        "text": "regulations are not reasonable because an individual’s right to",

        "text": "demonstrate outside the Capitol cannot turn on the discretion",
        "paragraph_id": "para_37"
      },
      {
        "text": "of a member of Congress. The universal injunction, however,",
        "paragraph_id": "para_38"
      },
      {
        "text": "exceeded the district court’s equitable authority. We therefore",
        "paragraph_id": "para_39"
      },
      {
        "text": "affirm the grant of summary judgment for Mahoney on his First",
        "paragraph_id": "para_40"
      },
      {
        "text": "Amendment claim but vacate the injunction and remand for the",
        "paragraph_id": "para_41"
      },

        "text": "district court to determine the appropriate scope of relief.",

        "text": "A.",

        "text": "Access to the Capitol Complex and the Capitol Grounds,",
        "paragraph_id": "para_45"
      },
      {
        "text": "the park-like area surrounding the Capitol, is governed by",
        "paragraph_id": "para_46"
      },
      {
        "text": "regulations promulgated by the Capitol Police Board. See",
        "paragraph_id": "para_47"
      },
      {
        "text": "Capitol Police Board, Traffic Regulations for the United States",
        "paragraph_id": "para_48"
      },
      {
        "text": "Capitol Grounds (Feb. 14, 2025) (“Traffic Regulations”). The",
        "paragraph_id": "para_49"
      },
      {
        "text": "public may freely access the Capitol Grounds for recreational",
        "paragraph_id": "para_50"
      },
      {
        "text": "activities such as sightseeing, exercising, and dog walking.",
        "paragraph_id": "para_51"
      },
      {

        "paragraph_id": "para_52"
      },
      {
        "text": "Areas for “demonstration activity,” however, are more limited.",
        "paragraph_id": "para_53"
      },
      {
        "text": "Demonstration activity is defined as “any protest, rally, march,",
        "paragraph_id": "para_54"
      },
      {
        "text": "vigil, gathering, assembly, projecting of images or similar",
        "paragraph_id": "para_55"
      },
      {
        "text": "conduct engaged in for the purpose of expressing political,",
        "paragraph_id": "para_56"
      },
      {
        "text": "social, religious or other similar ideas, views or concerns",
        "paragraph_id": "para_57"
      },
      {
        "text": "protected by the First Amendment of the United States",
        "paragraph_id": "para_58"
      },
      {
        "text": "Constitution.” Id. § 12.1.10. Violations of the Traffic",
        "paragraph_id": "para_59"
      },
      {
        "text": "Regulations are punishable by criminal penalties, including",
        "paragraph_id": "para_60"
      },
      {
        "text": "imprisonment. See 2 U.S.C. § 1969(a); Traffic Regulations",
        "paragraph_id": "para_61"
      },
      {
        "text": "§ 1.6.10.",
        "paragraph_id": "para_62"
      },
      {
        "text": "The map below shows where demonstration activity is",
        "paragraph_id": "para_63"
      },
      {
        "text": "permitted throughout the Capitol Complex and Grounds. See",

      },
      {
        "text": "Traffic Regulations § 12.2.10 (referencing the map).",
        "paragraph_id": "para_65"
      },

        "text": "Id. Appendix G. Demonstration activity is generally permitted",
        "paragraph_id": "para_66"
      },

        "text": "in the green areas and permitted in the yellow areas so long as",
        "paragraph_id": "para_67"
      },
      {
        "text": "demonstrators do not obstruct the flow of pedestrian traffic. In",
        "paragraph_id": "para_68"
      },
      {
        "text": "the red areas, however, demonstration activity is strictly",
        "paragraph_id": "para_69"
      },
      {
        "text": "prohibited.",
        "paragraph_id": "para_70"
      },
      {

        "text": "The red areas include the three stairways leading into the",
        "paragraph_id": "para_72"
      },
      {
        "text": "Capitol’s East Front, known collectively as the Eastern Steps.",
        "paragraph_id": "para_73"
      },
      {
        "text": "For decades, the Eastern Steps were open to the public,",
        "paragraph_id": "para_74"
      },
      {
        "text": "including for demonstration activity, subject to restrictions that",
        "paragraph_id": "para_75"
      },
      {
        "text": "changed over the years. After the September 11 attacks, the",
        "paragraph_id": "para_76"
      },
      {
        "text": "Steps were closed to public demonstrations, and fences",
        "paragraph_id": "para_77"
      },
      {
        "text": "cordoned off public access to all but the lower section of the",
        "paragraph_id": "para_78"
      },
      {
        "text": "Steps. Individuals may recreate on this section but cannot",
        "paragraph_id": "para_79"
      },
      {
        "text": "engage in demonstration activity.",
        "paragraph_id": "para_80"
      },
      {
        "text": "The restrictions on access and demonstration activity do",
        "paragraph_id": "para_81"
      },
      {
        "text": "not apply to members of Congress. Members and their staff",
        "paragraph_id": "para_82"
      },
      {
        "text": "may use the Eastern Steps to enter and exit the Capitol. Under",
        "paragraph_id": "para_83"
      },
      {
        "text": "the Member Exception to the Traffic Regulations, members",
        "paragraph_id": "para_84"
      },
      {
        "text": "may also sponsor demonstration activity, or organize their own",
        "paragraph_id": "para_85"
      },
      {
        "text": "events, in red areas, including the Eastern Steps. Id. § 12.2.20.",
        "paragraph_id": "para_86"
      },
      {
        "text": "To sponsor an event, a member must undertake the activity in",
        "paragraph_id": "para_87"
      },
      {
        "text": "his “official capacity” and must be “personally in attendance at",
        "paragraph_id": "para_88"
      },
      {
        "text": "the demonstration activity at all times.” Id. Outside of this",
        "paragraph_id": "para_89"
      },
      {
        "text": "Exception, members have no authority to permit",
        "paragraph_id": "para_90"
      },
      {
        "text": "“demonstration activity organized or sponsored by others.” Id.",
        "paragraph_id": "para_91"
      },
      {
        "text": "An individual or group seeking to demonstrate on the Steps",
        "paragraph_id": "para_92"
      },
      {
        "text": "must therefore be sponsored by a member.",
        "paragraph_id": "para_93"
      },
      {
        "text": "Members regularly rely on the Exception to organize and",
        "paragraph_id": "para_94"
      },
      {
        "text": "sponsor protests with the public on the Eastern Steps. For",
        "paragraph_id": "para_95"
      },
      {
        "text": "example, Representative Cori Bush organized an overnight",
        "paragraph_id": "para_96"
      },
      {
        "text": "demonstration that drew many individuals to protest the end of",
        "paragraph_id": "para_97"
      },
      {
        "text": "the eviction moratorium implemented during the COVID-19",
        "paragraph_id": "para_98"
      },
      {
        "text": "pandemic. See U.S. Rep. Cori Bush Spends Night Outside",
        "paragraph_id": "para_99"
      },
      {
        "text": "Capitol to Protest Return of Evictions, NBC News (July 31,",
        "paragraph_id": "para_100"
      },
      {
        "text": "2021). More recently, Senator Cory Booker and Representative",
        "paragraph_id": "para_101"
      },
      {
        "text": "Hakeem Jeffries hosted a 12-hour-long sit-in on the Eastern",
        "paragraph_id": "para_102"
      },
      {
        "text": "Steps, during which they invited supporters to protest a",
        "paragraph_id": "para_103"
      },
      {
        "text": "proposed budget. See Sen. Booker and House Minority Leader",
        "paragraph_id": "para_104"
      },
      {

      },
      {

        "paragraph_id": "para_108"
      },
      {
        "text": "This case was brought by Patrick Mahoney, a Presbyterian",
        "paragraph_id": "para_109"
      },
      {
        "text": "minister who would like to pray and demonstrate on the Eastern",
        "paragraph_id": "para_110"
      },
      {
        "text": "Steps with his wife and a few others. He seeks to pray for God’s",
        "paragraph_id": "para_111"
      },
      {
        "text": "intervention in the challenges facing the United States and to",
        "paragraph_id": "para_112"
      },
      {
        "text": "hold signs drawing attention to issues of public importance,",
        "paragraph_id": "para_113"
      },
      {
        "text": "including the federal funding of abortion. Because Mahoney",
        "paragraph_id": "para_114"
      },
      {
        "text": "has not secured congressional sponsorship, he faces arrest and",
        "paragraph_id": "para_115"
      },
      {
        "text": "possible imprisonment if he goes forward with these events on",
        "paragraph_id": "para_116"
      },
      {
        "text": "the Eastern Steps. Mahoney was previously arrested in August",
        "paragraph_id": "para_117"
      },
      {
        "text": "2021 when he organized a pro-life demonstration with five",
        "paragraph_id": "para_118"
      },
      {
        "text": "others on the Steps.",
        "paragraph_id": "para_119"
      },
      {
        "text": "Mahoney has been enmeshed in litigation with the Board",
        "paragraph_id": "para_120"
      },
      {
        "text": "over his plans to hold prayer vigils and other demonstrations",
        "paragraph_id": "para_121"
      },
      {
        "text": "throughout the Capitol Complex and Grounds since he first",
        "paragraph_id": "para_122"
      },
      {
        "text": "filed suit in 2021. After a series of legal proceedings, the parties",
        "paragraph_id": "para_123"
      },
      {
        "text": "reached a partial settlement. Mahoney agreed to dismiss some",
        "paragraph_id": "para_124"
      },
      {
        "text": "of his claims, leaving only his First and Fifth Amendment",
        "paragraph_id": "para_125"
      },
      {
        "text": "challenges to the restrictions in certain parts of the red “No",
        "paragraph_id": "para_126"
      },
      {
        "text": "Demonstration Permitted” areas, including the Eastern Steps.",
        "paragraph_id": "para_127"
      },
      {
        "text": "Under the settlement agreement, the parties jointly stipulated",
        "paragraph_id": "para_128"
      },
      {
        "text": "to facts and proceeded to summary judgment.",
        "paragraph_id": "para_129"
      },
      {
        "text": "The district court granted summary judgment for Mahoney",
        "paragraph_id": "para_130"
      },
      {
        "text": "on his First Amendment claim as to the lower section of the",
        "paragraph_id": "para_131"
      },
      {
        "text": "Eastern Steps beneath the fencing.1 Mahoney v. U.S. Capitol",
        "paragraph_id": "para_132"
      },
      {

        "text": "Police Bd., 734 F. Supp. 3d 114 (D.D.C. 2024). The court first",
        "paragraph_id": "para_138"
      },
      {
        "text": "held that the lower section of the Eastern Steps is a traditional",
        "paragraph_id": "para_139"
      },
      {
        "text": "public forum because, like the surrounding sidewalks on the",
        "paragraph_id": "para_140"
      },
      {
        "text": "Capitol Grounds, the Steps have historically been open to",
        "paragraph_id": "para_141"
      },
      {
        "text": "expression and do not serve a function incompatible with",
        "paragraph_id": "para_142"
      },
      {
        "text": "expressive activity. Id. at 125–29. Applying the stringent test",
        "paragraph_id": "para_143"
      },
      {
        "text": "for speech restrictions in a traditional public forum, the district",
        "paragraph_id": "para_144"
      },
      {
        "text": "court concluded that application of the Traffic Regulations to",
        "paragraph_id": "para_145"
      },
      {
        "text": "the lower section of the Eastern Steps violated the First",
        "paragraph_id": "para_146"
      },
      {
        "text": "Amendment because the restriction on speech not sponsored by",
        "paragraph_id": "para_147"
      },
      {
        "text": "a member prohibited substantially more speech than necessary",
        "paragraph_id": "para_148"
      },
      {
        "text": "to secure the Capitol. Id. at 122, 129–32.",
        "paragraph_id": "para_149"
      },
      {
        "text": "The district court entered a permanent injunction",
        "paragraph_id": "para_150"
      },
      {
        "text": "universally enjoining the Board from enforcing the",
        "paragraph_id": "para_151"
      },
      {
        "text": "demonstration ban as to the lower section of the Eastern Steps.",
        "paragraph_id": "para_152"
      },
      {
        "text": "Moving for reconsideration under Federal Rule of Civil",
        "paragraph_id": "para_153"
      },
      {
        "text": "Procedure 59(e), the Board argued the universal injunction",
        "paragraph_id": "para_154"
      },
      {
        "text": "exceeded the district court’s jurisdiction and violated equitable",
        "paragraph_id": "para_155"
      },
      {
        "text": "principles. The district court denied that motion but later",
        "paragraph_id": "para_156"
      },
      {
        "text": "granted the Board a partial stay pending appeal. The stay",
        "paragraph_id": "para_157"
      },
      {
        "text": "limited the reach of the injunction to Mahoney and up to 14",
        "paragraph_id": "para_158"
      },
      {
        "text": "other demonstrators.",
        "paragraph_id": "para_159"
      },
      {
        "text": "The Board appealed. We review the grant of summary",
        "paragraph_id": "para_160"
      },
      {
        "text": "judgment de novo, Hodge v. Talkin, 799 F.3d 1145, 1155 (D.C.",
        "paragraph_id": "para_161"
      },
      {
        "text": "Cir. 2015), and the permanent injunction for abuse of",
        "paragraph_id": "para_162"
      },
      {
        "text": "discretion. Cobell v. Norton, 428 F.3d 1070, 1074 (D.C. Cir.",
        "paragraph_id": "para_163"
      },
      {
        "text": "2005).",
        "paragraph_id": "para_164"
      },
      {
        "text": "did not object to this approach. Mahoney v. U.S. Capitol Police Bd.,",
        "paragraph_id": "para_165"
      },
      {
        "text": "734 F. Supp. 3d 114, 123–33 (D.D.C. 2024). The government’s",
        "paragraph_id": "para_166"
      },
      {
        "text": "appeal concerns only the lower section of the Eastern Steps.",
        "paragraph_id": "para_167"
      },
      {

