "para_801"
      },
      {
        "text": "not design an oversight regime under which only the Department",
        "paragraph_id": "para_802"
      },
      {
        "text": "can submit complaints; it designed one under which both the",
        "paragraph_id": "para_803"
      },
      {
        "text": "Department and the public can. The preliminary injunction",
        "paragraph_id": "para_804"
      },
      {
        "text": "removes one of those oversight mechanisms, directly weakening",
        "paragraph_id": "para_805"
      },
      {
        "text": "oversight of abortion providers. That has a real-world impact.",
        "paragraph_id": "para_806"
      },
      {
        "text": "Unrebutted testimony established below that all complaints about",
        "paragraph_id": "para_807"
      },
      {
        "text": "potential violations of state laws regulating abortion providers",
        "paragraph_id": "para_808"
      },
      {
        "text": "have come from the public.",
        "paragraph_id": "para_809"
      },
      {

        "text": "Commissioner’s Br. at 51 (record citation omitted).17",
        "paragraph_id": "para_811"

      {
        "text": "[42] Doctors note that the trial court’s injunction “does not prevent members of the",
        "paragraph_id": "para_812"
      },
      {
        "text": "public with personal knowledge of unlawful or legally questionable conduct",
        "paragraph_id": "para_813"
      },
      {
        "text": "from filing complaints with the Attorney General’s office” or “affect",
        "paragraph_id": "para_814"
      },
      {
        "text": "prosecuting attorneys’ ability to bring criminal enforcement proceedings against",
        "paragraph_id": "para_815"
      },
      {
        "text": "those who violate abortion laws.” Appellees’ Br. at 39. Finally, Doctors assert,",
        "paragraph_id": "para_816"
      },
      {
        "text": "and we agree, that Defendants’ “claim that vigilantism is central to the",
        "paragraph_id": "para_817"
      },
      {
        "text": "enforcement scheme for abortion laws created by the legislature is wholly",
        "paragraph_id": "para_818"
      },
      {
        "text": "unsupported by legal authority.” Id.",
        "paragraph_id": "para_819"
      },
      {
        "text": "[43] In sum, we conclude that the trial court did not abuse its discretion in granting",
        "paragraph_id": "para_820"
      },
      {
        "text": "Doctors a preliminary injunction as to the TPRs submitted by Doctors.",
        "paragraph_id": "para_821"
      },
      {
        "text": "Issue Three: Overbroad injunction",
        "paragraph_id": "para_822"
      },
      {
        "text": "[44] Finally, we address the Commissioner’s argument that the injunction is",
        "paragraph_id": "para_823"
      },
      {
        "text": "overbroad because it also applies to APRA requests for TPRs not submitted by",
        "paragraph_id": "para_824"
      },
      {
        "text": "Doctors. This argument ignores the fact that the trial court’s declaratory",
        "paragraph_id": "para_825"
      },
      {
        "text": "judgment will have statewide application because it will affect a state agency",
        "paragraph_id": "para_826"
      },
      {
        "text": "and doctors and patients throughout Indiana. To limit the injunction only to",
        "paragraph_id": "para_827"
      },
      {
        "text": "Doctors’ TPRs would create an illogical and harmful result: the Department",
        "paragraph_id": "para_828"
      },
      {
        "text": "17 Additionally, the Commissioner asserts, “Saying that the public can still access the Department’s quarterly",
        "paragraph_id": "para_829"
      },
      {
        "text": "reports is no answer either” because they “contain only aggregated data” and “do not provide sufficient",
        "paragraph_id": "para_830"
      },
      {
        "text": "details.” Commissioner’s Br. at 51. We reiterate that Indiana Code Section 16-34-2-5(e) specifically",
        "paragraph_id": "para_831"
      },
      {
        "text": "designates the quarterly reports as “public report[s],” which suggests that the legislature intended for the",
        "paragraph_id": "para_832"
      },
      {
        "text": "public to access only the “aggregated data” contained in the reports.",
        "paragraph_id": "para_833"
      },
      {

        "text": "could release hundreds of other doctors’ TPRs containing the same categories",
        "paragraph_id": "para_835"
      },
      {
        "text": "of sensitive patient information while the legal question of disclosability is being",
        "paragraph_id": "para_836"
      },
      {
        "text": "litigated. This would defeat the purpose of the preliminary injunction and",
        "paragraph_id": "para_837"
      },
      {
        "text": "irreparably harm both patient privacy and the physician-patient relationship",
        "paragraph_id": "para_838"
      },
      {
        "text": "statewide. The trial court’s preliminary injunction properly maintains the status",
        "paragraph_id": "para_839"
      },
      {
        "text": "quo that has existed for over a year—to our knowledge, no TPRs have been",
        "paragraph_id": "para_840"
      },
      {
        "text": "released since it was determined that they are exempt patient medical records.",
        "paragraph_id": "para_841"
      },
      {
        "text": "Accordingly, we affirm the trial court’s order in all respects.",
