        "text": "The panel affirmed (1) the district court’s dismissal of",
        "paragraph_id": "para_33"
      },
      {
        "text": "Jonathan Schmidt’s 42 U.S.C. § 1983 action against the City",
        "paragraph_id": "para_34"
      },
      {
        "text": "of Pasadena and individually named City employees,",
        "paragraph_id": "para_35"
      },
      {
        "text": "alleging that the City’s COVID-19 safety policy requiring",
        "paragraph_id": "para_36"
      },
      {
        "text": "unvaccinated employees to complete weekly COVID testing",
        "paragraph_id": "para_37"
      },
      {
        "text": "and wear masks in shared spaces unlawfully harmed him,",

        "text": "COVID-19 vaccination policy for its employees that",

        "text": "required City employees to either receive the COVID-19",
        "paragraph_id": "para_43"
      },
      {
        "text": "vaccination by September 17, 2021, or request a medical or",
        "paragraph_id": "para_44"
      },
      {

        "text": "religious exemption from the vaccination",
        "paragraph_id": "para_50"
      },
      {
        "text": "requirement. Schmidt, a forensic specialist in the Pasadena",
        "paragraph_id": "para_51"
      },
      {
        "text": "Police Department, requested and received a religious",
        "paragraph_id": "para_52"
      },
      {
        "text": "exemption from the vaccine requirement, but was required",
        "paragraph_id": "para_53"
      },
      {
        "text": "to test and wear a mask. He contends that the defendants",
        "paragraph_id": "para_54"
      },
      {
        "text": "created a hostile work environment by revealing his",
        "paragraph_id": "para_55"
      },
      {
        "text": "unvaccinated status through the masking and testing",
        "paragraph_id": "para_56"
      },
      {
        "text": "requirements.",
        "paragraph_id": "para_57"
      },
      {
        "text": "The panel held that the defendants have immunity from",
        "paragraph_id": "para_58"
      },
      {
        "text": "all of Schmidt’s claims under the Public Readiness and",
        "paragraph_id": "para_59"
      },
      {
        "text": "Emergency Preparedness (“PREP”) Act, which provides",
        "paragraph_id": "para_60"
      },
      {
        "text": "immunity from federal and state law claims relating to the",
        "paragraph_id": "para_61"
      },
      {
        "text": "administration of certain medical countermeasures during a",
        "paragraph_id": "para_62"
      },
      {
        "text": "declared public health emergency. The panel held the",
        "paragraph_id": "para_63"
      },
      {
        "text": "statutory requirements of PREP Act immunity were met",
        "paragraph_id": "para_64"
      },
      {
        "text": "where: (1) both the City and individual defendants qualify as",
        "paragraph_id": "para_65"
      },
      {
        "text": "“covered person[s]” under the PREP Act because both",
        "paragraph_id": "para_66"
      },
      {
        "text": "engaged in the administration of a covered countermeasure;",
        "paragraph_id": "para_67"
      },
      {
        "text": "(2) the COVID-19 testing and face masks required by the",
        "paragraph_id": "para_68"
      },
      {
        "text": "City’s policy meet the PREP Act’s requirements for being",
        "paragraph_id": "para_69"
      },
      {
        "text": "considered a “covered countermeasure”; and (3) Schmidt’s",
        "paragraph_id": "para_70"
      },
      {
        "text": "claims were “caused by, arising out of, relating to, or",
        "paragraph_id": "para_71"
      },
      {
        "text": "resulting from” the administration of a covered",
        "paragraph_id": "para_72"
      },
      {
        "text": "countermeasure.",
        "paragraph_id": "para_73"
      },
      {
        "text": "Clarifying the causation requirement of the PREP Act’s",
        "paragraph_id": "para_74"
      },
      {
        "text": "immunity provision, the panel wrote that the district court",
        "paragraph_id": "para_75"
      },
      {
        "text": "erred by focusing on the types of legal claims Schmidt pleads",
        "paragraph_id": "para_76"
      },
      {
        "text": "rather than the type of injury he alleges. The panel held that",
        "paragraph_id": "para_77"
      },
      {
        "text": "Schmidt’s allegations that he suffered physical, emotional,",
        "paragraph_id": "para_78"
      },
      {
        "text": "and property damage as a direct result of the City’s COVID-",
        "paragraph_id": "para_79"
      },

        "text": "19 safety policies are sufficient to establish causation for",
        "paragraph_id": "para_80"

        "text": "all of Schmidt’s claims under the Public Readiness and",
        "paragraph_id": "para_104"
      },
      {
        "text": "Emergency Preparedness (“PREP”) Act. Furthermore,",
        "paragraph_id": "para_105"
      },
      {
        "text": "because Schmidt fails to allege a valid ground for",
        "paragraph_id": "para_106"
      },
      {
        "text": "reconsideration or for finding that the district court abused",
        "paragraph_id": "para_107"
      },
      {

      {
        "text": "its discretion in managing his case, we affirm the district",
        "paragraph_id": "para_109"
      },
      {
        "text": "court’s dismissal and denial of his motion for",
        "paragraph_id": "para_110"
      },
      {
        "text": "reconsideration.",
        "paragraph_id": "para_111"
      },
      {
        "text": "I. Background",
        "paragraph_id": "para_112"
      },
      {
        "text": "A. Factual Background",
        "paragraph_id": "para_113"
      },
      {
        "text": "In August 2021, the City of Pasadena implemented a",
        "paragraph_id": "para_114"
      },
      {
        "text": "COVID-19 vaccination policy for its employees to “stem",
        "paragraph_id": "para_115"
      },
      {
        "text": "[the]rapid increase in COVID-19 transmission” resulting",
        "paragraph_id": "para_116"
      },
      {
        "text": "from the Delta variant of the virus. The policy required City",
        "paragraph_id": "para_117"
      },
      {
        "text": "employees to either (1) receive the COVID-19 vaccination",
        "paragraph_id": "para_118"
      },
      {
        "text": "by September 17, 2021, or (2) request a medical or religious",
        "paragraph_id": "para_119"
      },
      {
        "text": "exemption from the vaccination requirement.",
        "paragraph_id": "para_120"
      },
      {
        "text": "The City’s human resources department was charged",
        "paragraph_id": "para_121"
      },
      {
        "text": "with reviewing requests for exemptions, including",
        "paragraph_id": "para_122"
      },
      {
        "text": "exemptions for sincerely held religious beliefs or practices",
        "paragraph_id": "para_123"
      },
      {
        "text": "that would prohibit an employee from receiving a vaccine,",
        "paragraph_id": "para_124"
      },
      {
        "text": "which would then trigger testing and masking",
        "paragraph_id": "para_125"
      },
      {
        "text": "accommodations.",
        "paragraph_id": "para_126"
      },
      {
        "text": "Schmidt is a forensic specialist in the Pasadena Police",
        "paragraph_id": "para_127"
      },
      {
        "text": "Department. As an employee of the City, Schmidt was",
        "paragraph_id": "para_128"
      },
      {
        "text": "subject to the City’s vaccination policy. Schmidt requested",
        "paragraph_id": "para_129"
      },
      {
        "text": "and received a religious exemption from the vaccine",
        "paragraph_id": "para_130"
      },
      {
        "text": "requirement, but was required to test and wear a mask.",
        "paragraph_id": "para_131"
      },
      {
        "text": "Schmidt was placed on unpaid administrative leave for",
        "paragraph_id": "para_132"
      },
      {
        "text": "refusing to test and mask, and eventually agreed to comply",
        "paragraph_id": "para_133"
      },
      {
        "text": "with those provisions so that, in November 2021, he could",
        "paragraph_id": "para_134"
      },
      {
        "text": "return to work.",
        "paragraph_id": "para_135"
      },
      {
        "text": "Yet, Schmidt alleged, he continued to take issue with the",
        "paragraph_id": "para_136"
      },
      {
        "text": "City’s implementation of the COVID-19 safety policy once",
        "paragraph_id": "para_137"
      },
      {
        "text": "he returned to work, and he contends that Defendants created",
        "paragraph_id": "para_138"
      },
      {