      },
      {
        "text": "II.",
        "paragraph_id": "para_169"
      },
      {
        "text": "The Traffic Regulations prohibit demonstrations by the",
        "paragraph_id": "para_170"
      },
      {
        "text": "public on the Eastern Steps unless sponsored by a member of",
        "paragraph_id": "para_171"
      },
      {
        "text": "Congress. Mahoney has expressed concrete plans to engage in",
        "paragraph_id": "para_172"
      },
      {
        "text": "prayer and political advocacy on the Steps, activity that is",
        "paragraph_id": "para_173"
      },
      {
        "text": "unquestionably protected by the First Amendment. Mahoney",
        "paragraph_id": "para_174"
      },
      {
        "text": "therefore has standing to bring this pre-enforcement challenge",
        "paragraph_id": "para_175"
      },
      {
        "text": "against the Regulations because he faces criminal penalties if",
        "paragraph_id": "para_176"
      },
      {
        "text": "he goes forward with his plans.",
        "paragraph_id": "para_177"
      },
      {
        "text": "We hold that the Eastern Steps are a nonpublic forum but",
        "paragraph_id": "para_178"
      },
      {
        "text": "that the restriction on demonstration activity is unreasonable",
        "paragraph_id": "para_179"
      },
      {
        "text": "considering the history and use of the Steps.",
        "paragraph_id": "para_180"
      },
      {
        "text": "A.",
        "paragraph_id": "para_181"
      },
      {
        "text": "To resolve Mahoney’s challenge, we must first determine",
        "paragraph_id": "para_182"
      },
      {
        "text": "the forum status of the Eastern Steps. Cornelius v. NAACP",
        "paragraph_id": "para_183"
      },
      {
        "text": "Legal Def. & Educ. Fund, Inc., 473 U.S. 788, 797 (1985).",
        "paragraph_id": "para_184"
      },
      {
        "text": "1.",
        "paragraph_id": "para_185"
      },
      {
        "text": "The degree of First Amendment protection for public",
        "paragraph_id": "para_186"
      },
      {
        "text": "speech on government property turns on the type of forum,",
        "paragraph_id": "para_187"
      },
      {
        "text": "which we determine by considering the “history and",
        "paragraph_id": "para_188"
      },
      {
        "text": "characteristics” of the property. Oberwetter v. Hilliard, 639",
        "paragraph_id": "para_189"
      },
      {
        "text": "F.3d 545, 551–52 (D.C. Cir. 2011).",
        "paragraph_id": "para_190"
      },
      {
        "text": "A traditional public forum is government property that “by",
        "paragraph_id": "para_191"
      },
      {
        "text": "long tradition” has “been devoted to assembly and debate.”",
        "paragraph_id": "para_192"
      },
      {
        "text": "Perry Educ. Ass’n v. Perry Loc. Educators’ Ass’n, 460 U.S. 37,",
        "paragraph_id": "para_193"
      },
      {
        "text": "45 (1983). Streets, sidewalks, and parks that “time out of mind,",
        "paragraph_id": "para_194"
      },
      {
        "text": "have been used for purposes of assembly” are “quintessential”",
        "paragraph_id": "para_195"
      },
      {
        "text": "examples. Id. (cleaned up). A designated public forum arises",
        "paragraph_id": "para_196"
      },
      {
        "text": "when government property “that has not traditionally been",
        "paragraph_id": "para_197"
      },
      {

        "paragraph_id": "para_198"
      },
      {
        "text": "regarded as a public forum is intentionally opened up for that",
        "paragraph_id": "para_199"
      },
      {
        "text": "purpose.” Pleasant Grove City v. Summum, 555 U.S. 460, 469",
        "paragraph_id": "para_200"
      },
      {
        "text": "(2009). The government does not need to “indefinitely retain",
        "paragraph_id": "para_201"
      },
      {
        "text": "the open character” of a designated public forum. Perry, 460",
        "paragraph_id": "para_202"
      },
      {
        "text": "U.S. at 46. Speech restrictions in public fora, whether",
        "paragraph_id": "para_203"
      },
      {
        "text": "traditional or designated, are subject to heightened scrutiny",
        "paragraph_id": "para_204"
      },
      {
        "text": "because those spaces are devoted to public discourse and",
        "paragraph_id": "para_205"
      },
      {
        "text": "therefore most directly implicate the protections of the First",
        "paragraph_id": "para_206"
      },
      {
        "text": "Amendment. See id. at 45 (explaining courts apply strict",
        "paragraph_id": "para_207"
      },
      {
        "text": "scrutiny to content-based regulations and intermediate scrutiny",
        "paragraph_id": "para_208"
      },
      {
        "text": "to content-neutral regulations in public fora).",
        "paragraph_id": "para_209"
      },
      {
        "text": "A limited public forum is created when the government",
        "paragraph_id": "para_210"
      },
      {
        "text": "opens a space “limited to use by certain groups or dedicated",
        "paragraph_id": "para_211"
      },
      {
        "text": "solely to the discussion of certain subjects.” Summum, 555 U.S.",
        "paragraph_id": "para_212"
      },
      {
        "text": "at 470. For example, a public university creates a limited public",
        "paragraph_id": "para_213"
      },
      {
        "text": "forum when it opens school facilities and programs only to",
        "paragraph_id": "para_214"
      },
      {
        "text": "certain student groups. Rosenberger v. Rector & Visitors of",
        "paragraph_id": "para_215"
      },
      {
        "text": "Univ. of Virginia, 515 U.S. 819, 829–30 (1995).",
        "paragraph_id": "para_216"
      },
      {
        "text": "Most other government property is a nonpublic forum, “a",
        "paragraph_id": "para_217"
      },
      {
        "text": "space that is not by tradition or designation a forum for public",
        "paragraph_id": "para_218"
      },
      {
        "text": "communication.” Minnesota Voters All. v. Mansky, 585 U.S. 1,",
        "paragraph_id": "para_219"
      },
      {
        "text": "11 (2018) (cleaned up). A hallmark of the nonpublic forum is",
        "paragraph_id": "para_220"
      },
      {
        "text": "that it serves a purpose incompatible with unfettered",
        "paragraph_id": "para_221"
      },
      {
        "text": "expression. Government offices and museums are typical",
        "paragraph_id": "para_222"
      },
      {
        "text": "examples. In limited public and nonpublic fora, the government",
        "paragraph_id": "para_223"
      },
      {
        "text": "has “much more flexibility to craft rules limiting speech.” Id.",
        "paragraph_id": "para_224"
      },
      {
        "text": "at 11–12. Restrictions on speech “need only be reasonable and",
        "paragraph_id": "para_225"
      },
      {
        "text": "viewpoint neutral.”2 Price v. Garland, 45 F.4th 1059, 1068",
        "paragraph_id": "para_226"
      },
      {
        "text": "(D.C. Cir. 2022).",
        "paragraph_id": "para_227"
      },
      {
        "text": "2 Some government property is not a forum at all, because it serves",

        "text": "purposes incompatible with private communicative activity. Walker",

      },
      {

      {

        "paragraph_id": "para_232"
      },
      {
        "text": "Although we have not previously characterized the Eastern",
        "paragraph_id": "para_233"
      },
      {
        "text": "Steps for purposes of forum analysis, our inquiry is informed",
        "paragraph_id": "para_234"
      },
      {
        "text": "by earlier decisions considering speech restrictions within the",
        "paragraph_id": "para_235"
      },
      {
        "text": "Capitol Complex and Grounds. The inside of the Capitol is a",
        "paragraph_id": "para_236"
      },
      {
        "text": "nonpublic forum because of its specialized purpose and distinct",
        "paragraph_id": "para_237"
      },
      {
        "text": "physical characteristics. United States v. Nassif, 97 F.4th 968,",
        "paragraph_id": "para_238"
      },
      {
        "text": "975–78 (D.C. Cir. 2024). The Capitol serves as a workplace for",
        "paragraph_id": "para_239"
      },
      {
        "text": "members of Congress and their staff and therefore has a",
        "paragraph_id": "para_240"
      },
      {
        "text": "purpose incompatible with unfettered assembly. Moreover, the",
        "paragraph_id": "para_241"
      },
      {
        "text": "Capitol doorway’s “physical threshold” provides a “familiar",
        "paragraph_id": "para_242"
      },
      {
        "text": "signal” that the Capitol interior “differs from the remainder of",
        "paragraph_id": "para_243"
      },
      {
        "text": "the public Grounds.” Id. at 975 (cleaned up). Because the",
        "paragraph_id": "para_244"
      },
      {
        "text": "Capitol is a nonpublic forum, regulations prohibiting",
        "paragraph_id": "para_245"
      },
      {
        "text": "demonstration were reasonable and appropriately served to",
        "paragraph_id": "para_246"
      },
      {
        "text": "prevent disruption to the “very legislative process that the",
        "paragraph_id": "para_247"
      },
      {
        "text": "buildings are designed to accommodate.” Id. at 977–81.",
        "paragraph_id": "para_248"
      },
      {
        "text": "By contrast, the Grounds surrounding the Capitol are",
        "paragraph_id": "para_249"
      },
      {
        "text": "generally a traditional public forum. In Jeannette Rankin",
        "paragraph_id": "para_250"
      },
      {
        "text": "Brigade v. Chief of Capitol Police, a three-judge district court",
        "paragraph_id": "para_251"
      },
      {
        "text": "held that a categorical exclusion of demonstrations on the",
        "paragraph_id": "para_252"
      },
      {
        "text": "Capitol Grounds violated the First Amendment. 342 F. Supp.",
        "paragraph_id": "para_253"
      },
      {
        "text": "575 (D.D.C. 1972), aff’d, 409 U.S. 972 (1972). The Grounds",
        "paragraph_id": "para_254"
      },
      {
        "text": "have “traditionally been open to the public,” and the",
        "paragraph_id": "para_255"
      },
      {
        "text": "“fundamental function of a legislature in a democratic society",
        "paragraph_id": "para_256"
      },
      {
        "text": "assumes accessibility to [popular] opinion.” Id. at 584. The",
        "paragraph_id": "para_257"
      },
      {
        "text": "Capitol Grounds are therefore an area “to which access cannot",
        "paragraph_id": "para_258"
      },
      {
        "text": "be denied broadly or absolutely.” Id. at 583–85.",
        "paragraph_id": "para_259"
      },
      {
        "text": "19 (2015) (holding state-issued license plates are not a forum for",
        "paragraph_id": "para_260"
      },
      {
        "text": "private communication).",
        "paragraph_id": "para_261"
      },
      {
        "text": "10",
        "paragraph_id": "para_262"
      },
      {
        "text": "We have also specifically held that the sidewalk in front of",
        "paragraph_id": "para_263"
      },
      {
        "text": "the Eastern Steps is a traditional public forum. Lederman v.",
        "paragraph_id": "para_264"
      },
      {
        "text": "United States, 291 F.3d 36, 44 (D.C. Cir. 2002). Like the rest",
        "paragraph_id": "para_265"
      },
      {
        "text": "of the Grounds, the sidewalk is compatible with expressive",
        "paragraph_id": "para_266"
      },
      {
        "text": "activity. The long history and tradition of assembly on the",
        "paragraph_id": "para_267"
      },
      {
        "text": "Capitol Grounds mark its lawns and sidewalks as traditional",
        "paragraph_id": "para_268"
      },
      {
        "text": "public fora. Nassif, 97 F.4th at 975.",
        "paragraph_id": "para_269"
      },
      {
        "text": "3.",
        "paragraph_id": "para_270"
      },
      {
        "text": "The Eastern Steps are part of the exterior of the Capitol",
        "paragraph_id": "para_271"
      },
      {
        "text": "Building. They lie between the interior of the Capitol, a",
        "paragraph_id": "para_272"
      },
      {
        "text": "nonpublic forum, and the sidewalks around the Capitol, a",
        "paragraph_id": "para_273"
      },
      {
        "text": "traditional public forum. Because the Steps abut a traditional",
        "paragraph_id": "para_274"
      },
      {
        "text": "public forum, several factors guide our assessment. First, we",
        "paragraph_id": "para_275"
      },
      {
        "text": "consider whether the property serves a “specialized” purpose",
        "paragraph_id": "para_276"
      },
      {
        "text": "incompatible with unrestrained speech and assembly.",
        "paragraph_id": "para_277"
      },
      {
        "text": "Henderson v. Lujan, 964 F.2d 1179, 1182 (D.C. Cir. 1992).",
        "paragraph_id": "para_278"
      },
      {
        "text": "Second, we examine the “physical characteristics” of the",
        "paragraph_id": "para_279"
      },
      {
        "text": "property to determine whether it is distinguishable from the",
        "paragraph_id": "para_280"
      },
      {
        "text": "neighboring public forum. Oberwetter, 639 F.3d at 553.",
        "paragraph_id": "para_281"
      },
      {
        "text": "Finally, we scrutinize whether there is a “venerable tradition”",
        "paragraph_id": "para_282"
      },
      {
        "text": "of using the property for “expressive activities.” Initiative &",
        "paragraph_id": "para_283"
      },
      {
        "text": "Referendum Inst. v. U.S. Postal Serv., 685 F.3d 1066, 1071",
        "paragraph_id": "para_284"
      },
      {
        "text": "(D.C. Cir. 2012). This fact-specific inquiry focuses on the",
        "paragraph_id": "para_285"
      },
      {
        "text": "Eastern Steps’ “location, purpose, and history” to determine",
        "paragraph_id": "para_286"
      },
      {
        "text": "their forum status. Id.",
        "paragraph_id": "para_287"
      },
      {
        "text": "To begin with, the specialized purpose of the Eastern Steps",
        "paragraph_id": "para_288"
      },
      {
        "text": "marks them as a nonpublic forum. The Steps provide a",
        "paragraph_id": "para_289"
      },
      {
        "text": "secondary entrance and exit to the Capitol for members of",
        "paragraph_id": "para_290"
      },
      {
        "text": "Congress and their staff. As with the inside of the Capitol, and",
        "paragraph_id": "para_291"
      },
      {
        "text": "unlike neighboring sidewalks, the Eastern Steps have a purpose",
        "paragraph_id": "para_292"
      },
      {
        "text": "incompatible with unrestrained assembly. Such gatherings",
        "paragraph_id": "para_293"
      },
      {
        "text": "could impede access and create hazards for members and staff.",
        "paragraph_id": "para_294"
      },
      {
        "text": "11",
        "paragraph_id": "para_295"
      },
      {
        "text": "The Steps are similar to the sidewalks leading into a post office,",
        "paragraph_id": "para_296"
      },
      {
        "text": "which we held were a nonpublic forum given their purpose of",
        "paragraph_id": "para_297"
      },
      {
        "text": "“provid[ing] efficient access to the post office.” Id. Unlike",
        "paragraph_id": "para_298"
      },
      {
        "text": "sidewalks on the Capitol Grounds, the Eastern Steps serve a",
        "paragraph_id": "para_299"
      },
      {
        "text": "“sufficiently specialized” purpose that demonstrates they are",
        "paragraph_id": "para_300"
      },
      {
        "text": "“uniquely nonpublic.” Lederman, 291 F.3d at 42–43 (cleaned",
        "paragraph_id": "para_301"
      },
      {
        "text": "up). The Board must be able to close the Steps to the public",
        "paragraph_id": "para_302"
      },
      {
        "text": "when necessary to protect the primary purpose of the Steps as",
        "paragraph_id": "para_303"
      },
      {
        "text": "well as the safety of members and their staff.",
        "paragraph_id": "para_304"
      },
      {
        "text": "Furthermore, the physical location and architecture of the",
        "paragraph_id": "para_305"
      },
      {
        "text": "Eastern Steps suggest they are a nonpublic forum. Unlike the",
        "paragraph_id": "para_306"
      },
      {
        "text": "surrounding Capitol Grounds, the Steps are not a “street,",
        "paragraph_id": "para_307"
      },
      {
        "text": "sidewalk, or park” entitled to a “working presumption of",
        "paragraph_id": "para_308"
      },
      {
        "text": "public-forum status.” Nassif, 97 F.4th at 975 (cleaned up).",
        "paragraph_id": "para_309"
      },
      {
        "text": "Instead, they are physically integrated with the Capitol, which",
        "paragraph_id": "para_310"
      },
      {
        "text": "is a nonpublic forum. The Eastern Steps are also structurally",
        "paragraph_id": "para_311"
      },
      {
        "text": "distinct from the surrounding walkways on the Capitol",
        "paragraph_id": "para_312"
      },
      {
        "text": "Grounds. The Steps’ elevation creates a natural boundary from",
        "paragraph_id": "para_313"
      },
      {
        "text": "the paved areas below, physically “mark[ing] off” the Steps’",
        "paragraph_id": "para_314"
      },
      {
        "text": "“special use.” Henderson, 964 F.2d at 1182. The Steps are part",
        "paragraph_id": "para_315"
      },
      {
        "text": "of the Capitol, and individuals who climb the Steps would",
        "paragraph_id": "para_316"
      },
      {
        "text": "recognize they have entered a space with a different purpose",
        "paragraph_id": "para_317"
      },
      {
        "text": "than the surrounding Grounds.",
        "paragraph_id": "para_318"
      },
      {
        "text": "We relied on similar reasoning when concluding that the",
        "paragraph_id": "para_319"
      },
      {
        "text": "Supreme Court plaza is a nonpublic forum. The plaza is",
        "paragraph_id": "para_320"
      },
      {
        "text": "“elevated from the sidewalk by a set of marble steps,” making",
        "paragraph_id": "para_321"
      },
      {
        "text": "clear to individuals that they have entered “what amounts to the",
        "paragraph_id": "para_322"
      },
      {
        "text": "elevated front porch of the Supreme Court building.” Hodge,",
        "paragraph_id": "para_323"
      },
      {
        "text": "799 F.3d at 1158–59; see also Initiative & Referendum Inst.,",
        "paragraph_id": "para_324"
      },
      {
        "text": "685 F.3d at 1071 (holding sidewalk leading to post office was",
        "paragraph_id": "para_325"
      },
      {
        "text": "a nonpublic forum in part because it was separated from",
        "paragraph_id": "para_326"
      },
      {
        "text": "ordinary sidewalks). The Jefferson Memorial, too, is a",
        "paragraph_id": "para_327"
      },
      {
        "text": "nonpublic forum in part because its architectural boundaries",
        "paragraph_id": "para_328"
      },
      {
        "text": "12",

