        "text": "The panel reversed the district court’s dismissal of",
        "paragraph_id": "para_28"
      },
      {
        "text": "Oregon state prisoner Deymon Edwards’s 42 U.S.C. § 1983",
        "paragraph_id": "para_29"
      },
      {
        "text": "claims as time barred, and remanded for further",
        "paragraph_id": "para_30"
      },
      {
        "text": "proceedings.",
        "paragraph_id": "para_31"
      },
      {
        "text": "On January 10, 2025, Edwards filed suit under § 1983",
        "paragraph_id": "para_32"
      },
      {
        "text": "against correctional officers he alleged were responsible for",
        "paragraph_id": "para_33"
      },
      {
        "text": "denial of a decontamination shower after Edwards’s skin and",
        "paragraph_id": "para_34"
      },
      {
        "text": "lungs were exposed to pepper spray. The district court found",
        "paragraph_id": "para_35"
      },
      {
        "text": "that Edwards’s claims accrued on October 1, 2022, when",
        "paragraph_id": "para_36"
      },
      {
        "text": "Edwards was exposed to the pepper spray. The district court",
        "paragraph_id": "para_37"
      },
      {
        "text": "concluded that Edwards filed his complaint beyond",
        "paragraph_id": "para_38"
      },
      {
        "text": "Oregon’s two-year statute of limitations, and dismissed",
        "paragraph_id": "para_39"
      },
      {
        "text": "Edwards’s claims as time barred.",
        "paragraph_id": "para_40"
      },
      {
        "text": "Addressing a threshold issue, the panel held that that",
        "paragraph_id": "para_41"
      },
      {
        "text": "principles of waiver, party presentation, and comity did not",
        "paragraph_id": "para_42"
      },
      {
        "text": "prevent the court from determining the application of",
        "paragraph_id": "para_43"
      },
      {
        "text": "Oregon tolling law to this case.",

        "text": "Edwards argued that an Oregon statute, Oregon Revised",
        "paragraph_id": "para_45"
      },
      {
        "text": "Statutes § 12.210, tolls the statute of limitations from the",
        "paragraph_id": "para_46"

        "text": "date an inmate’s cause of action accrues until the time he",

      },

        "text": "Edwards that Oregon tolling rules afford him relief. Oregon",

        "text": "Revised Statutes § 12.210 authorizes tolling the statute of",
        "paragraph_id": "para_50"
      },

        "text": "limitations when another statute prevents a plaintiff from",
        "paragraph_id": "para_51"
      },
      {

      {
        "text": "filing suit. Because Edwards is incarcerated, a federal",
        "paragraph_id": "para_55"
      },
      {
        "text": "statute, 42 U.S.C. § 1997e(a), prohibited him from",
        "paragraph_id": "para_56"
      },
      {
        "text": "commencing this federal lawsuit until he had exhausted",
        "paragraph_id": "para_57"
      },
      {
        "text": "available administrative remedies. Taking these two statutes",
        "paragraph_id": "para_58"
      },
      {
        "text": "together, the panel held that the time an inmate spends",
        "paragraph_id": "para_59"
      },
      {
        "text": "completing the prison grievance process does not, under",
        "paragraph_id": "para_60"
      },
      {
        "text": "Oregon law, count toward the statute of limitations on a",
        "paragraph_id": "para_61"
      },
      {
        "text": "federal § 1983 claim. And the panel construed the Oregon",
        "paragraph_id": "para_62"
      },
      {
        "text": "tolling statute to begin the tolling period no later than when",
        "paragraph_id": "para_63"
      },
      {
        "text": "an inmate initiates the grievance process. Applying this",
        "paragraph_id": "para_64"
      },
      {
        "text": "statute, the panel concluded that Edwards timely filed his",
        "paragraph_id": "para_65"
      },
      {
        "text": "complaint within the applicable statute of limitations. For",
        "paragraph_id": "para_66"
      },
      {
        "text": "purposes of this appeal, Edwards presented his first",
        "paragraph_id": "para_67"
      },
      {
        "text": "grievance to the Oregon State Penitentiary on October 3,",
        "paragraph_id": "para_68"
      },

        "text": "2022. Tolling thus began under § 12.210 no later than",
        "paragraph_id": "para_69"
      },

        "text": "October 3, 2022. The tolling period continued until January",
        "paragraph_id": "para_70"
      },
      {
        "text": "13, 2023, when Edwards finished properly exhausting his",
        "paragraph_id": "para_71"
      },
      {
        "text": "administrative remedies. Accordingly, with tolling,",
        "paragraph_id": "para_72"
      },

        "text": "BENNETT, Circuit Judge:",
        "paragraph_id": "para_85"

      {
        "text": "Deymon Edwards appeals the dismissal of his 42 U.S.C.",
        "paragraph_id": "para_86"
      },
      {
        "text": "§ 1983 claims as time barred. In § 1983 actions, we apply",
        "paragraph_id": "para_87"
      },
      {
        "text": "the state statute of limitations for personal injury claims in",
        "paragraph_id": "para_88"
      },
      {
        "text": "the relevant jurisdiction, and we also borrow state tolling",
        "paragraph_id": "para_89"
      },
      {
        "text": "rules. An Oregon tolling statute, Oregon Revised Statutes",
        "paragraph_id": "para_90"
      },
      {
        "text": "§ 12.210, authorizes tolling the statute of limitations when",
        "paragraph_id": "para_91"
      },
      {
        "text": "another statute prevents a plaintiff from filing suit. Because",
        "paragraph_id": "para_92"
      },
      {
        "text": "Edwards is incarcerated, a federal statute, 42 U.S.C.",
        "paragraph_id": "para_93"
      },
      {
        "text": "§ 1997e(a), prohibited him from commencing this federal",
        "paragraph_id": "para_94"
      },

        "text": "lawsuit until he had exhausted available administrative",

        "text": "Deymon Edwards is incarcerated at Oregon State",
        "paragraph_id": "para_108"
      },
      {
        "text": "Penitentiary. On October 1, 2022, correctional officers",

        "text": "deployed pepper spray. Because the cells are open air,",
        "paragraph_id": "para_111"
      },
      {
        "text": "Edwards’s skin and lungs were exposed to the spray.",
        "paragraph_id": "para_112"
      },
      {
        "text": "Edwards asked the correctional officers for a",
        "paragraph_id": "para_113"
      },
      {

