Gilliam (Gilliam) challenges an order", "paragraph_id": "para_19" }, { "text": "denying his request to continue a hearing on Defendant-Appellee", "paragraph_id": "para_20" }, { "text": "Dan Elliott's (Elliott) motion to dismiss, and the subsequent", "paragraph_id": "para_21" }, { "text": "order granting dismissal. App. June 17, 2022) (SDO), this court affirmed a", "paragraph_id": "para_24" }, { "text": "grant of summary judgment on all claims, except for the \"Unfair and Deceptive", "paragraph_id": "para_25" }, { "text": "Trade Practice\" (UDAP) and \"Fraud\" claims.", "paragraph_id": "para_26" }, { "text": "Gilliam appeals from the Circuit Court of the Fifth", "paragraph_id": "para_27" }, { "text": "Circuit's (Circuit Court)2 February 9, 2023 Final Judgment", "paragraph_id": "para_28" }, { "text": "(Judgment) entered in favor of Elliott, and January 31, 2023", "paragraph_id": "para_29" }, { "text": "\"Order Granting [Elliott]'s Motion to Dismiss Complaint Filed", "paragraph_id": "para_30" }, { "text": "March 22, 2019\" (Dismissal Order).", "paragraph_id": "para_31" }, { "text": "While Gilliam's Opening Brief lacks an \"Argument\"", "paragraph_id": "para_32" }, { "text": "section and his \"Points of Error\" section does not fully comply", "paragraph_id": "para_33" }, { "text": "with Hawaiʻi Rules of Appellate Procedure (HRAP) Rule 28(b), we", "paragraph_id": "para_34" }, { "text": "are able to discern Gilliam's essential contentions. See Erum", "paragraph_id": "para_35" }, { "text": "v. Llego, 147 Hawaiʻi 368, 380-81, 465 P.3d 815, 827-28 (2020)", "paragraph_id": "para_36" }, { "text": "(affording liberal review to pleadings by self-represented", "paragraph_id": "para_37" }, { "text": "litigants \"to facilitate access to justice\" and to afford", "paragraph_id": "para_38" }, { "text": "opportunity for appellate review (citation omitted)).", "paragraph_id": "para_39" }, { "text": "On appeal, Gilliam appears to challenge, among other", "paragraph_id": "para_40" }, { "text": "things,3 (1) the denial of an \"HRCP 16 conference\" request; and", "paragraph_id": "para_41" }, { "text": "(2) the denial of his \"Motion to Reschedule Hearing on Motion to", "paragraph_id": "para_42" }, { "text": "Dismiss\" (motion to continue).", "paragraph_id": "para_43" }, { "text": "Upon careful review of the record and the briefs", "paragraph_id": "para_44" }, { "text": "submitted by the parties and having given due consideration to", "paragraph_id": "para_45" }, { "text": "the arguments advanced and the issues raised, we resolve", "paragraph_id": "para_46" }, { "text": "Gilliam's contentions as follows.", "paragraph_id": "para_47" }, { "text": "(1) Hawaiʻi Rules of Civil Procedure (HRCP) Rule 16", "paragraph_id": "para_48" }, { "text": "conference request: Gilliam points to HRCP Rule 16(b)(1) and", "paragraph_id": "para_49" }, { "text": "(2) to argue that the scheduling conference under that rule was4", "paragraph_id": "para_50" }, { "text": "2 The Honorable Randal G.B. Valenciano presided.", "paragraph_id": "para_51" }, { "text": "3 Gilliam's remaining points of error (Points 1, 3, 4, 5, and 6)", "paragraph_id": "para_52" }, { "text": "appear to raise arguments pertaining to the motion to dismiss. Because we", "paragraph_id": "para_53" }, { "text": "conclude the continuance should have been granted and the motion to dismiss", "paragraph_id": "para_54" }, { "text": "should not have gone forward, we need not reach these contentions. Gilliam's", "paragraph_id": "para_55" }, { "text": "\"Point 8\" contention regarding his motion for leave to amend filed August 26,", "paragraph_id": "para_56" }, { "text": "2019, was not raised in Gilliam's prior appeal filed October 31, 2019, and it", "paragraph_id": "para_57" }, { "text": "is waived.", "paragraph_id": "para_58" }, { "text": "4 HRCP Rule 16, entitled \"Pre-trial Conferences; Scheduling;", "paragraph_id": "para_59" }, { "text": "Management,\" provides