      },
      {
        "text": "“delineate the nonpublic forum.” Oberwetter, 639 F.3d at 553.",
        "paragraph_id": "para_330"
      },
      {
        "text": "The physical and architectural separation from the Capitol",
        "paragraph_id": "para_331"
      },
      {
        "text": "Grounds’ lawns and sidewalks indicates the Eastern Steps are",
        "paragraph_id": "para_332"
      },
      {
        "text": "a nonpublic forum.",
        "paragraph_id": "para_333"
      },
      {
        "text": "Finally, the history of the Eastern Steps demonstrates they",
        "paragraph_id": "para_334"
      },
      {
        "text": "have only sporadically been used for demonstration activity.",
        "paragraph_id": "para_335"
      },
      {
        "text": "Before 1976, the public was generally prohibited from",
        "paragraph_id": "para_336"
      },
      {
        "text": "engaging in demonstration activity across the Capitol Grounds,",
        "paragraph_id": "para_337"
      },
      {
        "text": "including on the Eastern Steps. Following the enactment of the",
        "paragraph_id": "para_338"
      },
      {
        "text": "first Traffic Regulations in 1976, the Board opened much of the",
        "paragraph_id": "para_339"
      },
      {
        "text": "Capitol Grounds to demonstration activity. Although the",
        "paragraph_id": "para_340"
      },
      {
        "text": "record is not entirely clear, it seems the Board permitted some",
        "paragraph_id": "para_341"
      },
      {
        "text": "public demonstrations on the Eastern Steps between 1976 and",
        "paragraph_id": "para_342"
      },
      {
        "text": "the September 11 attacks, subject to restrictions that changed",
        "paragraph_id": "para_343"
      },
      {
        "text": "over the years. This history suggests that at times the Eastern",
        "paragraph_id": "para_344"
      },
      {
        "text": "Steps were, at most, a designated public forum because the",
        "paragraph_id": "para_345"
      },
      {
        "text": "Board intentionally opened the area to expressive activity.",
        "paragraph_id": "para_346"
      },
      {
        "text": "The occasional designation of the Steps for expressive",
        "paragraph_id": "para_347"
      },
      {
        "text": "activity, however, does not mean the Steps are a traditional",
        "paragraph_id": "para_348"
      },
      {
        "text": "public forum that must remain indefinitely open to public",
        "paragraph_id": "para_349"
      },
      {
        "text": "expression. See Perry, 460 U.S. at 46 (recognizing the",
        "paragraph_id": "para_350"
      },
      {

        "text": "regulations concerning access to the Eastern Steps",

      },
      {
        "text": "demonstrates they are a nonpublic forum that the government",
        "paragraph_id": "para_354"
      },
      {
        "text": "may choose from time to time to designate and open for public",
        "paragraph_id": "para_355"
      },
      {
        "text": "expression.",
        "paragraph_id": "para_356"
      },
      {
        "text": "Mahoney argues the Eastern Steps are a traditional public",
        "paragraph_id": "para_357"
      },
      {
        "text": "forum because they are best understood as a part of the Capitol",
        "paragraph_id": "para_358"
      },
      {
        "text": "Grounds. And on the Grounds, the Board must show the Steps",
        "paragraph_id": "para_359"
      },
      {
        "text": "serve an “overwhelmingly specialized” purpose to be classified",
        "paragraph_id": "para_360"
      },
      {
        "text": "as a nonpublic forum. See Lederman, 291 F.3d at 43 (citing",
        "paragraph_id": "para_361"
      },
      {
        "text": "13",
        "paragraph_id": "para_362"
      },
      {
        "text": "Henderson, 964 F.2d at 1182). As already explained, we find",
        "paragraph_id": "para_363"
      },
      {
        "text": "the Eastern Steps are an integrated part of the Capitol Building",
        "paragraph_id": "para_364"
      },
      {
        "text": "and distinct from the Grounds’ lawns or sidewalks, so the",
        "paragraph_id": "para_365"
      },
      {
        "text": "Board need not satisfy the heightened standard.",
        "paragraph_id": "para_366"
      },
      {
        "text": "We are also unpersuaded by Mahoney’s efforts to",
        "paragraph_id": "para_367"
      },
      {
        "text": "distinguish the Eastern Steps from other property this court has",
        "paragraph_id": "para_368"
      },
      {
        "text": "recognized as a nonpublic forum, such as the sidewalks leading",
        "paragraph_id": "para_369"
      },
      {
        "text": "into post offices and the Supreme Court plaza. Mahoney",
        "paragraph_id": "para_370"
      },
      {
        "text": "emphasizes the distinctive role of the legislative branch in a",
        "paragraph_id": "para_371"
      },
      {
        "text": "representative system of government, arguing the Steps must",
        "paragraph_id": "para_372"
      },
      {
        "text": "be a traditional public forum that remains open to promote",
        "paragraph_id": "para_373"
      },
      {
        "text": "congressional accountability to the public. While the First",
        "paragraph_id": "para_374"
      },
      {
        "text": "Amendment certainly protects public demonstrations for",
        "paragraph_id": "para_375"
      },
      {
        "text": "individuals to petition their representatives in Congress, it does",
        "paragraph_id": "para_376"
      },
      {
        "text": "not require practically unfettered access up to the doorway of",
        "paragraph_id": "para_377"
      },
      {
        "text": "the Capitol.",
        "paragraph_id": "para_378"
      },
      {
        "text": "Furthermore, we disagree with our colleague that Dellums",
        "paragraph_id": "para_379"
      },
      {
        "text": "v. Powell, 566 F.2d 167 (D.C. Cir. 1977), compels the",
        "paragraph_id": "para_380"
      },
      {
        "text": "conclusion that the Eastern Steps are a traditional public forum.",
        "paragraph_id": "para_381"
      },
      {
        "text": "See Dissenting Op. 2–7. In Dellums, this court held that",
        "paragraph_id": "para_382"
      },
      {
        "text": "Vietnam War protestors arrested on the Steps could bring a",
        "paragraph_id": "para_383"
      },
      {
        "text": "Bivens claim for the loss of their First Amendment rights. 566",
        "paragraph_id": "para_384"
      },
      {
        "text": "F.2d at 194–96. The panel did not engage in forum analysis at",
        "paragraph_id": "para_385"
      },
      {
        "text": "all, nor did it hold that the Steps must remain open to public",
        "paragraph_id": "para_386"
      },
      {
        "text": "demonstrations. This is unsurprising given that Dellums",
        "paragraph_id": "para_387"
      },
      {
        "text": "predated Perry’s framework for forum analysis. Moreover, the",
        "paragraph_id": "para_388"
      },
      {
        "text": "fact that the Dellums demonstration occurred in 1971 does not",
        "paragraph_id": "para_389"
      },
      {
        "text": "support the conclusion that the Steps were a traditional public",
        "paragraph_id": "para_390"
      },
      {
        "text": "forum at that time, particularly because the parties stipulated",
        "paragraph_id": "para_391"
      },
      {
        "text": "that the public was generally prohibited from engaging in",
        "paragraph_id": "para_392"
      },
      {

      {
        "text": "demonstration activities prior to 1976. See J.A. 405; but see",
        "paragraph_id": "para_394"
      },
      {
        "text": "Dissenting Op. 7–9.",
        "paragraph_id": "para_395"
      },
      {
        "text": "In sum, we hold that the Eastern Steps are a nonpublic",
        "paragraph_id": "para_396"
      },
      {
        "text": "forum because they are integrated with the Capitol Building,",
        "paragraph_id": "para_397"
      },
      {
        "text": "serve the specialized purpose of providing members and their",
        "paragraph_id": "para_398"
      },
      {
        "text": "staff access to the Capitol, and are physically distinct from the",
        "paragraph_id": "para_399"
      },
      {
        "text": "surrounding Capitol Grounds. While the Board has",
        "paragraph_id": "para_400"
      },
      {
        "text": "occasionally permitted demonstrations on the Eastern Steps in",
        "paragraph_id": "para_401"
      },
      {
        "text": "the past, that history is consistent with the conclusion that the",
        "paragraph_id": "para_402"
      },
      {
        "text": "Steps are a nonpublic forum that at times may be opened for",
        "paragraph_id": "para_403"
      },
      {
        "text": "public expression.",
        "paragraph_id": "para_404"
      },
      {
        "text": "B.",
        "paragraph_id": "para_405"
      },
      {
        "text": "Because the Eastern Steps are a nonpublic forum, speech",
        "paragraph_id": "para_406"
      },
      {
        "text": "regulations must be “reasonable in light of the purpose served",
        "paragraph_id": "para_407"
      },
      {
        "text": "by the forum” and “viewpoint neutral.” Cornelius, 473 U.S. at",
        "paragraph_id": "para_408"
      },
      {
        "text": "806. Mahoney does not argue the Traffic Regulations",
        "paragraph_id": "para_409"
      },
      {
        "text": "discriminate on the basis of viewpoint, so we assess whether",
        "paragraph_id": "para_410"
      },
      {
        "text": "the restrictions are reasonable in light of the purpose and",
        "paragraph_id": "para_411"
      },
      {
        "text": "functions of the Eastern Steps.",
        "paragraph_id": "para_412"
      },
      {
        "text": "1.",
        "paragraph_id": "para_413"
      },
      {
        "text": "To be reasonable, a regulation of speech in a nonpublic",
        "paragraph_id": "para_414"
      },
      {
        "text": "forum must be “consistent with the [government’s] legitimate",
        "paragraph_id": "para_415"
      },
      {
        "text": "interest in preserving the property for the use to which it is",
        "paragraph_id": "para_416"
      },
      {
        "text": "lawfully dedicated.” Perry, 460 U.S. at 50–51 (cleaned up).",
        "paragraph_id": "para_417"
      },
      {
        "text": "Reasonableness requires “more than the toothless rational basis",
        "paragraph_id": "para_418"
      },
      {
        "text": "test used to review the typical exercise of a state’s police",
        "paragraph_id": "para_419"
      },
      {
        "text": "power.” Price, 45 F.4th at 1072 (cleaned up). Courts probe the",
        "paragraph_id": "para_420"
      },
      {
        "text": "“special attributes” and “characteristic nature and function of",
        "paragraph_id": "para_421"
      },
      {
        "text": "the particular forum involved.” United States v. Kokinda, 497",
        "paragraph_id": "para_422"
      },
      {
        "text": "U.S. 720, 732 (1990) (plurality) (cleaned up). When a forum is",
        "paragraph_id": "para_423"
      },
      {
        "text": "“compatible with expressive activity,” we apply a “more",
        "paragraph_id": "para_424"
      },
      {