      },
      {
        "text": "decontamination shower, but they denied his request for",
        "paragraph_id": "para_115"
      },
      {
        "text": "about two days.",
        "paragraph_id": "para_116"
      },
      {
        "text": "On October 3, 2022, Edwards signed and dated a prison",
        "paragraph_id": "para_117"
      },
      {
        "text": "grievance form. He alleged that correctional officers",
        "paragraph_id": "para_118"
      },
      {
        "text": "responded to a fight and deployed pepper spray “right next",
        "paragraph_id": "para_119"
      },
      {
        "text": "to [his] cell,” exposing Edwards to the chemical. He",
        "paragraph_id": "para_120"
      },
      {
        "text": "explained that he “was sprayed[] a good amount . . . on [his]",
        "paragraph_id": "para_121"
      },
      {
        "text": "face, arms, neck, and clothes; as well as [his] blankets,",
        "paragraph_id": "para_122"
      },
      {
        "text": "pillows, sheets, etc.” Edwards described the “pain” and",
        "paragraph_id": "para_123"
      },
      {
        "text": "“burning” he experienced in his “face, lungs, eyes, arms, and",
        "paragraph_id": "para_124"
      },
      {
        "text": "neck,” as well as “retching and coughing when [he] tried to",
        "paragraph_id": "para_125"
      },
      {
        "text": "breath[e].” He “pleaded with the [correctional officers] to",
        "paragraph_id": "para_126"
      },
      {
        "text": "allow [him] to decontaminate,” but they did not permit him",
        "paragraph_id": "para_127"
      },
      {
        "text": "to shower.",
        "paragraph_id": "para_128"
      },
      {
        "text": "The grievance office stamped Edwards’s grievance as",
        "paragraph_id": "para_129"
      },
      {
        "text": "“received” on October 11, 2022, and “denied” it that same",
        "paragraph_id": "para_130"
      },
      {
        "text": "day. An accompanying letter explained that his grievance",
        "paragraph_id": "para_131"
      },
      {
        "text": "did not comply with the Department of Corrections (“DOC”)",
        "paragraph_id": "para_132"
      },
      {
        "text": "rules because Edwards’s “narrative d[id] not indicate [he]",
        "paragraph_id": "para_133"
      },
      {
        "text": "received direct exposure to [oleoresin capsicum] chemical",
        "paragraph_id": "para_134"
      },
      {
        "text": "agents,” and “[n]on-direct exposure does not require [that] a",
        "paragraph_id": "para_135"
      },
      {
        "text": "shower or clean clothing be provided.”",
        "paragraph_id": "para_136"
      },
      {
        "text": "Edwards responded by filling out a second grievance",
        "paragraph_id": "para_137"
      },
      {
        "text": "form on October 13, 2022. He alleged that the correctional",
        "paragraph_id": "para_138"
      },
      {
        "text": "officers “deployed [pepper spray] . . . in a wide arc going",
        "paragraph_id": "para_139"
      },
      {
        "text": "back and forth, and at one point some of the spray projected",
        "paragraph_id": "para_140"
      },
      {
        "text": "directly into [his] face, eyes, arms, neck, and clothes.”",
        "paragraph_id": "para_141"
      },
      {
        "text": "Edwards again explained that “[t]he pain started . . . burning",
        "paragraph_id": "para_142"
      },
      {
        "text": "[his] face, lungs, eyes, arms, and neck.” And he “began",
        "paragraph_id": "para_143"
      },
      {
        "text": "retching and coughing when [he] tried to breath[e].”",
        "paragraph_id": "para_144"
      },
      {
        "text": "The grievance office stamped his second form as",
        "paragraph_id": "para_145"
      },
      {
        "text": "“received” on October 18, 2022, and “returned for",
        "paragraph_id": "para_146"
      },
      {

      {
        "text": "correction” the same day. An accompanying letter from the",
        "paragraph_id": "para_148"
      },
      {
        "text": "grievance office asked Edwards to clarify whether he",
        "paragraph_id": "para_149"
      },
      {
        "text": "suffered “direct or secondhand exposure.” It also noted that",
        "paragraph_id": "para_150"
      },
      {
        "text": "this “second grievance outlin[ed] the same incident [for]",
        "paragraph_id": "para_151"
      },
      {
        "text": "which [Edwards] filed a prior grievance . . . regarding use of",
        "paragraph_id": "para_152"
      },
      {
        "text": "[oleoresin capsicum] spray on [his] unit.”",
        "paragraph_id": "para_153"
      },
      {
        "text": "Edwards resubmitted his grievance, and this time the",
        "paragraph_id": "para_154"
      },
      {
        "text": "grievance office stamped it as “accepted” on",
        "paragraph_id": "para_155"
      },
      {
        "text": "November 2, 2022. Shelby Brown, a Correctional",
        "paragraph_id": "para_156"
      },
      {
        "text": "Lieutenant, responded to the grievance by explaining that all",
        "paragraph_id": "para_157"
      },
      {
        "text": "the inmates who “received direct exposure to the [oleoresin",
        "paragraph_id": "para_158"
      },
      {
        "text": "capsicum] [s]pray . . . were subsequently removed from the",
        "paragraph_id": "para_159"
      },
      {
        "text": "unit and afforded appropriate decontamination procedures.”",
        "paragraph_id": "para_160"
      },
      {
        "text": "Edwards appealed, asserting that he “disagree[d] with",
        "paragraph_id": "para_161"
      },
      {
        "text": "[Lieutenant] Brown” because he “received direct exposure",
        "paragraph_id": "para_162"
      },
      {
        "text": "to the [oleoresin capsicum] spray,” but “was not afforded",
        "paragraph_id": "para_163"
      },
      {
        "text": "any type of decontamination.”",
        "paragraph_id": "para_164"
      },
      {
        "text": "The Oregon State Penitentiary superintendent responded",
        "paragraph_id": "para_165"
      },
      {
        "text": "to the appeal. He concluded that Edwards had been only",
        "paragraph_id": "para_166"
      },
      {
        "text": "“indirectly” exposed to the chemicals and that the “[s]taff",
        "paragraph_id": "para_167"
      },
      {
        "text": "followed the decontamination process appropriately” and in",
        "paragraph_id": "para_168"
      },
      {
        "text": "accordance with the prison rules. Edwards then submitted a",
        "paragraph_id": "para_169"
      },
      {
        "text": "final grievance appeal, reiterating that the correctional",
        "paragraph_id": "para_170"
      },
      {
        "text": "officers “sprayed directly into [his] face, eyes, arms, and",
        "paragraph_id": "para_171"
      },
      {
        "text": "neck.” The grievance process concluded on",
        "paragraph_id": "para_172"
      },
      {
        "text": "January 13, 2023, when the Westside Institutions",
        "paragraph_id": "para_173"
      },
      {
        "text": "Administrator notified Edwards that he “ha[d] not provided",
        "paragraph_id": "para_174"
      },
      {
        "text": "any additional information in this appeal that would warrant",
        "paragraph_id": "para_175"
      },
      {
        "text": "a response other than that which [he] ha[d] already",
        "paragraph_id": "para_176"
      },
      {
        "text": "received.”",
        "paragraph_id": "para_177"
      },
      {

      {
        "text": "B",
        "paragraph_id": "para_179"
      },
      {
        "text": "On January 10, 2025, Edwards filed suit under 42 U.S.C.",
        "paragraph_id": "para_180"
      },
      {
        "text": "§ 1983 against the correctional officers he alleges are",
        "paragraph_id": "para_181"
      },
      {
        "text": "responsible for the denial of his decontamination shower.1",
        "paragraph_id": "para_182"
      },
      {
        "text": "Edwards claims violations of his rights under the First,",
        "paragraph_id": "para_183"
      },
      {
        "text": "Eighth, and Fourteenth Amendments.",
        "paragraph_id": "para_184"
      },
      {
        "text": "Defendants moved to dismiss Edwards’s complaint,",
        "paragraph_id": "para_185"
      },
      {
        "text": "contending that his claims are barred by the two-year statute",
        "paragraph_id": "para_186"
      },
      {
        "text": "of limitations. The district court agreed. In its view,",
        "paragraph_id": "para_187"
      },
      {
        "text": "Edwards’s claims accrued on October 1, 2022, when",
        "paragraph_id": "para_188"
      },
      {
        "text": "Edwards was exposed to the pepper spray. By the district",
        "paragraph_id": "para_189"
      },
      {
        "text": "court’s count, the statute of limitations ran from October 1",
        "paragraph_id": "para_190"
      },
      {
        "text": "to October 18—when the prison received Edwards’s second",
        "paragraph_id": "para_191"
      },
      {
        "text": "grievance. Relying on a federal equitable tolling rule, the",
        "paragraph_id": "para_192"
      },
      {
        "text": "district court determined that the statute of limitations was",
        "paragraph_id": "para_193"
      },
      {
        "text": "tolled from October 18, 2022, until January 13, 2023, while",
        "paragraph_id": "para_194"
      },
      {
        "text": "Edwards completed the prison grievance process. From",
        "paragraph_id": "para_195"
      },
      {
        "text": "there, it determined that the two-year statute of limitations",
        "paragraph_id": "para_196"
      },
      {
        "text": "ran again from January 13, 2023, until January 10, 2025,",
        "paragraph_id": "para_197"
      },
      {
        "text": "when Edwards filed his complaint.",
        "paragraph_id": "para_198"
      },
      {
        "text": "The district court declined to start the toll period from",
        "paragraph_id": "para_199"
      },
      {
        "text": "when Edwards submitted his first grievance, reasoning that",
        "paragraph_id": "para_200"
      },
      {
        "text": "he “did not exhaust [that] grievance.” The district court also",
        "paragraph_id": "para_201"
      },
      {
        "text": "declined to toll the period between when Edwards submitted",
        "paragraph_id": "para_202"
      },
      {
        "text": "his second grievance (October 13) and when the grievance",
        "paragraph_id": "para_203"
      },
      {
        "text": "office stamped it as received (October 18). The district court",
        "paragraph_id": "para_204"
      },
      {

