        "text": "nearly four decades in the United States Navy, ascending to the",

        "text": "rank of four-star Admiral and serving for a time as the Navy’s",
        "paragraph_id": "para_24"
      },
      {
        "text": "second highest ranking officer. He now faces years in prison.",
        "paragraph_id": "para_25"
      },
      {
        "text": "A jury convicted Burke of bribery and three related crimes",
        "paragraph_id": "para_26"
      },
      {
        "text": "based on evidence that he agreed to steer a Navy contract to a",
        "paragraph_id": "para_27"
      },
      {
        "text": "private company in exchange for a post-retirement job. He",
        "paragraph_id": "para_28"
      },
      {
        "text": "now appeals, raising a host of challenges to the proceedings",
        "paragraph_id": "para_29"
      },
      {
        "text": "below, primarily to the district court’s evidentiary rulings and",
        "paragraph_id": "para_30"
      },
      {
        "text": "the jury instructions. We conclude that the challenged",
        "paragraph_id": "para_31"
      },
      {
        "text": "evidentiary rulings were either appropriate exercises of",
        "paragraph_id": "para_32"
      },
      {
        "text": "discretion or non-prejudicial given the overwhelming, properly",
        "paragraph_id": "para_33"
      },
      {
        "text": "admitted evidence of Burke’s guilt. Burke does identify one",
        "paragraph_id": "para_34"
      },
      {
        "text": "legally erroneous jury instruction, but Burke’s own counsel",
        "paragraph_id": "para_35"
      },
      {
        "text": "proposed the instruction, so we will not remedy the error.",
        "paragraph_id": "para_36"
      },
      {
        "text": "We accordingly affirm Burke’s convictions.",
        "paragraph_id": "para_37"
      },
      {
        "text": "I",
        "paragraph_id": "para_38"
      },
      {
        "text": "A",
        "paragraph_id": "para_39"
      },
      {
        "text": "Next Jump, Inc. is a company that provides leadership",
        "paragraph_id": "para_40"
      },
      {
        "text": "training services. Burke first crossed paths with the company",
        "paragraph_id": "para_41"
      },
      {
        "text": "when the Navy contracted with it to conduct a pilot program",
        "paragraph_id": "para_42"
      },
      {
        "text": "with certain Navy units.1 At the time, Burke was Chief of",
        "paragraph_id": "para_43"
      },
      {
        "text": "Naval Personnel and was involved in overseeing the pilot.",
        "paragraph_id": "para_44"
      },
      {
        "text": "After about a year of testing Next Jump’s tool for giving and",
        "paragraph_id": "para_45"
      },
      {
        "text": "receiving workplace feedback, the Navy concluded that the",
        "paragraph_id": "para_46"
      },
      {
        "text": "product was not well suited to the Navy’s needs and decided",
        "paragraph_id": "para_47"
      },
      {
        "text": "not to extend the partnership. See, e.g., J.A. 111–12, 115.",
        "paragraph_id": "para_48"
      },
      {

        "text": "The Navy notified Next Jump in October 2019 that the pilot",
        "paragraph_id": "para_54"
      },
      {
        "text": "program would end.",
        "paragraph_id": "para_55"
      },
      {
        "text": "In July 2020, Burke was promoted to lead U.S. Naval",
        "paragraph_id": "para_56"
      },
      {
        "text": "Forces Europe and Africa. Soon after, Next Jump’s co-CEOs,",
        "paragraph_id": "para_57"
      },
      {
        "text": "Yongchul “Charlie” Kim and Meghan Messenger, reached out",
        "paragraph_id": "para_58"
      },
      {
        "text": "to Burke directly, touting various product improvements and",
        "paragraph_id": "para_59"
      },
      {
        "text": "angling for another partnership opportunity. S.A. 27. In",
        "paragraph_id": "para_60"
      },
      {
        "text": "April 2021, Kim and Messenger arranged a videoconference",
        "paragraph_id": "para_61"
      },
      {
        "text": "meeting with Burke and some of his staff for a sales",
        "paragraph_id": "para_62"
      },
      {
        "text": "presentation. A few weeks later, without his staff’s",
        "paragraph_id": "para_63"
      },
      {
        "text": "knowledge, Burke held an hour-long private videoconference",
        "paragraph_id": "para_64"
      },
      {
        "text": "with Kim and Messenger on WhatsApp. Shortly after the",
        "paragraph_id": "para_65"
      },
      {
        "text": "meeting, Kim emailed Next Jump colleagues that Burke “wants",
        "paragraph_id": "para_66"
      },
      {
        "text": "to work for us, but we’re asking for a deal first.” S.A. 54. In",
        "paragraph_id": "para_67"
      },
      {
        "text": "early May, Burke forwarded to Juliette Beyler an email in",
        "paragraph_id": "para_68"
      },
      {
        "text": "which he assured Kim and Messenger that Beyler was",
        "paragraph_id": "para_69"
      },
      {
        "text": "“working options and angles hard” to accomplish “our",
        "paragraph_id": "para_70"
      },
      {
        "text": "project”: a contract between Next Jump and Naval Forces",
        "paragraph_id": "para_71"
      },
      {
        "text": "Europe and Africa. J.A. 152. Beyler, the highest-ranking",
        "paragraph_id": "para_72"
      },
      {
        "text": "civilian in Burke’s command and the official responsible for its",
        "paragraph_id": "para_73"
      },
      {
        "text": "budget, had been doing no such thing. In fact, Beyler was",
        "paragraph_id": "para_74"
      },
      {
        "text": "frustrated to learn that Burke was engaging directly with Next",
        "paragraph_id": "para_75"
      },
      {
        "text": "Jump at all. On multiple prior occasions, Beyler had asked",
        "paragraph_id": "para_76"
      },
      {
        "text": "Burke to allow staff to communicate regarding potential",
        "paragraph_id": "para_77"
      },
      {
        "text": "contracts.",
        "paragraph_id": "para_78"
      },
      {
        "text": "In July 2021, Burke brought his then-girlfriend, Denese",
        "paragraph_id": "para_79"
      },
      {
        "text": "Canedo, to a lunch with Kim and Messenger at the Belga Café",
        "paragraph_id": "para_80"
      },
      {
        "text": "in Washington, D.C. There, Kim and Messenger again shared",
        "paragraph_id": "para_81"
      },
      {
        "text": "updates on Next Jump. But they also asked Burke about his",
        "paragraph_id": "para_82"
      },
      {
        "text": "own plans—after nearly forty years in the Navy, the Admiral",
        "paragraph_id": "para_83"
      },
      {
        "text": "would soon retire. At that point, according to emails and text",
        "paragraph_id": "para_84"
      },
      {
        "text": "messages introduced at trial, the conversation turned to the",
        "paragraph_id": "para_85"
      },
      {
        "text": "possibility that Burke might join Next Jump, and a plan",
        "paragraph_id": "para_86"
      },
      {
        "text": "emerged. Burke would use his position to help the company",
        "paragraph_id": "para_87"
      },
      {
        "text": "4",
        "paragraph_id": "para_88"
      },
      {
        "text": "secure a contract with his command. The two entrepreneurs",
        "paragraph_id": "para_89"
      },
      {
        "text": "could then leverage that success and Burke’s endorsement to",
        "paragraph_id": "para_90"
      },
      {
        "text": "secure other, larger contracts with U.S. and allied forces. S.A.",
        "paragraph_id": "para_91"
      },
      {
        "text": "55–57. And when Burke retired, he could join Next Jump as",
        "paragraph_id": "para_92"
      },
      {
        "text": "a full-time employee and a “junior” co-owner. See J.A. 690.",
        "paragraph_id": "para_93"
      },
      {
        "text": "Burke and Canedo exchanged a series of text messages",
        "paragraph_id": "para_94"
      },
      {
        "text": "shortly after the lunch meeting. Burke explained that he had",
        "paragraph_id": "para_95"
      },
      {
        "text": "asked Kim “to write out a job description” because he had",
        "paragraph_id": "para_96"
      },
      {
        "text": "“essentially agreed to work for” Next Jump. J.A. 689.",
        "paragraph_id": "para_97"
      },
      {
        "text": "Canedo asked whether she had heard correctly that the",
        "paragraph_id": "para_98"
      },
      {
        "text": "compensation would be a “500k base salary” and “ten percent",
        "paragraph_id": "para_99"
      },
      {
        "text": "equity in [the] entire biz.” Id. Burke confirmed: “10% in",
        "paragraph_id": "para_100"
      },
      {
        "text": "total co. I would be a junior coowner.” J.A. 690. When",
        "paragraph_id": "para_101"
      },
      {
        "text": "Canedo then asked “[t]o what extent” the job was “tied” to Next",
        "paragraph_id": "para_102"
      },
      {
        "text": "Jump obtaining the initial Navy contract, Burke responded:",
        "paragraph_id": "para_103"
      },
      {
        "text": "“[T]echnically - zero.” J.A. 694–95. Kim similarly reported",
        "paragraph_id": "para_104"
      },
      {
        "text": "to Next Jump colleagues that they had “talked salary, equity, et",
        "paragraph_id": "para_105"
      },
      {
        "text": "cetera.” J.A. 279. Kim also stated that, although Burke",
        "paragraph_id": "para_106"
      },
      {
        "text": "“[w]anted to resign next week,” Kim told him “to hold off”",
        "paragraph_id": "para_107"
      },
      {
        "text": "until Next Jump could obtain the first contract with Burke’s",
        "paragraph_id": "para_108"
      },
      {
        "text": "command. Id.",
        "paragraph_id": "para_109"
      },
      {
        "text": "By the end of the summer, Beyler and her staff had",
        "paragraph_id": "para_110"
      },
      {
        "text": "concluded that Naval Forces Europe and Africa should not",
        "paragraph_id": "para_111"
      },
      {
        "text": "pursue a contract with Next Jump, and she conveyed that",
        "paragraph_id": "para_112"
      },
      {
        "text": "recommendation to Burke. J.A. 172. Burke nevertheless",
        "paragraph_id": "para_113"
      },
      {
        "text": "continued to communicate with Kim and Messenger. In",
        "paragraph_id": "para_114"
      },
      {
        "text": "November, at Kim’s invitation, Burke planned to send four",
        "paragraph_id": "para_115"
      },
      {
        "text": "Navy officers to a Next Jump leadership training in New York.",
        "paragraph_id": "para_116"
      },
      {
        "text": "J.A. 235–36; S.A. 77. Around the same time, Burke visited",
        "paragraph_id": "para_117"
      },
      {
        "text": "Next Jump’s headquarters. After that visit, Kim reported to",
        "paragraph_id": "para_118"
      },
      {
        "text": "colleagues that Burke planned to propose that the Navy",
        "paragraph_id": "para_119"
      },
      {
        "text": "contract with Next Jump. S.A. 77–78.",
        "paragraph_id": "para_120"
      },
      {
        "text": "5",

      },
      {
        "text": "In December 2021, Kim sent Burke a pricing proposal for",
        "paragraph_id": "para_122"
      },