      {
        "text": "demanding” reasonableness inquiry. See PETA v. Tabak, 109",
        "paragraph_id": "para_426"
      },
      {
        "text": "F.4th 627, 636 (D.C. Cir. 2024) (assessing reasonableness in a",
        "paragraph_id": "para_427"
      },
      {
        "text": "limited public forum).",
        "paragraph_id": "para_428"
      },
      {
        "text": "Furthermore, in a nonpublic forum, the government must",
        "paragraph_id": "para_429"
      },
      {
        "text": "exercise its regulatory authority in a manner that follows",
        "paragraph_id": "para_430"
      },
      {
        "text": "“objective, workable standards” and does not permit officials",
        "paragraph_id": "para_431"
      },
      {
        "text": "to exercise “unbridled discretion over a forum’s use.” Am.",
        "paragraph_id": "para_432"
      },
      {
        "text": "Freedom Def. Initiative v. WMATA, 901 F.3d 356, 372 (D.C.",
        "paragraph_id": "para_433"
      },
      {
        "text": "Cir. 2018) (cleaned up). The Supreme Court has emphasized",
        "paragraph_id": "para_434"
      },
      {
        "text": "the “special dangers inherent in a law placing unbridled",
        "paragraph_id": "para_435"
      },
      {
        "text": "discretion directly to license speech … in the hands of a",
        "paragraph_id": "para_436"
      },
      {
        "text": "government official.” City of Lakewood v. Plain Dealer",
        "paragraph_id": "para_437"
      },
      {
        "text": "Publishing Co., 486 U.S. 750, 767–68 (1988). A regulation that",
        "paragraph_id": "para_438"
      },
      {
        "text": "grants the government arbitrary control over who may speak",
        "paragraph_id": "para_439"
      },
      {
        "text": "invites the suppression of disfavored viewpoints and",
        "paragraph_id": "para_440"
      },
      {
        "text": "undermines the First Amendment’s core protections. See",
        "paragraph_id": "para_441"
      },
      {
        "text": "Thomas v. Chicago Park Dist., 534 U.S. 316, 324 (2002)",
        "paragraph_id": "para_442"
      },
      {
        "text": "(recognizing a permitting decision cannot be left to the “whim",
        "paragraph_id": "para_443"
      },
      {
        "text": "of the administrator”) (cleaned up); Ateba v. Leavitt, 133 F.4th",
        "paragraph_id": "para_444"
      },
      {
        "text": "114, 125 (D.C. Cir. 2025) (holding it would be unreasonable to",
        "paragraph_id": "para_445"
      },
      {
        "text": "control access to White House press facilities through",
        "paragraph_id": "para_446"
      },
      {
        "text": "standardless discretion). Even when the government may",
        "paragraph_id": "para_447"
      },
      {
        "text": "regulate speech, it must avoid “unfair or inconsistent",
        "paragraph_id": "para_448"
      },
      {
        "text": "enforcement.” Mansky, 585 U.S. at 22.",
        "paragraph_id": "para_449"
      },
      {
        "text": "2.",
        "paragraph_id": "para_450"
      },
      {
        "text": "The history and “surrounding circumstances” of the",
        "paragraph_id": "para_451"
      },
      {
        "text": "Eastern Steps compel a relatively probing review of the Traffic",
        "paragraph_id": "para_452"
      },
      {
        "text": "Regulations. Cornelius, 473 U.S. at 809. Although the Eastern",
        "paragraph_id": "para_453"
      },
      {
        "text": "Steps are properly treated as a nonpublic forum, they were used",
        "paragraph_id": "para_454"
      },
      {
        "text": "for demonstrations before the September 11 attacks. And the",
        "paragraph_id": "para_455"
      },
      {
        "text": "Board continues to permit demonstration activity by",
        "paragraph_id": "para_456"
      },
      {
        "text": "16",
        "paragraph_id": "para_457"
      },
      {
        "text": "individuals who secure congressional sponsorship or",
        "paragraph_id": "para_458"
      },
      {
        "text": "participation.",
        "paragraph_id": "para_459"
      },
      {
        "text": "These uses of the Eastern Steps are also part of a wider",
        "paragraph_id": "para_460"
      },
      {
        "text": "American tradition of public speech near legislatures.",
        "paragraph_id": "para_461"
      },
      {
        "text": "Legislative grounds “occupy a special place in our First",
        "paragraph_id": "para_462"
      },
      {
        "text": "Amendment tradition” because their location enables “citizens",
        "paragraph_id": "para_463"
      },
      {
        "text": "[to] speak most directly to their elected representatives.”",
        "paragraph_id": "para_464"
      },
      {
        "text": "Hulbert v. Pope, 70 F.4th 726, 738 (4th Cir. 2023). “[T]he",
        "paragraph_id": "para_465"
      },
      {
        "text": "fundamental function of a legislature in a democratic society",
        "paragraph_id": "para_466"
      },
      {
        "text": "assumes accessibility to [popular] opinion.” Jeannette Rankin",
        "paragraph_id": "para_467"
      },
      {
        "text": "Brigade, 342 F. Supp. at 584. The suppression of disfavored",
        "paragraph_id": "para_468"
      },
      {
        "text": "speech on legislative grounds is at odds with our First",
        "paragraph_id": "para_469"
      },
      {
        "text": "Amendment tradition. Cf. Edwards v. South Carolina, 372 U.S.",
        "paragraph_id": "para_470"
      },
      {
        "text": "229, 238 (1963) (holding unconstitutional the convictions of",
        "paragraph_id": "para_471"
      },
      {
        "text": "civil rights protestors for demonstrating on state capitol",
        "paragraph_id": "para_472"
      },
      {
        "text": "grounds). This broader context compels a “more demanding”",
        "paragraph_id": "para_473"
      },
      {
        "text": "scrutiny when assessing the reasonableness of the Traffic",
        "paragraph_id": "para_474"
      },
      {
        "text": "Regulations.3 Cf. Tabak, 109 F.4th at 636.",
        "paragraph_id": "para_475"
      },
      {
        "text": "Because the Eastern Steps are a nonpublic forum, the",
        "paragraph_id": "para_476"
      },
      {
        "text": "Board could prohibit demonstrations altogether, as it has done",
        "paragraph_id": "para_477"
      },
      {
        "text": "inside the Capitol. See Nassif, 97 F.4th at 979–80. This would",
        "paragraph_id": "para_478"
      },
      {
        "text": "preserve the purpose of the Steps as a nonpublic entrance into",
        "paragraph_id": "para_479"
      },
      {
        "text": "the Capitol. Instead, the Regulations prohibit “gathering … for",
        "paragraph_id": "para_480"
      },
      {
        "text": "the purpose of expressing political, social, religious or other",
        "paragraph_id": "para_481"
      },
      {
        "text": "similar ideas, views or concerns protected by the First",
        "paragraph_id": "para_482"
      },
      {
        "text": "Amendment,” unless that activity is sponsored by a member of",
        "paragraph_id": "para_483"
      },
      {
        "text": "3 The district court and our colleague rely on similar considerations",
        "paragraph_id": "para_484"
      },
      {
        "text": "to conclude the Eastern Steps are a traditional public forum.",
        "paragraph_id": "para_485"
      },
      {
        "text": "Mahoney, 734 F. Supp. 3d at 125–29; Dissenting Op. 7–9. While we",
        "paragraph_id": "para_486"
      },
      {
        "text": "disagree with that categorization, the history of the Steps and the",
        "paragraph_id": "para_487"
      },
      {
        "text": "tradition of speech near legislatures compel us to closely assess the",
        "paragraph_id": "para_488"
      },
      {
        "text": "reasonableness of the Traffic Regulations.",
        "paragraph_id": "para_489"
      },
      {
        "text": "17",
        "paragraph_id": "para_490"
      },
      {
        "text": "Congress. Traffic Regulations §§ 12.1.10, 12.2.20. The Board",
        "paragraph_id": "para_491"
      },
      {
        "text": "tries to limit the reach of the Regulations by maintaining that",
        "paragraph_id": "para_492"
      },
      {
        "text": "they prohibit only “joint conduct that is expressive in nature",
        "paragraph_id": "para_493"
      },
      {
        "text": "and aimed to draw attention.” Board Br. 37. Even accepting",
        "paragraph_id": "para_494"
      },
      {
        "text": "this interpretation, the Regulations broadly restrict expressive",
        "paragraph_id": "para_495"
      },
      {
        "text": "activity, including Mahoney’s small group prayers and",
        "paragraph_id": "para_496"
      },
      {
        "text": "political advocacy. But the same expressive activity is",
        "paragraph_id": "para_497"
      },
      {
        "text": "permitted if sponsored by a member of Congress, essentially",
        "paragraph_id": "para_498"
      },
      {
        "text": "without other limits.",
        "paragraph_id": "para_499"
      },
      {
        "text": "We hold that the Traffic Regulations as applied to the",
        "paragraph_id": "para_500"
      },
      {
        "text": "Eastern Steps are unreasonable because of the Member",
        "paragraph_id": "para_501"
      },
      {
        "text": "Exception. The Board justifies the demonstration restrictions",
        "paragraph_id": "para_502"
      },
      {
        "text": "as necessary to allow the safe passage of members and staff",
        "paragraph_id": "para_503"
      },
      {
        "text": "into and out of the Capitol. Despite this safety rationale,",
        "paragraph_id": "para_504"
      },
      {
        "text": "however, the Board permits even large public demonstrations",
        "paragraph_id": "para_505"
      },
      {
        "text": "when sponsored by a member of Congress. If a particular cause",
        "paragraph_id": "para_506"
      },
      {
        "text": "garners the support of a member, demonstrations are allowed.",
        "paragraph_id": "para_507"
      },
      {
        "text": "Individuals and groups that lack the political power to secure a",
        "paragraph_id": "para_508"
      },
      {
        "text": "member’s support are out of luck.",
        "paragraph_id": "para_509"
      },
      {
        "text": "While the Regulations do not discriminate on the basis of",
        "paragraph_id": "para_510"
      },
      {
        "text": "viewpoint, only demonstrations favored by a current member",
        "paragraph_id": "para_511"
      },
      {
        "text": "of Congress will be permitted. This type of preferential",
        "paragraph_id": "para_512"
      },
      {
        "text": "treatment on the Steps of the Capitol is unreasonable. “It is",
        "paragraph_id": "para_513"
      },
      {
        "text": "fundamental to our free speech rights that the government",
        "paragraph_id": "para_514"
      },
      {
        "text": "cannot pick and choose between speakers, not when regulating",
        "paragraph_id": "para_515"
      },
      {
        "text": "and not when enforcing the laws.” Frederick Douglass Found.,",
        "paragraph_id": "para_516"
      },
      {
        "text": "Inc. v. District of Columbia, 82 F.4th 1122, 1141 (D.C. Cir.",
        "paragraph_id": "para_517"
      },
      {
        "text": "2023); see also Dellums, 566 F.2d at 179–80 (explaining that a",
        "paragraph_id": "para_518"
      },
      {
        "text": "law containing “no standards whatever for its enforcement”",
        "paragraph_id": "para_519"
      },
      {
        "text": "gives officials “too much discretion” and may therefore be",
        "paragraph_id": "para_520"
      },
      {
        "text": "“enforced selectively against those who hold unpopular points",
        "paragraph_id": "para_521"
      },
      {
        "text": "of view”). The Supreme Court has long recognized that it is",
        "paragraph_id": "para_522"
      },
      {
        "text": "“clearly unconstitutional to enable a public official to",
        "paragraph_id": "para_523"
      },
      {
        "text": "18",
        "paragraph_id": "para_524"
      },
      {
        "text": "determine which expressions of view will be permitted.” Cox",
        "paragraph_id": "para_525"
      },
      {
        "text": "v. Louisiana, 379 U.S. 536, 557 (1965); cf. Miller v. City of",
        "paragraph_id": "para_526"
      },
      {
        "text": "Cincinnati, 622 F.3d 524, 533–36 (6th Cir. 2010) (rejecting",
        "paragraph_id": "para_527"
      },
      {
        "text": "discretionary sponsorship requirement for rallies and press",
        "paragraph_id": "para_528"
      },
      {
        "text": "conferences held inside a city hall that was characterized as a",
        "paragraph_id": "para_529"
      },
      {
        "text": "nonpublic or limited public forum).",
        "paragraph_id": "para_530"
      },
      {
        "text": "Without the support of a member of Congress, Mahoney",
        "paragraph_id": "para_531"
      },
      {
        "text": "is prohibited from praying and advocating for the end of the",
        "paragraph_id": "para_532"
      },
      {
        "text": "federal funding of abortion on the Eastern Steps. The Exception",
        "paragraph_id": "para_533"
      },
      {
        "text": "unreasonably allows members of Congress to serve as",
        "paragraph_id": "para_534"
      },
      {
        "text": "gatekeepers of speech on the Eastern Steps. Because the",
        "paragraph_id": "para_535"
      },
      {
        "text": "protection of unpopular speech and advocacy is central to the",
        "paragraph_id": "para_536"
      },
      {
        "text": "First Amendment, we cannot leave it to the selective",
        "paragraph_id": "para_537"
      },
      {
        "text": "enforcement of members.",
        "paragraph_id": "para_538"
      },
      {
        "text": "3.",
        "paragraph_id": "para_539"
      },
      {
        "text": "The Board defends the reasonableness of its Regulations",
        "paragraph_id": "para_540"
      },
      {
        "text": "by emphasizing the special status of members of Congress. The",
        "paragraph_id": "para_541"
      },
      {
        "text": "Capitol is where members perform their legislative duties, and",
        "paragraph_id": "para_542"
      },
      {
        "text": "members are less likely to threaten the security of the Capitol.",
        "paragraph_id": "para_543"
      },
      {
        "text": "We take no issue with the fact that members may be",
        "paragraph_id": "para_544"
      },
      {
        "text": "afforded special access to the Eastern Steps, which are a",
        "paragraph_id": "para_545"
      },
      {
        "text": "nonpublic forum primarily used to enter and exit the Capitol.",
        "paragraph_id": "para_546"
      },
      {
        "text": "The Board may craft reasonable regulations that account for the",
        "paragraph_id": "para_547"
      },
      {
        "text": "status of members in their workplace, as well as their interests",
        "paragraph_id": "para_548"
      },
      {
        "text": "in speaking in and around the Capitol. These Regulations,",
        "paragraph_id": "para_549"
      },
      {
        "text": "however, unreasonably permit the public to demonstrate only",
        "paragraph_id": "para_550"
      },
      {
        "text": "after securing congressional sponsorship and attendance.",
        "paragraph_id": "para_551"
      },
      {
        "text": "The Board relatedly points to the fact that any",
        "paragraph_id": "para_552"
      },
      {
        "text": "demonstrations must be in a member’s “official capacity.”",
        "paragraph_id": "para_553"
      },
      {
        "text": "Traffic Regulations § 12.2.20. The Board suggests the",
        "paragraph_id": "para_554"
      },
      {
        "text": "Exception reasonably accommodates the speech rights of",
        "paragraph_id": "para_555"
      },
      {
        "text": "19",
        "paragraph_id": "para_556"
      },
      {
        "text": "members in and around the Capitol, and any consequences for",
        "paragraph_id": "para_557"
      },
      {
        "text": "public speech are incidental to serving that purpose. But",
        "paragraph_id": "para_558"
      },
      {
        "text": "requiring that speech be in the member’s official capacity does",
        "paragraph_id": "para_559"
      },
      {
        "text": "not limit the total discretion that members have to choose who",
        "paragraph_id": "para_560"
      },
      {
        "text": "may join their demonstrations and what messages may be",
        "paragraph_id": "para_561"
      },
      {
        "text": "conveyed. The Board has stipulated that to “sponsor” an event",
        "paragraph_id": "para_562"
      },
      {
        "text": "simply means that “the Member is supporting the activity of",
        "paragraph_id": "para_563"
      },
      {
        "text": "another who is organizing the activity.” J.A. 412 n.13. Nothing",
        "paragraph_id": "para_564"
      },
      {
        "text": "in this stipulation, or the Regulations, suggests there is any",
        "paragraph_id": "para_565"
      },
      {
        "text": "limit to member discretion with regard to sponsoring the",
        "paragraph_id": "para_566"
      },
      {
        "text": "speech of others. On the Eastern Steps, it may well be",
        "paragraph_id": "para_567"
      },
      {
        "text": "reasonable to permit preferential speech rights for members,",
        "paragraph_id": "para_568"
      },
      {
        "text": "but it is unreasonable to allow members unbridled discretion to",
        "paragraph_id": "para_569"
      },
      {
        "text": "choose which speech will be sponsored.",

        "paragraph_id": "para_575"
      },
      {
        "text": "the Regulations entirely prohibit even small demonstrations",
        "paragraph_id": "para_576"
      },
      {
        "text": "that lack member sponsorship. Even accepting the Board’s",
        "paragraph_id": "para_577"
      },
      {
        "text": "judgment about relative security risks, that rationale cannot",
        "paragraph_id": "para_578"
      },
      {
        "text": "justify a wholly discretionary sponsorship system for public",
        "paragraph_id": "para_579"
      },
      {
        "text": "speech.",

        "text": "On the Eastern Steps, the Board may craft reasonable",

        "text": "judgment for Mahoney on his First Amendment claim.4",
        "paragraph_id": "para_594"
      },
      {
        "text": "III.",
        "paragraph_id": "para_595"
      },
      {
        "text": "While the district court correctly concluded that the Traffic",
        "paragraph_id": "para_596"
      },
      {
        "text": "Regulations violate the First Amendment, it erred in entering a",
        "paragraph_id": "para_597"
      },
      {
        "text": "universal injunction.5 The district court enjoined the Board",
        "paragraph_id": "para_598"
      },
      {
        "text": "from enforcing the Traffic Regulations on the lower section of",
        "paragraph_id": "para_599"
      },
      {
        "text": "the Eastern Steps against anyone, regardless of any connection",
        "paragraph_id": "para_600"
      },
      {
        "text": "to Mahoney. The Supreme Court’s decision in Trump v. CASA,",
        "paragraph_id": "para_601"
      },
      {
        "text": "Inc., which was issued after the close of briefing in this appeal,",
        "paragraph_id": "para_602"
      },
      {
        "text": "holds that district courts lack equitable authority to enter such",
        "paragraph_id": "para_603"
      },
      {
        "text": "universal injunctions. 145 S. Ct. 2540, 2554 (2025). Instead,",
        "paragraph_id": "para_604"
      },
      {
        "text": "the “maximum a court can provide” is an injunction that",
        "paragraph_id": "para_605"
      },
      {
        "text": "provides “complete relief to the plaintiffs before the court.” Id.",
        "paragraph_id": "para_606"
      },
      {
        "text": "at 2557–58. In light of CASA, the universal injunction was an",
        "paragraph_id": "para_607"
      },
      {
        "text": "abuse of discretion.",
        "paragraph_id": "para_608"
      },
      {
        "text": "Mahoney maintains that CASA is inapposite because it",
        "paragraph_id": "para_609"
      },
      {
        "text": "involved the Fourteenth Amendment and a preliminary",
        "paragraph_id": "para_610"
      },
      {
        "text": "injunction, whereas his case raises a First Amendment",
        "paragraph_id": "para_611"
      },
      {
        "text": "challenge and the grant of a permanent injunction. These",
        "paragraph_id": "para_612"
      },
      {
        "text": "efforts to distinguish CASA are unavailing. CASA reflects limits",
        "paragraph_id": "para_613"
      },
      {
        "text": "4 Because we conclude summary judgment is appropriate on",
        "paragraph_id": "para_614"
      },
      {
        "text": "Mahoney’s First Amendment claim, like the district court, we do not",
        "paragraph_id": "para_615"
      },
      {
        "text": "reach his Fifth Amendment claim.",