        "paragraph_id": "para_209"
      },
      {
        "text": "applies to § 1983 suits filed by pro se prisoners.”).",
        "paragraph_id": "para_210"
      },
      {

        "text": "explained that “the Ninth Circuit has declined to apply the",
        "paragraph_id": "para_212"
      },
      {
        "text": "mailbox rule to administrative deadlines when inconsistent",
        "paragraph_id": "para_213"
      },
      {
        "text": "with applicable prison regulations,” so “the statute of",
        "paragraph_id": "para_214"
      },
      {
        "text": "limitations did not begin to toll until October 18, 2022, when",
        "paragraph_id": "para_215"
      },
      {
        "text": "[Edwards]’s grievance was received by the grievance",
        "paragraph_id": "para_216"
      },
      {
        "text": "office.”",
        "paragraph_id": "para_217"
      },
      {
        "text": "In the end, counting only eighty-seven days of tolling,",
        "paragraph_id": "para_218"
      },
      {
        "text": "the district court concluded that Edwards filed his complaint",
        "paragraph_id": "para_219"
      },
      {
        "text": "beyond the two-year limitations period. It thus dismissed",
        "paragraph_id": "para_220"
      },
      {
        "text": "Edwards’s claims as time barred.",
        "paragraph_id": "para_221"
      },
      {
        "text": "Edwards now appeals. While he proceeded pro se in the",
        "paragraph_id": "para_222"
      },
      {
        "text": "district court, Edwards has counsel on appeal.",
        "paragraph_id": "para_223"
      },
      {
        "text": "II",
        "paragraph_id": "para_224"
      },
      {
        "text": "We have jurisdiction under 28 U.S.C. § 1291. We",
        "paragraph_id": "para_225"
      },
      {
        "text": "review de novo a district court’s “dismissal of a complaint",
        "paragraph_id": "para_226"
      },
      {
        "text": "on the basis of a statute of limitations.” Lyons v. Michael &",
        "paragraph_id": "para_227"
      },
      {
        "text": "Assocs., 824 F.3d 1169, 1171 (9th Cir. 2016). Undertaking",
        "paragraph_id": "para_228"
      },
      {
        "text": "this review, we accept “all factual allegations in the",
        "paragraph_id": "para_229"
      },
      {
        "text": "complaint as true and draw all reasonable inferences in favor",
        "paragraph_id": "para_230"
      },
      {
        "text": "of the nonmoving party.” Hoang v. Bank of Am., N.A., 910",
        "paragraph_id": "para_231"
      },
      {
        "text": "F.3d 1096, 1100 (9th Cir. 2018).",
        "paragraph_id": "para_232"
      },
      {
        "text": "“Federal courts in § 1983 actions apply the state statute",
        "paragraph_id": "para_233"
      },
      {
        "text": "of limitations from personal-injury claims and borrow the",
        "paragraph_id": "para_234"
      },
      {
        "text": "state’s tolling rules.” Soto v. Sweetman, 882 F.3d 865, 871",
        "paragraph_id": "para_235"
      },
      {
        "text": "(9th Cir. 2018); see 42 U.S.C. § 1988(a). As relevant here,",
        "paragraph_id": "para_236"
      },
      {
        "text": "Oregon’s two-year statute of limitations for personal injury",
        "paragraph_id": "para_237"
      },
      {
        "text": "actions, Or. Rev. Stat. § 12.110(1), applies to federal § 1983",
        "paragraph_id": "para_238"
      },
      {
        "text": "claims. See Sain v. City of Bend, 309 F.3d 1134, 1139 (9th",
        "paragraph_id": "para_239"
      },
      {
        "text": "Cir. 2002). As for tolling, we adhere to Oregon’s rules",
        "paragraph_id": "para_240"
      },
      {
        "text": "“unless their full application” would “defeat either § 1983’s",
        "paragraph_id": "para_241"
      },
      {
        "text": "chief goals of compensation and deterrence or its subsidiary",
        "paragraph_id": "para_242"
      },
      {

        "text": "goals of uniformity and federalism.” Hardin v. Straub, 490",
        "paragraph_id": "para_244"
      },
      {
        "text": "U.S. 536, 539 (1989) (footnote omitted) (citing Bd. of",
        "paragraph_id": "para_245"
      },
      {
        "text": "Regents of Univ. of State of N.Y. v. Tomanio, 446 U.S. 478,",
        "paragraph_id": "para_246"
      },
      {
        "text": "488–92 (1980)). If tolling under Oregon law renders a",
        "paragraph_id": "para_247"
      },
      {
        "text": "complaint timely (and does not defeat the goals of § 1983),",
        "paragraph_id": "para_248"
      },
      {
        "text": "our inquiry ends. See id. at 543–44 (explaining that a State",
        "paragraph_id": "para_249"
      },
      {
        "text": "may, consistent with § 1983, “extend[] the time in which",
        "paragraph_id": "para_250"
      },
      {
        "text": "prisoners may seek recovery for constitutional injuries”);",
        "paragraph_id": "para_251"
      },
      {
        "text": "accord Battle v. Ledford, 912 F.3d 708, 713 (4th Cir. 2019);",
        "paragraph_id": "para_252"
      },
      {
        "text": "Pearson v. Sec’y Dep’t of Corr., 775 F.3d 598, 603–04 (3d",
        "paragraph_id": "para_253"
      },
      {
        "text": "Cir. 2015); Johnson v. Rivera, 272 F.3d 519, 520 n.1 (7th",
        "paragraph_id": "para_254"
      },
      {
        "text": "Cir. 2001). If not, we consider whether a federal equitable",
        "paragraph_id": "para_255"
      },
      {
        "text": "tolling rule applies. See Wallace v. Kato, 549 U.S. 384, 394–",
        "paragraph_id": "para_256"
      },
      {
        "text": "96 (2007).",
        "paragraph_id": "para_257"
      },
      {
        "text": "The parties agree that Edwards’s cause of action accrued",
        "paragraph_id": "para_258"
      },
      {
        "text": "on October 1, 2022, when he was exposed to the pepper",
        "paragraph_id": "para_259"
      },
      {
        "text": "spray. Without tolling, his complaint would have been due",
        "paragraph_id": "para_260"
      },
      {
        "text": "on October 1, 2024. See Or. Rev. Stat. §§ 12.110(1),",
        "paragraph_id": "para_261"
      },
      {
        "text": "174.120(5). Thus, because Edwards did not file his",
        "paragraph_id": "para_262"
      },
      {
        "text": "complaint until January 10, 2025, his claims survive only if",
        "paragraph_id": "para_263"
      },
      {
        "text": "tolling applies.",
        "paragraph_id": "para_264"
      },
      {
        "text": "Edwards makes two arguments in favor of tolling. First,",
        "paragraph_id": "para_265"
      },
      {
        "text": "he contends that an Oregon statute, Oregon Revised Statutes",
        "paragraph_id": "para_266"
      },
      {
        "text": "§ 12.210, tolls the statute of limitations from the date an",
        "paragraph_id": "para_267"
      },
      {
        "text": "inmate’s cause of action accrues until the time he exhausts",
        "paragraph_id": "para_268"
      },
      {
        "text": "his administrative remedies. Second, he relies on a federal",
        "paragraph_id": "para_269"
      },
      {
        "text": "equitable tolling rule recognized by our court in Brown v.",
        "paragraph_id": "para_270"
      },
      {
        "text": "Valoff, 422 F.3d 926, 942–43 (9th Cir. 2005), and Soto, 882",
        "paragraph_id": "para_271"
      },
      {
        "text": "F.3d at 872–75. Because we agree that Oregon tolling rules",
        "paragraph_id": "para_272"
      },
      {
        "text": "afford Edwards relief, we do not reach the issue of equitable",
        "paragraph_id": "para_273"
      },
      {
        "text": "tolling under federal law.",
        "paragraph_id": "para_274"
      },
      {