      {
        "text": "the desired contract, a training in Naples, Italy, and Burke",
        "paragraph_id": "para_123"
      },
      {
        "text": "forwarded it to Beyler, stating: “Would like to get this in place",
        "paragraph_id": "para_124"
      },
      {
        "text": "to support kickoff events in early January, if possible.” J.A.",
        "paragraph_id": "para_125"
      },
      {
        "text": "228; see J.A. 359; S.A. 91–94. Beyler interpreted Burke’s",
        "paragraph_id": "para_126"
      },
      {
        "text": "email as an “order” to finalize a contract with Next Jump. J.A.",
        "paragraph_id": "para_127"
      },
      {
        "text": "228. Although meeting that deadline required deviations from",
        "paragraph_id": "para_128"
      },
      {
        "text": "normal due diligence and contracting processes, Beyler and",
        "paragraph_id": "para_129"
      },
      {
        "text": "other staff immediately moved to implement Burke’s order,",
        "paragraph_id": "para_130"
      },
      {
        "text": "thus completing the first step in the plan discussed at the July",
        "paragraph_id": "para_131"
      },
      {
        "text": "2021 Belga Café lunch. S.A. 44–45, 48–50. The training",
        "paragraph_id": "para_132"
      },
      {
        "text": "went forward in January 2022 as scheduled. But when the",
        "paragraph_id": "para_133"
      },
      {
        "text": "Navy collected participants’ feedback after the training ended,",
        "paragraph_id": "para_134"
      },
      {
        "text": "the responses were abysmal. According to one witness who",
        "paragraph_id": "para_135"
      },
      {
        "text": "reviewed the feedback, it was “the worst [she had] ever seen,”",
        "paragraph_id": "para_136"
      },
      {
        "text": "and revealed the contract to be an “embarrassing . . . waste of",
        "paragraph_id": "para_137"
      },
      {
        "text": "money.” J.A. 239–40.",
        "paragraph_id": "para_138"
      },
      {
        "text": "As these events unfolded, Burke continued to prepare for",
        "paragraph_id": "para_139"
      },
      {
        "text": "retirement. In March 2022, he consulted a Navy ethics",
        "paragraph_id": "para_140"
      },
      {
        "text": "counselor about post-government employment and assured the",
        "paragraph_id": "para_141"
      },
      {
        "text": "counselor that “to date I have had no conversations, have no",
        "paragraph_id": "para_142"
      },
      {
        "text": "intent to aim for a specific company, and most likely will not",
        "paragraph_id": "para_143"
      },
      {
        "text": "actively seek employment until after 1 July.” S.A. 113–14,",
        "paragraph_id": "para_144"
      },
      {

        "text": "“anticipated commencing discussions related to employment",
        "paragraph_id": "para_146"
      },
      {
        "text": "with” Next Jump. J.A. 450–51, 705. Just over two weeks",
        "paragraph_id": "para_147"
      },
      {
        "text": "later, on May 24, 2022, Next Jump sent Burke an offer letter",
        "paragraph_id": "para_148"
      },
      {
        "text": "proposing a $500,000 base salary and 100,000 stock options.",
        "paragraph_id": "para_149"
      },
      {
        "text": "J.A. 323–24. Burke accepted the offer two days later. S.A.",
        "paragraph_id": "para_150"
      },
      {
        "text": "125. That same day—nearly a year after the Belga Café",
        "paragraph_id": "para_151"
      },
      {
        "text": "lunch—Burke informed the ethics counselor that he “began",
        "paragraph_id": "para_152"
      },
      {
        "text": "negotiations with Next Jump on 24 May 2022 concerning",
        "paragraph_id": "para_153"
      },
      {
        "text": "future employment.” S.A. 118. He signed a memorandum",
        "paragraph_id": "para_154"
      },
      {
        "text": "attesting that he would not “substantially participate” in",
        "paragraph_id": "para_155"
      },
      {
        "text": "decisions “that would have a direct and predictable effect on",
        "paragraph_id": "para_156"
      },
      {
        "text": "6",
        "paragraph_id": "para_157"
      },
      {
        "text": "the financial interests of Next Jump” during the remainder of",
        "paragraph_id": "para_158"
      },
      {
        "text": "his employment with the Navy. S.A. 118-19; see J.A. 449–51.",
        "paragraph_id": "para_159"
      },
      {
        "text": "B",
        "paragraph_id": "para_160"
      },
      {
        "text": "Burke retired in the summer of 2022, began working at",
        "paragraph_id": "para_161"
      },
      {
        "text": "Next Jump that October, and resigned in January 2023. In",
        "paragraph_id": "para_162"
      },
      {
        "text": "October 2023, investigators from the Department of Defense",
        "paragraph_id": "para_163"
      },
      {
        "text": "Criminal Investigative Service and the Naval Criminal",
        "paragraph_id": "para_164"
      },
      {
        "text": "Investigative Service came to his home in Florida to interview",
        "paragraph_id": "para_165"
      },
      {
        "text": "him. J.A. 462–63. While discussing his dealings with Next",
        "paragraph_id": "para_166"
      },
      {
        "text": "Jump, Burke admitted he had “allow[ed] [him]self to be",
        "paragraph_id": "para_167"
      },
      {
        "text": "influenced in ways that were inappropriate” and “didn’t fully",
        "paragraph_id": "para_168"
      },
      {
        "text": "disclose them to people that needed to be aware of them. It",
        "paragraph_id": "para_169"
      },
      {
        "text": "was wrong.” J.A. 720–21.",
        "paragraph_id": "para_170"
      },
      {
        "text": "In May 2024, Burke was indicted on four counts:",
        "paragraph_id": "para_171"
      },
      {
        "text": "conspiracy to accept a bribe in violation of 18 U.S.C. § 371;",
        "paragraph_id": "para_172"
      },
      {
        "text": "bribery in violation of 18 U.S.C. § 201(b)(2); conflict of",
        "paragraph_id": "para_173"
      },
      {
        "text": "interest in violation of 18 U.S.C. § 208(a); and concealment of",
        "paragraph_id": "para_174"
      },
      {
        "text": "a material fact in violation of 18 U.S.C. § 1001(a)(1). J.A. 1–",
        "paragraph_id": "para_175"
      },
      {
        "text": "16. At trial, the government argued that Burke, Kim and",
        "paragraph_id": "para_176"
      },
      {
        "text": "Messenger had illegally exchanged “a contract for a job,” J.A.",
        "paragraph_id": "para_177"
      },
      {
        "text": "530; see also J.A. 299–301, 79, and that Burke then concealed",
        "paragraph_id": "para_178"
      },
      {
        "text": "the nature and existence of his agreement with Next Jump",
        "paragraph_id": "para_179"
      },
      {
        "text": "because he knew it was wrong, J.A. 85.",
        "paragraph_id": "para_180"
      },
      {
        "text": "A jury found Burke guilty on all four counts. The district",
        "paragraph_id": "para_181"
      },
      {
        "text": "court sentenced him to 60 months of incarceration for the",
        "paragraph_id": "para_182"
      },
      {
        "text": "conspiracy, conflict-of-interest, and concealment convictions,",
        "paragraph_id": "para_183"
      },
      {
        "text": "and 72 months for the bribery conviction, to be served",
        "paragraph_id": "para_184"
      },
      {
        "text": "concurrently.2",
        "paragraph_id": "para_185"
      },
      {
        "text": "2 Kim and Messenger were separately tried for conspiracy and",
        "paragraph_id": "para_186"
      },
      {
        "text": "bribery. J.A. 5, 12–13. Their initial trial ended in a hung jury and",
        "paragraph_id": "para_187"
      },
      {
        "text": "on retrial they were both acquitted. See Burke 28(j) Letter. Our",
        "paragraph_id": "para_188"
      },
      {
        "text": "review of Burke’s convictions is limited to the record before us and,",
        "paragraph_id": "para_189"
      },
      {
        "text": "7",
        "paragraph_id": "para_190"
      },
      {
        "text": "II",
        "paragraph_id": "para_191"
      },
      {
        "text": "In this appeal, Burke argues that the district court (A)",
        "paragraph_id": "para_192"
      },
      {
        "text": "improperly denied his pretrial motion to dismiss; (B) made",
        "paragraph_id": "para_193"
      },
      {
        "text": "various evidentiary errors; (C) delivered improper jury",
        "paragraph_id": "para_194"
      },
      {
        "text": "instructions; and (D) subjected him to a fundamentally unfair",
        "paragraph_id": "para_195"
      },
      {
        "text": "trial due to the cumulative effect of these errors. We disagree",
        "paragraph_id": "para_196"
      },
      {
        "text": "and affirm Burke’s convictions.",
        "paragraph_id": "para_197"
      },
      {
        "text": "A",
        "paragraph_id": "para_198"
      },
      {
        "text": "We start with Burke’s challenge to the district court’s",
        "paragraph_id": "para_199"
      },
      {
        "text": "denial of his pre-trial motion to dismiss. We review such",
        "paragraph_id": "para_200"
      },
      {
        "text": "decisions de novo. See United States v. Yakou, 428 F.3d 241,",
        "paragraph_id": "para_201"
      },
      {
        "text": "246 (D.C. Cir. 2005).",
        "paragraph_id": "para_202"
      },
      {
        "text": "Under 18 U.S.C. § 201(b)(2), a public official commits",
        "paragraph_id": "para_203"
      },
      {
        "text": "bribery if he or she “corruptly” accepts or agrees to accept",
        "paragraph_id": "para_204"
      },
      {
        "text": "“anything of value . . . in return for . . . being influenced in the",
        "paragraph_id": "para_205"
      },
      {
        "text": "performance of any official act.” An “official act,” in turn,",
        "paragraph_id": "para_206"
      },
      {
        "text": "“means any decision or action on any question, matter, cause,",
        "paragraph_id": "para_207"
      },
      {
        "text": "suit, proceeding or controversy, which may at any time be",
        "paragraph_id": "para_208"
      },
      {
        "text": "pending, or which may by law be brought before any public",
        "paragraph_id": "para_209"
      },
      {
        "text": "official, in such official’s official capacity, or in such official’s",
        "paragraph_id": "para_210"
      },
      {
        "text": "place of trust or profit.” Id. § 201(a)(3). The indictment",
        "paragraph_id": "para_211"
      },
      {
        "text": "alleged that Burke’s official act was “ordering a United States",
        "paragraph_id": "para_212"
      },
      {
        "text": "Government contract for [Next Jump]” in exchange for a job",
        "paragraph_id": "para_213"
      },
      {
        "text": "with the company. J.A. 13.",
        "paragraph_id": "para_214"
      },
      {
        "text": "Burke argues that the allegation that he “ordered” a",
        "paragraph_id": "para_215"
      },
      {
        "text": "contract does not describe an official act because he lacked",
        "paragraph_id": "para_216"
      },
      {
        "text": "authority to directly enter into contracts on the Navy’s behalf.",