      },

        "text": "on the judiciary’s equitable power under the Judiciary Act of",
        "paragraph_id": "para_622"
      },
      {
        "text": "1789. Id. at 2554 (“Because the universal injunction lacks a",
        "paragraph_id": "para_623"
      },
      {
        "text": "historical pedigree, it falls outside the bounds of a federal",
        "paragraph_id": "para_624"
      },
      {
        "text": "court’s equitable authority under the Judiciary Act.”). The",
        "paragraph_id": "para_625"
      },
      {
        "text": "principle of party-specific relief applies regardless of the",
        "paragraph_id": "para_626"
      },
      {
        "text": "substantive basis of a claim or type of injunction.6",
        "paragraph_id": "para_627"
      },
      {
        "text": "Alternatively, Mahoney argues the Board forfeited any",
        "paragraph_id": "para_628"
      },
      {
        "text": "objection to the universal nature of the injunction because it did",
        "paragraph_id": "para_629"
      },
      {
        "text": "not object to the scope of relief in its summary judgment",
        "paragraph_id": "para_630"
      },
      {
        "text": "briefing.",
        "paragraph_id": "para_631"
      },
      {
        "text": "It is well established that “issues and legal theories not",
        "paragraph_id": "para_632"
      },
      {
        "text": "asserted in the district court ordinarily will not be heard on",
        "paragraph_id": "para_633"
      },
      {
        "text": "appeal.” Prime Time Int’l Co. v. Vilsack, 599 F.3d 678, 686",
        "paragraph_id": "para_634"
      },
      {
        "text": "(D.C. Cir. 2010) (cleaned up). We retain discretion, however,",
        "paragraph_id": "para_635"
      },
      {
        "text": "to excuse forfeiture in some circumstances, for example when",
        "paragraph_id": "para_636"
      },
      {
        "text": "“the proper resolution is beyond any doubt” or “injustice might",
        "paragraph_id": "para_637"
      },
      {
        "text": "otherwise result.” Singleton v. Wulff, 428 U.S. 106, 121 (1976)",
        "paragraph_id": "para_638"
      },
      {
        "text": "(cleaned up). We are more likely to excuse forfeiture when",
        "paragraph_id": "para_639"
      },
      {
        "text": "“both parties have fully addressed the issue on appeal.” Liff v.",
        "paragraph_id": "para_640"
      },
      {
        "text": "Off. of Inspector Gen. for U.S. Dep’t of Labor, 881 F.3d 912,",
        "paragraph_id": "para_641"
      },
      {
        "text": "919 (D.C. Cir. 2018) (cleaned up). An “intervening change in",
        "paragraph_id": "para_642"
      },
      {
        "text": "the law” may also call for an exercise of this discretion. Flynn",
        "paragraph_id": "para_643"
      },
      {
        "text": "v. Commissioner, 269 F.3d 1064, 1069 (D.C. Cir. 2001).",
        "paragraph_id": "para_644"
      },
      {
        "text": "The circumstances warrant excusing the Board’s failure to",
        "paragraph_id": "para_645"
      },
      {
        "text": "raise an objection to the universal injunction in its summary",
        "paragraph_id": "para_646"
      },
      {
        "text": "judgment briefing. We note the Board objected to the",
        "paragraph_id": "para_647"
      },
      {
        "text": "injunction’s universal scope in its Rule 59(e) motion, and the",
        "paragraph_id": "para_648"
      },
      {
        "text": "6 Mahoney points to no other source of equitable authority to support",
        "paragraph_id": "para_649"
      },
      {
        "text": "the injunction. Because CASA’s holding regarding the Judiciary Act",
        "paragraph_id": "para_650"
      },
      {
        "text": "resolves this case, we need not address the Board’s argument that",
        "paragraph_id": "para_651"
      },
      {
        "text": "universal injunctions violate Article III. See 145 S. Ct. at 2550 n.4.",

      {

      {
        "text": "district court considered and rejected the objection.7 On appeal,",
        "paragraph_id": "para_654"
      },
      {
        "text": "both parties briefed the question of whether a universal",
        "paragraph_id": "para_655"
      },
      {
        "text": "injunction was within the district court’s equitable authority.",
        "paragraph_id": "para_656"
      },
      {
        "text": "And the Supreme Court’s intervening decision in CASA leaves",
        "paragraph_id": "para_657"
      },
      {
        "text": "no doubt about the issue’s proper resolution. We conclude it is",
        "paragraph_id": "para_658"
      },
      {
        "text": "an appropriate exercise of our discretion to reach the Board’s",
        "paragraph_id": "para_659"
      },
      {
        "text": "challenge to the scope of the injunction.",
        "paragraph_id": "para_660"
      },
      {
        "text": "The district court’s universal injunction exceeded its",
        "paragraph_id": "para_661"
      },
      {
        "text": "equitable authority because it provided more than complete",
        "paragraph_id": "para_662"
      },
      {
        "text": "relief to Mahoney. We therefore vacate the injunction. In doing",
        "paragraph_id": "para_663"
      },
      {
        "text": "so, we recognize there may be some “doctrinal complexities”",
        "paragraph_id": "para_664"
      },
      {
        "text": "relevant to the scope of relief in the First Amendment context.",
        "paragraph_id": "para_665"
      },
      {
        "text": "See Griffin v. HM Fla.-ORL, LLC, 144 S. Ct. 1, 2 (2023)",
        "paragraph_id": "para_666"
      },
      {
        "text": "(statement of Kavanaugh, J.). Because the parties did not have",
        "paragraph_id": "para_667"
      },
      {
        "text": "an opportunity to brief the proper scope of the injunction after",
        "paragraph_id": "para_668"
      },
      {
        "text": "CASA, we remand for the district court to fashion an",
        "paragraph_id": "para_669"
      },
      {
        "text": "appropriate injunction that remedies Mahoney’s injury.",
        "paragraph_id": "para_670"
      },
      {

        "text": "The Eastern Steps are a nonpublic forum because they rise",
        "paragraph_id": "para_672"
      },
      {
        "text": "above the surrounding Capitol Grounds and serve as an",

        "text": "entrance to the Capitol for members and their staff. The Board",
        "paragraph_id": "para_674"
      },
      {
        "text": "is free to take reasonable measures to secure the Capitol and",
        "paragraph_id": "para_675"
      },
      {
        "text": "provide members with special access to the Steps. What the",
        "paragraph_id": "para_676"
      },
      {
        "text": "Board cannot do, however, is make the public’s right to",
        "paragraph_id": "para_677"
      },
      {
        "text": "demonstrate at the seat of Congress contingent on securing the",
        "paragraph_id": "para_678"
      },
      {
        "text": "goodwill of a member of Congress. We affirm the grant of",
        "paragraph_id": "para_679"
      },
      {

        "paragraph_id": "para_699"
      },
      {
        "text": "Capitol Grounds, §§ 12.1, 12.2 (“Traffic Regulations”); see",
        "paragraph_id": "para_700"

        "text": "D.C. Code § 22-1307(b)(1). The same Traffic Regulations",

        "text": "permit Members of Congress and an unlimited number of their",

        "text": "framework adopted by the Supreme Court in Perry Educ. Ass’n",

      },
      {
        "text": "v. Perry Loc. Educators’ Ass’n, 460 U.S. 37, 45 (1983), Chief",
        "paragraph_id": "para_790"
      },
      {
        "text": "Judge Green held that “[t]he Capitol of the United States, a",
        "paragraph_id": "para_791"
      },
      {

      },
      {
        "text": "national historical shrine and the political centerpiece of the",
        "paragraph_id": "para_793"
      },
      {
        "text": "Republic,” including the Eastern Steps, is a public forum that",
        "paragraph_id": "para_794"
      },
      {
        "text": "“may not ordinarily be closed to the public for reasonable use.”",
        "paragraph_id": "para_795"
      },
      {
        "text": "Id. at 198. Therefore, “individual citizens could not be held to",
        "paragraph_id": "para_796"
      },
      {
        "text": "be ‘without lawful authority to remain . . . thereon’, within the",
        "paragraph_id": "para_797"
      },
      {
        "text": "meaning of the unlawful entry statute, in the absence of some",
        "paragraph_id": "para_798"
      },
      {
        "text": "other, specific bar to their presence.” Id. A separate statute,",
        "paragraph_id": "para_799"
      },
      {
        "text": "D.C. Code § 9–124, which banned all use of the Capitol as a",
        "paragraph_id": "para_800"
      },
      {
        "text": "public forum “except as permitted by the Speaker of the House",
        "paragraph_id": "para_801"
      },
      {
        "text": "and the President of the Senate,” could not serve as such a bar",
        "paragraph_id": "para_802"
      },
      {
        "text": "because it was unconstitutionally vague as enacted. Id. at 198–",
        "paragraph_id": "para_803"
      },
      {
        "text": "200. Chief Judge Greene proceeded to adopt a limiting",
        "paragraph_id": "para_804"
      },
      {
        "text": "construction of Section 124 as permitting “the imposition of",
        "paragraph_id": "para_805"
      },
      {
        "text": "criminal punishment” solely “for acts or conduct which",
        "paragraph_id": "para_806"
      },
      {
        "text": "interferes with the orderly processes of the Congress, or with",
        "paragraph_id": "para_807"
      },
      {
        "text": "the safety of individual legislators, staff members, visitors, or",
        "paragraph_id": "para_808"
      },
      {
        "text": "tourists, or their right to be free from intimidation, undue",
        "paragraph_id": "para_809"
      },
      {
        "text": "pressure, noise, or inconvenience.” 566 F.2d at 204.",
        "paragraph_id": "para_810"
      },
      {
        "text": "Dellums, following Nicholson, held that the “plaintiffs",
        "paragraph_id": "para_811"
      },
      {
        "text": "could not constitutionally have been arrested as a group under",
        "paragraph_id": "para_812"
      },
      {
        "text": "either [D.C. Code § 9–124] or [D.C. Code § 22–3102] unless",
        "paragraph_id": "para_813"
      },
      {
        "text": "[the Chief of the Capitol Police] had reason to believe: (1) that",
        "paragraph_id": "para_814"
      },
      {
        "text": "the plaintiffs comprised one of the groups that could be banned",
        "paragraph_id": "para_815"
      },
      {
        "text": "or ordered from the Capitol under [the construction of Section",
        "paragraph_id": "para_816"
      },
      {
        "text": "124 in] Nicholson; (2) that orders to disperse had been given",
        "paragraph_id": "para_817"
      },
      {
        "text": "which apprised the crowd as a whole that it was under an",
        "paragraph_id": "para_818"
      },
      {
        "text": "obligation to leave; and (3) that a reasonable opportunity had",
        "paragraph_id": "para_819"
      },
      {
        "text": "been given the plaintiffs to leave the Capitol.” 566 F.2d at 183.",
        "paragraph_id": "para_820"
      },
      {
        "text": "The court thus embraced Chief Judge Greene’s construction of",
        "paragraph_id": "para_821"
      },
      {
        "text": "the statutes at issue in light of his antecedent holding that the",
        "paragraph_id": "para_822"
      },
      {
        "text": "Eastern Steps are a public forum.",
        "paragraph_id": "para_823"
      },
      {
        "text": "“[A]t stake” in Dellums was the “loss of an opportunity to",
        "paragraph_id": "para_824"
      },
      {
        "text": "express to Congress one’s dissatisfaction with the laws and",
        "paragraph_id": "para_825"
      },
      {
        "text": "5",
        "paragraph_id": "para_826"
      },
      {
        "text": "policies of the United States” in a forum likely to attract “the",
        "paragraph_id": "para_827"
      },
      {
        "text": "attention of a mass audience and, in turn, . . . the attention of a",
        "paragraph_id": "para_828"
      },
      {
        "text": "national legislature.” Id. at 195. The stakes are no different",
        "paragraph_id": "para_829"
      },
      {
        "text": "today when the Board’s regulations prohibit Mahoney and his",
        "paragraph_id": "para_830"
      },
      {
        "text": "associates from engaging in a peaceful vigil on the Eastern",
        "paragraph_id": "para_831"
      },
      {
        "text": "Steps to call the attention of Members of Congress and the",
        "paragraph_id": "para_832"
      },
      {
        "text": "public to their cause. Unlike other forms of communication",
        "paragraph_id": "para_833"
      },
      {
        "text": "with the legislative branch of the government, “[t]he",
        "paragraph_id": "para_834"
      },
      {
        "text": "demonstration, the picket line, and the myriad other forms of",
        "paragraph_id": "para_835"
      },
      {
        "text": "protest which abound in our society each offer peculiarly",
        "paragraph_id": "para_836"
      },
      {
        "text": "important opportunities in which speakers may at once",
        "paragraph_id": "para_837"
      },
      {
        "text": "persuade, accuse, and seek sympathy or political support, all in",
        "paragraph_id": "para_838"
      },
      {
        "text": "a manner likely to be noticed. Loss of such an opportunity is",
        "paragraph_id": "para_839"
      },
      {
        "text": "surely not insignificant.” Id.",
        "paragraph_id": "para_840"
      },
      {
        "text": "The majority begins its analysis on the faulty premise that",
        "paragraph_id": "para_841"
      },
      {
        "text": "this court “ha[s] not previously characterized the Eastern Steps",
        "paragraph_id": "para_842"
      },
      {
        "text": "for purposes of forum analysis.” Op. 9. It thereafter attempts",
        "paragraph_id": "para_843"
      },
      {
        "text": "to diminish the persuasive force of Dellums by stating this court",
        "paragraph_id": "para_844"
      },
      {
        "text": "neither engaged in a forum analysis nor held that the steps must",
        "paragraph_id": "para_845"
      },
      {
        "text": "remain open to public demonstrations. Id. at 13. The majority,",
        "paragraph_id": "para_846"
      },
      {
        "text": "ignoring Dellums and subsequent decisions by this court, is",
        "paragraph_id": "para_847"
      },
      {
        "text": "wrong on both the law and the facts.",
        "paragraph_id": "para_848"
      },
      {
        "text": "First, the majority, focusing solely on the Bivens holding",
        "paragraph_id": "para_849"
      },
      {
        "text": "in Dellums, overlooks that this court applied Nicholson to",
        "paragraph_id": "para_850"
      },
      {
        "text": "resolve questions about the Dellums defendants’ First",
        "paragraph_id": "para_851"
      },
      {
        "text": "Amendment right to protest peacefully on the Eastern Steps.",
        "paragraph_id": "para_852"
      },
      {
        "text": "This court reviewed the First Amendment holding and forum",
        "paragraph_id": "para_853"
      },
      {
        "text": "analysis in Nicholson before relying on it as “the controlling",
        "paragraph_id": "para_854"
      },
      {
        "text": "case” and a correct statement of the law, Dellums, 566 F.2d at",
        "paragraph_id": "para_855"
      },
      {
        "text": "185, in affirming the jury’s verdicts for false arrest, false",
        "paragraph_id": "para_856"
      },
      {
        "text": "imprisonment, and violation of the plaintiffs’ First Amendment",
        "paragraph_id": "para_857"
      },
      {
        "text": "rights, id. at 179–183; see id. at 197 n.89. That review included",
        "paragraph_id": "para_858"
      },
      {
        "text": "Chief Judge Greene’s prescient forum analysis citing Supreme",
        "paragraph_id": "para_859"
      },
      {