        "text": "a hostile work environment by revealing his unvaccinated",
        "paragraph_id": "para_140"
      },
      {
        "text": "status through the masking and testing requirements.",
        "paragraph_id": "para_141"
      },
      {
        "text": "Nevertheless, Schmidt complied until the City rescinded",
        "paragraph_id": "para_142"
      },
      {
        "text": "the policy in March 2022.",
        "paragraph_id": "para_143"
      },
      {
        "text": "B. Procedural History",
        "paragraph_id": "para_144"
      },
      {
        "text": "Schmidt originally filed this action on November 8,",
        "paragraph_id": "para_145"
      },
      {
        "text": "2021, and five iterations of his complaint ultimately ensued.",
        "paragraph_id": "para_146"
      },
      {
        "text": "For the purposes of this appeal, the operative complaints are",
        "paragraph_id": "para_147"
      },
      {
        "text": "Schmidt’s Third Amended Complaint (“TAC”) and Fourth",
        "paragraph_id": "para_148"
      },
      {
        "text": "Amended Complaint (“FAC”).",
        "paragraph_id": "para_149"
      },
      {
        "text": "The TAC asserted twenty-one federal and state claims,",
        "paragraph_id": "para_150"
      },
      {
        "text": "all related to the testing and masking requirements, against",
        "paragraph_id": "para_151"
      },
      {
        "text": "the City and several current and former employees of the",
        "paragraph_id": "para_152"
      },
      {
        "text": "city. Defendants moved to dismiss, asserting among other",
        "paragraph_id": "para_153"
      },
      {
        "text": "defenses that they had immunity under the PREP Act. The",
        "paragraph_id": "para_154"
      },
      {
        "text": "district court concluded that the PREP Act applied but did",
        "paragraph_id": "para_155"
      },
      {
        "text": "not immunize the individual Defendants from all of",
        "paragraph_id": "para_156"
      },
      {
        "text": "Schmidt’s claims. Nevertheless, it found that the individual",
        "paragraph_id": "para_157"
      },
      {
        "text": "Defendants were entitled to other forms of immunity and",
        "paragraph_id": "para_158"
      },
      {
        "text": "dismissed the entire TAC.",
        "paragraph_id": "para_159"
      },
      {
        "text": "Schmidt then filed the FAC. The City moved to dismiss,",
        "paragraph_id": "para_160"
      },
      {
        "text": "and Schmidt moved for reconsideration of the TAC",
        "paragraph_id": "para_161"
      },
      {
        "text": "dismissal based on what he argued was new evidence",
        "paragraph_id": "para_162"
      },
      {
        "text": "regarding the COVID-19 testing that he underwent. The",
        "paragraph_id": "para_163"
      },
      {
        "text": "district court denied Schmidt’s request for reconsideration.",
        "paragraph_id": "para_164"
      },
      {
        "text": "The court reasoned that the evidence Schmidt raised was",
        "paragraph_id": "para_165"
      },
      {
        "text": "previously available and was not enough to cure the legal",
        "paragraph_id": "para_166"
      },
      {
        "text": "deficiencies underlying the TAC’s dismissal. In addition, the",
        "paragraph_id": "para_167"
      },
      {
        "text": "court granted Defendants’ motion to dismiss the FAC, and",
        "paragraph_id": "para_168"
      },
      {
        "text": "denied the remaining discovery motions as moot.",
        "paragraph_id": "para_169"
      },
      {

      {
        "text": "The district court entered judgment for Defendants in",
        "paragraph_id": "para_171"
      },
      {
        "text": "January 2025. Schmidt timely appealed.",
        "paragraph_id": "para_172"
      },
      {
        "text": "II. Jurisdiction and Standard of Review",
        "paragraph_id": "para_173"
      },
      {
        "text": "We have jurisdiction pursuant to 28 U.S.C. § 1291. We",
        "paragraph_id": "para_174"
      },
      {
        "text": "review a district court’s dismissal of a complaint under",
        "paragraph_id": "para_175"
      },
      {
        "text": "Federal Rule of Civil Procedure 12(b)(6) de novo. Steinle v.",
        "paragraph_id": "para_176"
      },
      {
        "text": "City & Cnty. of San Francisco, 919 F.3d 1154, 1160 (9th Cir.",
        "paragraph_id": "para_177"
      },
      {
        "text": "2019) (citation omitted); Benavidez v. Cnty. of San Diego,",
        "paragraph_id": "para_178"
      },
      {
        "text": "993 F.3d 1134, 1141 (9th Cir. 2021). To survive a motion",
        "paragraph_id": "para_179"
      },
      {
        "text": "to dismiss, the plaintiff must provide “a short and plain",
        "paragraph_id": "para_180"
      },
      {
        "text": "statement of the claim showing the pleader is entitled to",
        "paragraph_id": "para_181"
      },
      {
        "text": "relief,” containing “sufficient factual matter, accepted as",
        "paragraph_id": "para_182"
      },
      {
        "text": "true, to state a claim to relief that is plausible on its face.”",
        "paragraph_id": "para_183"
      },
      {
        "text": "Disability Rts. Montana, Inc. v. Batista, 930 F.3d 1090, 1096",
        "paragraph_id": "para_184"
      },
      {
        "text": "(9th Cir. 2019) (citations omitted). On a motion to dismiss,",
        "paragraph_id": "para_185"
      },
      {
        "text": "we “take all allegations of material fact as true and construe",
        "paragraph_id": "para_186"
      },
      {
        "text": "them in the light most favorable to the nonmoving party.”",
        "paragraph_id": "para_187"
      },
      {
        "text": "Id. at 1097. We may affirm a dismissal “on any grounds",
        "paragraph_id": "para_188"
      },
      {
        "text": "supported by the record.” Steinle, 919 F.3d at 1160; Sonner",
        "paragraph_id": "para_189"
      },
      {
        "text": "v. Premier Nutrition Corp., 971 F.3d 834, 839 (9th Cir.",
        "paragraph_id": "para_190"
      },
      {
        "text": "2020). “Review is limited to the complaint, materials",
        "paragraph_id": "para_191"
      },
      {
        "text": "incorporated into the complaint by reference, and matters of",
        "paragraph_id": "para_192"
      },
      {
        "text": "which the court may take judicial notice” Petrie v. Elec.",
        "paragraph_id": "para_193"
      },
      {
        "text": "Game Card, Inc., 761 F.3d 959, 966 (9th Cir. 2014) (citation",
        "paragraph_id": "para_194"
      },
      {
        "text": "omitted).",
        "paragraph_id": "para_195"
      },
      {
        "text": "We review a district court’s decisions as to requests for",
        "paragraph_id": "para_196"
      },
      {
        "text": "judicial notice, motions for reconsideration, recusals, and",
        "paragraph_id": "para_197"
      },
      {
        "text": "Rule 11 sanctions for abuse of discretion. See Ritter v.",
        "paragraph_id": "para_198"
      },
      {
        "text": "Hughes Aircraft Co., 58 F.3d 454, 458 (9th Cir. 1995)",
        "paragraph_id": "para_199"
      },
      {
        "text": "(judicial notice); Do Sung Uhm v. Humana, Inc., 620 F.3d",
        "paragraph_id": "para_200"
      },
      {
        "text": "1134, 1140 (9th Cir. 2010) (motion for reconsideration);",
        "paragraph_id": "para_201"
      },
      {
        "text": "United States v. Carey, 929 F.3d 1092, 1104 (9th Cir. 2019)",
        "paragraph_id": "para_202"
      },
      {

        "text": "(recusal); Cooter & Gell v. Hartmarx Corp., 496 U.S. 384,",
        "paragraph_id": "para_204"
      },
      {
        "text": "409 (1990) (Rule 11 determinations).",
        "paragraph_id": "para_205"
      },
      {
        "text": "III. Discussion",
        "paragraph_id": "para_206"
      },
      {
        "text": "Defendants assert that all of Schmidt’s claims are barred",
        "paragraph_id": "para_207"
      },
      {
        "text": "by the PREP Act. 42 U.S.C. § 247d-6d. The PREP Act",
        "paragraph_id": "para_208"
      },
      {
        "text": "“provides immunity from federal and state law claims",
        "paragraph_id": "para_209"
      },
      {
        "text": "relating to the administration of certain medical",
        "paragraph_id": "para_210"
      },
      {
        "text": "countermeasures during a declared public health",
        "paragraph_id": "para_211"
      },
      {
        "text": "emergency.” Polanco v. Diaz, 76 F.4th 918, 932 (9th Cir.",
        "paragraph_id": "para_212"
      },
      {
        "text": "2023). On the face of Schmidt’s complaint, Defendants are",
        "paragraph_id": "para_213"
      },
      {
        "text": "entitled to immunity under the PREP Act. Moreover,",
        "paragraph_id": "para_214"
      },
      {
        "text": "Schmidt has failed to allege a valid ground for",
        "paragraph_id": "para_215"
      },
      {
        "text": "reconsideration of the TAC dismissal or for finding abuse of",
        "paragraph_id": "para_216"
      },
      {
        "text": "discretion in how the district court managed his case. We",
        "paragraph_id": "para_217"
      },
      {
        "text": "therefore affirm the district court’s dismissal on the grounds",
        "paragraph_id": "para_218"
      },
      {
        "text": "of PREP Act immunity. See Steinle, 919 F.3d at 1160;",
        "paragraph_id": "para_219"
      },
      {
        "text": "Sonner, 971 F.3d at 839.",
        "paragraph_id": "para_220"
      },
      {
        "text": "A. PREP Act",
        "paragraph_id": "para_221"
      },
      {
        "text": "“Congress passed the PREP Act in 2005 to encourage",
        "paragraph_id": "para_222"
      },
      {
        "text": "during times of crisis the development and deployment of",
        "paragraph_id": "para_223"
      },
      {
        "text": "medical countermeasures (such as diagnostics, treatments,",
        "paragraph_id": "para_224"
      },
      {
        "text": "and vaccines) by limiting legal liability relating to their",
        "paragraph_id": "para_225"
      },
      {
        "text": "administration.” Hampton v. California, 83 F.4th 754, 762",
        "paragraph_id": "para_226"
      },
      {
        "text": "(9th Cir. 2023) (citation modified); see also Maney v. Brown,",
        "paragraph_id": "para_227"
      },
      {
        "text": "91 F.4th 1296, 1298 (9th Cir. 2024). The statute provides",
        "paragraph_id": "para_228"
      },
      {
        "text": "“covered persons” immunity “from suit and liability” for",
        "paragraph_id": "para_229"
      },
      {
        "text": "“claims for loss caused by, arising out of, relating to, or",
        "paragraph_id": "para_230"
      },
      {
        "text": "resulting from the administration to or the use by an",
        "paragraph_id": "para_231"
      },
      {
        "text": "individual of a covered countermeasure.” Maney, 91 F.4th",
        "paragraph_id": "para_232"
      },
      {
        "text": "at 1298 (quoting 42 U.S.C. § 247d-6d(a)(1)). This immunity",
        "paragraph_id": "para_233"
      },
      {
        "text": "“applies to any claim for loss that has a causal relationship",
        "paragraph_id": "para_234"
      },
      {