        "paragraph_id": "para_217"
      },
      {
        "text": "The government does not dispute that Burke lacked that",
        "paragraph_id": "para_218"
      },
      {
        "text": "authority. It argues instead that Burke could nevertheless",
        "paragraph_id": "para_219"
      },
      {
        "text": "as noted, we must view that record “in the light most favorable to the",
        "paragraph_id": "para_220"
      },
      {
        "text": "jury verdict.” Clark, 156 F.4th at 672.",
        "paragraph_id": "para_221"
      },
      {
        "text": "8",
        "paragraph_id": "para_222"
      },
      {
        "text": "satisfy the statute’s definition of an “official act” by ordering a",
        "paragraph_id": "para_223"
      },
      {
        "text": "subordinate to enter such a contract.",
        "paragraph_id": "para_224"
      },
      {
        "text": "The government is correct. The Supreme Court has",
        "paragraph_id": "para_225"
      },
      {
        "text": "explained that a public official can commit an official act under",
        "paragraph_id": "para_226"
      },
      {
        "text": "the bribery statute not only by directly acting on a matter, but",
        "paragraph_id": "para_227"
      },
      {
        "text": "also “by using his official position to exert pressure on another",
        "paragraph_id": "para_228"
      },
      {
        "text": "official to perform an ‘official act.’” McDonnell v. United",
        "paragraph_id": "para_229"
      },
      {
        "text": "States, 579 U.S. 550, 572 (2016) (emphasis omitted). Indeed,",
        "paragraph_id": "para_230"
      },
      {
        "text": "even using one’s “official position to provide advice to another",
        "paragraph_id": "para_231"
      },
      {
        "text": "official . . . can qualify” in certain circumstances. Id. The",
        "paragraph_id": "para_232"
      },
      {
        "text": "indictment’s allegation that a four-star Navy Admiral",
        "paragraph_id": "para_233"
      },
      {
        "text": "“ordered” a subordinate to enter into a contract thus easily",
        "paragraph_id": "para_234"
      },
      {
        "text": "qualifies.",
        "paragraph_id": "para_235"
      },
      {
        "text": "Faced with McDonnell’s clear guidance, Burke retreats to",
        "paragraph_id": "para_236"
      },
      {
        "text": "the assertion that the indictment cannot be read to suggest that",
        "paragraph_id": "para_237"
      },
      {
        "text": "he pressured a subordinate to enter the contract. That is, he",
        "paragraph_id": "para_238"
      },
      {
        "text": "argues that the allegation that he “ordered a contract” can only",
        "paragraph_id": "para_239"
      },
      {
        "text": "have meant that he personally finalized a legally enforceable",
        "paragraph_id": "para_240"
      },
      {
        "text": "contract. We see no basis to inject that narrow interpretation",
        "paragraph_id": "para_241"
      },
      {
        "text": "into the indictment’s plain language, particularly given how the",
        "paragraph_id": "para_242"
      },
      {
        "text": "indictment describes Burke’s alleged actions elsewhere. For",
        "paragraph_id": "para_243"
      },
      {
        "text": "example, in an allegation specifically incorporated into the",
        "paragraph_id": "para_244"
      },
      {
        "text": "bribery count, J.A. 13, the indictment alleges that Burke",
        "paragraph_id": "para_245"
      },
      {
        "text": "“ordered [Beyler] to provide a contract to [Next Jump], to make",
        "paragraph_id": "para_246"
      },
      {
        "text": "sure the contract was in place by January 10, 2022, and for it to",
        "paragraph_id": "para_247"
      },
      {
        "text": "be valued at approximately $350,000,” J.A. 9. Especially with",
        "paragraph_id": "para_248"
      },
      {
        "text": "that context, the allegation later in the indictment that Burke’s",
        "paragraph_id": "para_249"
      },
      {
        "text": "official act was “ordering” a contract readily sufficed “to",
        "paragraph_id": "para_250"
      },
      {
        "text": "inform the defendant of the nature of the accusation against",
        "paragraph_id": "para_251"
      },
      {
        "text": "him.” United States v. Ballestas, 795 F.3d 138, 148–49 (D.C.",
        "paragraph_id": "para_252"
      },
      {
        "text": "Cir. 2015) (quoting United States v. Hitt, 249 F.3d 1010, 1016",
        "paragraph_id": "para_253"
      },
      {
        "text": "(D.C. Cir. 2001)).",
        "paragraph_id": "para_254"
      },
      {

      },
      {
        "text": "B",
        "paragraph_id": "para_256"
      },
      {
        "text": "Next, Burke raises several challenges to the district court’s",
        "paragraph_id": "para_257"
      },
      {
        "text": "evidentiary decisions, which we review for abuse of discretion.",
        "paragraph_id": "para_258"
      },
      {
        "text": "See United States v. Whitmore, 359 F.3d 609, 616 (D.C. Cir.",
        "paragraph_id": "para_259"
      },
      {
        "text": "2004).",
        "paragraph_id": "para_260"
      },
      {
        "text": "1",
        "paragraph_id": "para_261"
      },
      {
        "text": "First, Burke argues that the district court erroneously",
        "paragraph_id": "para_262"
      },
      {
        "text": "excluded excerpts from his October 2023 interview with",
        "paragraph_id": "para_263"
      },
      {
        "text": "investigators that would have been helpful to his case. The",
        "paragraph_id": "para_264"
      },
      {
        "text": "government introduced several excerpts of the interview as",
        "paragraph_id": "para_265"
      },
      {
        "text": "statements of a party opponent under Federal Rule of Evidence",
        "paragraph_id": "para_266"
      },
      {
        "text": "801(d)(2)(A). Burke then moved to admit additional excerpts",
        "paragraph_id": "para_267"
      },
      {
        "text": "under Rule 106, which permits a party to introduce any",
        "paragraph_id": "para_268"
      },
      {
        "text": "“statement . . . that in fairness ought to be considered at the",
        "paragraph_id": "para_269"
      },
      {
        "text": "same time” as other statements introduced by the opposing",
        "paragraph_id": "para_270"
      },
      {
        "text": "party. The district court did not abuse its discretion by",
        "paragraph_id": "para_271"
      },
      {
        "text": "denying Burke’s request.",
        "paragraph_id": "para_272"
      },
      {
        "text": "Rule 106 embodies the “common-law doctrine of",
        "paragraph_id": "para_273"
      },
      {
        "text": "completeness” and can, in certain circumstances, permit the",
        "paragraph_id": "para_274"
      },
      {
        "text": "admission of “otherwise inadmissible evidence.” United",
        "paragraph_id": "para_275"
      },
      {
        "text": "States v. Sutton, 801 F.2d 1346, 1368 & n.17 (D.C. Cir. 1986).",
        "paragraph_id": "para_276"
      },
      {
        "text": "The Rule most often applies when the opposing party has",
        "paragraph_id": "para_277"
      },
      {
        "text": "“already introduced portions” of a statement that “might be",
        "paragraph_id": "para_278"
      },
      {
        "text": "misleading unless properly placed in context” by other portions",
        "paragraph_id": "para_279"
      },
      {
        "text": "of the same statement, document, or conversation. Id. at 1367.",
        "paragraph_id": "para_280"
      },
      {
        "text": "But it is “invoked rarely and for a limited purpose”: to avoid",
        "paragraph_id": "para_281"
      },
      {
        "text": "“distort[ed]” and misleading evidence. Id. at 1369.",
        "paragraph_id": "para_282"
      },
      {
        "text": "The government initially sought to introduce four excerpts",
        "paragraph_id": "para_283"
      },
      {
        "text": "from the interview transcript. In one excerpt, referencing the",
        "paragraph_id": "para_284"
      },
      {
        "text": "Belga Café meeting where Burke and Canedo met with Kim",
        "paragraph_id": "para_285"
      },
      {
        "text": "and Messenger, a Special Agent asked Burke, “what’s the full",
        "paragraph_id": "para_286"
      },
      {
        "text": "story on the July 2021 meeting?” J.A. 735. Burke’s answer",
        "paragraph_id": "para_287"
      },
      {
        "text": "10",
        "paragraph_id": "para_288"
      },
      {
        "text": "spanned six pages, but the government sought to introduce only",
        "paragraph_id": "para_289"
      },
      {
        "text": "a portion of the first two pages. J.A. 468. Burke objected,",
        "paragraph_id": "para_290"
      },
      {
        "text": "arguing that the remaining four pages must be admitted as well",
        "paragraph_id": "para_291"
      },
      {
        "text": "under Rule 106 to fairly present his answer. The district court",
        "paragraph_id": "para_292"
      },
      {
        "text": "agreed. J.A. 130–31. In response to that adverse ruling, the",
        "paragraph_id": "para_293"
      },
      {
        "text": "government pivoted and decided not to introduce this excerpt",
        "paragraph_id": "para_294"
      },
      {
        "text": "at all. It continued, however, to seek admission of the",
        "paragraph_id": "para_295"
      },
      {
        "text": "remaining three excerpts.3",
        "paragraph_id": "para_296"
      },
      {
        "text": "The next relevant excerpt came from significantly earlier",
        "paragraph_id": "para_297"
      },
      {
        "text": "in the interview. There, the interviewer asked Burke, “So",
        "paragraph_id": "para_298"
      },
      {
        "text": "from July of 2021 through May of 2022, was there ever any",
        "paragraph_id": "para_299"
      },
      {
        "text": "discussions about working for Next Jump?” J.A. 716. Burke",
        "paragraph_id": "para_300"
      },
      {
        "text": "answered “No” and then said that Kim made some vague",
        "paragraph_id": "para_301"
      },
      {
        "text": "overtures but “I just tried to squash it as best I could.” Id. At",
        "paragraph_id": "para_302"
      },
      {
        "text": "trial, Burke urged that admitting this excerpt also required",
        "paragraph_id": "para_303"
      },
      {
        "text": "admitting under Rule 106 his entire six-page response to the",
        "paragraph_id": "para_304"
      },
      {
        "text": "later interview question, “what’s the full story on the July 2021",
        "paragraph_id": "para_305"
      },
      {
        "text": "meeting?” J.A. 735. In that answer, Burke acknowledged",
        "paragraph_id": "para_306"
      },
      {
        "text": "that the July 2021 meeting included discussions of employment",
        "paragraph_id": "para_307"
      },
      {
        "text": "at Next Jump but insisted “there was no agreement” between",
        "paragraph_id": "para_308"
      },
      {
        "text": "him and Next Jump at that time. J.A. 735–37.",
        "paragraph_id": "para_309"
      },
      {
        "text": "Burke argues that the later question-and-answer is so",
        "paragraph_id": "para_310"
      },
      {
        "text": "closely related to the earlier exchange that both were required",
        "paragraph_id": "para_311"