      },
      {
        "text": "Court decisions from 1939 through 1969, which led him to",
        "paragraph_id": "para_861"
      },
      {
        "text": "conclude that the Capitol is a “preeminently public building,”",
        "paragraph_id": "para_862"
      },
      {
        "text": "and that its surrounding grounds could not “be declared off",
        "paragraph_id": "para_863"
      },
      {
        "text": "limits to the people,” unless the activity in question was",
        "paragraph_id": "para_864"
      },
      {
        "text": "obstructive, dangerous, or destructive. Nicholson, 566 F.2d at",
        "paragraph_id": "para_865"
      },
      {
        "text": "198, 204. All the parties to Dellums, including the Justice",
        "paragraph_id": "para_866"
      },
      {
        "text": "Department and the Chief of the Capitol Police conceded that",
        "paragraph_id": "para_867"
      },
      {
        "text": "Nicholson was a correct and controlling statement of the law.",
        "paragraph_id": "para_868"
      },
      {
        "text": "Id. at 177.",
        "paragraph_id": "para_869"
      },
      {
        "text": "Dellums is not an outlier, for this court has repeatedly",
        "paragraph_id": "para_870"
      },
      {
        "text": "characterized the Capitol grounds, including the Eastern Steps,",
        "paragraph_id": "para_871"
      },
      {
        "text": "as a traditional public forum. See, e.g., Lederman v. United",
        "paragraph_id": "para_872"
      },
      {
        "text": "States, 291 F.3d 36, 43 (D.C. Cir. 2002), and Jeannette Rankin",
        "paragraph_id": "para_873"
      },
      {
        "text": "Brigade v. Chief of Capitol Police, 342 F. Supp. 575 (D.D.C.",
        "paragraph_id": "para_874"
      },
      {
        "text": "1972), discussed infra. The majority also ignores the import of",
        "paragraph_id": "para_875"
      },
      {
        "text": "Supreme Court precedent characterizing State legislative sites",
        "paragraph_id": "para_876"
      },
      {
        "text": "as traditional public fora, including in Edwards, 372 U.S. 229,",

      {
        "text": "In this day of the violent confrontation, the harsh, non-",
        "paragraph_id": "para_887"
      },
      {
        "text": "negotiable demand, the disregard of the most",
        "paragraph_id": "para_888"
      },
      {
        "text": "elementary forms of civilized discourse, it is",
        "paragraph_id": "para_889"
      },
      {
        "text": "especially important that peaceful speech and",
        "paragraph_id": "para_890"
      },
      {
        "text": "courteous persuasion be given their rightful chance. It",
        "paragraph_id": "para_891"
      },
      {
        "text": "would be strange, indeed, if our constitutional system,",
        "paragraph_id": "para_892"
      },
      {

      },
      {
        "text": "and especially the First Amendment, were to",
        "paragraph_id": "para_894"
      },
      {
        "text": "countenance the congregation on the grounds",
        "paragraph_id": "para_895"
      },
      {
        "text": "occupied by the national legislature of all manner of",
        "paragraph_id": "para_896"
      },
      {
        "text": "groups except those who wish to speak out peacefully",
        "paragraph_id": "para_897"
      },
      {
        "text": "on the controversial issues of the day. That is not the",
        "paragraph_id": "para_898"
      },
      {
        "text": "mark set by the Bill of Rights.",
        "paragraph_id": "para_899"
      },
      {
        "text": "Id. at 202. Dellums and the court’s subsequent decisions are",
        "paragraph_id": "para_900"
      },
      {
        "text": "the controlling First Amendment law in this Circuit.",
        "paragraph_id": "para_901"
      },
      {
        "text": "Furthermore, the majority overlooks that Dellums and",
        "paragraph_id": "para_902"
      },
      {
        "text": "Nicholson were controlled by the Supreme Court precedent in",
        "paragraph_id": "para_903"
      },
      {
        "text": "Edwards, 372 U.S. 229. See Dellums, 566 F.2d at 194–95, 195",
        "paragraph_id": "para_904"
      },
      {
        "text": "nn.82 & 86; Nicholson, id. at 202–03. In Edwards, the",
        "paragraph_id": "para_905"
      },
      {
        "text": "Supreme Court reversed state breach-of-peace convictions of",
        "paragraph_id": "para_906"
      },
      {
        "text": "187 African American students who peacefully demonstrated",
        "paragraph_id": "para_907"
      },
      {
        "text": "against South Carolina’s segregationist laws on the grounds of",
        "paragraph_id": "para_908"
      },
      {
        "text": "the South Carolina State Capitol. 372 U.S. at 238. The Court",
        "paragraph_id": "para_909"
      },
      {
        "text": "concluded that the students’ peaceful demonstration was “an",
        "paragraph_id": "para_910"
      },
      {
        "text": "exercise of [free speech] in [its] most pristine and classic form”",
        "paragraph_id": "para_911"
      },
      {
        "text": "and that the students’ arrest and conviction was therefore",
        "paragraph_id": "para_912"
      },
      {
        "text": "contrary to the First Amendment of the Constitution. Id. at 235.",
        "paragraph_id": "para_913"
      },
      {
        "text": "Second, the majority errs as a matter of fact in concluding",
        "paragraph_id": "para_914"
      },
      {
        "text": "that the Eastern Steps are not a traditional public forum. Op.",
        "paragraph_id": "para_915"
      },
      {
        "text": "14. In fact, there is a rich First Amendment tradition of",
        "paragraph_id": "para_916"
      },
      {
        "text": "expressive activity at or near legislative buildings marking",
        "paragraph_id": "para_917"
      },
      {
        "text": "important moments of civic resistance in this Nation’s history.",
        "paragraph_id": "para_918"
      },
      {
        "text": "For example, in Cox, 379 U.S. 536, college students assembled",
        "paragraph_id": "para_919"
      },
      {
        "text": "at the Louisiana State Capitol before marching to the",
        "paragraph_id": "para_920"
      },
      {
        "text": "courthouse to protest racial segregation and discrimination. Id.",
        "paragraph_id": "para_921"
      },
      {
        "text": "at 539, 545–46. And Reverend Martin Luther King Jr.",
        "paragraph_id": "para_922"
      },
      {
        "text": "delivered his famous “How Long, Not Long” speech",
        "paragraph_id": "para_923"
      },
      {
        "text": "campaigning for voting rights on the steps of the Alabama State",
        "paragraph_id": "para_924"
      },
      {
        "text": "Capitol to thousands of nonviolent demonstrators following a",
        "paragraph_id": "para_925"
      },
      {

        "text": "two of the many anti-war protests on the Eastern Steps in the",
        "paragraph_id": "para_945"
      },
      {
        "text": "sixties and seventies. Dellums, 566 F.2d at 173; Nicholson, id.",
        "paragraph_id": "para_946"
      },
      {
        "text": "at 197. More recently, March 12, 1990, marked the day of a",
        "paragraph_id": "para_947"
      },
      {
        "text": "pivotal disability rights protest where over sixty activists",
        "paragraph_id": "para_948"
      },
      {
        "text": "crawled up the Capitol steps to demand the passage of the",
        "paragraph_id": "para_949"
      },
      {
        "text": "American with Disabilities Act. The Iconic Civil Rights",
        "paragraph_id": "para_950"
      },
      {
        "text": "Protest You Don’t Know About, PBS (Mar. 11, 2025),",
        "paragraph_id": "para_951"
      },
      {

        "text": "The court emphasized the “fundamental function of a",
        "paragraph_id": "para_966"
      },
      {
        "text": "legislature in a democratic society assumes accessibility” to",
        "paragraph_id": "para_967"
      },
      {
        "text": "“popular opinion,” id., and distinguished between the whole",
        "paragraph_id": "para_968"
      },
      {
        "text": "exterior grounds of the Capitol, a traditional public forum, and",
        "paragraph_id": "para_969"
      },
      {
        "text": "the interior of the Capitol buildings themselves, id. at 584. The",
        "paragraph_id": "para_970"
      },

        "text": "Supreme Court affirmed. Chief of Capitol Police v. Jeannette",

        "text": "Yet despite the long line of precedent and tradition of",
        "paragraph_id": "para_977"
      },
      {
        "text": "expressive activity on the Eastern Steps, the majority concludes",
        "paragraph_id": "para_978"
      },
      {
        "text": "that the Eastern Steps are a nonpublic forum, largely because",
        "paragraph_id": "para_979"
      },
      {
        "text": "the steps are “physically integrated with the Capitol,” and their",
        "paragraph_id": "para_980"
      },
      {
        "text": "“specialized purpose” is to “provide a secondary entrance and",
        "paragraph_id": "para_981"
      },
      {
        "text": "exit to the Capitol for members of Congress and their staff.”",
        "paragraph_id": "para_982"
      },
      {
        "text": "Op. 11, 12. This conclusion too rests on faulty premises.",
        "paragraph_id": "para_983"
      },
      {
        "text": "First, the physical characteristics of the steps do not",
        "paragraph_id": "para_984"
      },
      {
        "text": "“warrant distinguishing” them from the rest of the Capitol",
        "paragraph_id": "para_985"
      },
      {
        "text": "Grounds. Lederman, 291 F.3d at 43. Again, contrary to",
        "paragraph_id": "para_986"
      },
      {
        "text": "precedent, the majority ignores that this court has concluded",
        "paragraph_id": "para_987"
      },
      {
        "text": "the Eastern Steps are “architectural[ly] integrat[ed],” Hodge v.",
        "paragraph_id": "para_988"
      },
      {
        "text": "Talkin, 799 F.3d 1145, 1158 (D.C. Cir. 2015), with the",
        "paragraph_id": "para_989"
      },
      {
        "text": "surrounding East Front Plaza. The marble steps and the paving",
        "paragraph_id": "para_990"
      },
      {
        "text": "of the Plaza create an impression of a unified, open gathering",
        "paragraph_id": "para_991"
      },
      {
        "text": "space that gradually ascends to the Capitol’s entrance. The",
        "paragraph_id": "para_992"
      },
      {
        "text": "base of the Eastern Capitol Steps, in particular, is entirely",
        "paragraph_id": "para_993"
      },
      {

        "text": "Eastern House and Senate Steps are only slightly elevated from",
        "paragraph_id": "para_997"
      },
      {
        "text": "the Plaza. These steps unfold above the bases in broad",
        "paragraph_id": "para_998"
      },
      {
        "text": "cascading marble terraces that readily serve as speaking",
        "paragraph_id": "para_999"
      },
      {
        "text": "platforms and places for congregating, rather than steps solely",
        "paragraph_id": "para_1000"
      },
      {
        "text": "dedicated to entering and exiting a building. So integrated with",
        "paragraph_id": "para_1001"
      },
      {
        "text": "the surrounding East Front Plaza and Capitol Grounds, the",
        "paragraph_id": "para_1002"
      },
      {
        "text": "Eastern Steps function no differently than a sidewalk leading",
        "paragraph_id": "para_1003"
      },
      {
        "text": "up to a legislative building where people can sit on benches,",
        "paragraph_id": "para_1004"
      },
      {
        "text": "congregate, and engage in expressive activity. See Jeannette",
        "paragraph_id": "para_1005"
      },
      {
        "text": "Rankin Brigade, 342 F. Supp. at 584; Edwards, 372 U.S. at",
        "paragraph_id": "para_1006"
      },
      {
        "text": "231–32, 235.",
        "paragraph_id": "para_1007"
      },
      {
        "text": "Second, the Eastern Steps are distinguishable in their",
        "paragraph_id": "para_1008"
      },
      {
        "text": "appearance and function from the other nonpublic fora",
        "paragraph_id": "para_1009"
      },
      {
        "text": "identified by the majority. Unlike the Supreme Court plaza and",
        "paragraph_id": "para_1010"
      },
      {
        "text": "the steps leading thereto, the East Front Plaza and the Eastern",
        "paragraph_id": "para_1011"
      },
      {
        "text": "Steps are not significantly “elevated from the sidewalk” nor",
        "paragraph_id": "para_1012"
      },
      {
        "text": "cordoned off by a “patterned marble wall” defining their",
        "paragraph_id": "para_1013"
      },
      {
        "text": "“boundaries.” Hodge, 799 F.3d at 1158. Neither is there any",
        "paragraph_id": "para_1014"
      },
      {
        "text": "other “physical threshold” separating the Eastern Steps from",
        "paragraph_id": "para_1015"
      },
      {
        "text": "“the remainder of the public Grounds in ways that make it",
        "paragraph_id": "para_1016"
      },
      {
        "text": "uniquely ‘nonpublic.’” United States v. Nassif, 97 F.4th 968,",
        "paragraph_id": "para_1017"
      },
      {
        "text": "975 (D.C. Cir. 2024) (quoting Lederman, 291 F.3d at 42).",
        "paragraph_id": "para_1018"
      },
      {
        "text": "The open and accessible architecture of the East Front",
        "paragraph_id": "para_1019"
      },
      {
        "text": "Plaza and Eastern Steps underscores that the main function of",
        "paragraph_id": "para_1020"
      },
      {
        "text": "the legislative branch of the government is to legislate for and",
        "paragraph_id": "para_1021"
      },
      {
        "text": "on behalf of its citizenry. In Jeannette Rankin Brigade, the",
        "paragraph_id": "para_1022"
      },
      {
        "text": "court observed that “traditionally, the judiciary does not decide",
        "paragraph_id": "para_1023"
      },
      {
        "text": "cases by reference to popular opinion,” while “the fundamental",
        "paragraph_id": "para_1024"
      },
      {
        "text": "function of a legislature in a democratic society assumes",
        "paragraph_id": "para_1025"
      },
      {
        "text": "accessibility to such opinion.” 342 F. Supp. at 584. Similarly,",
        "paragraph_id": "para_1026"
      },
      {
        "text": "this court’s holding in Ateba, 133 F.4th 114, that the White",
        "paragraph_id": "para_1027"
      },
      {