        "text": "with the administration to or use by an individual of a",
        "paragraph_id": "para_236"
      },
      {
        "text": "covered countermeasure.” 42 U.S.C. § 247d-6d(a)(2)(B).",
        "paragraph_id": "para_237"
      },
      {
        "text": "“The Act’s immunity lies dormant until the Secretary of",
        "paragraph_id": "para_238"
      },
      {
        "text": "Health and Human Services makes a determination that a",
        "paragraph_id": "para_239"
      },
      {
        "text": "disease constitutes a public health emergency and makes a",
        "paragraph_id": "para_240"
      },
      {
        "text": "declaration, through publication in the Federal Register, that",
        "paragraph_id": "para_241"
      },
      {
        "text": "the Act’s immunity is in effect.” Hampton, 83 F.4th at 762",
        "paragraph_id": "para_242"
      },
      {
        "text": "(citing 42 U.S.C. § 247d-6d(b)(1)) (citation modified). The",
        "paragraph_id": "para_243"
      },
      {
        "text": "HHS Secretary “controls the scope of immunity through the",
        "paragraph_id": "para_244"
      },
      {
        "text": "declaration and amendments, within the confines of the",
        "paragraph_id": "para_245"
      },
      {
        "text": "PREP Act.” Saldana v. Glenhaven Healthcare LLC, 27",
        "paragraph_id": "para_246"
      },
      {
        "text": "F.4th 679, 687 (9th Cir. 2022) (citation modified). The HHS",
        "paragraph_id": "para_247"
      },
      {
        "text": "Secretary’s declaration “may specify[ ] the manufacture,",
        "paragraph_id": "para_248"
      },
      {
        "text": "testing, development, distribution, administration, or use of",
        "paragraph_id": "para_249"
      },
      {
        "text": "one or more covered countermeasures” giving rise to",
        "paragraph_id": "para_250"
      },
      {
        "text": "immunity. 42 U.S.C. § 247d-6d(b)(1). “The scope of",
        "paragraph_id": "para_251"
      },
      {
        "text": "immunity is broad.” Maglioli v. All. HC Holdings LLC, 16",
        "paragraph_id": "para_252"
      },
      {
        "text": "F.4th 393, 401 (3d Cir. 2021).",
        "paragraph_id": "para_253"
      },
      {
        "text": "As relevant in this case, such a declaration was issued by",
        "paragraph_id": "para_254"
      },
      {
        "text": "the HHS Secretary as part of the federal government’s",
        "paragraph_id": "para_255"
      },
      {
        "text": "response to the COVID-19 pandemic. In March 2020, the",
        "paragraph_id": "para_256"
      },
      {
        "text": "HHS Secretary declared that COVID-19 “constitutes a",
        "paragraph_id": "para_257"
      },
      {
        "text": "public health emergency” and ordered that “immunity as",
        "paragraph_id": "para_258"
      },
      {
        "text": "prescribed in the PREP Act” was “in effect” for the",
        "paragraph_id": "para_259"
      },
      {
        "text": "“manufacture, testing, development, distribution,",
        "paragraph_id": "para_260"
      },
      {
        "text": "administration, and use of” covered countermeasures.",
        "paragraph_id": "para_261"
      },
      {
        "text": "Declaration Under the Public Readiness and Emergency",
        "paragraph_id": "para_262"
      },
      {
        "text": "Preparedness Act for Medical Countermeasures Against",
        "paragraph_id": "para_263"
      },
      {
        "text": "COVID-19, 85 Fed. Reg. 15198, 15201 (Mar. 17, 2020).",
        "paragraph_id": "para_264"
      },
      {
        "text": "Municipalities administering and using covered",
        "paragraph_id": "para_265"
      },
      {
        "text": "countermeasures may be entitled to liability protection under",
        "paragraph_id": "para_266"
      },
      {
        "text": "the PREP Act for actions taken from February 4, 2020, to",
        "paragraph_id": "para_267"
      },
      {

        "text": "May 11, 2023.1 See Twelfth Amendment to Declaration",
        "paragraph_id": "para_269"
      },
      {
        "text": "Under the Public Readiness and Emergency Preparedness",
        "paragraph_id": "para_270"
      },
      {
        "text": "Act for Medical Countermeasures Against COVID–19, 89",
        "paragraph_id": "para_271"
      },
      {
        "text": "Fed. Reg. 99875, 99876, 99882 (Dec. 11, 2024) (defining",
        "paragraph_id": "para_272"
      },
      {
        "text": "scope and effective time period of liability protections).",
        "paragraph_id": "para_273"
      },
      {
        "text": "All of Schmidt’s claims arise from the City of",
        "paragraph_id": "para_274"
      },
      {
        "text": "Pasadena’s implementation of a COVID-19 testing and",
        "paragraph_id": "para_275"
      },
      {
        "text": "masking policy for its employees. He alleges that he was",
        "paragraph_id": "para_276"
      },
      {
        "text": "harmed by these requirements from November 2021, when",
        "paragraph_id": "para_277"
      },
      {
        "text": "he returned to work after agreeing to comply with the City’s",
        "paragraph_id": "para_278"
      },
      {
        "text": "COVID-19 safety policy, through March 2022, when the",
        "paragraph_id": "para_279"
      },
      {
        "text": "City rescinded the policy. This five-month period is plainly",
        "paragraph_id": "para_280"
      },
      {
        "text": "within the Declaration’s effective time period. See 42",
        "paragraph_id": "para_281"
      },
      {
        "text": "U.S.C. § 247d-6d(a)(3) (stating that immunity is only",
        "paragraph_id": "para_282"
      },
      {
        "text": "available if the “countermeasure was administered or used",
        "paragraph_id": "para_283"
      },
      {
        "text": "during the effective period of the declaration”).",
        "paragraph_id": "para_284"
      },
      {
        "text": "With this threshold question satisfied, we must",
        "paragraph_id": "para_285"
      },
      {
        "text": "determine whether Defendants’ implementation of its",
        "paragraph_id": "para_286"
      },
      {
        "text": "COVID-19 testing and masking policy meets the PREP",
        "paragraph_id": "para_287"
      },
      {
        "text": "Act’s requirements for immunity. In other words, we must",
        "paragraph_id": "para_288"
      },
      {
        "text": "determine (1) whether the City and the individual",
        "paragraph_id": "para_289"
      },
      {

      {

        "paragraph_id": "para_293"
      },
      {
        "text": "Act for Medical Countermeasures Against COVID–19, 89 Fed. Reg.",
        "paragraph_id": "para_294"
      },
      {
        "text": "99875, 99882 (Dec. 11, 2024). The liability protection period for",
        "paragraph_id": "para_295"
      },
      {
        "text": "“program planner[s]” began on February 4, 2020, whereas the protection",
        "paragraph_id": "para_296"
      },
      {
        "text": "period for an “Authority Having Jurisdiction” began on January 31,",
        "paragraph_id": "para_297"
      },
      {
        "text": "2020. Id. For reasons explained later in this opinion, we consider the",
        "paragraph_id": "para_298"
      },
      {
        "text": "City to be a “program planner,” as defined in the PREP act. See infra",
        "paragraph_id": "para_299"
      },
      {
        "text": "Section III.A.1. Regardless, under either definition, Schmidt’s claims",
        "paragraph_id": "para_300"
      },
      {
        "text": "still fall within the Declaration’s proscribed time period.",
        "paragraph_id": "para_301"
      },
      {

        "text": "Defendants are “covered person[s]”; (2) whether the City’s",
        "paragraph_id": "para_303"
      },
      {
        "text": "COVID-19 testing and masking policy constitutes a",
        "paragraph_id": "para_304"
      },
      {
        "text": "“covered countermeasure”; and (3) whether Schmidt’s",
        "paragraph_id": "para_305"
      },
      {
        "text": "claims were “caused by, arising out of, relating to, or",
        "paragraph_id": "para_306"
      },
      {
        "text": "resulting from” the administration of a covered",
        "paragraph_id": "para_307"
      },
      {
        "text": "countermeasure. See 42 U.S.C. § 247d-6d(a)(1). Because",
        "paragraph_id": "para_308"
      },
      {
        "text": "each of these statutory requirements is met, Defendants are",
        "paragraph_id": "para_309"
      },
      {
        "text": "entitled to PREP Act immunity for all of Schmidt’s claims.",
        "paragraph_id": "para_310"
      },
      {
        "text": "1. Covered Persons",
        "paragraph_id": "para_311"
      },
      {
        "text": "Because both the City and individual Defendants",
        "paragraph_id": "para_312"
      },
      {
        "text": "engaged in the “administration of a covered",
        "paragraph_id": "para_313"
      },
      {
        "text": "countermeasure,” both qualify as “covered persons” under",
        "paragraph_id": "para_314"
      },
      {
        "text": "the Act. See 42 U.S.C. § 247d-6d(a)..",
        "paragraph_id": "para_315"
      },
      {
        "text": "The PREP Act defines “covered person[s]” as follows:",
        "paragraph_id": "para_316"
      },
      {
        "text": "The term “covered person”, when used with",
        "paragraph_id": "para_317"