in pertinent part:", "paragraph_id": "para_60" }, { "text": "2", "paragraph_id": "para_61" }, { "text": "\"mandatory\"; the Circuit Court was required to \"set the same on", "paragraph_id": "para_62", "court_paragraph": 2 }, { "text": "request\"; Gilliam submitted his September 16, 2022 request for a", "paragraph_id": "para_63" }, { "text": "scheduling conference; and the Circuit Court erroneously", "paragraph_id": "para_64" }, { "text": "\"denied\" the request \"with a bold rubber stamp\" on October 4,", "paragraph_id": "para_65" }, { "text": "2022.", "paragraph_id": "para_66" }, { "text": "Here, Elliott was served with the March 22, 2019", "paragraph_id": "para_67" }, { "text": "Complaint on March 27, 2019, and the 90-day time frame specified", "paragraph_id": "para_68" }, { "text": "in HRCP Rule 16(b) ran from March 27, 2019. HRCP Rule 16(b) did", "paragraph_id": "para_69" }, { "text": "not apply to Gilliam's request filed September 16, 2022.", "paragraph_id": "para_70" }, { "text": "(2) Denial of the motion to continue: Elliott's", "paragraph_id": "para_71" }, { "text": "motion to dismiss the remaining UDAP and Fraud claims was set", "paragraph_id": "para_72" }, { "text": "for hearing on November 17, 2022. Gilliam argues that the", "paragraph_id": "para_73" }, { "text": "Circuit Court should have granted his November 15, 2022 motion", "paragraph_id": "para_74" }, { "text": "to continue the November 17, 2022 hearing due to his illness.", "paragraph_id": "para_75" }, { "text": "Gilliam points to his \"health declaration\" and attached letter", "paragraph_id": "para_76" }, { "text": "from his \"board certified treating physician,\" which was also", "paragraph_id": "para_77" }, { "text": "submitted on November 15, 2022. Gilliam claims that he", "paragraph_id": "para_78" }, { "text": "experienced a \"genuine health issue\" that made him \"foreseeably", "paragraph_id": "para_79" }, { "text": "unavailable\" for the hearing.5 Gilliam quotes the following", "paragraph_id": "para_80" }, { "text": "(b) Scheduling and planning.", "paragraph_id": "para_81" }, { "text": "(1) Issuing order. Except in cases exempted by the Rules", "paragraph_id": "para_82" }, { "text": "of the Circuit Courts of the State of Hawaiʻi, the court", "paragraph_id": "para_83" }, { "text": "must issue a scheduling order after consulting with the", "paragraph_id": "para_84" }, { "text": "parties' attorneys and any self-represented parties at a", "paragraph_id": "para_85" }, { "text": "scheduling conference.", "paragraph_id": "para_86" }, { "text": "(2) Time to issue. The court must issue the scheduling", "paragraph_id": "para_87" }, { "text": "order as soon as practicable, but unless the court finds", "paragraph_id": "para_88" }, { "text": "good cause for delay, the court must issue it within the", "paragraph_id": "para_89" }, { "text": "earlier of 90 days after any defendant has been served with", "paragraph_id": "para_90" }, { "text": "the complaint or 60 days after any defendant has appeared.", "paragraph_id": "para_91" }, { "text": ". . . .", "paragraph_id": "para_92" }, { "text": "(Emphasis added.)", "paragraph_id": "para_93" }, { "text": "5 William's Reply Brief also asserts, without any citation to the", "paragraph_id": "para_94" }, { "text": "record, that he flew back to \"Lihue\" on the \"16th and 17th\" and did not", "paragraph_id": "para_95" }, { "text": "3", "paragraph_id": "para_96" }, { "text": "passage from Onaka v. Onaka, to support his assertion that his", "paragraph_id": "para_97", "court_paragraph": 3 }, { "text": "illness warranted a continuance:", "paragraph_id": "para_98" }, { "text": "It is customary to grant a continuance on the ground of", "paragraph_id": "para_99" }, { "text": "illness of a party. We conclude that [the defendant]'s", "paragraph_id": "para_100" }, { "text": "testimony was necessary for the defense of