      },
      {
        "text": "to avoid misleading the jury. To be sure, the two questions",
        "paragraph_id": "para_312"
      },
      {
        "text": "overlap in subject matter, which makes the Rule 106 question",
        "paragraph_id": "para_313"
      },
      {
        "text": "3 Burke argues in part that the government’s change of course",
        "paragraph_id": "para_314"
      },
      {
        "text": "after the district court’s adverse ruling was itself improper. See",
        "paragraph_id": "para_315"
      },
      {
        "text": "Appellant’s Brief 18–20. He casts the government’s decision not to",
        "paragraph_id": "para_316"
      },
      {
        "text": "introduce this excerpt as a “strategic withdrawal” that violated the",
        "paragraph_id": "para_317"
      },
      {
        "text": "government’s “duty to conduct a fair trial.” Id. at 18–19. The",
        "paragraph_id": "para_318"
      },
      {
        "text": "government’s decision was surely strategic, but Burke offers no",
        "paragraph_id": "para_319"
      },
      {
        "text": "caselaw or principle that suggests it was improper. Nothing forbids",
        "paragraph_id": "para_320"
      },
      {
        "text": "the government—or any party—from changing tack in response to",
        "paragraph_id": "para_321"
      },
      {
        "text": "an unfavorable evidentiary ruling.",
        "paragraph_id": "para_322"
      },
      {
        "text": "11",
        "paragraph_id": "para_323"
      },
      {
        "text": "close. But in the interview transcript, these two questions are",
        "paragraph_id": "para_324"
      },
      {
        "text": "separated by approximately forty-five pages representing many",
        "paragraph_id": "para_325"
      },
      {
        "text": "minutes of discussion on various topics. Compare J.A. 716–",
        "paragraph_id": "para_326"
      },
      {
        "text": "18 (pages 48–50 of the interview transcript), with J.A. 735–741",
        "paragraph_id": "para_327"
      },
      {
        "text": "(pages 94–100). This gap between the two exchanges is not",
        "paragraph_id": "para_328"
      },
      {
        "text": "dispositive, but it is a factor courts appropriately consider when",
        "paragraph_id": "para_329"
      },
      {
        "text": "assessing whether one statement “provide[s] necessary",
        "paragraph_id": "para_330"
      },
      {
        "text": "context” for another. United States v. Martinez, 156 F.4th",
        "paragraph_id": "para_331"
      },
      {
        "text": "1185, 1204 (11th Cir. 2025). As the district court put it,",
        "paragraph_id": "para_332"
      },
      {
        "text": "because Burke’s preferred version of the conversation occurred",
        "paragraph_id": "para_333"
      },
      {
        "text": "“significantly after” the initial question, it did not constitute",
        "paragraph_id": "para_334"
      },
      {
        "text": "necessary context for a fair presentation of the initial answer",
        "paragraph_id": "para_335"
      },
      {
        "text": "but rather Burke’s attempt at “additional explanation . . . after",
        "paragraph_id": "para_336"
      },
      {
        "text": "he’s had additional time to think about it.” J.A. 476.",
        "paragraph_id": "para_337"
      },
      {
        "text": "That rationale accords with decisions from other circuits",
        "paragraph_id": "para_338"
      },
      {
        "text": "finding that district courts are not required to admit exculpatory",
        "paragraph_id": "para_339"
      },
      {
        "text": "statements every time the government has moved to admit an",
        "paragraph_id": "para_340"
      },
      {
        "text": "inculpatory statement from the same interview. As the",
        "paragraph_id": "para_341"
      },
      {
        "text": "Second Circuit put the point, it “is not uncommon for a suspect,",
        "paragraph_id": "para_342"
      },
      {
        "text": "upon interrogation by police, to first claim in a self-serving",
        "paragraph_id": "para_343"
      },
      {
        "text": "manner that he did not commit a crime, only thereafter to",
        "paragraph_id": "para_344"
      },
      {
        "text": "confess that he did,” but Rule 106 “does not require the",
        "paragraph_id": "para_345"
      },
      {
        "text": "admission of [such] self-serving exculpatory statements in all",
        "paragraph_id": "para_346"
      },
      {
        "text": "circumstances.” United States v. Williams, 930 F.3d 44, 61",
        "paragraph_id": "para_347"
      },
      {
        "text": "(2d Cir. 2019); see also Fed. R. Evid. 106 advisory committee’s",
        "paragraph_id": "para_348"
      },
      {
        "text": "note to 2023 amendment (endorsing Williams and the",
        "paragraph_id": "para_349"
      },
      {
        "text": "proposition that “[t]he mere fact that a statement is probative",
        "paragraph_id": "para_350"
      },
      {
        "text": "and contradicts a statement offered by the opponent is not",
        "paragraph_id": "para_351"
      },
      {
        "text": "enough to justify completion under Rule 106”). At least",
        "paragraph_id": "para_352"
      },
      {
        "text": "where, as here, the two arguably contradictory statements are",
        "paragraph_id": "para_353"
      },
      {
        "text": "made in “stand-alone portions” of an interview that are",
        "paragraph_id": "para_354"
      },
      {
        "text": "materially separated in time and answer different questions, a",
        "paragraph_id": "para_355"
      },
      {
        "text": "district court has discretion to admit one and not the other.",
        "paragraph_id": "para_356"
      },
      {
        "text": "Martinez, 156 F.4th at 1204 (affirming district court’s",
        "paragraph_id": "para_357"
      },
      {
        "text": "exclusion of “stand-alone portions” from an interview that",
        "paragraph_id": "para_358"
      },
      {
        "text": "12",
        "paragraph_id": "para_359"
      },
      {
        "text": "arguably contradicted earlier statements introduced by the",
        "paragraph_id": "para_360"
      },
      {
        "text": "government).4",
        "paragraph_id": "para_361"
      },
      {
        "text": "Separately, Burke argues that the district court erred in",
        "paragraph_id": "para_362"
      },
      {
        "text": "refusing to admit another portion of the interview under Rule",
        "paragraph_id": "para_363"
      },
      {
        "text": "106. The district court admitted a government excerpt in",
        "paragraph_id": "para_364"
      },
      {

        "text": "would do certain “things differently.” J.A. 742. Burke said:",
        "paragraph_id": "para_366"
      },
      {
        "text": "“I was allowing myself to be influenced in ways that were",
        "paragraph_id": "para_367"
      },
      {
        "text": "inappropriate. I put myself in positions that allowed them to",
        "paragraph_id": "para_368"
      },
      {
        "text": "influence me, and I didn’t fully disclose them to people that",
        "paragraph_id": "para_369"
      },
      {
        "text": "needed to be aware of them. It was wrong.” Id. at 742–43.",
        "paragraph_id": "para_370"
      },
      {
        "text": "Burke sought to admit his statement, beginning on the next",
        "paragraph_id": "para_371"
      },
      {
        "text": "page of the transcript, in which he said “[c]an I tell you one",
        "paragraph_id": "para_372"
      },
      {
        "text": "other thing that just . . . came to mind,” and proceeded to",
        "paragraph_id": "para_373"
      },
      {
        "text": "explain, in essence, that he was “infuriated” to learn after",
        "paragraph_id": "para_374"
      },
      {
        "text": "joining Next Jump that Kim had told others he had hired Burke",
        "paragraph_id": "para_375"
      },
      {
        "text": "before Burke had actually agreed to take the job. J.A. 744–45.",
        "paragraph_id": "para_376"
      },
      {
        "text": "Excluding that later statement did not “distort[]” the first.",
        "paragraph_id": "para_377"
      },
      {
        "text": "Sutton, 801 F.2d at 1369. As Burke’s interjection—“Can I tell",
        "paragraph_id": "para_378"
      },
      {
        "text": "you one other thing”—suggested, Burke’s attempt to cast doubt",
        "paragraph_id": "para_379"
      },
      {
        "text": "on Kim’s account of the timeline bore little if any relation to",
        "paragraph_id": "para_380"
      },
      {
        "text": "Burke’s admission that he wished he had behaved differently.",
        "paragraph_id": "para_381"
      },
      {
        "text": "As the district court noted, the later statement was not",
        "paragraph_id": "para_382"
      },
      {
        "text": "“qualifying or otherwise explaining his response to, ‘Why",
        "paragraph_id": "para_383"
      },
      {
        "text": "would you do those things differently?’” but rather giving “a",
        "paragraph_id": "para_384"
      },
      {
        "text": "separate explanation” of how Kim’s statements were “wrong.”",
        "paragraph_id": "para_385"
      },
      {
        "text": "4 All that said, Burke is right that the district court could not",
        "paragraph_id": "para_386"
      },
      {
        "text": "exclude evidence proffered under Rule 106 simply because it was",
        "paragraph_id": "para_387"
      },
      {
        "text": "“self-serving.” J.A. 476. No party would bother raising Rule 106",
        "paragraph_id": "para_388"
      },
      {
        "text": "to introduce evidence that did not serve its interests. But although",
        "paragraph_id": "para_389"
      },
      {
        "text": "the district court referred to the evidence as “self-serving,” that",
        "paragraph_id": "para_390"
      },
      {
        "text": "characterization was not, as just explained, the primary basis for its",
        "paragraph_id": "para_391"
      },
      {
        "text": "ruling.",
        "paragraph_id": "para_392"
      },
      {
        "text": "13",
        "paragraph_id": "para_393"
      },
      {
        "text": "J.A. 124. Burke’s briefing does not provide any basis for us",
        "paragraph_id": "para_394"
      },
      {
        "text": "to question that explanation.",
        "paragraph_id": "para_395"
      },
      {
        "text": "2",
        "paragraph_id": "para_396"
      },
      {
        "text": "Next, Burke challenges the district court’s exclusion of an",
        "paragraph_id": "para_397"
      },
      {
        "text": "email he offered to impeach Kim’s credibility. We again",
        "paragraph_id": "para_398"
      },
      {
        "text": "conclude that the district court did not abuse its discretion.",
        "paragraph_id": "para_399"
      },
      {
        "text": "Kim sent the email at issue to Burke on September 9, 2022,",
        "paragraph_id": "para_400"
      },
      {
        "text": "just before Burke started working at Next Jump. The primary",
        "paragraph_id": "para_401"
      },
      {
        "text": "subject of the email was whether Burke could appropriately",
        "paragraph_id": "para_402"
      },
      {
        "text": "participate in certain conversations with Department of",
        "paragraph_id": "para_403"
      },
      {
        "text": "Defense personnel so soon after retiring. See J.A. 754–57.",