      },
      {
        "text": "countermeasure;",
        "paragraph_id": "para_323"
      },
      {
        "text": "(ii) a distributor of such countermeasure;",
        "paragraph_id": "para_324"
      },
      {
        "text": "(iii) a program planner of such",
        "paragraph_id": "para_325"
      },
      {
        "text": "countermeasure;",
        "paragraph_id": "para_326"
      },
      {
        "text": "(iv) a qualified person who prescribed,",
        "paragraph_id": "para_327"
      },
      {
        "text": "administered, or dispensed such",
        "paragraph_id": "para_328"
      },
      {
        "text": "countermeasure; or",
        "paragraph_id": "para_329"
      },
      {

      {
        "text": "(v) an official, agent, or employee of a",
        "paragraph_id": "para_331"
      },
      {
        "text": "person or entity described in clause (i),",
        "paragraph_id": "para_332"
      },
      {
        "text": "(ii), (iii), or (iv).",
        "paragraph_id": "para_333"
      },
      {
        "text": "Id. § 247d-6d(i)(2).",
        "paragraph_id": "para_334"
      },
      {
        "text": "A “program planner” is further defined as:",
        "paragraph_id": "para_335"
      },
      {
        "text": "“[A] State or local government, including an",
        "paragraph_id": "para_336"
      },
      {
        "text": "Indian tribe, person employed by the State or",
        "paragraph_id": "para_337"
      },
      {
        "text": "local government, or other person who",
        "paragraph_id": "para_338"
      },
      {
        "text": "supervised or administered a program with",
        "paragraph_id": "para_339"
      },
      {
        "text": "respect to the administration, dispensing,",
        "paragraph_id": "para_340"
      },
      {
        "text": "distribution, provision, or use of a security",
        "paragraph_id": "para_341"
      },
      {
        "text": "countermeasure or a qualified pandemic or",
        "paragraph_id": "para_342"
      },
      {
        "text": "epidemic product, including a person who",
        "paragraph_id": "para_343"
      },
      {
        "text": "has established requirements, provided",
        "paragraph_id": "para_344"
      },
      {
        "text": "policy guidance, or supplied technical or",
        "paragraph_id": "para_345"
      },
      {
        "text": "scientific advice or assistance or provides a",
        "paragraph_id": "para_346"
      },
      {
        "text": "facility to administer or use a covered",
        "paragraph_id": "para_347"
      },
      {
        "text": "countermeasure in accordance with a",
        "paragraph_id": "para_348"
      },
      {
        "text": "declaration under subsection (b)”",
        "paragraph_id": "para_349"
      },
      {
        "text": "Id. § 247d-6d(i)(6).",
        "paragraph_id": "para_350"
      },
      {
        "text": "On the face of his FAC, Schmidt concedes that each",
        "paragraph_id": "para_351"
      },
      {
        "text": "individually named defendant was involved in the",
        "paragraph_id": "para_352"
      },
      {
        "text": "implementation of the City’s COVID-19 testing-and-mask",
        "paragraph_id": "para_353"
      },
      {
        "text": "requirements for employees. Because they are “person[s]",
        "paragraph_id": "para_354"
      },
      {
        "text": "who supervised or administered a program with respect to",
        "paragraph_id": "para_355"
      },
      {
        "text": "the administration. . . of a security countermeasure,” the",
        "paragraph_id": "para_356"
      },
      {
        "text": "individually named defendants constitute “covered persons”",
        "paragraph_id": "para_357"
      },
      {
        "text": "under the PREP Act. Id.",
        "paragraph_id": "para_358"
      },
      {
        "text": "The allegations in Schmidt’s FAC also establish that the",
        "paragraph_id": "para_359"
      },
      {
        "text": "City is an eligible “covered person.” One of the",
        "paragraph_id": "para_360"
      },
      {
        "text": "SCHMIDT V. CITY OF PASADENA 13",
        "paragraph_id": "para_361"
      },
      {
        "text": "fundamental, and undisputed, facts in Schmidt’s complaint",
        "paragraph_id": "para_362"
      },
      {
        "text": "is that the City of Pasadena issued a vaccine and mask",
        "paragraph_id": "para_363"
      },
      {
        "text": "“mandate” for its employees. Broadly speaking, “[t]he",
        "paragraph_id": "para_364"
      },
      {
        "text": "purpose of this policy [was] to provide a safe work",
        "paragraph_id": "para_365"
      },
      {
        "text": "environment and protect the health and safety of City of",
        "paragraph_id": "para_366"
      },
      {
        "text": "Pasadena employees, and the public.” The City’s COVID-",
        "paragraph_id": "para_367"
      },
      {
        "text": "19 safety requirements applied to “all City employees”—all",
        "paragraph_id": "para_368"
      },
      {
        "text": "employees were required to either be fully vaccinated for",
        "paragraph_id": "para_369"
      },
      {
        "text": "COVID-19 or, otherwise, regularly test for COVID-19 and",
        "paragraph_id": "para_370"
      },
      {
        "text": "mask. In issuing its mandate, the City, under its authority as",
        "paragraph_id": "para_371"
      },
      {
        "text": "a local government, made “policy-level decisions regarding",
        "paragraph_id": "para_372"
      },
      {
        "text": "administration or use of covered countermeasures.” Maney,",
        "paragraph_id": "para_373"
      },
      {
        "text": "91 F.4th at 1301 (interpreting the definition of “program",
        "paragraph_id": "para_374"
      },
      {
        "text": "planner” under 42 U.S.C. § 247d-6d(i)(2)(B)(iii)). The City",
        "paragraph_id": "para_375"
      },
      {
        "text": "therefore constitutes a “program planner,” and t a “covered",
        "paragraph_id": "para_376"
      },
      {
        "text": "person” under the PREP Act. See id.; 42 U.S.C. § 247d-",
        "paragraph_id": "para_377"
      },
      {
        "text": "6d(i)(2)(B)(iii).",
        "paragraph_id": "para_378"
      },
      {
        "text": "2. Covered Countermeasure",
        "paragraph_id": "para_379"
      },
      {
        "text": "Schmidt argues that COVID-19 tests and face masks",
        "paragraph_id": "para_380"
      },
      {
        "text": "cannot be considered “covered countermeasures” under case",
        "paragraph_id": "para_381"
      },
      {
        "text": "precedent, federal statute, and HHS regulations. None of his",
        "paragraph_id": "para_382"
      },
      {
        "text": "arguments are availing. Both the PREP Act and the HHS",
        "paragraph_id": "para_383"
      },
      {
        "text": "Secretary’s Declaration plainly extend immunity for the",
        "paragraph_id": "para_384"
      },
      {
        "text": "administration of COVID-19 tests and masks.",
        "paragraph_id": "para_385"
      },
      {
        "text": "Under the PREP Act, “covered countermeasures” are",
        "paragraph_id": "para_386"
      },
      {
        "text": "defined as products “manufactured, used, designed,",
        "paragraph_id": "para_387"
      },
      {
        "text": "developed, modified, licensed, or procured—(I) to diagnose,",
        "paragraph_id": "para_388"
      },
      {
        "text": "mitigate, prevent, treat, or cure a pandemic or epidemic; or",
        "paragraph_id": "para_389"
      },
      {
        "text": "(II) to limit the harm such pandemic or epidemic might",
        "paragraph_id": "para_390"
      },
      {
        "text": "otherwise cause.” 42 U.S.C. § 247d-6d(i)(7)(A)(i). Covered",
        "paragraph_id": "para_391"
      },
      {
        "text": "countermeasures under the PREP Act must receive some",
        "paragraph_id": "para_392"
      },
      {
        "text": "kind of federal authorization for use in accordance with the",
        "paragraph_id": "para_393"
      },
      {
        "text": "14 SCHMIDT V. CITY OF PASADENA",
        "paragraph_id": "para_394"
      },
      {
        "text": "Federal Food, Drug, and Cosmetic Act. See 21 U.S.C. § 351",
        "paragraph_id": "para_395"
      },
      {
        "text": "et seq.; see also 42 U.S.C. §§ 247d-6d(i)(1), (6), (7); 42",
        "paragraph_id": "para_396"
      },
      {
        "text": "U.S.C. § 247d-6b(c)(1)(B). An Emergency Use",
        "paragraph_id": "para_397"
      },
      {
        "text": "Authorization (“EUA”) from the Food and Drug",
        "paragraph_id": "para_398"
      },
      {
        "text": "Administration (“FDA”) is sufficient to meet this",
        "paragraph_id": "para_399"
      },
      {
        "text": "requirement. Id. § 247d-6d (i)(7)(B)(iii).",
        "paragraph_id": "para_400"
      },
      {
        "text": "The HHS Secretary elaborated on what constituted",
        "paragraph_id": "para_401"
      },
      {
        "text": "covered countermeasures for responding to the COVID-19",
        "paragraph_id": "para_402"
      },
      {
        "text": "pandemic in its declarations. The Twelfth Amendment to",
        "paragraph_id": "para_403"
      },
      {
        "text": "the Declaration defined covered countermeasures as “[a]ny",
        "paragraph_id": "para_404"
      },
      {
        "text": "antiviral, any drug, any biologic, any diagnostic, any other",
        "paragraph_id": "para_405"
      },
      {
        "text": "device, any respiratory protective device, or any vaccine",
        "paragraph_id": "para_406"
      },
      {
        "text": "manufactured, used, designed, developed, modified,",
        "paragraph_id": "para_407"
      },
      {
        "text": "licensed, or procured to diagnose, mitigate, prevent, treat, or",
        "paragraph_id": "para_408"
      },
      {
        "text": "cure COVID-19, or the transmission of SARS-CoV-2 or a",
        "paragraph_id": "para_409"
      },
      {
        "text": "virus mutating therefrom.” 89 Fed. Reg. at 99880. We have",
        "paragraph_id": "para_410"
      },
      {
        "text": "previously found that the HHS Secretary defined “‘covered",
        "paragraph_id": "para_411"
      },
      {
        "text": "countermeasures’ about as broadly as the [PREP] Act",
        "paragraph_id": "para_412"
      },
      {
        "text": "permits.” Hampton, 83 F.4th at 763–64; see also 42 U.S.C.",
        "paragraph_id": "para_413"
      },
      {
        "text": "§ 247d-6d(b)(4) (stating that amendments to declarations",
        "paragraph_id": "para_414"
      },
      {
        "text": "shall not retroactively limit the applicability of the PREP",
        "paragraph_id": "para_415"
      },
      {
        "text": "Act’s immunity provision).",
        "paragraph_id": "para_416"
      },
      {
        "text": "Accordingly, the saliva test and mask requirements the",
        "paragraph_id": "para_417"
      },
      {
        "text": "City imposed plainly constitute a “diagnostic” and a",
        "paragraph_id": "para_418"
      },
      {
        "text": "“respiratory protective device” under the Declaration’s",
        "paragraph_id": "para_419"
      },
      {
        "text": "broad definition of “covered countermeasures.” Schmidt",
        "paragraph_id": "para_420"
      },
      {
        "text": "does not necessarily dispute that the saliva test and face",
        "paragraph_id": "para_421"
      },
      {
        "text": "masks constitute a “diagnostic” and “respiratory protective",
        "paragraph_id": "para_422"
      },
      {
        "text": "device.” Rather, he contends that the measures were",
        "paragraph_id": "para_423"
      },
      {
        "text": "ineffective and unauthorized. We agree that both measures",
        "paragraph_id": "para_424"
      },
      {
        "text": "require some kind of federal authorization. See 21 U.S.C.",
        "paragraph_id": "para_425"
      },
      {
        "text": "§ 351 et seq.; see also 42 U.S.C. §§ 247d-6d(i)(1), (6), (7);",
        "paragraph_id": "para_426"
      },
      {
        "text": "42 U.S.C. § 247d-6b(c)(1)(B). However, we find that both",
        "paragraph_id": "para_427"
      },
      {