        "text": "III",
        "paragraph_id": "para_276"
      },
      {
        "text": "Oregon law provides that “[w]hen the commencement of",
        "paragraph_id": "para_277"
      },
      {
        "text": "an action is stayed by injunction or a statutory prohibition,",
        "paragraph_id": "para_278"
      },
      {
        "text": "the time of the continuance of the injunction or prohibition",
        "paragraph_id": "para_279"
      },
      {
        "text": "shall not be a part of the time limited for the commencement",
        "paragraph_id": "para_280"
      },
      {
        "text": "of the action.” Or. Rev. Stat. § 12.210. One relevant",
        "paragraph_id": "para_281"
      },
      {
        "text": "statutory prohibition is found in the Prison Litigation Reform",
        "paragraph_id": "para_282"
      },
      {
        "text": "Act (“PLRA”), which requires inmates to exhaust their",
        "paragraph_id": "para_283"
      },
      {
        "text": "administrative remedies before filing a § 1983 suit. See",
        "paragraph_id": "para_284"
      },
      {
        "text": "42 U.S.C. § 1997e(a) (“No action shall be brought with",
        "paragraph_id": "para_285"
      },
      {
        "text": "respect to prison conditions under section 1983 of this title,",
        "paragraph_id": "para_286"
      },
      {
        "text": "or any other Federal law, by a prisoner . . . until such",
        "paragraph_id": "para_287"
      },
      {
        "text": "administrative remedies as are available are exhausted.”).",
        "paragraph_id": "para_288"
      },
      {
        "text": "The PLRA “mandates that an inmate exhaust ‘such",
        "paragraph_id": "para_289"
      },
      {
        "text": "administrative remedies as are available’ before bringing",
        "paragraph_id": "para_290"
      },
      {
        "text": "suit to challenge prison conditions.” Ross v. Blake, 578 U.S.",
        "paragraph_id": "para_291"
      },
      {
        "text": "632, 635 (2016) (emphasis added) (quoting § 1997e(a)).",
        "paragraph_id": "para_292"
      },
      {
        "text": "This exhaustion requirement, Edwards contends, is a",
        "paragraph_id": "para_293"
      },
      {
        "text": "“statutory prohibition” that stayed the commencement of his",
        "paragraph_id": "para_294"
      },
      {
        "text": "§ 1983 action. In his view, the PLRA prohibited him from",
        "paragraph_id": "para_295"
      },
      {
        "text": "commencing suit from the date his cause of action accrued",
        "paragraph_id": "para_296"
      },
      {
        "text": "(October 1, 2022) until the date he finished exhausting his",
        "paragraph_id": "para_297"
      },
      {
        "text": "administrative remedies (January 13, 2023). So under the",
        "paragraph_id": "para_298"
      },
      {
        "text": "Oregon statute, he reasons, this period is not “part of the time",
        "paragraph_id": "para_299"
      },
      {
        "text": "limited for the commencement of [his § 1983] action.” See",
        "paragraph_id": "para_300"
      },
      {
        "text": "Or. Rev. Stat. § 12.210.",
        "paragraph_id": "para_301"
      },
      {
        "text": "A",
        "paragraph_id": "para_302"
      },
      {
        "text": "Before evaluating Edwards’s entitlement to tolling under",
        "paragraph_id": "para_303"
      },
      {
        "text": "§ 12.210, we first must address a threshold issue.",
        "paragraph_id": "para_304"
      },
      {
        "text": "Defendants urge us to forgo deciding whether Oregon law",
        "paragraph_id": "para_305"
      },
      {
        "text": "entitles Edwards to tolling. In their view, principles of",
        "paragraph_id": "para_306"
      },
      {

      {
        "text": "waiver, party presentation, and comity prevent us from",
        "paragraph_id": "para_308"
      },
      {
        "text": "reaching this state law question.",
        "paragraph_id": "para_309"
      },
      {
        "text": "Before the district court, the parties did not address the",
        "paragraph_id": "para_310"
      },
      {
        "text": "application of Oregon tolling law to this case. In his",
        "paragraph_id": "para_311"
      },
      {
        "text": "opposition to Defendants’ motion to dismiss, Edwards—",
        "paragraph_id": "para_312"
      },
      {
        "text": "proceeding pro se—argued that his § 1983 claim is not time",
        "paragraph_id": "para_313"
      },
      {
        "text": "barred because “there is a toll involved when a Plaintiff is",
        "paragraph_id": "para_314"
      },
      {
        "text": "going through the grievance process.” But he relied",
        "paragraph_id": "para_315"
      },
      {
        "text": "exclusively on our precedent adopting an equitable rule: that",
        "paragraph_id": "para_316"
      },
      {
        "text": "the statute of limitations is tolled while an inmate exhausts",
        "paragraph_id": "para_317"
      },
      {
        "text": "the prison administrative grievance process. The district",
        "paragraph_id": "para_318"
      },
      {
        "text": "court accordingly considered only whether federal equitable",
        "paragraph_id": "para_319"
      },
      {
        "text": "principles entitle Edwards to tolling.",
        "paragraph_id": "para_320"
      },
      {
        "text": "In their original briefs on appeal, the parties again",
        "paragraph_id": "para_321"
      },
      {
        "text": "discussed tolling under only our own federal rule. But",
        "paragraph_id": "para_322"
      },
      {
        "text": "before oral argument, we ordered supplemental briefing on",
        "paragraph_id": "para_323"
      },
      {
        "text": "whether Edwards is entitled to tolling under Oregon Revised",
        "paragraph_id": "para_324"
      },
      {
        "text": "Statutes § 12.210 because the PLRA is a statutory",
        "paragraph_id": "para_325"
      },

        "text": "In this posture, we disagree that Edwards has waived or",
        "paragraph_id": "para_328"
      },
      {
        "text": "forfeited any right to relief under Oregon tolling law. “When",
        "paragraph_id": "para_329"
      },
      {
        "text": "an issue or claim is properly before the court, the court is not",
        "paragraph_id": "para_330"
      },
      {
        "text": "limited to the particular legal theories advanced by the",
        "paragraph_id": "para_331"
      },
      {
        "text": "parties, but rather retains the independent power to identify",
        "paragraph_id": "para_332"
      },
      {
        "text": "and apply the proper construction of governing law.” Kamen",
        "paragraph_id": "para_333"
      },
      {
        "text": "v. Kemper Fin. Servs., Inc., 500 U.S. 90, 99 (1991).",
        "paragraph_id": "para_334"
      },
      {
        "text": "Proceeding pro se in the district court, Edwards argued that",
        "paragraph_id": "para_335"
      },
      {
        "text": "his § 1983 claim is not time barred because “there is a toll",
        "paragraph_id": "para_336"
      },
      {
        "text": "involved when a Plaintiff is going through the grievance",
        "paragraph_id": "para_337"
      },
      {
        "text": "process.” Aided by counsel on appeal, Edwards continues",
        "paragraph_id": "para_338"
      },
      {