        "paragraph_id": "para_404"
      },
      {
        "text": "After Burke expressed hesitation, Kim assured him that “there",
        "paragraph_id": "para_405"
      },
      {
        "text": "is nothing unethical we would ask of you.” J.A. 754. Kim",
        "paragraph_id": "para_406"
      },
      {
        "text": "added that Burke “be[ing] a token or entree into DoD business”",
        "paragraph_id": "para_407"
      },
      {
        "text": "was “[n]ot the driver of our hiring decision.” Id. Instead,",
        "paragraph_id": "para_408"
      },
      {
        "text": "“the majority reason for our interest and our actions to hire”",
        "paragraph_id": "para_409"
      },
      {
        "text": "was that Burke was the “sharpest and most experienced leader",
        "paragraph_id": "para_410"
      },
      {
        "text": "we’ve met in all of DoD.” Id.",
        "paragraph_id": "para_411"
      },
      {
        "text": "Earlier in the trial, the government had introduced several",
        "paragraph_id": "para_412"
      },
      {
        "text": "hearsay statements by Kim suggesting that Next Jump had",
        "paragraph_id": "para_413"
      },
      {
        "text": "hired Burke in exchange for Burke’s efforts to secure a contract",
        "paragraph_id": "para_414"
      },
      {
        "text": "for the company. See, e.g., S.A. 54, 76–79 (discussing April",
        "paragraph_id": "para_415"
      },
      {
        "text": "and November 2021 emails to that effect). Burke sought to",
        "paragraph_id": "para_416"
      },
      {
        "text": "introduce Kim’s September 2022 email under Federal Rule of",
        "paragraph_id": "para_417"
      },
      {
        "text": "Evidence 806. “When a hearsay statement . . . has been",
        "paragraph_id": "para_418"
      },
      {
        "text": "admitted,” Rule 806 allows a party to attack the declarant’s",
        "paragraph_id": "para_419"
      },
      {
        "text": "credibility with “any evidence that would be admissible for",
        "paragraph_id": "para_420"
      },
      {
        "text": "those purposes if the declarant had testified as a witness.”",
        "paragraph_id": "para_421"
      },
      {
        "text": "Fed. R. Evid. 806. That category includes a declarant’s",
        "paragraph_id": "para_422"
      },
      {
        "text": "“inconsistent statement . . . regardless of when it occurred.”",
        "paragraph_id": "para_423"
      },
      {
        "text": "Id. Burke argued that Kim’s September 2022 assertion that",
        "paragraph_id": "para_424"
      },
      {
        "text": "Next Jump hired Burke because of his leadership skills was",
        "paragraph_id": "para_425"
      },
      {
        "text": "inconsistent with Kim’s earlier representations that Burke’s job",
        "paragraph_id": "para_426"
      },
      {
        "text": "14",
        "paragraph_id": "para_427"
      },
      {
        "text": "offer was contingent on his success in securing Next Jump a",
        "paragraph_id": "para_428"
      },
      {
        "text": "Navy contract. The district court disagreed, explaining that",
        "paragraph_id": "para_429"
      },
      {
        "text": "the September 2022 email “is not inconsistent with the other",
        "paragraph_id": "para_430"
      },
      {
        "text": "evidence” and was not from “the relevant timeframe” because",
        "paragraph_id": "para_431"
      },
      {
        "text": "“[t]he bargain ha[d] already been made.” J.A. 414.",
        "paragraph_id": "para_432"
      },
      {
        "text": "The district court did not abuse its discretion. Put",
        "paragraph_id": "para_433"
      },
      {
        "text": "together, Kim’s statements effectively said, “We want to hire",
        "paragraph_id": "para_434"
      },
      {
        "text": "you because you’re a great leader, but we’ll only hire you if",
        "paragraph_id": "para_435"
      },
      {
        "text": "you get us a contract.” That is an entirely coherent—not",
        "paragraph_id": "para_436"
      },
      {
        "text": "contradictory—explanation. Nor does the district court’s",
        "paragraph_id": "para_437"
      },
      {
        "text": "observation that the statement was from a different",
        "paragraph_id": "para_438"
      },
      {
        "text": "“timeframe” suggest that the court erred. True, Rule 806",
        "paragraph_id": "para_439"
      },
      {
        "text": "permits the admission of an inconsistent statement “regardless",
        "paragraph_id": "para_440"
      },
      {
        "text": "of when it occurred.” Fed. R. Evid. 806. But the district",
        "paragraph_id": "para_441"
      },
      {
        "text": "court did not suggest that it viewed the timing of the statements",
        "paragraph_id": "para_442"
      },
      {
        "text": "as a categorical bar. Instead, given the circumstances, the",
        "paragraph_id": "para_443"
      },
      {
        "text": "timing of the statements provided relevant context that further",
        "paragraph_id": "para_444"
      },
      {
        "text": "illustrates why the statements are not inconsistent. Kim’s",
        "paragraph_id": "para_445"
      },
      {
        "text": "earlier statements were made to colleagues explaining the",
        "paragraph_id": "para_446"
      },
      {
        "text": "reasons for hiring Burke; his later statement was made directly",
        "paragraph_id": "para_447"
      },
      {
        "text": "to Burke in an effort to keep Burke on board. The district",
        "paragraph_id": "para_448"
      },
      {
        "text": "court’s determination that the two statements were not",
        "paragraph_id": "para_449"
      },
      {
        "text": "inconsistent fell well within its discretion.",
        "paragraph_id": "para_450"
      },
      {
        "text": "3",
        "paragraph_id": "para_451"
      },
      {
        "text": "Burke’s final evidentiary challenge concerns the",
        "paragraph_id": "para_452"
      },
      {
        "text": "admission of two text messages, one from Messenger to Kim",
        "paragraph_id": "para_453"
      },
      {
        "text": "and the other from Canedo to Burke. Burke argues that the",
        "paragraph_id": "para_454"
      },
      {
        "text": "district court improperly admitted the former under Federal",
        "paragraph_id": "para_455"
      },
      {
        "text": "Rule of Evidence 801(d)(2)(E) as a statement of a",
        "paragraph_id": "para_456"
      },
      {
        "text": "coconspirator and improperly admitted the latter as an adopted",
        "paragraph_id": "para_457"
      },
      {
        "text": "statement under Federal Rule of Evidence 801(d)(2)(B).",
        "paragraph_id": "para_458"
      },
      {
        "text": "Whether these messages were properly admitted presents close",
        "paragraph_id": "para_459"
      },
      {
        "text": "questions. But the improper admission of evidence would be",
        "paragraph_id": "para_460"
      },
      {
        "text": "15",
        "paragraph_id": "para_461"
      },
      {
        "text": "grounds for reversal only if the evidence were sufficiently",
        "paragraph_id": "para_462"
      },
      {
        "text": "prejudicial, and this evidence was not.",
        "paragraph_id": "para_463"
      },
      {
        "text": "The first text is from Messenger to Kim dated October 5,",
        "paragraph_id": "para_464"
      },
      {
        "text": "2022. S.A. 14. In it, Messenger expressed anger at Burke",
        "paragraph_id": "para_465"
      },
      {
        "text": "and frustration that Next Jump still had not secured a",
        "paragraph_id": "para_466"
      },
      {
        "text": "significant Navy contract. She then stated that she had “been",
        "paragraph_id": "para_467"
      },
      {
        "text": "shoving down [her] anger except 1 outburst saying no contract",
        "paragraph_id": "para_468"
      },
      {
        "text": "no job.” Id. The government introduced the text and",
        "paragraph_id": "para_469"
      },
      {
        "text": "referenced the “no contract no job” statement in closing. J.A.",
        "paragraph_id": "para_470"
      },
      {
        "text": "513.",
        "paragraph_id": "para_471"
      },
      {
        "text": "The second text is from Canedo to Burke. The district",
        "paragraph_id": "para_472"
      },
      {
        "text": "court admitted the following July 23, 2021 exchange from",
        "paragraph_id": "para_473"
      },
      {
        "text": "shortly after their Belga Café meeting with Kim and",
        "paragraph_id": "para_474"
      },
      {
        "text": "Messenger:",
        "paragraph_id": "para_475"
      },
      {
        "text": "Canedo (continued): Was it 10 percent equity in entire",
        "paragraph_id": "para_476"
      },
      {
        "text": "biz or just whatever projects you’d work on? It was",
        "paragraph_id": "para_477"
      },
      {
        "text": "hard to hear with 500K base salary ringing in my ears.",
        "paragraph_id": "para_478"
      },
      {
        "text": "LOL.",
        "paragraph_id": "para_479"
      },
      {
        "text": ". . .",
        "paragraph_id": "para_480"
      },
      {
        "text": "Burke: 10 percent in total co. I would be a junior co-",
        "paragraph_id": "para_481"
      },
      {
        "text": "owner, third behind Meghan.",
        "paragraph_id": "para_482"
      },
      {
        "text": "J.A. 285–94; J.A. 689–90. The government used Canedo’s",
        "paragraph_id": "para_483"
      },
      {
        "text": "text to prove the truth of the matter asserted: Kim and",
        "paragraph_id": "para_484"
      },
      {
        "text": "Messenger offered Burke a $500,000 salary that day. See J.A.",
        "paragraph_id": "para_485"
      },
      {
        "text": "517 (“Kim and Messenger sent the Defendant an offer letter",
        "paragraph_id": "para_486"
      },
      {
        "text": "and, sure enough, just as they had discussed back at the Belga",
        "paragraph_id": "para_487"
      },
      {
        "text": "Café in July of 2021, as Canedo confirmed . . . that offer letter",
        "paragraph_id": "para_488"
      },
      {
        "text": "had the $500,000 salary and the stock options.” (emphasis",
        "paragraph_id": "para_489"
      },
      {
        "text": "added)).5",
        "paragraph_id": "para_490"
      },
      {
        "text": "5 Many of Canedo’s other texts were admitted not to prove the",
        "paragraph_id": "para_491"
      },
      {
        "text": "truth of the matters asserted, but rather as necessary context to",
        "paragraph_id": "para_492"
      },
      {

      },
      {
        "text": "Even if the district court abused its discretion in applying",
        "paragraph_id": "para_494"
      },
      {
        "text": "the relevant rules of evidence, we would reverse Burke’s",
        "paragraph_id": "para_495"
      },
      {
        "text": "conviction only if the errors “had a ‘substantial and injurious",
        "paragraph_id": "para_496"
      },
      {
        "text": "effect on the jury’s verdict.’” United States v. McGill, 815",
        "paragraph_id": "para_497"
      },
      {
        "text": "F.3d 846, 880 (D.C. Cir. 2016) (quoting United States v. Clark,",
        "paragraph_id": "para_498"
      },
      {
        "text": "747 F.3d 890, 896 (D.C. Cir. 2014)); see Fed. R. Crim. P. 52(a).",