      },
      {
        "text": "challenged measures in this case had the statutorily required",
        "paragraph_id": "para_429"
      },
      {
        "text": "authorization needed to be considered “covered",
        "paragraph_id": "para_430"
      },
      {
        "text": "countermeasures.”",
        "paragraph_id": "para_431"
      },
      {
        "text": "In challenging the City’s use of the saliva tests, Schmidt",
        "paragraph_id": "para_432"
      },
      {
        "text": "contends that “the saliva test was explicitly excluded as a",
        "paragraph_id": "para_433"
      },
      {
        "text": "valid diagnostic device” in the EUA granted to Ultimate DX",
        "paragraph_id": "para_434"
      },
      {
        "text": "for its COVID-19 test. Thus, according to Schmidt, the",
        "paragraph_id": "para_435"
      },
      {
        "text": "saliva test cannot be considered a “covered",
        "paragraph_id": "para_436"
      },
      {
        "text": "countermeasure.” However, Schmidt misstates the scope of",
        "paragraph_id": "para_437"
      },
      {
        "text": "authorization Ultimate DX’s EUA provided.",
        "paragraph_id": "para_438"
      },
      {
        "text": "Per Ultimate DX’s accelerated EUA summary, “[t]he",
        "paragraph_id": "para_439"
      },
      {
        "text": "performance of UDX SARS-CoV-2 Molecular Assay was",
        "paragraph_id": "para_440"
      },
      {
        "text": "established using nasopharyngeal swabs.” The summary",
        "paragraph_id": "para_441"
      },
      {
        "text": "further explains that “[n]asal swabs, mid-turbinate nasal",
        "paragraph_id": "para_442"
      },
      {
        "text": "swabs and oropharyngeal swabs are also considered",
        "paragraph_id": "para_443"
      },
      {
        "text": "acceptable specimen types for use with the UDX SARS-",
        "paragraph_id": "para_444"
      },
      {
        "text": "CoV-2 Molecular Assay but performance has not been",
        "paragraph_id": "para_445"
      },
      {
        "text": "established.” Finally, the summary warns “[o]ther",
        "paragraph_id": "para_446"
      },
      {
        "text": "extraction approaches” may lead to false-negative results.",
        "paragraph_id": "para_447"
      },
      {
        "text": "Nothing in the EUA summary expressly limits the use of",
        "paragraph_id": "para_448"
      },
      {
        "text": "Ultimate DX’s diagnostic tool under the EUA to particular",
        "paragraph_id": "para_449"
      },
      {
        "text": "collection methods. The absence of such limiting language",
        "paragraph_id": "para_450"
      },
      {
        "text": "is notable given that the summary explicitly states that the",
        "paragraph_id": "para_451"
      },
      {
        "text": "use of [Ultimate DX’s] diagnostic under the EUA “is limited",
        "paragraph_id": "para_452"
      },
      {
        "text": "to laboratories that are certified under the Clinical",
        "paragraph_id": "para_453"
      },
      {
        "text": "Laboratory Improvement Amendments of 1988 (CLIA), 42",
        "paragraph_id": "para_454"
      },
      {
        "text": "U.S.C. § 263a, to perform high complexity tests” and",
        "paragraph_id": "para_455"
      },
      {
        "text": "“limited to personnel who are trained in the procedure.” The",
        "paragraph_id": "para_456"
      },
      {
        "text": "summary discusses collection methods to warn that the",
        "paragraph_id": "para_457"
      },
      {
        "text": "“[f]ailure to follow these instructions may result in erroneous",
        "paragraph_id": "para_458"
      },
      {
        "text": "results,” not to limit the scope of the EUA. See McGinity v.",
        "paragraph_id": "para_459"
      },
      {
        "text": "Procter & Gamble Co., 69 F.4th 1093, 1096 (9th Cir. 2023)",
        "paragraph_id": "para_460"
      },
      {

        "paragraph_id": "para_461"
      },
      {
        "text": "(“Determining whether a complaint states a plausible claim",
        "paragraph_id": "para_462"
      },
      {
        "text": "for relief is a ‘context-specific task,’ requiring ‘the",
        "paragraph_id": "para_463"
      },
      {
        "text": "reviewing court to draw on its judicial experience and",
        "paragraph_id": "para_464"
      },
      {
        "text": "common sense.’”) (quoting Ashcroft v. Iqbal, 556 U.S. 662,",
        "paragraph_id": "para_465"
      },
      {
        "text": "679 (2009)); Eclectic Props. E., LLC v. Marcus & Millichap",
        "paragraph_id": "para_466"
      },
      {
        "text": "Co., 751 F.3d 990, 996 (9th Cir. 2014) (“When considering",
        "paragraph_id": "para_467"
      },
      {
        "text": "plausibility, courts must also consider an ‘obvious",
        "paragraph_id": "para_468"
      },
      {
        "text": "alternative explanation’ for [the] defendant’s behavior.”).",
        "paragraph_id": "para_469"
      },
      {
        "text": "Schmidt’s characterization of the EUA’s scope is simply",
        "paragraph_id": "para_470"
      },
      {
        "text": "incorrect. Indeed, the allegations in Schmidt’s complaint",
        "paragraph_id": "para_471"
      },
      {
        "text": "establish that the COVID-19 diagnostic administered by the",
        "paragraph_id": "para_472"
      },
      {
        "text": "City received the required authorization. Thus, the COVID-",
        "paragraph_id": "para_473"
      },
      {
        "text": "19 tests the City administered meet the statutory",
        "paragraph_id": "para_474"
      },
      {
        "text": "requirements to be considered “covered countermeasures.”",
        "paragraph_id": "para_475"
      },
      {
        "text": "See 42 U.S.C. §§ 247d-6d(i)(1), (6), (7); 42 U.S.C. § 247d-",
        "paragraph_id": "para_476"
      },
      {
        "text": "6b(c)(1)(B).2",
        "paragraph_id": "para_477"
      },
      {
        "text": "Face masks also constitute a “covered countermeasure”",
        "paragraph_id": "para_478"
      },
      {
        "text": "under the HHS Secretary’s Declaration. Again, face masks",
        "paragraph_id": "para_479"
      },
      {
        "text": "are included in the Declaration’s definition of “covered",
        "paragraph_id": "para_480"
      },
      {
        "text": "countermeasures” as a “respiratory protective device” used",
        "paragraph_id": "para_481"
      },
      {
        "text": "to “prevent” the transmission of the virus. 89 Fed. Reg. at",
        "paragraph_id": "para_482"
      },
      {
        "text": "99880 (discussing definition and permissible activities in",
        "paragraph_id": "para_483"
      },
      {
        "text": "Sections VI and VII(b)). Additionally, the FDA granted a",
        "paragraph_id": "para_484"
      },
      {
        "text": "broad EUA “authorizing the use of face masks for use by",
        "paragraph_id": "para_485"
      },
      {

