        "text": "[1] In our June 22, 2026 Opinion, we held that the claims filed by the Estate of",
        "paragraph_id": "para_24"

      {
        "text": "Timothy Parsons and his parents (collectively, the Parsons) against Crum &",
        "paragraph_id": "para_25"
      },
      {
        "text": "Forster Specialty Insurance Company’s (Crum & Forster’s) insureds are",
        "paragraph_id": "para_26"
      },
      {
        "text": "covered by the commercial general liability part of the primary policy, not the",
        "paragraph_id": "para_27"
      },
      {
        "text": "third-party pollution liability coverage part. We did not comment on whether",
        "paragraph_id": "para_28"
      },
      {
        "text": "Crum & Forster will ultimately have a duty to indemnify its insureds, as that",
        "paragraph_id": "para_29"
      },
      {
        "text": "issue was not put before us and, even if it had been, it is not ripe for",
        "paragraph_id": "para_30"
      },
      {
        "text": "adjudication at this procedural juncture. See Ind. Ins. Co. v. Kopetsky, 11 N.E.3d",
        "paragraph_id": "para_31"
      },
      {
        "text": "508, 529 (Ind. Ct. App. 2014) (“[T]he issue of indemnity is not ripe for review",
        "paragraph_id": "para_32"
      },
      {
        "text": "on any basis when there has been no finding of liability in the underlying",
        "paragraph_id": "para_33"
      },
      {
        "text": "lawsuit.”), trans. denied.",
        "paragraph_id": "para_34"
      },
      {
        "text": "[2] Crum & Forster petitions for rehearing and asks us to clarify that the trial court",
        "paragraph_id": "para_35"
      },
      {
        "text": "should refrain from ruling on the issue of indemnity until liability has been",
        "paragraph_id": "para_36"
      },
      {
        "text": "determined on the Parsons’ underlying claims. We write solely to explain that",
        "paragraph_id": "para_37"
      },
      {
        "text": "on remand, the trial court should (1) deny Crum & Forster’s motion for",
        "paragraph_id": "para_38"
      },
      {
        "text": "summary judgment, (2) deny at this juncture the Parsons’ cross-motion for",