        "paragraph_id": "para_499"
      },
      {
        "text": "Under that standard, reversal is warranted only if we are left",
        "paragraph_id": "para_500"
      },
      {
        "text": "“in grave doubt as to the harmlessness of an error.” McGill,",
        "paragraph_id": "para_501"
      },
      {
        "text": "815 F.3d at 886 (quoting United States v. Smart, 98 F.3d 1379,",
        "paragraph_id": "para_502"
      },
      {
        "text": "1392 (D.C. Cir. 1996)).",
        "paragraph_id": "para_503"
      },
      {
        "text": "The government used both texts to demonstrate the",
        "paragraph_id": "para_504"
      },
      {
        "text": "presence of an agreement between Burke, Kim, and Messenger",
        "paragraph_id": "para_505"
      },
      {
        "text": "focused on the exchange of a job for a contract. But Burke",
        "paragraph_id": "para_506"
      },
      {
        "text": "himself stated in his text messages to Canedo about the Belga",
        "paragraph_id": "para_507"
      },
      {
        "text": "Café meeting that he “essentially agreed” to accept a job offer",
        "paragraph_id": "para_508"
      },
      {
        "text": "in July 2021, J.A. 689, that had “technically - zero” connection",
        "paragraph_id": "para_509"
      },
      {
        "text": "to him securing Next Jump a contract, J.A. 694–95. It is this",
        "paragraph_id": "para_510"
      },
      {
        "text": "fact—the existence of an agreement to exchange a job for the",
        "paragraph_id": "para_511"
      },
      {
        "text": "Navy contract, not the dollar amounts or Messenger’s snappy",
        "paragraph_id": "para_512"
      },
      {
        "text": "summation 15 months later—that mattered for the charged",
        "paragraph_id": "para_513"
      },
      {
        "text": "crimes. Further, as recounted above, the record also included:",
        "paragraph_id": "para_514"
      },
      {
        "text": "several statements by Kim describing the agreement with",
        "paragraph_id": "para_515"
      },
      {
        "text": "Burke essentially in real-time, J.A. 278–79; S.A. 54–57;",
        "paragraph_id": "para_516"
      },
      {
        "text": "testimony about the unusual way Burke secretly met with Next",
        "paragraph_id": "para_517"
      },
      {
        "text": "Jump and pushed through the contract, S.A. 46–50, 52, 91–93;",
        "paragraph_id": "para_518"
      },
      {
        "text": "and evidence showing Burke misled his ethics counselor about",
        "paragraph_id": "para_519"
      },
      {
        "text": "his contacts with Next Jump before later admitting he acted",
        "paragraph_id": "para_520"
      },
      {
        "text": "inappropriately, S.A. 71–77, 113–14; J.A. 720–21. Given that",
        "paragraph_id": "para_521"
      },
      {
        "text": "record, we have no “grave doubt” about whether the two",
        "paragraph_id": "para_522"
      },
      {
        "text": "messages in question affected the jury’s verdict. McGill, 815",
        "paragraph_id": "para_523"
      },
      {
        "text": "F.3d at 886.",
        "paragraph_id": "para_524"
      },
      {
        "text": "understand Burke’s own messages, which in turn were admissible as",
        "paragraph_id": "para_525"
      },
      {
        "text": "opposing party statements. See Fed. R. Evid. 801(d)(2)(A).",
        "paragraph_id": "para_526"
      },
      {
        "text": "17",
        "paragraph_id": "para_527"
      },
      {
        "text": "C",
        "paragraph_id": "para_528"
      },
      {
        "text": "Burke also challenges the jury instructions in three",
        "paragraph_id": "para_529"
      },
      {
        "text": "respects. But the one error he identifies, though serious, was",
        "paragraph_id": "para_530"
      },
      {
        "text": "invited by defense counsel.",
        "paragraph_id": "para_531"
      },
      {
        "text": "1",
        "paragraph_id": "para_532"
      },
      {
        "text": "Burke first argues that the district court should have given",
        "paragraph_id": "para_533"
      },
      {
        "text": "a so-called “missing witness instruction” for Canedo, which",
        "paragraph_id": "para_534"
      },
      {
        "text": "would have told the jurors they could infer that, if Canedo had",
        "paragraph_id": "para_535"
      },
      {
        "text": "testified, her testimony would have been damaging to the",
        "paragraph_id": "para_536"
      },
      {
        "text": "government. See United States v. Glenn, 64 F.3d 706, 709",
        "paragraph_id": "para_537"
      },
      {
        "text": "(D.C. Cir. 1995). Burke requested the instruction because the",
        "paragraph_id": "para_538"
      },
      {
        "text": "government opted not to call Canedo as a witness even though",
        "paragraph_id": "para_539"
      },
      {
        "text": "it had subpoenaed her and her communications with Burke had",
        "paragraph_id": "para_540"
      },
      {
        "text": "contributed to the government’s case.",
        "paragraph_id": "para_541"
      },
      {
        "text": "A district court may issue a missing witness instruction if",
        "paragraph_id": "para_542"
      },
      {
        "text": "(1) the missing witness was “peculiarly” within the control of",
        "paragraph_id": "para_543"
      },
      {
        "text": "the party who did not produce the witness, and (2) under “all",
        "paragraph_id": "para_544"
      },
      {
        "text": "the circumstances[,] an inference of unfavorable testimony",
        "paragraph_id": "para_545"
      },
      {
        "text": "from an absent witness is a natural and reasonable one.”",
        "paragraph_id": "para_546"
      },
      {
        "text": "Burgess v. United States, 440 F.2d 226, 231, 234 (D.C. Cir.",
        "paragraph_id": "para_547"
      },
      {
        "text": "1970). Whether to provide such an instruction is “within the",
        "paragraph_id": "para_548"
      },
      {
        "text": "discretion of the trial court.” United States v. Tarantino, 846",
        "paragraph_id": "para_549"
      },
      {
        "text": "F.2d 1384, 1404 (D.C. Cir. 1988).",
        "paragraph_id": "para_550"
      },
      {
        "text": "The district court denied Burke’s request based on the first",
        "paragraph_id": "para_551"
      },
      {
        "text": "prong. The court explained that although Canedo had been",
        "paragraph_id": "para_552"
      },
      {
        "text": "“connected” with both the government and Burke at different",
        "paragraph_id": "para_553"
      },
      {
        "text": "times, there had been “a rupture” in both relationships. J.A.",
        "paragraph_id": "para_554"
      },
      {
        "text": "488. Importantly, Burke “could have subpoenaed her, was",
        "paragraph_id": "para_555"
      },
      {
        "text": "well aware of her, and saw her as an important witness, but",
        "paragraph_id": "para_556"
      },
      {
        "text": "chose not to.” Id. The court also explained that it appeared",
        "paragraph_id": "para_557"
      },
      {
        "text": "Canedo’s testimony could have been damaging to both parties.",
        "paragraph_id": "para_558"
      },
      {
        "text": "J.A. 489. At bottom, the court concluded that Canedo “was",
        "paragraph_id": "para_559"
      },
      {
        "text": "18",
        "paragraph_id": "para_560"
      },
      {
        "text": "available to both parties,” both had “strategic reasons not to call",
        "paragraph_id": "para_561"
      },
      {
        "text": "her,” and a missing witness instruction was therefore",
        "paragraph_id": "para_562"
      },
      {
        "text": "inappropriate. J.A. 489–90.",
        "paragraph_id": "para_563"
      },
      {
        "text": "That determination was sound. A missing witness",
        "paragraph_id": "para_564"
      },
      {
        "text": "instruction is “generally permissible only when it is within the",
        "paragraph_id": "para_565"
      },
      {
        "text": "government’s exclusive power to call the witness to testify.”",
        "paragraph_id": "para_566"
      },
      {
        "text": "Tarantino, 846 F.2d at 1404. So the fact that a defendant “had",
        "paragraph_id": "para_567"
      },
      {
        "text": "every opportunity to call” the witness who was not “in fact",
        "paragraph_id": "para_568"
      },
      {
        "text": "unavailable to the defense” counsels against giving such an",
        "paragraph_id": "para_569"
      },
      {
        "text": "instruction. Id.; see also United States v. Lawson, 494 F.3d",
        "paragraph_id": "para_570"
      },
      {
        "text": "1046, 1053 (D.C. Cir. 2007) (explaining that a missing witness",
        "paragraph_id": "para_571"
      },
      {
        "text": "instruction was properly denied when the defendant “could just",
        "paragraph_id": "para_572"
      },
      {
        "text": "as easily have called” the witness).",
        "paragraph_id": "para_573"
      },
      {
        "text": "On appeal, Burke offers nothing to call into question the",
        "paragraph_id": "para_574"
      },
      {
        "text": "district court’s factual determination that he could readily have",
        "paragraph_id": "para_575"
      },
      {
        "text": "secured Canedo’s attendance at trial. Instead, Burke",
        "paragraph_id": "para_576"
      },
      {
        "text": "emphasizes the various ways in which Canedo assisted the",
        "paragraph_id": "para_577"
      },
      {
        "text": "government. For example, Canedo filed a complaint against",
        "paragraph_id": "para_578"
      },
      {
        "text": "Burke with the Department of Defense, J.A. 370; the",
        "paragraph_id": "para_579"
      },
      {
        "text": "government interviewed her multiple times during the",
        "paragraph_id": "para_580"
      },
      {
        "text": "investigation, J.A. 381–82; she voluntarily provided critical",
        "paragraph_id": "para_581"
      },
      {
        "text": "evidence by turning over her cell phone, J.A. 380, 587, 674,",
        "paragraph_id": "para_582"
      },
      {
        "text": "686; and she was subpoenaed by the government and listed as",
        "paragraph_id": "para_583"
      },
      {
        "text": "its witness, J.A. 488–89. But we have held that “no automatic",
        "paragraph_id": "para_584"
      },
      {

      },
      {
        "text": "granted immunity from prosecution. Tarantino, 846 F.2d at",
        "paragraph_id": "para_587"
      },
      {
        "text": "1404. Burke shows no error, much less an abuse of discretion,",
        "paragraph_id": "para_588"
      },
      {
        "text": "in the district court’s determination that there was no",
        "paragraph_id": "para_589"
      },
      {
        "text": "meaningful obstacle to his calling Canedo to the stand if he had",
        "paragraph_id": "para_590"
      },
      {
        "text": "wished. The court thus reasonably concluded that it was",
        "paragraph_id": "para_591"
      },
      {
        "text": "“most appropriate” to say nothing at all to the jury regarding",
        "paragraph_id": "para_592"
      },
      {
        "text": "“why Ms. Canedo is not here.” J.A. 486–87; see 2A Wright &",
        "paragraph_id": "para_593"
      },
      {
        "text": "Miller’s Federal Practice and Procedure § 489 (4th ed. 2009)",