        "paragraph_id": "para_487"
      },
      {
        "text": "countermeasures,’” we note that our decision in that case did not",
        "paragraph_id": "para_488"
      },
      {
        "text": "establish a per se rule that COVID-19 tests constitute “covered",
        "paragraph_id": "para_489"
      },
      {
        "text": "countermeasures” in all instances. Our statement in Hampton was",
        "paragraph_id": "para_490"
      },
      {
        "text": "limited to explaining that the parties in that case had conceded that",
        "paragraph_id": "para_491"
      },
      {
        "text": "COVID-19 tests were “covered countermeasures.” Hampton, 83 F.4th",
        "paragraph_id": "para_492"
      },
      {
        "text": "at 764. Sufficient factual allegations are still necessary for a Defendant",
        "paragraph_id": "para_493"
      },
      {
        "text": "to establish their entitlement to immunity under the PREP Act.",
        "paragraph_id": "para_494"
      },
      {
        "text": "SCHMIDT V. CITY OF PASADENA 17",
        "paragraph_id": "para_495"
      },
      {
        "text": "members of the general public . . . to prevent the spread of",
        "paragraph_id": "para_496"
      },
      {
        "text": "the virus.” Authorization was granted broadly enough to",
        "paragraph_id": "para_497"
      },
      {
        "text": "even cover “cloth face coverings.” Schmidt has not alleged",
        "paragraph_id": "para_498"
      },
      {
        "text": "that the City’s face mask requirement fell outside of the",
        "paragraph_id": "para_499"
      },
      {
        "text": "Declaration or EUA’s scope. Thus, on the face of Schmidt’s",
        "paragraph_id": "para_500"
      },
      {
        "text": "complaint, masks constitute a “covered countermeasure.”",
        "paragraph_id": "para_501"
      },
      {
        "text": "Per the facts alleged in Schmidt’s complaint, both the",
        "paragraph_id": "para_502"
      },
      {
        "text": "COVID-19 testing and face masks the City’s policy required",
        "paragraph_id": "para_503"
      },
      {
        "text": "were covered by the HHS Secretary’s definition of “covered",
        "paragraph_id": "para_504"
      },
      {
        "text": "countermeasure” and approved for emergency use.3 Thus,",
        "paragraph_id": "para_505"
      },
      {
        "text": "both meet the PREP Act’s requirements for being considered",
        "paragraph_id": "para_506"
      },
      {
        "text": "a “covered countermeasure.”",
        "paragraph_id": "para_507"
      },
      {
        "text": "3. Causation and Injury",
        "paragraph_id": "para_508"
      },
      {
        "text": "In dismissing the FAC, the district court found that",
        "paragraph_id": "para_509"
      },
      {
        "text": "Defendants were entitled to immunity under the PREP Act",
        "paragraph_id": "para_510"
      },
      {
        "text": "for only two of Schmidt’s claims, violations of Cal. Const.",
        "paragraph_id": "para_511"
      },
      {
        "text": "Art. 1 Secs. 1 and 7—i.e., the alleged deprivation without",
        "paragraph_id": "para_512"
      },
      {
        "text": "due process of Schmidt’s purported property interest in his",
        "paragraph_id": "para_513"
      },
      {
        "text": "“DNA.” The district court did not find that PREP Act",
        "paragraph_id": "para_514"
      },
      {
        "text": "immunity applied to Schmidt’s remaining claims,",
        "paragraph_id": "para_515"
      },
      {
        "text": "incorporating the reasoning from its earlier dismissal of the",
        "paragraph_id": "para_516"
      },
      {
        "text": "TAC that while Schmidt’s “claims involve alleged",
        "paragraph_id": "para_517"
      },
      {
        "text": "emotional injury,” his “claims primarily involve reputational",
        "paragraph_id": "para_518"
      },
      {
        "text": "harms for which [he] has not pleaded any emotional effect.”",
        "paragraph_id": "para_519"
      },
      {
        "text": "3 Schmidt argues that Loper Bright v. Raimondo, 603 U.S. 369 (2024),",
        "paragraph_id": "para_520"
      },
      {
        "text": "permits us to disregard the HHS Secretary’s definition of “covered",
        "paragraph_id": "para_521"
      },
      {
        "text": "countermeasure.” However, even under Loper Bright, we must respect",
        "paragraph_id": "para_522"
      },
      {
        "text": "when Congress has “expressly delegated to an agency the authority to",
        "paragraph_id": "para_523"
      },
      {
        "text": "give meaning to a particular statutory term.” Id. at 394–95 (citation",
        "paragraph_id": "para_524"
      },
      {
        "text": "modified). Schmidt has not alleged that the PREP Act’s grant of",
        "paragraph_id": "para_525"
      },
      {
        "text": "authority is ambiguous nor that HHS has acted outside its statutory",
        "paragraph_id": "para_526"
      },
      {
        "text": "authority. See id. at 412–13. Therefore, Loper Bright is inapplicable.",
        "paragraph_id": "para_527"
      },
      {
        "text": "18 SCHMIDT V. CITY OF PASADENA",
        "paragraph_id": "para_528"
      },
      {
        "text": "This determination misunderstood the causation requirement",
        "paragraph_id": "para_529"
      },
      {
        "text": "for PREP Act immunity. As such, we take this opportunity",
        "paragraph_id": "para_530"
      },
      {
        "text": "to clarify the causation requirement of the PREP Act’s",
        "paragraph_id": "para_531"
      },
      {
        "text": "immunity provision.",
        "paragraph_id": "para_532"
      },
      {
        "text": "The PREP Act provides immunity “with respect to all",
        "paragraph_id": "para_533"
      },
      {
        "text": "claims for loss caused by, arising out of, relating to, or",

        "text": "individual of a covered countermeasure.” 42 U.S.C. § 247d-",
        "paragraph_id": "para_536"
      },
      {
        "text": "6d(a)(1). “The causal relationship is satisfied if any of these",
        "paragraph_id": "para_537"
      },
      {
        "text": "four terms applies.” See Dressen v. AstraZeneca AB, 182",
        "paragraph_id": "para_538"
      },
      {
        "text": "F.4th 1232, 1253 (10th Cir. 2026); see also Hampton, 83",
        "paragraph_id": "para_539"
      },
      {
        "text": "F.4th at 764 (“[F]or PREP Act immunity to apply, the",
        "paragraph_id": "para_540"
      },
      {
        "text": "underlying use or administration of a covered",
        "paragraph_id": "para_541"
      },
      {
        "text": "countermeasure must have played some role in bringing",
        "paragraph_id": "para_542"
      },
      {
        "text": "about or contributing to the plaintiff's injury.”) (emphasis",
        "paragraph_id": "para_543"
      },
      {
        "text": "added)). The PREP Act further defines “loss” as “any type",
        "paragraph_id": "para_544"
      },
      {
        "text": "of loss, including (i) death; (ii) physical, mental, or",
        "paragraph_id": "para_545"
      },
      {
        "text": "emotional injury, illness, disability, or condition; (iii) fear of",
        "paragraph_id": "para_546"
      },
      {
        "text": "physical, mental, or emotional injury, illness, disability, or",
        "paragraph_id": "para_547"
      },
      {
        "text": "condition, including any need for medical monitoring; and",
        "paragraph_id": "para_548"
      },
      {
        "text": "(iv) loss of or damage to property, including business",
        "paragraph_id": "para_549"
      },
      {
        "text": "interruption loss.” 42 U.S.C. § 247d-6d(a)(2).",
        "paragraph_id": "para_550"
      },
      {
        "text": "The Tenth Circuit’s recent decision in Dressen v.",
        "paragraph_id": "para_551"
      },
      {
        "text": "AstraZeneca AB is helpful for understanding the PREP Act’s",
        "paragraph_id": "para_552"
      },
      {
        "text": "causation requirement. In Dressen, the plaintiff argued that",
        "paragraph_id": "para_553"
      },
      {
        "text": "the defendant was not entitled to immunity from her claims",
        "paragraph_id": "para_554"
      },
      {
        "text": "because her claims were based in contract law, not tort law.",
        "paragraph_id": "para_555"
      },
      {
        "text": "Dressen, 182 F.4th at 1245. The Tenth Circuit rejected the",
        "paragraph_id": "para_556"
      },
      {
        "text": "plaintiff’s argument, finding that “[t]he PREP Act’s",
        "paragraph_id": "para_557"
      },
      {
        "text": "immunity provision says nothing about shielding covered",
        "paragraph_id": "para_558"
      },
      {
        "text": "persons from specific causes of action.” Id. The court noted",
        "paragraph_id": "para_559"
      },
      {
        "text": "that the plaintiff’s prayer for relief sought both economic",
        "paragraph_id": "para_560"
      },
      {
        "text": "damages, such as past and future medical expenses, past and",
        "paragraph_id": "para_561"
      },
      {