his case, that", "paragraph_id": "para_101" }, { "text": "the granting of a continuance would not have unduly", "paragraph_id": "para_102" }, { "text": "prejudiced the other parties, and that the continuance", "paragraph_id": "para_103" }, { "text": "motion was not motivated by procrastination, bad planning", "paragraph_id": "para_104" }, { "text": "or bad faith on the part of [the defendant] or his counsel.", "paragraph_id": "para_105" }, { "text": "It is the law that where none of the foregoing appear, the", "paragraph_id": "para_106" }, { "text": "denial of a continuance for illness is abuse of discretion.", "paragraph_id": "para_107" }, { "text": "112 Hawaiʻi 374, 385, 146 P.3d 89, 100 (2006) (quoting Gaspar v.", "paragraph_id": "para_108" }, { "text": "Kassm, 493 F.2d 964, 969 (3d Cir. 1974)).", "paragraph_id": "para_109" }, { "text": "The record reflects that toward the end of the day on", "paragraph_id": "para_110" }, { "text": "November 15, 2022, two days before the November 17, 2022", "paragraph_id": "para_111" }, { "text": "hearing, Gilliam filed his motion to continue, declaring that he", "paragraph_id": "para_112" }, { "text": "was on the U.S. mainland and had an unanticipated \"illness and", "paragraph_id": "para_113" }, { "text": "emergency.\" He requested \"a reasonable continuance until after", "paragraph_id": "para_114" }, { "text": "surgery\"; stated that this would \"be without prejudice\" to", "paragraph_id": "para_115" }, { "text": "Elliott; and referenced his \"treating physician statement of", "paragraph_id": "para_116" }, { "text": "unavailability\" that was filed in camera. The November 15, 2022", "paragraph_id": "para_117" }, { "text": "in camera letter stated that Gilliam was treated at a mainland", "paragraph_id": "para_118" }, { "text": "medical center on November 15, 2022; that Gilliam should be", "paragraph_id": "para_119" }, { "text": "\"excused from all necessary duties from 11/14-11/18\"; and that", "paragraph_id": "para_120" }, { "text": "the medical center was \"in the process of scheduling him for", "paragraph_id": "para_121" }, { "text": "surgery.\"", "paragraph_id": "para_122" }, { "text": "At the November 17, 2022 hearing on the motion to", "paragraph_id": "para_123" }, { "text": "dismiss, the Circuit Court noted that Gilliam was not present,", "paragraph_id": "para_124" }, { "text": "arrive in time for the hearing on the November 17, 2022. The source of these", "paragraph_id": "para_125" }, { "text": "assertions regarding Gilliam's return flight to Kauaʻi appears to be Gilliam's", "paragraph_id": "para_126" }, { "text": "declaration appended to the Reply Brief. This declaration is not part of the", "paragraph_id": "para_127" }, { "text": "record. We do not consider this declaration appended to the Reply Brief, or", "paragraph_id": "para_128" }, { "text": "the declarations that Elliott appended to the Answering Brief, as none of", "paragraph_id": "para_129" }, { "text": "them are part of the record below or the record on appeal. See HRAP Rule", "paragraph_id": "para_130" }, { "text": "10(a); Bettencourt v. Bettencourt, 80 Hawaiʻi 225, 229 n.2, 909 P.2d 553,", "paragraph_id": "para_131" }, { "text": "557 n.2 (holding that matters outside the record on appeal may not be", "paragraph_id": "para_132" }, { "text": "appended to an appellate brief).", "paragraph_id": "para_133" }, { "text": "4", "paragraph_id": "para_134" }, { "text": "and that it had received Gilliam's motion to continue the", "paragraph_id": "para_135", "court_paragraph": 4 }, { "text": "hearing, as follows:", "paragraph_id": "para_136" }, { "text": "THE COURT: You know, and the reason for that is he", "paragraph_id": "para_137" }, { "text": "submitted a declaration regarding a continuance. And", "paragraph_id": "para_138" }, { "text": "attached to the declaration, there was an excuse from 11-14", "paragraph_id": "para_139" }, { "text": "to 