        "paragraph_id": "para_1028"
      },
      {
        "text": "House Press Area is a nonpublic forum, is also distinguishable",
        "paragraph_id": "para_1029"
      },
      {
        "text": "because the Press Area is within the interior of the official",
        "paragraph_id": "para_1030"
      },
      {
        "text": "residence of the President, the head of the executive branch,",
        "paragraph_id": "para_1031"
      },
      {
        "text": "and “not generally open to a class of speakers” or to the public",
        "paragraph_id": "para_1032"
      },
      {
        "text": "at large. Id. at 117, 121–23. Similarly, the court’s holding in",
        "paragraph_id": "para_1033"
      },
      {
        "text": "Oberwetter v. Hilliard, 639 F.3d 545, 552 (D.C. Cir. 2011), that",
        "paragraph_id": "para_1034"
      },
      {
        "text": "the interior of the Jefferson Memorial is a nonpublic forum is",
        "paragraph_id": "para_1035"
      },
      {
        "text": "inapposite. Unlike the exterior spaces of legislative buildings,",
        "paragraph_id": "para_1036"
      },
      {
        "text": "“the interior space of national memorials has not traditionally",
        "paragraph_id": "para_1037"
      },
      {
        "text": "‘been used for purposes of assembly, communicating thoughts",
        "paragraph_id": "para_1038"
      },
      {
        "text": "between citizens, and discussing public questions.’” Id.",
        "paragraph_id": "para_1039"
      },
      {
        "text": "(quoting Perry, 460 U.S. at 45).",
        "paragraph_id": "para_1040"
      },
      {
        "text": "Third, the majority’s perception that the Eastern Steps are",
        "paragraph_id": "para_1041"
      },
      {
        "text": "predominantly used to enter and exit the Capitol Building is",
        "paragraph_id": "para_1042"
      },
      {
        "text": "contrary to the stipulated facts in the instant case that “for the",
        "paragraph_id": "para_1043"
      },
      {
        "text": "most part, those who work in the Capitol typically enter the",
        "paragraph_id": "para_1044"
      },
      {
        "text": "building by way of other entrances.” Stipulations of Fact ¶ 68.",
        "paragraph_id": "para_1045"
      },
      {
        "text": "The record shows that Members of Congress and their invitees",
        "paragraph_id": "para_1046"
      },
      {
        "text": "have regularly been demonstrating on the steps. And before",
        "paragraph_id": "para_1047"
      },
      {
        "text": "September 11, 2001, members of the public had done so as",
        "paragraph_id": "para_1048"
      },
      {
        "text": "well. This record does not support a conclusion that the steps",
        "paragraph_id": "para_1049"
      },
      {
        "text": "have served a “specialized use [that] may outweigh the",
        "paragraph_id": "para_1050"
      },
      {
        "text": "attributes that would otherwise mark [them] as [a] public",
        "paragraph_id": "para_1051"
      },
      {
        "text": "forum.” Lederman, 291 F.3d at 43 (alteration omitted)",
        "paragraph_id": "para_1052"
      },
      {
        "text": "(quoting Henderson v. Lujan, 964 F.2d 1179, 1182 (D.C. Cir.",
        "paragraph_id": "para_1053"
      },
      {
        "text": "1992)). The record and this court’s precedent support the",
        "paragraph_id": "para_1054"
      },
      {
        "text": "district court’s conclusion that the Eastern Steps, a part of the",
        "paragraph_id": "para_1055"
      },
      {
        "text": "Capitol Grounds, have historically been opened to the public",
        "paragraph_id": "para_1056"
      },
      {
        "text": "“for purposes of assembly, communicating thoughts between",
        "paragraph_id": "para_1057"
      },
      {
        "text": "citizens, and discussing public questions.” Perry, 460 U.S. at",
        "paragraph_id": "para_1058"
      },
      {
        "text": "45 (quoting Hague v. Comm. for Indus. Org., 307 U.S. 496,",
        "paragraph_id": "para_1059"
      },
      {
        "text": "515 (1939)).",
        "paragraph_id": "para_1060"
      },
      {
        "text": "12",
        "paragraph_id": "para_1061"
      },
      {
        "text": "In sum, the majority charts a path of its own, ignoring",
        "paragraph_id": "para_1062"
      },
      {
        "text": "precedent as well as Supreme Court decisions on when a",
        "paragraph_id": "para_1063"
      },
      {
        "text": "tradition has been established for purposes of the exercise of",
        "paragraph_id": "para_1064"
      },
      {
        "text": "First Amendment rights.",
        "paragraph_id": "para_1065"
      },
      {
        "text": "II.",
        "paragraph_id": "para_1066"
      },
      {
        "text": "Because the Eastern Steps are a traditional public forum,",
        "paragraph_id": "para_1067"
      },
      {
        "text": "“the government’s ability to permissibly restrict expressive",
        "paragraph_id": "para_1068"
      },
      {
        "text": "conduct is very limited: the government may enforce",
        "paragraph_id": "para_1069"
      },
      {
        "text": "reasonable time, place, and manner regulations as long as the",
        "paragraph_id": "para_1070"
      },
      {
        "text": "restrictions ‘are content-neutral, are narrowly tailored to serve",
        "paragraph_id": "para_1071"
      },
      {
        "text": "a significant government interest, and leave open ample",
        "paragraph_id": "para_1072"
      },
      {
        "text": "alternative channels of communication.’” United States v.",
        "paragraph_id": "para_1073"
      },
      {
        "text": "Grace, 461 U.S. 171, 177 (1983) (quoting Perry, 460 U.S. at",
        "paragraph_id": "para_1074"
      },
      {
        "text": "45). Mahoney principally contends, and the district court",
        "paragraph_id": "para_1075"
      },
      {
        "text": "agreed, that the Traffic Regulations’ prohibition on",
        "paragraph_id": "para_1076"
      },
      {
        "text": "demonstrations captures “a vast amount of speech that creates",
        "paragraph_id": "para_1077"
      },
      {
        "text": "no threat to Capitol security,” and is therefore",
        "paragraph_id": "para_1078"
      },
      {
        "text": "unconstitutionally overinclusive because “there are alternative",
        "paragraph_id": "para_1079"
      },
      {
        "text": "security measures that are substantially less restrictive of",
        "paragraph_id": "para_1080"
      },
      {
        "text": "speech.” Appellee’s Br. 18–19. Mahoney is correct.",
        "paragraph_id": "para_1081"
      },
      {
        "text": "After the September 11, 2001, terrorist attacks, the Board",
        "paragraph_id": "para_1082"
      },
      {
        "text": "promulgated the Traffic Regulations, which prohibit “any one",
        "paragraph_id": "para_1083"
      },
      {
        "text": "(1) person or group of persons” from engaging in",
        "paragraph_id": "para_1084"
      },
      {
        "text": "“[d]emonstration activity . . . defined as any protest, rally,",
        "paragraph_id": "para_1085"
      },
      {
        "text": "march, vigil, gathering, assembly, projecting of images or",
        "paragraph_id": "para_1086"
      },
      {
        "text": "similar conduct engaged in for the purpose of expressing",
        "paragraph_id": "para_1087"
      },
      {
        "text": "political, social, religious or other similar ideas, views or",
        "paragraph_id": "para_1088"
      },
      {
        "text": "concerns protected by the First Amendment,” Traffic Regs.",
        "paragraph_id": "para_1089"
      },
      {
        "text": "§§ 12.1.10, 12.1.20, on areas of the Capitol Grounds",
        "paragraph_id": "para_1090"
      },
      {
        "text": "designated as “No Demonstration Permitted,” Stipulations of",
        "paragraph_id": "para_1091"
      },
      {
        "text": "Fact ¶¶ 25–27. The area on which no demonstration activity is",
        "paragraph_id": "para_1092"
      },
      {
        "text": "permitted is depicted on the Capitol Grounds Demonstration",
        "paragraph_id": "para_1093"
      },
      {
        "text": "13",
        "paragraph_id": "para_1094"
      },
      {
        "text": "Areas Map; it encompasses the Eastern Steps. Id. ¶¶ 26, 29;",
        "paragraph_id": "para_1095"
      },
      {
        "text": "see Traffic Regs. §§ 12.2.10, 12.2.20. The Eastern Steps",
        "paragraph_id": "para_1096"
      },
      {
        "text": "comprise the Eastern Senate, Eastern House, and Eastern",
        "paragraph_id": "para_1097"
      },
      {
        "text": "Capitol Steps. Stipulations of Fact ¶¶ 12–22. The Board",
        "paragraph_id": "para_1098"
      },
      {
        "text": "appeals the district court’s ruling finding the Traffic",
        "paragraph_id": "para_1099"
      },
      {
        "text": "Regulations unconstitutional as applied on the lower parts of",
        "paragraph_id": "para_1100"
      },
      {
        "text": "each set of steps on which Mahoney wishes to demonstrate.",
        "paragraph_id": "para_1101"
      },
      {
        "text": "The Board’s ban on nearly all expressive activities on the",
        "paragraph_id": "para_1102"
      },
      {
        "text": "steps is unconstitutionally overinclusive. The plain text of the",
        "paragraph_id": "para_1103"
      },
      {
        "text": "regulations “prevents even a single person from holding a quiet",
        "paragraph_id": "para_1104"
      },
      {
        "text": "vigil on the bottom House or Senate steps” or two persons from",
        "paragraph_id": "para_1105"
      },
      {
        "text": "“gathering on the Eastern Steps to oppose or support the latest",
        "paragraph_id": "para_1106"
      },
      {
        "text": "editorial in the New York Times.” Mahoney, 734 F. Supp. at",
        "paragraph_id": "para_1107"
      },
      {
        "text": "130 (citing Traffic Regs. §§ 12.1.10, 12.1.20).",
        "paragraph_id": "para_1108"
      },
      {
        "text": "The Board does not dispute the district court’s conclusion",
        "paragraph_id": "para_1109"
      },
      {
        "text": "that a single person peacefully engaging in expressive activity",
        "paragraph_id": "para_1110"
      },
      {
        "text": "would be prohibited from doing so or that entire types of",
        "paragraph_id": "para_1111"
      },
      {
        "text": "expressive activity including a “vigil, gathering, assembly, [or]",
        "paragraph_id": "para_1112"
      },
      {
        "text": "projecting of images” by any number of people and at any time",
        "paragraph_id": "para_1113"
      },
      {
        "text": "are categorically prohibited under the regulations. Instead, the",
        "paragraph_id": "para_1114"
      },
      {
        "text": "Board faults the court and the stipulated facts for failing to",
        "paragraph_id": "para_1115"
      },
      {
        "text": "“include any meaningful explanation of why demonstrating on",
        "paragraph_id": "para_1116"
      },
      {
        "text": "the adjacent sidewalks or other open spaces, rather than on the",
        "paragraph_id": "para_1117"
      },
      {
        "text": "stairways, would be less effective to convey plaintiff’s (or",
        "paragraph_id": "para_1118"
      },
      {
        "text": "anyone else’s) message.” Appellants’ Br. 20. But this court",
        "paragraph_id": "para_1119"
      },
      {
        "text": "has never held the government may impose overinclusive",
        "paragraph_id": "para_1120"
      },
      {
        "text": "restrictions on expressive activity in a public forum merely",
        "paragraph_id": "para_1121"
      },
      {
        "text": "because another, adjacent public forum exists. To the contrary.",
        "paragraph_id": "para_1122"
      },
      {
        "text": "Because the Capitol Grounds “have traditionally been open to",
        "paragraph_id": "para_1123"
      },
      {
        "text": "the public; indeed, thousands of people visit them each year,”",
        "paragraph_id": "para_1124"
      },
      {
        "text": "Jeannette Rankin Brigade, 342 F. Supp. at 584, and because",
        "paragraph_id": "para_1125"
      },
      {
        "text": "the Eastern Steps are integrated with the Capitol Grounds and",
        "paragraph_id": "para_1126"
      },
      {
        "text": "14",
        "paragraph_id": "para_1127"
      },
      {
        "text": "serve a similar function, the steps are subject to the same First",
        "paragraph_id": "para_1128"
      },
      {
        "text": "Amendment protections as the Capitol Grounds.",
        "paragraph_id": "para_1129"
      },
      {
        "text": "The Board’s prohibition on expressive activity here is no",
        "paragraph_id": "para_1130"
      },
      {
        "text": "different than the Board’s restriction on demonstration activity",
        "paragraph_id": "para_1131"
      },
      {
        "text": "on the sidewalk at the foot of the Eastern Steps. In Lederman,",
        "paragraph_id": "para_1132"
      },
      {
        "text": "291 F.3d 36, the court held that a “‘total’ restriction on certain",
        "paragraph_id": "para_1133"
      },
      {
        "text": "types of speech,” including “parading, picketing, leafleting,",
        "paragraph_id": "para_1134"
      },
      {
        "text": "vigils, sit-ins, and speechmaking,” on the sidewalk abutting the",
        "paragraph_id": "para_1135"
      },
      {
        "text": "Eastern Steps could not be justified by the government’s",
        "paragraph_id": "para_1136"
      },
      {
        "text": "“stated objectives of traffic control and safety” because, inter",
        "paragraph_id": "para_1137"
      },
      {
        "text": "alia, “a single leafleteer standing on the East Front sidewalk",
        "paragraph_id": "para_1138"
      },
      {
        "text": "will no more likely block traffic or threaten security than will",
        "paragraph_id": "para_1139"
      },
      {
        "text": "photographers, star-struck tourists, and landscape painters",
        "paragraph_id": "para_1140"
      },
      {
        "text": "complete with easels.” Id. at 45. “Freedom of expression . . .",
        "paragraph_id": "para_1141"
      },
      {
        "text": "would rest on a soft foundation indeed if government could",
        "paragraph_id": "para_1142"
      },
      {
        "text": "distinguish between demonstrators and pedestrians on a",
        "paragraph_id": "para_1143"
      },
      {
        "text": "wholesale and categorical basis, without providing evidence",
        "paragraph_id": "para_1144"
      },
      {
        "text": "that demonstrators pose a greater risk to identified government",
        "paragraph_id": "para_1145"
      },
      {
        "text": "interests than do” other members of the public. Id. (internal",
        "paragraph_id": "para_1146"
      },
      {
        "text": "quotation marks omitted) (quoting Police Dep’t of Chicago v.",
        "paragraph_id": "para_1147"
      },
      {
        "text": "Mosley, 408 U.S. 92, 101 (1972)).",
        "paragraph_id": "para_1148"
      },
      {
        "text": "The Board would minimize the district court’s concern",
        "paragraph_id": "para_1149"
      },
      {
        "text": "that the regulations are overinclusive, appearing to cover, for",
        "paragraph_id": "para_1150"
      },
      {
        "text": "example, “a pair of individuals gathering on the Eastern Steps",
        "paragraph_id": "para_1151"
      },
      {
        "text": "to oppose or support the latest editorial in the New York Times.”",
        "paragraph_id": "para_1152"
      },
      {
        "text": "Mahoney, 734 F. Supp. 3d at 130 (citing Traffic",
        "paragraph_id": "para_1153"
      },
      {
        "text": "Regs. § 12.1.10). But as the majority’s conclusion indicates,",
        "paragraph_id": "para_1154"
      },
      {
        "text": "Op. 19–20, the district court’s interpretation of the regulations,",
        "paragraph_id": "para_1155"
      },
      {
        "text": "which proscribe “gathering[s]” on the steps “for the purpose of",
        "paragraph_id": "para_1156"
      },
      {
        "text": "expressing . . . views or concerns,” is plainly plausible. Traffic",
        "paragraph_id": "para_1157"
      },
      {
        "text": "Regs. § 12.1.10. For another example, a meeting of two",
        "paragraph_id": "para_1158"
      },
      {
        "text": "friends wearing T-shirts supporting a cause or silently holding",
        "paragraph_id": "para_1159"
      },
      {
        "text": "a prop could come within the ambit of the regulations.",
        "paragraph_id": "para_1160"
      },
      {
        "text": "15",
        "paragraph_id": "para_1161"
      },
      {
        "text": "The Board’s reasoning also reveals another critical flaw of",
        "paragraph_id": "para_1162"
      },
      {
        "text": "the Traffic Regulations: they permit two friends to gather on",
        "paragraph_id": "para_1163"
      },
      {
        "text": "the steps to discuss the particulars of the latest action of",
        "paragraph_id": "para_1164"
      },
      {
        "text": "Congress but prohibit the same two friends from gathering on",
        "paragraph_id": "para_1165"
      },
      {
        "text": "the steps while carrying a banner asking for Congress to take",
        "paragraph_id": "para_1166"
      },
      {
        "text": "action in support of their cause. In this regard, the Traffic",
        "paragraph_id": "para_1167"
      },
      {
        "text": "Regulations are so underinclusive as to “raise[] serious doubts",
        "paragraph_id": "para_1168"
      },
      {
        "text": "about whether the government is in fact pursuing the interest it",
        "paragraph_id": "para_1169"
      },
      {
        "text": "invokes, rather than disfavoring a particular speaker or",
        "paragraph_id": "para_1170"
      },
      {
        "text": "viewpoint.” Brown v. Ent. Merchs. Ass’n, 564 U.S. 786, 802",
        "paragraph_id": "para_1171"
      },
      {
        "text": "(2011).",
        "paragraph_id": "para_1172"
      },
      {
        "text": "The Board offers no persuasive security justification for",
        "paragraph_id": "para_1173"
      },
      {
        "text": "distinguishing between members of the public who are",
        "paragraph_id": "para_1174"
      },
      {
        "text": "permitted to “sit, stand or congregate on the Eastern Steps” in",
        "paragraph_id": "para_1175"
      },
      {
        "text": "potentially unlimited numbers, Stipulations of Fact ¶ 67, and",
        "paragraph_id": "para_1176"
      },
      {
        "text": "members of the public who wish to engage in a silent vigil or a",
        "paragraph_id": "para_1177"
      },
      {
        "text": "peaceful two-person call for congressional action. It posits that",
        "paragraph_id": "para_1178"
      },
      {
        "text": "“situations” involving “tourists and other public visitors . . . .",
        "paragraph_id": "para_1179"
      },
      {
        "text": "tend to be less prone to volatility and more fleeting in duration”",
        "paragraph_id": "para_1180"
      },
      {
        "text": "than demonstrations. Appellants’ Br. 39. Maybe so, but thus",
        "paragraph_id": "para_1181"
      },
      {
        "text": "far its conclusion is bereft of any explanation grounded in the",
        "paragraph_id": "para_1182"
      },
      {
        "text": "facts or binding caselaw. The Board’s security rationale is also",
        "paragraph_id": "para_1183"
      },
      {
        "text": "undermined by the exception to the Traffic Regulations",
        "paragraph_id": "para_1184"
      },
      {
        "text": "allowing Members of Congress to invite potentially unlimited",
        "paragraph_id": "para_1185"
      },
      {
        "text": "and unvetted members of public for expressive activities on the",
        "paragraph_id": "para_1186"
      },
      {
        "text": "steps. Stipulations of Fact ¶¶ 56, 64.",
        "paragraph_id": "para_1187"
      },
      {
        "text": "To the extent that appellants deny the existence of",
        "paragraph_id": "para_1188"
      },
      {
        "text": "“‘substantially less restrictive’ alternatives that would ‘equally",
        "paragraph_id": "para_1189"
      },
      {
        "text": "effective[ly]’ promote safety,” Lederman, 291 F.3d at 45",
        "paragraph_id": "para_1190"
      },
      {
        "text": "(alteration in text) (quoting Cmty. for Creative Non-Violence v.",
        "paragraph_id": "para_1191"
      },
      {
        "text": "Kerrigan, 865 F.2d 382, 390 (D.C. Cir. 1989)), the district",
        "paragraph_id": "para_1192"
      },
      {
        "text": "court identified some: for example, the Board could: (1) “limit",
        "paragraph_id": "para_1193"
      },
      {
        "text": "16",
        "paragraph_id": "para_1194"
      },
      {
        "text": "the number of people who can demonstrate on the Eastern",
        "paragraph_id": "para_1195"
      },
      {
        "text": "Steps at one time”; (2) “require individuals like Plaintiff to",
        "paragraph_id": "para_1196"
      },
      {
        "text": "obtain a permit, as they already do for groups wishing to",
        "paragraph_id": "para_1197"
      },
      {
        "text": "demonstrate on different areas of the Capitol Grounds”; (3)",
        "paragraph_id": "para_1198"
      },
      {
        "text": "“ban the use of props”; or (4) “ban expressive activities at",
        "paragraph_id": "para_1199"
      },
      {
        "text": "certain times of the day, or force prospective demonstrators to",
        "paragraph_id": "para_1200"
      },
      {
        "text": "submit to police screening.” Mahoney, 734 F. Supp. 3d at 131;",
        "paragraph_id": "para_1201"
      },
      {
        "text": "see Lederman, 291 F.3d at 45–46. The Board responds that",