      },
      {
        "text": "to press that he is entitled to tolling for the period he was",
        "paragraph_id": "para_340"
      },
      {
        "text": "exhausting his administrative remedies.",
        "paragraph_id": "para_341"
      },
      {
        "text": "With the tolling issue properly before us, we retain the",
        "paragraph_id": "para_342"
      },
      {
        "text": "power to “identify and apply the proper construction of",
        "paragraph_id": "para_343"
      },
      {
        "text": "governing law.” Id. And Oregon law governs tolling here.",
        "paragraph_id": "para_344"
      },
      {
        "text": "We are required to follow Oregon’s tolling rules “unless",
        "paragraph_id": "para_345"
      },
      {
        "text": "their full application would defeat the goals of [§ 1983].”",
        "paragraph_id": "para_346"
      },
      {
        "text": "See Hardin, 490 U.S. at 539. Thus, the question of Oregon",
        "paragraph_id": "para_347"
      },
      {
        "text": "law is “‘antecedent to . . . and ultimately dispositive of’ the",
        "paragraph_id": "para_348"
      },
      {
        "text": "dispute before [us],” even though “the parties fail[ed] to",
        "paragraph_id": "para_349"
      },
      {
        "text": "identify and brief” the effect of the relevant statute. See U.S.",
        "paragraph_id": "para_350"
      },
      {
        "text": "Nat’l Bank of Or. v. Indep. Ins. Agents of Am., Inc., 508 U.S.",
        "paragraph_id": "para_351"
      },
      {
        "text": "439, 447 (1993) (quoting Arcadia v. Ohio Power Co., 498",
        "paragraph_id": "para_352"
      },
      {
        "text": "U.S. 73, 77 (1990)).",
        "paragraph_id": "para_353"
      },
      {
        "text": "As to party presentation, we have similarly declined to",
        "paragraph_id": "para_354"
      },
      {
        "text": "apply that doctrine when the court has “merely ‘identif[ied]",
        "paragraph_id": "para_355"
      },
      {
        "text": "and appl[ied] the proper construction of governing law.’”",
        "paragraph_id": "para_356"
      },
      {
        "text": "Does v. Wasden, 982 F.3d 784, 793 (9th Cir. 2020)",
        "paragraph_id": "para_357"
      },
      {
        "text": "(alterations in original) (quoting Kamen, 500 U.S. at 99); see",
        "paragraph_id": "para_358"
      },
      {
        "text": "also All. for the Wild Rockies v. Higgins, 183 F.4th 671, 680",
        "paragraph_id": "para_359"
      },
      {
        "text": "n.5 (9th Cir. 2026) (“It is not determinative, as a matter of",
        "paragraph_id": "para_360"
      },
      {
        "text": "party presentation, that [the appellant] neglected relevant",
        "paragraph_id": "para_361"
      },
      {
        "text": "legal authority directly bearing on th[e] issue; we must apply",
        "paragraph_id": "para_362"
      },
      {
        "text": "the correct law to decide the issue raised on appeal.”). “[A]",
        "paragraph_id": "para_363"
      },
      {
        "text": "court,” we have explained, “is not hidebound by the precise",
        "paragraph_id": "para_364"
      },
      {
        "text": "arguments of counsel.” Machowski v. 333 N. Placentia",
        "paragraph_id": "para_365"
      },
      {
        "text": "Prop., LLC, 38 F.4th 837, 843 (9th Cir. 2022) (quoting",
        "paragraph_id": "para_366"
      },
      {
        "text": "United States v. Sineneng-Smith, 590 U.S. 371, 380 (2020)).",
        "paragraph_id": "para_367"
      },
      {
        "text": "So a decision does not violate the party presentation",
        "paragraph_id": "para_368"
      },
      {
        "text": "principle simply because its “analysis [does] not perfectly",
        "paragraph_id": "para_369"
      },
      {
        "text": "track the arguments [the appellants] present[] in [their]",
        "paragraph_id": "para_370"
      },
      {
        "text": "briefing.” Id.",
        "paragraph_id": "para_371"
      },
      {
        "text": "EDWARDS V. BROWN 13",

      },
      {
        "text": "Finally, Defendants invoke principles of comity. They",
        "paragraph_id": "para_373"
      },
      {
        "text": "press that we should not resolve whether Edwards is entitled",
        "paragraph_id": "para_374"
      },
      {
        "text": "to tolling under Oregon law because Oregon courts should",
        "paragraph_id": "para_375"
      },
      {
        "text": "be the ones to interpret the state tolling statute at issue. But",
        "paragraph_id": "para_376"
      },
      {
        "text": "Defendants’ contention fails because we are required to",
        "paragraph_id": "para_377"
      },
      {
        "text": "apply Oregon tolling rules unless doing so “defeat[s] either",
        "paragraph_id": "para_378"
      },
      {
        "text": "§ 1983’s chief goals of compensation and deterrence or its",
        "paragraph_id": "para_379"
      },
      {
        "text": "subsidiary goals of uniformity and federalism.” See Hardin,",
        "paragraph_id": "para_380"
      },
      {
        "text": "490 U.S. at 539 (footnote omitted). Moreover, neither party",
        "paragraph_id": "para_381"
      },
      {
        "text": "has asked us to certify this question to the Oregon Supreme",
        "paragraph_id": "para_382"
      },
      {
        "text": "Court, and we see no need to do so.",
        "paragraph_id": "para_383"
      },
      {
        "text": "In sum, we conclude that principles of waiver, party",
        "paragraph_id": "para_384"
      },
      {
        "text": "presentation, and comity do not prevent us from determining",
        "paragraph_id": "para_385"
      },
      {
        "text": "the application of Oregon tolling law to this case.",
        "paragraph_id": "para_386"
      },
      {
        "text": "B",
        "paragraph_id": "para_387"
      },
      {
        "text": "Oregon law provides that “[w]hen the commencement of",
        "paragraph_id": "para_388"
      },
      {
        "text": "an action is stayed by injunction or a statutory prohibition,",
        "paragraph_id": "para_389"
      },
      {
        "text": "the time of the continuance of the injunction or prohibition",
        "paragraph_id": "para_390"
      },
      {
        "text": "shall not be a part of the time limited for the commencement",
        "paragraph_id": "para_391"
      },
      {
        "text": "of the action.” Or. Rev. Stat. § 12.210. We construe",
        "paragraph_id": "para_392"
      },
      {
        "text": "§ 12.210 using Oregon’s “methodology for interpreting a",
        "paragraph_id": "para_393"
      },
      {
        "text": "statute,” under which “examination of text and context” are",
        "paragraph_id": "para_394"
      },
      {
        "text": "“given primary weight.”2 State v. Gaines, 206 P.3d 1042,",
        "paragraph_id": "para_395"
      },
      {
        "text": "1050 (Or. 2009) (en banc).",
        "paragraph_id": "para_396"
      },
      {
        "text": "2 After examining text and context in the first step, Oregon law requires",
        "paragraph_id": "para_397"
      },
      {
        "text": "the court to “consult [proffered legislative history in the second",
        "paragraph_id": "para_398"
      },
      {
        "text": "step] . . . even if the court does not perceive an ambiguity in the statute’s",
        "paragraph_id": "para_399"
      },
      {
        "text": "text, where that legislative history appears useful to the court’s analysis.”",
        "paragraph_id": "para_400"
      },
      {
        "text": "Gaines, 206 P.3d at 1050 (footnote omitted). In the third and final step,",
        "paragraph_id": "para_401"
      },
      {
        "text": "“[i]f the legislature’s intent remains unclear after examining text,",
        "paragraph_id": "para_402"
      },
      {
        "text": "context, and legislative history, the court may resort to general maxims",
        "paragraph_id": "para_403"
      },
      {
        "text": "of statutory construction to aid in resolving the remaining uncertainty.”",
        "paragraph_id": "para_404"
      },
      {