11-18. And there was a discussion about a possible", "paragraph_id": "para_140" }, { "text": "surgery that could occur. Or scheduling of a surgery. But", "paragraph_id": "para_141" }, { "text": "I thought depending on when the surgery was scheduled,", "paragraph_id": "para_142" }, { "text": "there would be a window for us to actually deal with this", "paragraph_id": "para_143" }, { "text": "matter even if I continued it until next week.", "paragraph_id": "para_144" }, { "text": "But given that Mr. Gilliam may not be present today .", "paragraph_id": "para_145" }, { "text": ". .", "paragraph_id": "para_146" }, { "text": "(Ellipses in original.) The Circuit Court then noted that while", "paragraph_id": "para_147" }, { "text": "Gilliam made the motion to continue, he \"didn't physically", "paragraph_id": "para_148" }, { "text": "appear for the motion[,]\" and \"didn't make arrangements through", "paragraph_id": "para_149" }, { "text": "Zoom\" or \"even by telephone.\" Elliott's counsel responded that", "paragraph_id": "para_150" }, { "text": "when Gilliam called her office \"less than 48 hours ago . . .", "paragraph_id": "para_151" }, { "text": "asking for a continuance[,]\" she told Gilliam that she \"could", "paragraph_id": "para_152" }, { "text": "not\" agree to a continuance, and \"advised him to contact the", "paragraph_id": "para_153" }, { "text": "Court and that maybe he can appear by video-conferenc[e].\" The", "paragraph_id": "para_154" }, { "text": "Circuit Court then ruled: \"So on the motion to continue, he's", "paragraph_id": "para_155" }, { "text": "not here to advocate for his own motion. So the Court's going", "paragraph_id": "para_156" }, { "text": "to deny the motion.\" The Circuit Court then took up the motion", "paragraph_id": "para_157" }, { "text": "to dismiss, and granted it because Gilliam was \"not here on the", "paragraph_id": "para_158" }, { "text": "motion to dismiss[.]\" The Circuit Court later filed its January", "paragraph_id": "para_159" }, { "text": "31, 2023 \"Order Denying with Prejudice [Gilliam]'s Motion to", "paragraph_id": "para_160" }, { "text": "Reschedule Hearing on Motion to Dismiss\" (Order Denying", "paragraph_id": "para_161" }, { "text": "Continuance) and the Dismissal Order.", "paragraph_id": "para_162" }, { "text": "Here, the record as of November 17, 2022 when the", "paragraph_id": "para_163" }, { "text": "motion to continue was heard, reflects that Gilliam had set", "paragraph_id": "para_164" }, { "text": "forth a medical reason and attached a medical note to explain", "paragraph_id": "para_165" }, { "text": "his absence at the hearing. The medical note indicated that", "paragraph_id": "para_166" }, { "text": "Gilliam should be excused from necessary duties from November 14", "paragraph_id": "para_167" }, { "text": "to 18, 2022. This time period included the hearing date. Under", "paragraph_id": "para_168" }, { "text": "these circumstances, we conclude that the Circuit Court acted", "paragraph_id": "para_169" }, { "text": "5", "paragraph_id": "para_170" }, { "text": "outside its discretion by denying the motion to continue based", "paragraph_id": "para_171", "court_paragraph": 5 }, { "text": "on Gilliam's failure to appear. See id. at 378, 146 P.3d at 93", "paragraph_id": "para_172" }, { "text": "(reviewing grant or denial of a continuance for abuse of", "paragraph_id": "para_173" }, { "text": "discretion). Accordingly, we reverse the January 31, 2023 Order", "paragraph_id": "para_174" }, { "text": "Denying Continuance. On remand, the motion to dismiss should be", "paragraph_id": "para_175" }, { "text": "heard on the merits.", "paragraph_id": "para_176" }, { "text": "For the foregoing reasons, we vacate the Circuit Court", "paragraph_id": "para_177" }, { "text": "of the Fifth Circuit's February 9, 2023 Judgment, and", "paragraph_id": "para_178" }, { "text": "January 31, 2023 Dismissal Order.