        "paragraph_id": "para_1203"
      },
      {
        "text": "objectives as effectively given that the presence of",
        "paragraph_id": "para_1204"
      },
      {
        "text": "demonstrators on the stairways is what gives rise to the access",
        "paragraph_id": "para_1205"
      },
      {
        "text": "and security concerns in the first place,” while time restrictions",
        "paragraph_id": "para_1206"
      },
      {
        "text": "“ignore[] that employees enter and exit at all hours and that the",
        "paragraph_id": "para_1207"
      },
      {
        "text": "threat of damage to the buildings persists around the clock.”",
        "paragraph_id": "para_1208"
      },
      {
        "text": "Appellants’ Br. 42. In essence, the Board’s response is",
        "paragraph_id": "para_1209"
      },
      {
        "text": "circular: any group of demonstrators engaging in any",
        "paragraph_id": "para_1210"
      },
      {
        "text": "expressive activity is a threat simply because they are",
        "paragraph_id": "para_1211"
      },
      {
        "text": "demonstrators. And the Board’s insistence that the danger to",
        "paragraph_id": "para_1212"
      },
      {
        "text": "the building persists “around the clock” is undercut by its",
        "paragraph_id": "para_1213"
      },
      {
        "text": "relaxed attitude toward expressive activity of unvetted invitees",
        "paragraph_id": "para_1214"
      },
      {
        "text": "of Members of Congress and other members of the public",
        "paragraph_id": "para_1215"
      },
      {
        "text": "congregating on the steps. In sum, the Board fails to explain",
        "paragraph_id": "para_1216"
      },
      {
        "text": "why alternative measures implemented separately or together",
        "paragraph_id": "para_1217"
      },
      {
        "text": "could not effectively promote its security interest.",
        "paragraph_id": "para_1218"
      },
      {
        "text": "Because the Board’s prohibition on demonstration on the",
        "paragraph_id": "para_1219"
      },
      {
        "text": "Eastern Steps is not narrowly tailored to achieve the Board’s",
        "paragraph_id": "para_1220"
      },
      {
        "text": "security interest and there appear to be less restrictive",
        "paragraph_id": "para_1221"
      },
      {
        "text": "alternatives that would, the regulations fail even intermediate",
        "paragraph_id": "para_1222"
      },
      {
        "text": "scrutiny.",
        "paragraph_id": "para_1223"
      },
      {
        "text": "III.",
        "paragraph_id": "para_1224"
      },
      {
        "text": "Having granted summary judgment for Mahoney, the",
        "paragraph_id": "para_1225"
      },
      {
        "text": "district court on May 17, 2024, permanently enjoined the Board",
        "paragraph_id": "para_1226"
      },
      {
        "text": "17",
        "paragraph_id": "para_1227"
      },
      {
        "text": "from enforcing the regulations forbidding demonstration on the",
        "paragraph_id": "para_1228"
      },
      {
        "text": "Eastern Steps against anyone. On October 16, 2024, the district",
        "paragraph_id": "para_1229"
      },
      {
        "text": "court granted the Board’s motion to stay the injunction as to",
        "paragraph_id": "para_1230"
      },
      {
        "text": "nonparties to this action pending appeal after initially denying",
        "paragraph_id": "para_1231"
      },
      {
        "text": "the Board’s motion for reconsideration, which sought a",
        "paragraph_id": "para_1232"
      },
      {
        "text": "narrowing of the injunction to cover Mahoney alone.",
        "paragraph_id": "para_1233"
      },
      {
        "text": "While this appeal was pending, the Supreme Court on June",
        "paragraph_id": "para_1234"
      },
      {
        "text": "27, 2025, in Trump v. CASA, Inc., 606 U.S. 831 (2025), limited",
        "paragraph_id": "para_1235"
      },
      {
        "text": "the scope of injunctive relief available under the Judiciary Act",
        "paragraph_id": "para_1236"
      },
      {
        "text": "of 1789, holding that Article III courts have authority to issue",
        "paragraph_id": "para_1237"
      },
      {
        "text": "preliminary injunctions no “broader than necessary to provide",
        "paragraph_id": "para_1238"
      },
      {
        "text": "complete relief to each plaintiff with standing to sue.” Id. at",
        "paragraph_id": "para_1239"
      },
      {
        "text": "861. The Court acknowledged that its holding does not disturb",
        "paragraph_id": "para_1240"
      },
      {
        "text": "the principle that injunctions may “incidentally” benefit",
        "paragraph_id": "para_1241"
      },
      {
        "text": "nonparties. Id. at 851. It “decline[d] to take up” the parties’",
        "paragraph_id": "para_1242"
      },
      {
        "text": "arguments about the appropriate scope of the injunction,",
        "paragraph_id": "para_1243"
      },
      {
        "text": "instructing that “[t]he [three] lower courts should determine",
        "paragraph_id": "para_1244"
      },
      {
        "text": "whether a narrower injunction is appropriate.” Id. at 854.",
        "paragraph_id": "para_1245"
      },
      {
        "text": "The parties disagree on the proper scope of injunctive",
        "paragraph_id": "para_1246"
      },
      {
        "text": "relief under CASA in the First Amendment context. So far their",
        "paragraph_id": "para_1247"
      },
      {
        "text": "views are confined to Appellants’ Rule 28(j) letter (July 8,",
        "paragraph_id": "para_1248"
      },
      {
        "text": "2025) and the Response to Appellants’ Rule 28(j) letter (July",
        "paragraph_id": "para_1249"
      },
      {
        "text": "17, 2025). The CASA decision arose under the Fourteenth",
        "paragraph_id": "para_1250"
      },
      {
        "text": "Amendment’s Citizenship Clause, CASA, 606 U.S. at 839,",
        "paragraph_id": "para_1251"
      },
      {
        "text": "while the instant case raises questions under the First",
        "paragraph_id": "para_1252"
      },
      {
        "text": "Amendment. Two Justices have noted that an overbreadth",
        "paragraph_id": "para_1253"
      },
      {
        "text": "challenge under the First Amendment “presents its own",
        "paragraph_id": "para_1254"
      },
      {
        "text": "doctrinal complexities about the scope of relief.” Griffin v. HM",
        "paragraph_id": "para_1255"
      },
      {
        "text": "Fla.-ORL, LLC, 144 S. Ct. 1, 2 (2023) (statement of",
        "paragraph_id": "para_1256"
      },
      {
        "text": "Kavanaugh, J., joined by Barrett, J., except as to footnote 1).",
        "paragraph_id": "para_1257"
      },
      {
        "text": "It is well established that a plaintiff may bring a facial First",
        "paragraph_id": "para_1258"
      },
      {
        "text": "Amendment challenge “not because [the plaintiff’s] own rights",
        "paragraph_id": "para_1259"
      },
      {

      },
      {
        "text": "of free expression are violated, but because of a judicial",
        "paragraph_id": "para_1261"
      },
      {
        "text": "prediction or assumption that the [challenged law]’s very",
        "paragraph_id": "para_1262"
      },
      {
        "text": "existence may cause others not before the court to refrain from",
        "paragraph_id": "para_1263"
      },
      {
        "text": "constitutionally protected speech or expression.” Sec’y of State",
        "paragraph_id": "para_1264"
      },
      {
        "text": "of Md. v. Joseph H. Munson Co., 467 U.S. 947, 956–57 (1984)",
        "paragraph_id": "para_1265"
      },
      {
        "text": "(quoting Broadrick v. Oklahoma, 413 U.S. 601, 612 (1973)).",
        "paragraph_id": "para_1266"
      },
      {
        "text": "Facing the threat of prosecution, some people, rather than",
        "paragraph_id": "para_1267"
      },
      {
        "text": "“vindicating their rights through case-by-case litigation, will",
        "paragraph_id": "para_1268"
      },
      {
        "text": "choose simply to abstain from protected speech — harming not",
        "paragraph_id": "para_1269"
      },
      {
        "text": "only themselves but society as a whole, which is deprived of",
        "paragraph_id": "para_1270"
      },
      {
        "text": "an uninhibited marketplace of ideas.” Virginia v. Hicks, 539",
        "paragraph_id": "para_1271"
      },
      {
        "text": "U.S. 113, 119 (2003) (citation omitted). “(T)he point of",
        "paragraph_id": "para_1272"
      },
      {
        "text": "ultimate interest (of the First Amendment) is not the words of",
        "paragraph_id": "para_1273"
      },
      {
        "text": "the speakers, but the minds of the hearers, and manifestly a",
        "paragraph_id": "para_1274"
      },
      {
        "text": "speaker will be deprived of an opportunity to affect those minds",
        "paragraph_id": "para_1275"
      },
      {
        "text": "if his audience is arrested and carted away. Certainly the harm",
        "paragraph_id": "para_1276"
      },
      {
        "text": "is as great as if the speaker had himself been silenced.”",
        "paragraph_id": "para_1277"
      },
      {
        "text": "Dellums, 566 F.2d at 195 (citations and internal quotation",

        "text": "marks omitted). So a successful challenge to a law that is",
        "paragraph_id": "para_1279"
      },

        "text": "overbroad in restricting speech “suffices to invalidate all",
        "paragraph_id": "para_1280"
      },
      {
        "text": "enforcement of that law” to protect “an uninhibited",
        "paragraph_id": "para_1281"
      },
      {
        "text": "marketplace of ideas” and “reduce[] the[] social costs caused",
        "paragraph_id": "para_1282"
      },
      {
        "text": "by the withholding of protected speech.” Hicks, 539 U.S. at",
        "paragraph_id": "para_1283"
      },
      {
        "text": "119 (emphasis omitted); Citizens United v. Fed. Election",
        "paragraph_id": "para_1284"
      },
      {
        "text": "Comm’n, 558 U.S. 310, 335–36 (2010).",
        "paragraph_id": "para_1285"
      },
      {
        "text": "Because of the doctrinal complexities presented by the",
        "paragraph_id": "para_1286"
      },
      {
        "text": "question of appropriate injunctive relief in the First",
        "paragraph_id": "para_1287"
      },
      {
        "text": "Amendment context, it is prudent in accord with CASA, 606",
        "paragraph_id": "para_1288"
      },
      {
        "text": "U.S. at 854, to remand the parties’ contentions regarding the",
        "paragraph_id": "para_1289"
      },
      {
        "text": "appropriate scope of the injunction to the district court to",
        "paragraph_id": "para_1290"
      },