        "paragraph_id": "para_594"
      },
      {
        "text": "19",
        "paragraph_id": "para_595"
      },
      {
        "text": "(noting that “[w]here an absent witness is readily available to",
        "paragraph_id": "para_596"
      },
      {
        "text": "both sides” a reasonable approach is “for the court to say",
        "paragraph_id": "para_597"
      },
      {
        "text": "nothing whatsoever on the subject”).",
        "paragraph_id": "para_598"
      },
      {
        "text": "2",
        "paragraph_id": "para_599"
      },
      {
        "text": "Second, Burke argues that the instructions may have",
        "paragraph_id": "para_600"
      },
      {
        "text": "confused the jury by listing certain actions as “overt acts” for",
        "paragraph_id": "para_601"
      },
      {
        "text": "the conspiracy charge that would not qualify as “official acts”",
        "paragraph_id": "para_602"
      },
      {
        "text": "for purposes of the bribery charge. We review this challenge",
        "paragraph_id": "para_603"
      },
      {
        "text": "to the “choice of language to be used in a particular instruction”",
        "paragraph_id": "para_604"
      },
      {
        "text": "for abuse of discretion. United States v. Vega, 826 F.3d 514,",
        "paragraph_id": "para_605"
      },
      {
        "text": "524 (D.C. Cir. 2016) (quoting Joy v. Bell Helicopter Textron,",
        "paragraph_id": "para_606"
      },
      {
        "text": "Inc., 999 F.2d 549, 556 (D.C. Cir. 1993)).",
        "paragraph_id": "para_607"
      },
      {
        "text": "The conspiracy count required the jury to find that at least",
        "paragraph_id": "para_608"
      },
      {
        "text": "one member of the conspiracy committed an “overt act” in",
        "paragraph_id": "para_609"
      },
      {
        "text": "furtherance of that conspiracy. The jury instructions listed the",
        "paragraph_id": "para_610"
      },
      {
        "text": "“overt acts” the government alleged and explained that the",
        "paragraph_id": "para_611"
      },
      {
        "text": "jurors “must all agree on at least one . . . that was done.” Jury",
        "paragraph_id": "para_612"
      },
      {
        "text": "Instructions 26–32, Dkt. No. 160 (Jury Instructions). Burke",
        "paragraph_id": "para_613"
      },
      {
        "text": "does not argue that any of the listed overt acts is not properly",
        "paragraph_id": "para_614"
      },
      {
        "text": "regarded as an overt act for purposes of the conspiracy charge.",
        "paragraph_id": "para_615"
      },
      {
        "text": "Nor could he—as a legal matter, any act can constitute an",
        "paragraph_id": "para_616"
      },
      {
        "text": "“overt act” so long as it is “in furtherance of the conspiracy.”",
        "paragraph_id": "para_617"
      },
      {
        "text": "United States v. Hitt, 249 F.3d 1010, 1015 (D.C. Cir. 2001);",
        "paragraph_id": "para_618"
      },
      {
        "text": "see 18 U.S.C. § 371 (imposing criminal liability when “two or",
        "paragraph_id": "para_619"
      },
      {
        "text": "more persons conspire . . . to commit any offense against the",
        "paragraph_id": "para_620"
      },
      {
        "text": "United States” and “one or more of such persons do any act to",
        "paragraph_id": "para_621"
      },
      {
        "text": "effect the object of the conspiracy”).",
        "paragraph_id": "para_622"
      },
      {
        "text": "Burke’s concern is instead that some of the identified",
        "paragraph_id": "para_623"
      },
      {
        "text": "“overt acts” would not also qualify as “official acts” under 18",
        "paragraph_id": "para_624"
      },
      {
        "text": "U.S.C. § 201(a)(3)’s definition for bribery. For instance, the",
        "paragraph_id": "para_625"
      },
      {
        "text": "instruction would permit the jury to find the “overt act” element",
        "paragraph_id": "para_626"
      },
      {
        "text": "of the conspiracy charge satisfied if it found Burke had",
        "paragraph_id": "para_627"
      },
      {
        "text": "“promoted Next Jump to senior Navy officers,” Jury",
        "paragraph_id": "para_628"
      },
      {
        "text": "20",
        "paragraph_id": "para_629"
      },
      {
        "text": "Instructions 29, even though merely “talking to another",
        "paragraph_id": "para_630"
      },
      {
        "text": "official” would not typically meet the “official act” element of",
        "paragraph_id": "para_631"
      },
      {
        "text": "bribery, McDonnell, 579 U.S. at 574. Burke asserts that the",
        "paragraph_id": "para_632"
      },
      {
        "text": "jury may have been confused and believed that it could convict",
        "paragraph_id": "para_633"
      },
      {
        "text": "Burke of conspiracy to commit bribery merely by finding that",
        "paragraph_id": "para_634"
      },
      {
        "text": "he and Kim or Messenger made an agreement regarding an",
        "paragraph_id": "para_635"
      },
      {
        "text": "overt act, not an official act. But he provides no concrete basis",
        "paragraph_id": "para_636"
      },
      {
        "text": "for that concern, and we cannot perceive one.",
        "paragraph_id": "para_637"
      },
      {
        "text": "The instructions separately defined “overt” and “official”",
        "paragraph_id": "para_638"
      },
      {
        "text": "acts. See Jury Instructions 26–32 (overt act); id. at 35–36",
        "paragraph_id": "para_639"
      },
      {
        "text": "(official act). They specified that an “official act” is an",
        "paragraph_id": "para_640"
      },
      {
        "text": "element of the crime of bribery and that the only official act",
        "paragraph_id": "para_641"
      },
      {
        "text": "alleged here relates to “Next Jump’s January 2022 contract",
        "paragraph_id": "para_642"
      },
      {
        "text": "with the United States Government.” Id. at 35. The",
        "paragraph_id": "para_643"
      },
      {
        "text": "instructions were similarly clear that the conspiracy charge",
        "paragraph_id": "para_644"
      },
      {
        "text": "required an agreement “to commit the crime of bribery.” Id.",
        "paragraph_id": "para_645"
      },
      {
        "text": "at 25. “A jury is presumed to follow its instructions” and we",
        "paragraph_id": "para_646"
      },
      {
        "text": "have no cause for concern that the jury did not do so here.",
        "paragraph_id": "para_647"
      },
      {
        "text": "Weeks v. Angelone, 528 U.S. 225, 234 (2000).",
        "paragraph_id": "para_648"
      },
      {
        "text": "3",
        "paragraph_id": "para_649"
      },
      {
        "text": "Burke’s last challenge to the jury instructions raises a more",
        "paragraph_id": "para_650"
      },
      {
        "text": "significant concern. On appeal he has identified a potentially",
        "paragraph_id": "para_651"
      },
      {
        "text": "prejudicial error in the instruction describing the mens rea",
        "paragraph_id": "para_652"
      },
      {
        "text": "requirement for bribery. We will not remedy the error,",
        "paragraph_id": "para_653"
      },
      {
        "text": "however, because the defense invited it.",
        "paragraph_id": "para_654"
      },
      {
        "text": "Section 201(b)(2) prohibits public officials from",
        "paragraph_id": "para_655"
      },
      {
        "text": "“corruptly” accepting or agreeing to accept “anything of value”",
        "paragraph_id": "para_656"
      },
      {
        "text": "“in return for . . . being influenced in the performance of any",
        "paragraph_id": "para_657"
      },
      {
        "text": "official act.” 18 U.S.C. § 201(b)(2). The Supreme Court and",
        "paragraph_id": "para_658"
      },
      {
        "text": "this court have squarely held that “corruptly” in this statute",
        "paragraph_id": "para_659"
      },
      {
        "text": "requires that the public official “accept (or agree to accept) the",
        "paragraph_id": "para_660"
      },
      {
        "text": "payment intending to be influenced in the official act.” United",
        "paragraph_id": "para_661"
      },
      {
        "text": "States v. Paitsel, 147 F.4th 1010, 1016–17 (D.C. Cir. 2025)",
        "paragraph_id": "para_662"
      },
      {
        "text": "21",
        "paragraph_id": "para_663"
      },
      {
        "text": "(quoting Snyder v. United States, 603 U.S. 1, 11 (2024)), cert.",
        "paragraph_id": "para_664"
      },
      {
        "text": "denied, 146 S. Ct. 998 (2025); see also United States v. Sun-",
        "paragraph_id": "para_665"
      },
      {
        "text": "Diamond Growers of Cal., 526 U.S. 398, 404–05 (1999).",
        "paragraph_id": "para_666"
      },
      {
        "text": "That is, “corruptly” requires “intent to be influenced.”",
        "paragraph_id": "para_667"
      },
      {
        "text": "Snyder, 603 U.S. at 11–12. The distinction between an",
        "paragraph_id": "para_668"
      },
      {
        "text": "official’s intent to be influenced and less culpable states of",
        "paragraph_id": "para_669"
      },
      {
        "text": "mind—such as merely knowing or understanding that another",
        "paragraph_id": "para_670"
      },
      {
        "text": "hopes the official will be influenced—is crucial. If the latter",
        "paragraph_id": "para_671"
      },
      {
        "text": "sufficed, bribery could arise in all sorts of circumstances. For",
        "paragraph_id": "para_672"
      },
      {
        "text": "example, a legislator who votes in favor of a bill could be found",
        "paragraph_id": "para_673"
      },
      {
        "text": "guilty of bribery if she knew a distant relative had given her a",
        "paragraph_id": "para_674"
      },
      {
        "text": "birthday gift in hopes of influencing her vote, even if the",
        "paragraph_id": "para_675"
      },
      {
        "text": "legislator’s vote was guided purely by an honest assessment of",
        "paragraph_id": "para_676"
      },
      {
        "text": "the bill’s merits. The Supreme Court has therefore noted that",
        "paragraph_id": "para_677"
      },
      {
        "text": "intent to be influenced is one of the key distinctions between",
        "paragraph_id": "para_678"
      },
      {
        "text": "bribery and lesser crimes. See Snyder, 603 U.S. at 12; Sun-",
        "paragraph_id": "para_679"
      },
      {
        "text": "Diamond Growers of Cal., 526 U.S. at 404–05.",
        "paragraph_id": "para_680"
      },
      {
        "text": "The jury instructions in this case repeatedly (and correctly)",
        "paragraph_id": "para_681"
      },
      {
        "text": "stated that bribery requires specific intent. See Jury",
        "paragraph_id": "para_682"
      },
      {
        "text": "Instructions 34 (“the Government must prove . . . [that] [t]he",
        "paragraph_id": "para_683"
      },
      {
        "text": "Defendant acted corruptly, that is, he intended that, in exchange",
        "paragraph_id": "para_684"
      },
      {
        "text": "for the thing of value, he would be influenced in the",
        "paragraph_id": "para_685"
      },
      {
        "text": "performance of an official act.”); id. at 35 (“The Government",
        "paragraph_id": "para_686"