        "paragraph_id": "para_405"
      },
      {
        "text": "Examining the text of § 12.210, we conclude that Oregon",
        "paragraph_id": "para_406"
      },
      {
        "text": "law plainly and unambiguously authorizes tolling the statute",
        "paragraph_id": "para_407"
      },
      {
        "text": "of limitations when another statute—state or federal—",
        "paragraph_id": "para_408"
      },
      {
        "text": "prevents a plaintiff from bringing suit.",
        "paragraph_id": "para_409"
      },
      {
        "text": "The PLRA commands that “[n]o action shall be brought",
        "paragraph_id": "para_410"
      },
      {
        "text": "with respect to prison conditions under section 1983 of this",
        "paragraph_id": "para_411"
      },
      {
        "text": "title, or any other Federal law, by a prisoner confined in any",
        "paragraph_id": "para_412"
      },
      {
        "text": "jail, prison, or other correctional facility until such",
        "paragraph_id": "para_413"
      },
      {
        "text": "administrative remedies as are available are exhausted.” 42",
        "paragraph_id": "para_414"
      },
      {
        "text": "U.S.C. § 1997e(a). In other words, the PLRA functions as a",
        "paragraph_id": "para_415"
      },
      {
        "text": "“statutory prohibition” that stays “the commencement of an",
        "paragraph_id": "para_416"
      },
      {
        "text": "action,” during the time an inmate exhausts his available",
        "paragraph_id": "para_417"
      },
      {
        "text": "administrative remedies. Or. Rev. Stat. § 12.210. We",
        "paragraph_id": "para_418"
      },
      {
        "text": "therefore hold that under Oregon’s tolling statute, the time",
        "paragraph_id": "para_419"
      },
      {
        "text": "an inmate spends exhausting available administrative",
        "paragraph_id": "para_420"
      },
      {
        "text": "remedies does not run against the statute of limitations on",
        "paragraph_id": "para_421"
      },
      {
        "text": "their federal § 1983 claim. See Pearson, 775 F.3d at 602–03",
        "paragraph_id": "para_422"
      },
      {
        "text": "(applying a Pennsylvania tolling statute with similar",
        "paragraph_id": "para_423"
      },
      {
        "text": "language); Johnson, 272 F.3d at 521 (applying an Illinois",
        "paragraph_id": "para_424"
      },
      {
        "text": "tolling statute with similar language).",
        "paragraph_id": "para_425"
      },
      {
        "text": "Applied here, we conclude that the statute of limitations",
        "paragraph_id": "para_426"
      },
      {
        "text": "for Edwards’s § 1983 lawsuit was tolled until he had",
        "paragraph_id": "para_427"
      },
      {
        "text": "properly exhausted available administrative remedies as",
        "paragraph_id": "para_428"
      },
      {
        "text": "required by the PLRA. The parties further dispute, however,",
        "paragraph_id": "para_429"
      },
      {
        "text": "exactly how long § 12.210 tolled the two-year statute of",
        "paragraph_id": "para_430"
      },
      {
        "text": "limitations. Edwards contends that he is entitled to tolling",
        "paragraph_id": "para_431"
      },
      {
        "text": "from the date his cause of action accrued (October 1, 2022)",
        "paragraph_id": "para_432"
      },
      {
        "text": "Id. at 1051. We do not analyze the legislative history of § 12.210 here",
        "paragraph_id": "para_433"
      },
      {
        "text": "because the parties did not provide this information in their briefing. See",
        "paragraph_id": "para_434"
      },
      {
        "text": "Or. Rev. Stat. § 174.020(3) (“A court may limit its consideration of",
        "paragraph_id": "para_435"
      },
      {
        "text": "legislative history to the information that the parties provide to the",
        "paragraph_id": "para_436"
      },
      {
        "text": "court.”).",
        "paragraph_id": "para_437"
      },
      {

      {
        "text": "until the date he finished exhausting available administrative",
        "paragraph_id": "para_439"
      },
      {
        "text": "remedies (January 13, 2023). Defendants counter that",
        "paragraph_id": "para_440"
      },
      {
        "text": "tolling begins only once an inmate initiates the grievance",
        "paragraph_id": "para_441"
      },
      {
        "text": "process, not when the cause of action accrues. But we need",
        "paragraph_id": "para_442"
      },
      {
        "text": "not—and do not—resolve today whether § 12.210 tolls the",
        "paragraph_id": "para_443"
      },
      {
        "text": "statute of limitations beginning on the date an inmate starts",
        "paragraph_id": "para_444"
      },
      {
        "text": "exhausting their administrative remedies or on the date an",
        "paragraph_id": "para_445"
      },
      {
        "text": "inmate’s § 1983 claim accrues. On the record before us,",
        "paragraph_id": "para_446"
      },
      {
        "text": "Edwards timely filed his complaint under either standard.",
        "paragraph_id": "para_447"
      },
      {
        "text": "We thus assume without deciding that the tolling period",
        "paragraph_id": "para_448"
      },
      {
        "text": "starts on the date Edwards initiated the grievance process.",
        "paragraph_id": "para_449"
      },
      {
        "text": "And we leave for another day whether Oregon law, as",
        "paragraph_id": "para_450"
      },
      {
        "text": "applied to a § 1983 claim subject to the PLRA’s exhaustion",
        "paragraph_id": "para_451"
      },
      {
        "text": "requirement, also tolls the statute of limitations for the time",
        "paragraph_id": "para_452"
      },
      {
        "text": "between an inmate’s injury and his filing of an",
        "paragraph_id": "para_453"
      },
      {
        "text": "administrative grievance.",
        "paragraph_id": "para_454"
      },
      {
        "text": "C",
        "paragraph_id": "para_455"
      },
      {
        "text": "Under Oregon law, tolling commenced no later than",
        "paragraph_id": "para_456"
      },
      {
        "text": "when Edwards initiated the grievance process. See Or. Rev.",
        "paragraph_id": "para_457"
      },
      {
        "text": "Stat. § 12.210. Edwards signed and dated his first grievance",
        "paragraph_id": "para_458"
      },
      {
        "text": "form on October 3, 2022. It is unclear from the record what",
        "paragraph_id": "para_459"
      },
      {
        "text": "steps Edwards took to submit this grievance and why the",
        "paragraph_id": "para_460"
      },
      {
        "text": "grievance office did not stamp it as “received” until",
        "paragraph_id": "para_461"
      },
      {
        "text": "October 11, eight days later. But Defendants do not contend",
        "paragraph_id": "para_462"
      },
      {
        "text": "that Edwards actually tendered his grievance to the prison or",
        "paragraph_id": "para_463"
      },
      {
        "text": "a prison official after October 3, nor have they provided an",
        "paragraph_id": "para_464"
      },
      {
        "text": "explanation for the delay in receipt. “[D]raw[ing] all",
        "paragraph_id": "para_465"
      },
      {
        "text": "reasonable inferences in favor of” Edwards as the",
        "paragraph_id": "para_466"
      },
      {
        "text": "nonmoving party, see Hoang, 910 F.3d at 1100, we conclude",
        "paragraph_id": "para_467"
      },
      {
        "text": "for purposes of this appeal that he presented his first",
        "paragraph_id": "para_468"
      },
      {
        "text": "grievance to the Oregon State Penitentiary on",
        "paragraph_id": "para_469"
      },
      {
        "text": "October 3, 2022.",
        "paragraph_id": "para_470"
      },
      {