      },
      {
        "text": "future loss of household services, childcare expenses, past",
        "paragraph_id": "para_563"
      },
      {
        "text": "and future lost income, and past and future transportation",
        "paragraph_id": "para_564"
      },
      {
        "text": "costs, and non-economic damages, including emotional",
        "paragraph_id": "para_565"
      },
      {
        "text": "damages. Id.",
        "paragraph_id": "para_566"
      },
      {
        "text": "Similarly, here, Schmidt seeks damages for alleged",
        "paragraph_id": "para_567"
      },
      {
        "text": "mental and emotional injury and loss of property. In his",
        "paragraph_id": "para_568"
      },
      {
        "text": "FAC, Schmidt expressly alleges he suffered “emotional and",
        "paragraph_id": "para_569"
      },
      {
        "text": "physical harm” by complying with the City’s COVID-19",
        "paragraph_id": "para_570"
      },
      {
        "text": "safety policies. Furthermore, Schmidt’s foundational",
        "paragraph_id": "para_571"
      },
      {
        "text": "argument—underlying each of the claims in his FAC—is",
        "paragraph_id": "para_572"
      },
      {
        "text": "that the City and individually named Defendants deprived",
        "paragraph_id": "para_573"
      },
      {
        "text": "him of his property interests in his DNA. Assuming without",
        "paragraph_id": "para_574"
      },
      {
        "text": "holding that Schmidt had any property interest in the saliva",
        "paragraph_id": "para_575"
      },
      {
        "text": "samples he provided for COVID-19 testing, Schmidt’s",
        "paragraph_id": "para_576"
      },
      {
        "text": "complaint plainly alleges a loss of property.",
        "paragraph_id": "para_577"
      },
      {
        "text": "The district court focused on the types of legal claims",
        "paragraph_id": "para_578"
      },
      {
        "text": "Schmidt pleads rather than the type of injury he alleges. This",
        "paragraph_id": "para_579"
      },
      {
        "text": "was incorrect. We agree with the Tenth Circuit that “the",
        "paragraph_id": "para_580"
      },
      {
        "text": "PREP Act’s phrase ‘all claims for loss’ is limited by the",
        "paragraph_id": "para_581"
      },
      {
        "text": "statute’s causation requirement, not by the category of the",
        "paragraph_id": "para_582"
      },
      {
        "text": "legal claim.” Id. at 1246; cf. Maney, 91 F.4th at 1302–03",
        "paragraph_id": "para_583"
      },
      {
        "text": "(holding that PREP Act immunity applies to claims under 42",
        "paragraph_id": "para_584"
      },
      {
        "text": "U.S.C. § 1983). And Schmidt has not argued, nor did the",
        "paragraph_id": "para_585"
      },
      {
        "text": "district court find, that the damages he seeks for his alleged",
        "paragraph_id": "para_586"
      },
      {
        "text": "“emotional and physical harm” and loss of property are",
        "paragraph_id": "para_587"
      },
      {
        "text": "recoverable only through his claims under Cal. Const. Art. 1",
        "paragraph_id": "para_588"
      },
      {
        "text": "Secs. 1 and 7. See Dressen, 182 F.4th at 1245 (noting that",
        "paragraph_id": "para_589"
      },
      {
        "text": "plaintiff had “ma[de] no effort to show that [her] losses",
        "paragraph_id": "para_590"
      },
      {
        "text": "[were] recoverable only through tort claims”).",
        "paragraph_id": "para_591"
      },
      {
        "text": "Schmidt alleges that he suffered physical, emotional, and",
        "paragraph_id": "para_592"
      },
      {
        "text": "property damage as a direct result of the City’s COVID-19",
        "paragraph_id": "para_593"
      },
      {
        "text": "safety policies. These allegations are sufficient to establish",
        "paragraph_id": "para_594"
      },
      {
        "text": "20 SCHMIDT V. CITY OF PASADENA",
        "paragraph_id": "para_595"
      },
      {
        "text": "causation for PREP Act immunity. See Hampton, 83 F.4th",
        "paragraph_id": "para_596"
      },
      {
        "text": "at 754; see also Dressen, 182 F.4th at 1253 (“[W]e think it",
        "paragraph_id": "para_597"
      },
      {
        "text": "safe to say that a causal relationship satisfies the [PREP] Act",
        "paragraph_id": "para_598"
      },
      {
        "text": "when it meets the simple and traditional standard of but-for",
        "paragraph_id": "para_599"
      },
      {
        "text": "causation.)” (citation modified).",
        "paragraph_id": "para_600"
      },
      {
        "text": "For the aforementioned reasons, we find that the City and",
        "paragraph_id": "para_601"
      },
      {
        "text": "individually named Defendants are “covered person[s]”",
        "paragraph_id": "para_602"
      },
      {
        "text": "entitled to immunity “from suit and liability” from Schmidt’s",
        "paragraph_id": "para_603"
      },
      {
        "text": "claims regarding the administration of the City’s COVID-19",
        "paragraph_id": "para_604"
      },
      {
        "text": "testing and mask protocols for its employees under the PREP",
        "paragraph_id": "para_605"
      },
      {
        "text": "Act. See 42 U.S.C. § 247d-6d(a)(1).4",
        "paragraph_id": "para_606"
      },
      {
        "text": "B. Schmidt’s Other Challenges",
        "paragraph_id": "para_607"
      },
      {
        "text": "Finally, Schmidt proposes several different bases for",
        "paragraph_id": "para_608"
      },
      {
        "text": "finding that the district court abused its discretion. While the",
        "paragraph_id": "para_609"
      },
      {
        "text": "nature of Schmidt’s exact challenges is unclear, the record",
        "paragraph_id": "para_610"
      },
      {
        "text": "establishes that the district court did not abuse its discretion",
        "paragraph_id": "para_611"
      },
      {
        "text": "in any manner.",
        "paragraph_id": "para_612"
      },
      {
        "text": "1. Motion for Reconsideration",
        "paragraph_id": "para_613"
      },
      {
        "text": "Schmidt argues that “[t]he narrative that the court below",
        "paragraph_id": "para_614"
      },
      {
        "text": "entertained regarding the SARS-COV2 virus, the pandemic,",
        "paragraph_id": "para_615"
      },
      {
        "text": "the necessity of the countermeasures such as tests, vaccines",
        "paragraph_id": "para_616"
      },
      {
        "text": "and masks, was fundamentally at odds with the totally new",
        "paragraph_id": "para_617"
      },
      {
        "text": "evidence on the same presented by Schmidt’s two proposed",
        "paragraph_id": "para_618"
      },
      {
        "text": "experts, Dr. David Rasnick and Dr. Jonathan Jay Couey.”",
        "paragraph_id": "para_619"
      },
      {
        "text": "Thus, Schmidt reasons, the court should have granted the",
        "paragraph_id": "para_620"
      },
      {
        "text": "motion to reconsider the TAC dismissal. The problem with",
        "paragraph_id": "para_621"
      },
      {
        "text": "Schmidt’s assertion, in general, is his characterization of the",
        "paragraph_id": "para_622"
      },
      {
        "text": "expert evidence as “new.”",
        "paragraph_id": "para_623"
      },
      {
        "text": "4 Because we find the Defendants entitled to immunity under the PREP",
        "paragraph_id": "para_624"
      },
      {
        "text": "Act, we decline to reach the merits of Schmidt’s other arguments.",
        "paragraph_id": "para_625"
      },
      {