      },
      {
        "text": "must prove beyond a reasonable doubt that the Defendant",
        "paragraph_id": "para_687"
      },
      {
        "text": "intended to be influenced in the performance of a specific",
        "paragraph_id": "para_688"
      },
      {
        "text": "official act or acts”); id. at 36 (“The Defendant’s intent to",
        "paragraph_id": "para_689"
      },
      {
        "text": "engage in the exchange of a bribe for an official act need not",
        "paragraph_id": "para_690"
      },
      {
        "text": "be explicit.”).",
        "paragraph_id": "para_691"
      },
      {
        "text": "But then, in the most important place, they deviated. The",
        "paragraph_id": "para_692"
      },
      {
        "text": "specific instruction defining the term “corruptly” for purposes",
        "paragraph_id": "para_693"
      },
      {
        "text": "of “these instructions” stated, in relevant part: “A public",
        "paragraph_id": "para_694"
      },
      {
        "text": "official acts corruptly if the public official … agrees to accept",
        "paragraph_id": "para_695"
      },
      {
        "text": "something of value with the understanding, at least in part, that,",
        "paragraph_id": "para_696"
      },
      {
        "text": "in exchange, the public official is expected to be influenced in",
        "paragraph_id": "para_697"
      },
      {
        "text": "22",
        "paragraph_id": "para_698"
      },
      {
        "text": "the performance of an official act.” Id. at 34 (emphasis",
        "paragraph_id": "para_699"
      },
      {
        "text": "added). As the discussion above shows, that instruction",
        "paragraph_id": "para_700"
      },
      {
        "text": "misstated the law. A public official’s mere knowledge that",
        "paragraph_id": "para_701"
      },
      {
        "text": "another person expects him to be influenced is insufficient; the",
        "paragraph_id": "para_702"
      },
      {
        "text": "public official himself must intend to be influenced.6",
        "paragraph_id": "para_703"
      },
      {
        "text": "We are also skeptical that the other portions of the jury",
        "paragraph_id": "para_704"
      },
      {
        "text": "instructions referring to “intent” could have cured this problem.",
        "paragraph_id": "para_705"
      },
      {
        "text": "The erroneous description appears in the one portion of the",
        "paragraph_id": "para_706"
      },
      {
        "text": "instructions purporting to define the “corruptly” mental state;",
        "paragraph_id": "para_707"
      },
      {
        "text": "the accurate “intent” language appears in portions that describe",
        "paragraph_id": "para_708"
      },
      {
        "text": "bribery more generally.",
        "paragraph_id": "para_709"
      },
      {
        "text": "The obstacle for Burke is that his own lawyers invited this",
        "paragraph_id": "para_710"
      },
      {
        "text": "error. The problematic definition of “corruptly” was jointly",
        "paragraph_id": "para_711"
      },
      {
        "text": "proposed by both parties. See Dkt. 102–1 at 13. “A party",
        "paragraph_id": "para_712"
      },
      {
        "text": "who challenges a jury instruction on appeal after having",
        "paragraph_id": "para_713"
      },
      {
        "text": "proposed the instruction’s language commits ‘a textbook case",
        "paragraph_id": "para_714"
      },
      {
        "text": "of invited error.’” United States v. Benton, 98 F.4th 1119,",
        "paragraph_id": "para_715"
      },
      {
        "text": "1130 (D.C. Cir. 2024) (quoting United States v. Maradiaga,",
        "paragraph_id": "para_716"
      },
      {
        "text": "987 F.3d 1315, 1322 (11th Cir. 2021)). That fact “precludes",
        "paragraph_id": "para_717"
      },
      {

        "paragraph_id": "para_722"
      },
      {
        "text": "McDonnell opinion addressed the kinds of facts that could support",
        "paragraph_id": "para_723"
      },
      {
        "text": "an inference that there was an “agreement” to perform an official act,",
        "paragraph_id": "para_724"
      },
      {
        "text": "not the test for establishing a corrupt state of mind. McDonnell, 579",
        "paragraph_id": "para_725"
      },
      {
        "text": "U.S. at 572 (“A jury could, for example, conclude that an agreement",
        "paragraph_id": "para_726"
      },
      {
        "text": "was reached if the evidence shows that the public official received a",
        "paragraph_id": "para_727"
      },
      {
        "text": "thing of value knowing that it was given with the expectation that the",
        "paragraph_id": "para_728"
      },
      {
        "text": "official would perform an ‘official act’ in return.”). McDonnell",
        "paragraph_id": "para_729"
      },
      {
        "text": "does not purport to replace bribery’s longstanding intent requirement",
        "paragraph_id": "para_730"
      },
      {
        "text": "with a lower knowledge-like mens rea.",
        "paragraph_id": "para_731"
      },
      {
        "text": "23",
        "paragraph_id": "para_732"
      },
      {
        "text": "an appellate court from reviewing [the claimed error] on",
        "paragraph_id": "para_733"
      },
      {
        "text": "appeal.” Id.",
        "paragraph_id": "para_734"
      },
      {
        "text": "It is true that Burke later proposed an addition to the joint",
        "paragraph_id": "para_735"
      },
      {
        "text": "instruction that incorrectly defined the term “corruptly.”",
        "paragraph_id": "para_736"
      },
      {
        "text": "Specifically, he asked the court to add the following sentence",
        "paragraph_id": "para_737"
      },
      {
        "text": "to the definition: “The prosecution must prove beyond a",
        "paragraph_id": "para_738"
      },
      {
        "text": "reasonable doubt that the defendant had a specific intent to",
        "paragraph_id": "para_739"
      },
      {
        "text": "engage in a quid pro quo arrangement where the benefit",
        "paragraph_id": "para_740"
      },
      {
        "text": "received was intended to influence an official act.” J.A. 423.",
        "paragraph_id": "para_741"
      },
      {
        "text": "At best, adding this language would have compounded jurors’",
        "paragraph_id": "para_742"
      },
      {
        "text": "confusion by inserting into the “corruptly” definition the",
        "paragraph_id": "para_743"
      },
      {
        "text": "“intent” language already included elsewhere in the",
        "paragraph_id": "para_744"
      },
      {
        "text": "instructions. But Burke’s proposal would not have removed",
        "paragraph_id": "para_745"
      },
      {
        "text": "the erroneous language he now identifies on appeal. Burke",
        "paragraph_id": "para_746"
      },
      {
        "text": "never alerted the district court that the jointly proposed",
        "paragraph_id": "para_747"
      },
      {
        "text": "language incorrectly stated that “understanding” another’s",
        "paragraph_id": "para_748"
      },
      {
        "text": "“expectations” could satisfy the statute’s mens rea requirement.",
        "paragraph_id": "para_749"
      },
      {
        "text": "That misstatement is the core of the error, and it was invited by",
        "paragraph_id": "para_750"
      },
      {
        "text": "the defense.",
        "paragraph_id": "para_751"
      },
      {
        "text": "D",
        "paragraph_id": "para_752"
      },
      {
        "text": "In a last-ditch effort, Burke asks us to conclude that, even",
        "paragraph_id": "para_753"
      },
      {
        "text": "if no single error warrants reversal, “the total effect of",
        "paragraph_id": "para_754"
      },
      {
        "text": "numerous small missteps” has “deprive[d] [him] of a fair trial.”",
        "paragraph_id": "para_755"
      },
      {
        "text": "McGill, 815 F.3d at 947 (quoting United States v. Celis, 608",
        "paragraph_id": "para_756"
      },
      {
        "text": "F.3d 818, 847 (D.C. Cir. 2010)). Although vacating a",
        "paragraph_id": "para_757"
      },
      {
        "text": "conviction can be warranted in such circumstances, id., they",
        "paragraph_id": "para_758"
      },
      {
        "text": "are not present here.",
        "paragraph_id": "para_759"
      },
      {
        "text": "Most of the issues Burke raises do not amount to “errors”",
        "paragraph_id": "para_760"
      },
      {
        "text": "at all. See United States v. Rivera, 900 F.2d 1462, 1470–71",
        "paragraph_id": "para_761"
      },
      {
        "text": "(10th Cir. 1990) (en banc) (“[A] cumulative-error analysis",
        "paragraph_id": "para_762"
      },
      {
        "text": "aggregates only actual errors to determine their cumulative",
        "paragraph_id": "para_763"
      },
      {
        "text": "effect . . . not the cumulative effect of non-errors.”). Nor can",
        "paragraph_id": "para_764"
      },
      {
        "text": "we credit the various concerns Burke acknowledges in passing",
        "paragraph_id": "para_765"
      },
      {
        "text": "24",
        "paragraph_id": "para_766"
      },
      {
        "text": "but never develops. See, e.g., Appellant’s Brief 26, 36",
        "paragraph_id": "para_767"
      },
      {
        "text": "(gesturing at Confrontation Clause issues but applying no case",
        "paragraph_id": "para_768"
      },
      {
        "text": "law or legal test); id. at 53–56 (mentioning in a few sentences",
        "paragraph_id": "para_769"
      },
      {
        "text": "that Burke may have been entitled to a Franks hearing based",
        "paragraph_id": "para_770"
      },
      {
        "text": "on the government’s failure to disclose the past misconduct of",
        "paragraph_id": "para_771"
      },
      {
        "text": "a special agent who participated in the investigation of Burke).",
        "paragraph_id": "para_772"
      },
      {
        "text": "“A party forfeits an argument by mentioning it only in the most",
        "paragraph_id": "para_773"
      },
      {
        "text": "skeletal way, leaving the court to do counsel’s work . . . .”",
        "paragraph_id": "para_774"
      },
      {
        "text": "Gov’t of Manitoba v. Bernhardt, 923 F.3d 173, 179 (D.C. Cir.",
        "paragraph_id": "para_775"
      },
      {
        "text": "2019) (cleaned up). Burke has identified only two potential",
        "paragraph_id": "para_776"
      },
      {
        "text": "errors that are cognizable on appeal—the potentially erroneous",
        "paragraph_id": "para_777"
      },
      {
        "text": "introduction of Messenger’s and Canedo’s texts. But these",
        "paragraph_id": "para_778"
      },
      {
        "text": "errors, as explained, did not have a “substantial and injurious",
        "paragraph_id": "para_779"
      },
      {
        "text": "effect on the jury’s verdict.” McGill, 815 F.3d at 880 (quoting",
        "paragraph_id": "para_780"
      },
      {
        "text": "Clark, 747 F.3d at 896). So this argument too must fail.",
        "paragraph_id": "para_781"
      },
      {
        "text": "III",
        "paragraph_id": "para_782"
      },
      {
        "text": "For these reasons, we affirm Burke’s convictions.",
        "paragraph_id": "para_783"
      },
      {
        "text": "So ordered.",