        "paragraph_id": "para_471"
      },
      {
        "text": "Tolling thus began, under § 12.210, no later than",
        "paragraph_id": "para_472"
      },
      {
        "text": "October 3, 2022. The tolling period continued until",
        "paragraph_id": "para_473"
      },
      {
        "text": "January 13, 2023, when Edwards finished properly",
        "paragraph_id": "para_474"
      },
      {
        "text": "exhausting his administrative remedies. So these 102 days",
        "paragraph_id": "para_475"
      },
      {
        "text": "between October 3, 2022, and January 13, 2023, did not run",
        "paragraph_id": "para_476"
      },
      {
        "text": "against the statute of limitations on his federal § 1983 claim.",
        "paragraph_id": "para_477"
      },
      {
        "text": "The parties agree that Edwards’s cause of action accrued",
        "paragraph_id": "para_478"
      },
      {
        "text": "on October 1, 2022. Without any tolling, Edwards’s",
        "paragraph_id": "para_479"
      },
      {
        "text": "complaint would have been due by October 1, 2024. See",
        "paragraph_id": "para_480"
      },
      {
        "text": "Sain, 309 F.3d at 1139; Or. Rev. Stat. §§ 12.110(1),",
        "paragraph_id": "para_481"
      },
      {
        "text": "174.120(5). Tolled 102 days, the statute of limitations",
        "paragraph_id": "para_482"
      },
      {
        "text": "would have expired on Saturday, January 11, 2025.",
        "paragraph_id": "para_483"
      },
      {
        "text": "Pursuant to Federal Rule of Civil Procedure 6(a)(1)(C),",
        "paragraph_id": "para_484"
      },
      {
        "text": "however, a period of time ending on a weekend is extended",
        "paragraph_id": "para_485"
      },
      {
        "text": "to the following Monday, in this case, January 13, 2025. See",
        "paragraph_id": "para_486"
      },
      {
        "text": "Fed. R. Civ. P. 6(a)(1)(C) (providing that “if the last day is a",
        "paragraph_id": "para_487"
      },
      {
        "text": "Saturday, Sunday, or legal holiday, the period continues to",
        "paragraph_id": "para_488"
      },
      {
        "text": "run until the end of the next day that is not a Saturday,",
        "paragraph_id": "para_489"
      },
      {
        "text": "Sunday, or legal holiday”); see also Sain, 309 F.3d at 1138",
        "paragraph_id": "para_490"
      },
      {
        "text": "(holding that Rule 6(a) governs the computation of time for",
        "paragraph_id": "para_491"
      },
      {
        "text": "tolling purposes when the statute of limitations for a",
        "paragraph_id": "para_492"
      },
      {
        "text": "section 1983 claim is borrowed from state law).",
        "paragraph_id": "para_493"
      },
      {
        "text": "Edwards filed his complaint on Friday,",
        "paragraph_id": "para_494"
      },
      {
        "text": "January 10, 2025. Thus, applying the Oregon tolling statute,",
        "paragraph_id": "para_495"
      },
      {
        "text": "we conclude that Edwards’s claims are not barred by the",
        "paragraph_id": "para_496"
      },
      {
        "text": "statute of limitations.",
        "paragraph_id": "para_497"
      },
      {
        "text": "D",
        "paragraph_id": "para_498"
      },
      {
        "text": "Defendants urge an altogether different analysis. They",
        "paragraph_id": "para_499"
      },
      {
        "text": "press that Edwards did not initiate the grievance process",
        "paragraph_id": "para_500"
      },
      {
        "text": "until October 18, 2022, when the prison received his second",
        "paragraph_id": "para_501"
      },
      {
        "text": "grievance form. Embedded in Defendants’ position are two",
        "paragraph_id": "para_502"
      },
      {
        "text": "arguments: first, that Edwards’s original grievance should be",
        "paragraph_id": "para_503"
      },
      {

      },
      {
        "text": "excluded from the tolling period altogether; and second, that",
        "paragraph_id": "para_505"
      },
      {
        "text": "Edwards did not initiate the grievance process when he",
        "paragraph_id": "para_506"
      },
      {
        "text": "submitted his grievance but instead when the prison’s",
        "paragraph_id": "para_507"
      },
      {
        "text": "grievance office stamped it as received. We disagree on both",
        "paragraph_id": "para_508"
      },
      {
        "text": "counts.",
        "paragraph_id": "para_509"
      },
      {
        "text": "We begin with the contention that Edwards’s first",
        "paragraph_id": "para_510"
      },
      {
        "text": "grievance should be excluded from the tolling period.",
        "paragraph_id": "para_511"
      },
      {
        "text": "Again, drawing all reasonable inferences in his favor,",
        "paragraph_id": "para_512"
      },
      {
        "text": "Edwards submitted this grievance on October 3, 2022, and",
        "paragraph_id": "para_513"
      },
      {
        "text": "the prison “denied” it on October 11, 2022, for non-",
        "paragraph_id": "para_514"
      },
      {
        "text": "compliance with DOC rules. Because Edwards “did not",
        "paragraph_id": "para_515"
      },
      {
        "text": "appeal the denial of that grievance,” Defendants assert that",
        "paragraph_id": "para_516"
      },
      {
        "text": "he “did not exhaust the administrative remedies such as to",
        "paragraph_id": "para_517"
      },
      {
        "text": "toll the statute of limitations” for that grievance. But as",
        "paragraph_id": "para_518"
      },
      {
        "text": "Edwards points out, the DOC rules provide that “[a] denied",
        "paragraph_id": "para_519"
      },
      {
        "text": "grievance or grievance appeal cannot be appealed.” Or.",
        "paragraph_id": "para_520"
      },
      {
        "text": "Admin. R. 291-109-0225(5) (emphasis added).",
        "paragraph_id": "para_521"
      },
      {
        "text": "“[T]he PLRA exhaustion requirement requires proper",
        "paragraph_id": "para_522"
      },
      {
        "text": "exhaustion.” Woodford v. Ngo, 548 U.S. 81, 93 (2006).",
        "paragraph_id": "para_523"
      },
      {
        "text": "“[T]o properly exhaust administrative remedies,” the",
        "paragraph_id": "para_524"
      },
      {
        "text": "Supreme Court has explained, “prisoners must ‘complete the",
        "paragraph_id": "para_525"
      },
      {
        "text": "administrative review process in accordance with the",
        "paragraph_id": "para_526"
      },
      {
        "text": "applicable procedural rules’—rules that are defined not by",
        "paragraph_id": "para_527"
      },
      {
        "text": "the PLRA, but by the prison grievance process itself.” Jones",
        "paragraph_id": "para_528"
      },
      {
        "text": "v. Bock, 549 U.S. 199, 218 (2007) (citation omitted) (quoting",
        "paragraph_id": "para_529"
      },
      {
        "text": "Woodford, 548 U.S. at 88). And “[t]he obligation to exhaust",
        "paragraph_id": "para_530"
      },
      {
        "text": "‘available’ remedies persists as long as some remedy",
        "paragraph_id": "para_531"
      },
      {
        "text": "remains ‘available.’” Brown, 422 F.3d at 935.",
        "paragraph_id": "para_532"
      },
      {
        "text": "Without an option under the prison rules to appeal his",
        "paragraph_id": "para_533"
      },
      {
        "text": "denied grievance, Edwards reasonably believed that he",
        "paragraph_id": "para_534"
      },
      {
        "text": "needed to file another grievance in order to exhaust available",
        "paragraph_id": "para_535"
      },
      {
        "text": "remedies. Indeed, Defendants have not suggested that",
        "paragraph_id": "para_536"
      },
      {

      },
      {
        "text": "Edwards strayed from any DOC rules in filing a second",
        "paragraph_id": "para_538"
      },
      {
        "text": "grievance. When Edwards did so, the prison officials",
        "paragraph_id": "para_539"
      },
      {
        "text": "properly recognized that this “second grievance outlin[ed]",
        "paragraph_id": "para_540"
      },
      {
        "text": "the same incident [for] which [Edwards] filed a prior",
        "paragraph_id": "para_541"
      },
      {
        "text": "grievance.” The prison later “accepted” Edwards’s second",