      },
      {
        "text": "A district court may revise an order “that adjudicates",
        "paragraph_id": "para_627"
      },
      {
        "text": "fewer than all the claims or the rights and liabilities of all the",
        "paragraph_id": "para_628"
      },
      {
        "text": "parties . . . at any time before the entry of a judgment.” Fed.",
        "paragraph_id": "para_629"
      },
      {
        "text": "R. Civ. P. 54(b). Reconsideration under Rule 54(b) is",
        "paragraph_id": "para_630"
      },
      {
        "text": "appropriate “(1) if such motion is necessary to correct",
        "paragraph_id": "para_631"
      },
      {
        "text": "manifest errors of law or fact upon which the judgment rests;",
        "paragraph_id": "para_632"
      },
      {
        "text": "(2) if such motion is necessary to present newly discovered",
        "paragraph_id": "para_633"
      },
      {
        "text": "or previously unavailable evidence; (3) if such motion is",
        "paragraph_id": "para_634"
      },
      {
        "text": "necessary to prevent manifest injustice; or (4) if the",
        "paragraph_id": "para_635"
      },
      {
        "text": "amendment is justified by an intervening change in",
        "paragraph_id": "para_636"
      },
      {
        "text": "controlling law.” Allstate Ins. Co. v. Herron, 634 F.3d 1101,",
        "paragraph_id": "para_637"
      },
      {
        "text": "1111 (9th Cir. 2011) (discussing Fed. R. Civ. P. 59(e)); see",
        "paragraph_id": "para_638"
      },
      {
        "text": "also Lyden v. Nike Inc., No. 13-CV-00662-HZ, 2014 WL",
        "paragraph_id": "para_639"
      },
      {
        "text": "4631206, at *1 (D. Ore. Sept. 15, 2014) (“Rule 54(b) does",
        "paragraph_id": "para_640"
      },
      {
        "text": "not address the standards a district court should apply when",
        "paragraph_id": "para_641"
      },
      {
        "text": "reconsidering an interlocutory order, but several district",
        "paragraph_id": "para_642"
      },
      {
        "text": "courts in the Ninth Circuit have applied standards of review",
        "paragraph_id": "para_643"
      },
      {
        "text": "substantially similar to those used under Rules 59(e) and",
        "paragraph_id": "para_644"
      },
      {
        "text": "60(b).”). The district court’s local Rule 7-18 similarly",
        "paragraph_id": "para_645"
      },
      {
        "text": "provides that such a motion must be based on: a material",
        "paragraph_id": "para_646"
      },
      {
        "text": "difference in fact or law from that presented to the Court",
        "paragraph_id": "para_647"
      },
      {
        "text": "before such decision; the emergence of new material facts or",
        "paragraph_id": "para_648"
      },
      {
        "text": "a change of law occurring after the time of such decision; or",
        "paragraph_id": "para_649"
      },
      {
        "text": "a manifest showing of a failure to consider material facts",
        "paragraph_id": "para_650"
      },
      {
        "text": "presented to the Court before such decision.",
        "paragraph_id": "para_651"
      },
      {
        "text": "Schmidt’s motion fails to establish any such ground",
        "paragraph_id": "para_652"
      },
      {
        "text": "warranting reconsideration of the TAC dismissal. First, his",
        "paragraph_id": "para_653"
      },
      {
        "text": "MFR fails to present a valid ground for reconsideration",
        "paragraph_id": "para_654"
      },
      {
        "text": "under either Local Rule 7-18 or Fed. R. Civ. P. 54(b). In",
        "paragraph_id": "para_655"
      },
      {
        "text": "support of his MFR, Schmidt submitted 20 exhibits—each",
        "paragraph_id": "para_656"
      },
      {
        "text": "of which was available to him before the TAC dismissal was",
        "paragraph_id": "para_657"
      },
      {
        "text": "issued. In denying the MFR, the district court highlighted",
        "paragraph_id": "para_658"
      },
      {
        "text": "that many of the exhibits must have been previously",
        "paragraph_id": "para_659"
      },
      {

        "paragraph_id": "para_660"
      },
      {
        "text": "available because they were submitted to the court prior to",
        "paragraph_id": "para_661"
      },
      {
        "text": "the dismissal. The district court also noted that many of the",
        "paragraph_id": "para_662"
      },
      {
        "text": "exhibits were time-stamped prior to the issuance of the",
        "paragraph_id": "para_663"
      },
      {
        "text": "dismissal. Because the evidence Schmidt relied on in his",
        "paragraph_id": "para_664"
      },
      {
        "text": "motion to reconsider was available prior to the district",
        "paragraph_id": "para_665"
      },
      {
        "text": "court’s TAC dismissal, it was appropriate for the district",
        "paragraph_id": "para_666"
      },
      {
        "text": "court to deny the motion.",
        "paragraph_id": "para_667"
      },
      {
        "text": "2. Recusal and Sanctions",
        "paragraph_id": "para_668"
      },
      {
        "text": "Schmidt also accuses the district court judge of improper",
        "paragraph_id": "para_669"
      },
      {
        "text": "conduct for failing to recuse himself from the case and for",
        "paragraph_id": "para_670"
      },
      {
        "text": "failing to properly rule on Schmidt’s Rule 11 sanctions",
        "paragraph_id": "para_671"
      },
      {
        "text": "motion. These allegations are baseless.",
        "paragraph_id": "para_672"
      },
      {
        "text": "Contrary to Schmidt’s allegations, Judge Kronstadt’s",
        "paragraph_id": "para_673"
      },
      {
        "text": "investment in mutual funds cannot support a finding of bias",
        "paragraph_id": "para_674"
      },
      {
        "text": "as a matter of law. Federal judges are required to recuse",
        "paragraph_id": "para_675"
      },
      {
        "text": "themselves in cases where they have a “financial interest.”",
        "paragraph_id": "para_676"
      },
      {
        "text": "28 U.S.C. § 455(d)(4)(i). However, “[o]wnership in a",
        "paragraph_id": "para_677"
      },
      {
        "text": "mutual or common investment fund that holds securities is",
        "paragraph_id": "para_678"
      },
      {
        "text": "not a ‘financial interest’ in such securities unless the judge",
        "paragraph_id": "para_679"
      },
      {
        "text": "participates in the management of the fund.” Id. (emphasis",
        "paragraph_id": "para_680"
      },
      {
        "text": "added). Schmidt has not alleged that Judge Kronstadt",
        "paragraph_id": "para_681"
      },
      {
        "text": "participates in the management of any mutual fund, and",
        "paragraph_id": "para_682"
      },
      {
        "text": "therefore, he does not have a valid claim to challenge Judge",
        "paragraph_id": "para_683"
      },
      {
        "text": "Kronstadt’s refusal to recuse himself from the case.",
        "paragraph_id": "para_684"
      },
      {
        "text": "Additionally, Schmidt argues the district court erred in",
        "paragraph_id": "para_685"
      },
      {
        "text": "denying his Rule 11 sanctions motion because Defendants",
        "paragraph_id": "para_686"
      },
      {
        "text": "purportedly disparaged his expert, Dr. Couey, in its briefing",
        "paragraph_id": "para_687"
      },
      {
        "text": "by using terms like “conspiracy theory” and “outlandish",
        "paragraph_id": "para_688"
      },
      {
        "text": "theories” to describe his assertions. “We recognize that Rule",
        "paragraph_id": "para_689"
      },
      {
        "text": "11 ‘must be read in light of concerns that it will spawn",
        "paragraph_id": "para_690"
      },
      {
        "text": "satellite litigation and chill vigorous advocacy.’” Townsend",
        "paragraph_id": "para_691"
      },
      {
        "text": "v. Holman Consulting Corp., 929 F.2d 1358, 1363 (9th Cir.",
        "paragraph_id": "para_692"
      },
      {
        "text": "SCHMIDT V. CITY OF PASADENA 23",
        "paragraph_id": "para_693"
      },
      {
        "text": "1990) (citation omitted). Sanctions may be imposed on the",
        "paragraph_id": "para_694"
      },
      {
        "text": "signer of a paper if “either a) the paper is filed for an",
        "paragraph_id": "para_695"
      },
      {
        "text": "improper purpose, or b) the paper is ‘frivolous.’” Id. at 1362.",
        "paragraph_id": "para_696"
      },
      {
        "text": "“The word ‘frivolous’ does not appear anywhere in the text",
        "paragraph_id": "para_697"
      },
      {
        "text": "of the Rule; rather, it is a shorthand that this court has used",
        "paragraph_id": "para_698"
      },
      {
        "text": "to denote a filing that is both baseless and made without a",
        "paragraph_id": "para_699"
      },
      {
        "text": "reasonable and competent inquiry.” Id.",
        "paragraph_id": "para_700"
      },
      {
        "text": "Defendants’ word choice simply does not meet the",
        "paragraph_id": "para_701"
      },
      {
        "text": "criteria for being made without reasonable, competent",
        "paragraph_id": "para_702"
      },
      {
        "text": "inquiry. In support of their claims, Defendants submitted",
        "paragraph_id": "para_703"
      },
      {
        "text": "several documents establishing the existence of the COVID-",
        "paragraph_id": "para_704"
      },
      {
        "text": "19 public health emergency, the need for mitigation, and the",
        "paragraph_id": "para_705"
      },
      {
        "text": "scientific information underlying these determinations on a",
        "paragraph_id": "para_706"
      },
      {
        "text": "federal, state, and local level.",
        "paragraph_id": "para_707"
      },
      {
        "text": "The record does not show any basis for concluding that",
        "paragraph_id": "para_708"
      },
      {
        "text": "the district court abused its discretion. Thus, Schmidt’s",
        "paragraph_id": "para_709"
      },
      {
        "text": "remaining challenges fail.",
        "paragraph_id": "para_710"
      },
      {
        "text": "IV. Conclusion",
        "paragraph_id": "para_711"
      },
      {
        "text": "We conclude that the PREP Act’s immunity provision",
        "paragraph_id": "para_712"
      },
      {
        "text": "applies to all claims in this case, and we accordingly",
        "paragraph_id": "para_713"
      },
      {
        "text": "AFFIRM the district court’s dismissal on this basis and its",
        "paragraph_id": "para_714"
      },
      {
        "text": "denial of the motion for reconsideration.",
        "paragraph_id": "para_715"
      }