        "text": "grievance, and this grievance proceeded to later steps in the",
        "paragraph_id": "para_543"
      },
      {
        "text": "process until Edwards ultimately exhausted his",
        "paragraph_id": "para_544"
      },
      {
        "text": "administrative remedies as required by the PLRA.",
        "paragraph_id": "para_545"
      },
      {
        "text": "The DOC rules and the prison’s treatment of Edwards’s",
        "paragraph_id": "para_546"
      },
      {
        "text": "grievances confirm that both grievances should be viewed as",
        "paragraph_id": "para_547"
      },
      {
        "text": "part of the same exhaustion process. So we conclude that his",
        "paragraph_id": "para_548"
      },
      {
        "text": "first grievance is included in the tolling calculation.",
        "paragraph_id": "para_549"
      },
      {
        "text": "Defendants also contend that the tolling period begins on",
        "paragraph_id": "para_550"
      },
      {
        "text": "the date the prison’s grievance office stamped Edwards’s",
        "paragraph_id": "para_551"
      },
      {
        "text": "first grievance as received (October 11)—and not the date",
        "paragraph_id": "para_552"
      },
      {
        "text": "that Edwards submitted it (October 3). That is so,",
        "paragraph_id": "para_553"
      },
      {
        "text": "Defendants urge, because prison administrative rules",
        "paragraph_id": "para_554"
      },
      {
        "text": "provide the metric by which to measure when a plaintiff has",
        "paragraph_id": "para_555"
      },
      {
        "text": "initiated the administrative review process. And under DOC",
        "paragraph_id": "para_556"
      },
      {
        "text": "rules, they continue, a grievance is filed when it is “received",
        "paragraph_id": "para_557"
      },
      {
        "text": "by the institution grievance coordinator.” Or. Admin.",
        "paragraph_id": "para_558"
      },
      {
        "text": "R. 291-109-0205(1) (emphasis added).",
        "paragraph_id": "para_559"
      },
      {
        "text": "For this argument, Defendants rely on Nigro v. Sullivan,",
        "paragraph_id": "para_560"
      },
      {
        "text": "40 F.3d 990 (9th Cir. 1994). There, we addressed whether",
        "paragraph_id": "para_561"
      },
      {
        "text": "an inmate timely filed his grievance appeal under the federal",
        "paragraph_id": "para_562"
      },
      {
        "text": "Bureau of Prisons’ internal administrative exhaustion",
        "paragraph_id": "para_563"
      },
      {
        "text": "process, and if not, whether his late filing “amounted to",
        "paragraph_id": "para_564"
      },
      {
        "text": "procedural default . . . warranting dismissal” of his habeas",
        "paragraph_id": "para_565"
      },
      {
        "text": "petition. See id. at 992–97. The question here is not whether",
        "paragraph_id": "para_566"
      },
      {
        "text": "Edwards timely filed his grievances or correctly followed the",
        "paragraph_id": "para_567"
      },
      {
        "text": "prison procedures as to properly exhaust his administrative",
        "paragraph_id": "para_568"
      },
      {
        "text": "remedies, but whether the statute of limitations for his",
        "paragraph_id": "para_569"
      },
      {

      },
      {
        "text": "§ 1983 claim is tolled. Indeed, Defendants did not raise",
        "paragraph_id": "para_571"
      },
      {
        "text": "failure to exhaust as an affirmative defense in the district",
        "paragraph_id": "para_572"
      },
      {
        "text": "court. Nor do they press this on appeal as an alternative",
        "paragraph_id": "para_573"
      },
      {
        "text": "ground to affirm the dismissal of Edwards’s complaint. So",
        "paragraph_id": "para_574"
      },
      {
        "text": "compliance with the DOC rules and deadlines is not at issue.",
        "paragraph_id": "para_575"
      },
      {
        "text": "Viewing the facts, as we must, in the light most favorable",
        "paragraph_id": "para_576"
      },
      {
        "text": "to Edwards, he presented his first grievance to the prison or",
        "paragraph_id": "para_577"
      },
      {
        "text": "prison officials on October 3, 2022. We thus determine that",
        "paragraph_id": "para_578"
      },
      {
        "text": "he is entitled to tolling beginning on that date. Tolling the",
        "paragraph_id": "para_579"
      },
      {
        "text": "applicable limitations period from October 3, 2022, when",
        "paragraph_id": "para_580"
      },
      {
        "text": "Edwards submitted his first grievance, through",
        "paragraph_id": "para_581"
      },
      {
        "text": "January 13, 2023, when Edwards finished exhausting his",
        "paragraph_id": "para_582"
      },
      {
        "text": "administrative remedies, we conclude that Edwards filed his",
        "paragraph_id": "para_583"
      },
      {
        "text": "complaint within the applicable statute of limitations.",
        "paragraph_id": "para_584"
      },
      {
        "text": "IV",
        "paragraph_id": "para_585"
      },
      {
        "text": "One final matter merits mention. In a § 1983 action like",
        "paragraph_id": "para_586"
      },
      {
        "text": "this one, the Supreme Court has instructed that we “should",
        "paragraph_id": "para_587"
      },
      {
        "text": "not unravel state limitations rules unless their full application",
        "paragraph_id": "para_588"
      },
      {
        "text": "would defeat the goals of the federal statute.” Hardin, 490",
        "paragraph_id": "para_589"
      },
      {
        "text": "U.S. at 539. Here, we see no basis to conclude that applying",
        "paragraph_id": "para_590"
      },
      {
        "text": "Oregon’s tolling statute would “defeat either § 1983’s chief",
        "paragraph_id": "para_591"
      },
      {
        "text": "goals of compensation and deterrence or its subsidiary goals",
        "paragraph_id": "para_592"
      },
      {
        "text": "of uniformity and federalism.” Id. (footnote omitted). “A",
        "paragraph_id": "para_593"
      },
      {
        "text": "State’s decision to toll the statute of limitations,” the",
        "paragraph_id": "para_594"
      },
      {
        "text": "Supreme Court has explained, “does not frustrate § 1983’s",
        "paragraph_id": "para_595"
      },
      {
        "text": "compensation goal. Rather, it enhances the inmate’s ability",
        "paragraph_id": "para_596"
      },
      {
        "text": "to bring suit and recover damages for injuries. Nor does [a]",
        "paragraph_id": "para_597"
      },
      {
        "text": "State’s decision to toll its statute of limitations hinder",
        "paragraph_id": "para_598"
      },
      {
        "text": "§ 1983’s deterrence interest.” Id. at 543 (footnote omitted).",
        "paragraph_id": "para_599"
      },
      {
        "text": "So consistent with § 1983, a State may “extend[] the time in",
        "paragraph_id": "para_600"
      },
      {
        "text": "which prisoners may seek recovery for constitutional",
        "paragraph_id": "para_601"
      },
      {
        "text": "20 EDWARDS V. BROWN",

      },
      {
        "text": "injuries.” See id. at 544. And that is the result when",
        "paragraph_id": "para_603"
      },
      {
        "text": "§ 12.210 is applied to an inmate’s § 1983 claim.",
        "paragraph_id": "para_604"
      },
      {
        "text": "Defendants argue that tolling the statute of limitations",
        "paragraph_id": "para_605"
      },
      {
        "text": "before an inmate begins exhausting their administrative",
        "paragraph_id": "para_606"
      },
      {
        "text": "remedies is inconsistent with the purposes of the PLRA",
        "paragraph_id": "para_607"
      },
      {
        "text": "because it would incentivize inmates to delay the exhaustion",
        "paragraph_id": "para_608"
      },
      {
        "text": "process. Edwards counters that such tolling would not",
        "paragraph_id": "para_609"
      },
      {
        "text": "enable lengthy delays because Oregon’s regulations require",
        "paragraph_id": "para_610"
      },
      {
        "text": "grievances to “be received by the institution grievance",
        "paragraph_id": "para_611"
      },
      {
        "text": "coordinator within 14 calendar days from the date of the",
        "paragraph_id": "para_612"
      },
      {
        "text": "incident,” and failure to comply with this deadline would bar",
        "paragraph_id": "para_613"
      },
      {
        "text": "a lawsuit on exhaustion grounds. We do not address these",
        "paragraph_id": "para_614"
      },
      {
        "text": "arguments because we do not decide today whether § 12.210",
        "paragraph_id": "para_615"
      },
      {
        "text": "tolls the statute of limitations for the time period between the",
        "paragraph_id": "para_616"
      },
      {
        "text": "accrual of an inmate’s § 1983 claim and the start of the",
        "paragraph_id": "para_617"
      },
      {
        "text": "prison grievance process.",
        "paragraph_id": "para_618"
      },
      {
        "text": "V",
        "paragraph_id": "para_619"
      },
      {
        "text": "Edwards is entitled to tolling under Oregon Revised",
        "paragraph_id": "para_620"
      },
      {
        "text": "Statutes § 12.210. With tolling, he timely filed his complaint",
        "paragraph_id": "para_621"
      },
      {
        "text": "under the applicable statute of limitations. And enforcing",
        "paragraph_id": "para_622"
      },
      {
        "text": "the Oregon tolling statute does not defeat the goals of 42",
        "paragraph_id": "para_623"
      },
      {
        "text": "U.S.C. § 1983. Thus, the district court erred in dismissing",
        "paragraph_id": "para_624"
      },
      {
        "text": "Edwards’s claims as time barred.",
        "paragraph_id": "para_625"
      },
      {
        "text": "REVERSED and REMANDED.",
        "paragraph_id": "para_626"
